NSSF Congressional Scorecard U.S. Senate 113th Congress Key Votes

1. On the Nomination (Confirmation Vivek Hallegere Murthy to be Surgeon General). Vote on Dr. Vivek H. Murthy to be Surgeon General of the United States (Roll Call Vote 356). NSSF expressed concerns with Dr. Murthy's efforts at turning the medical community against law-abiding gun manufacturers and gun owners in an effort to restrict our Second Amendment rights. As President and Co-Founder of Doctors for America (DFA), he organized and directed campaigns seeking to place limits on the ability of Americans to exercise their Second Amendment rights. For example, in a letter to Congress, Dr. Murthy called for an outright federal ban of many of the most commonly purchased firearms and ammunition in the U.S. Under the guise of "gun safety," he

aggressively lobbied for doctors and the medical community to confront gun owners with spurious facts on gun ownership during visits and checkups. Dr. Murthy's use of the medical community as a tool to intimidate gun owners and their family members represents an egregious abuse of doctors and their bond of trust with their patients. His vocal support for DFA's "Docs Against Glocks" initiative is a telling example. The Surgeon General is entrusted with educating the American people on how best to lead healthier lives. The office should not, and must not, become a platform for launching attacks on Americans' constitutional right to own a firearm. NSSF Position: OPPOSE

1. S.Amdt. 2910 to S.Amdt. 2874 to H.R. 3762. Vote on Senator Dianne Feinstein (D-CA) S.Amdt. 2910 to the concurrent resolution on the budget for fiscal year 2016 (Roll Call Vote 319). S.Amdt. 2910 would have permitted the federal government to place people on a problem-ridden, secret watch list without due process or recourse thereby preventing them from exercising their constitutional rights protected by the Second Amendment. NSSF Position: OPPOSE

2. S.Amdt. 2908 to S.Amdt. 2874 to H.R. 3762. Vote on Senators Joe Manchin (D-WV) and Pat Toomey (R-PA) S.Amdt. 2908 to the concurrent resolution on the budget for fiscal year 2016 (Roll Call Vote 321). The Manchin – Toomey Amendment would have effectively shut down all storefront FFL checks on weekends nationwide by requiring that gun show checks must be COMPLETED before any non-gun show check can be completed. Since most gun shows occur over the weekend, NSSF fears that all storefront sales would end on weekends, currently the busiest time for our retail members. NSSF Position: OPPOSE

3. S.Amdt. 3234 to S.Amdt. 2953 to S. 2012. Vote on Senator Lisa Murkowski (R-AK) S.Amdt. 3234 to the North American Energy and Infrastructure Act of 2016 to include major portions of the Bipartisan Sportsmen’s Act, the most important package of pro-sportsmen’s legislation in a generation (Roll Call Vote 48). Among its provisions, this amendment would have allowed for more flexibility to use Pittman-Robertson funds to build and maintain badly needed public shooting ranges so that tens of millions of recreational target shooters will have a place to safely enjoy their sport and hunters will have a place to sight in their firearms for the hunting season. The amendment would have also helped facilitate and provide for more access to public lands and waters for hunting, recreational fishing, and shooting. NSSF Position: SUPPORT

4. S.Amdt. 4751 to S.Amdt. 4750 to H.R. 2578. Vote on Senator Chuck Grassley (R-IA) S.Amdt. 4751 to the Commerce, Justice, Science, and Related Agencies Appropriations Act, 2016 (Roll Call Vote 103). S.Amdt. 4751 would have reauthorized the NICS Improvement Amendments Act of 2007 and make several improvements, including providing for greater accountability, the availability of records to the National Instant Criminal Background Check System (NICS), and incentives for state compliance with NICS mental health record requirements. NSSF Position: SUPPORT

5. On the Cloture Motion (Motion to Invoke Cloture on the Motion to Commit H.R. 2578 with instructions (Amdt. No. 4750)). Vote on Senator Chris Murphy (D-CT) S.Amdt. 4750 to the Commerce, Justice, Science, and Related Agencies Appropriations Act, 2016 to require a background check for every firearm sale. (Roll Call Vote 104). Universal background checks will not address the problem of the main source of crime guns: the black market. If universal background checks were mandated, the question becomes whether criminals would change their behavior and instead choose to obtain firearms from venues that require a background check. A 2013 Justice Department review of violence prevention studies found that even a “perfect universal background check system” would not address the largest sources of crime guns. Rather than enacting an ineffective new law to expand background checks, NSSF supports improving the current NICS system by increasing the number of prohibiting records states and federal agencies submit to the FBI databases, helping to prevent illegal transfers of firearms to those who are prohibited from owning firearms under current law. NSSF Position: OPPOSE

6. S.Amdt. 4749 to S.Amdt. 4720 to S.Amdt. 4685 to H.R. 2578. Vote on Senator John Cornyn (R-TX) S.Amdt. 4749 to the Commerce, Justice, Science, and Related Agencies Appropriations Act, 2016 to Secure our Homeland from radical Islamists by Enhancing Law enforcement Detection (SHIELD) (Roll Call Vote 105). S.Amdt. 4749 would have set in place a procedure with due process that would have denied the transfer of a firearm or explosive to a person who is a known or suspected terrorist and protect the rights of law abiding citizens. NSSF Position: SUPPORT

7. S.Amdt. 4720 to S.Amdt. 4685 to H.R. 2578. Vote on Senator Dianne Feinstein (D-CA) S.Amdt. 4720 to the Commerce, Justice, Science, and Related Agencies Appropriations Act, 2016 (Roll Call Vote 106). S.Amdt. 4720 would have authorized the Attorney General to deny the transfer of a firearm to an individual if the Attorney General determines that an individual is a threat to public safety based on reasonable suspicion. NSSF Position: OPPOSE

1. On the Nomination (Confirmation Jeff Sessions, of Alabama, to be Attorney General). Vote on U.S. Senator Jeff Sessions to be the 84th Attorney General of the United States (Roll Call Vote 59). As evidenced by Sessions’ tireless efforts to protect the rights of law-abiding citizens, including through his staunch support of the passage of the Protection of Lawful Commerce in Arms Act, NSSF expressed confidence that with then-Senator Sessions as the chief law enforcement officer in the country, criminals will be taken off our streets, justice will be served, and the firearms and ammunition industry will no longer be under attack. NSSF Position: SUPPORT

2. On the Nomination (Confirmation Ryan Zinke, of Montana, to be Secretary of the Interior). Vote on Congressman Ryan Zinke to be 52nd Secretary of the United States Department of the Interior (Roll Call Vote 75). The Secretary of the Interior is arguably the nation’s single most important position with regard to the management of federal lands, wildlife habitat and natural resources. As an avid hunter and angler and as evidenced by his pro-sportsmen and conservation voting record, Zinke not only treasures the abundance of natural resources we are fortunate to have, but he understands the importance of helping to ensure that generations to come have the same opportunities to enjoy America’s rich outdoors that we do today and preserving our nation’s rich hunting and shooting sports traditions. NSSF Position: SUPPORT

3. On the Joint Resolution (H.J.Res. 69). Vote on H.J.Res. 69 to provide for congressional disapproval under chapter 8 of title 5, United States Code, of the final rule of the Department of the Interior relating to “Non-Subsistence Take of Wildlife, and Public Participation and Closure Procedures, on National Wildlife Refuges in Alaska” (Roll Call Vote 92).

In August 2016, the U.S. Department of the Interior published a final rule that preempts state management authority, which is protected by law in Alaska. Among other things, the U.S. Fish and Wildlife Service (FWS) final rule fundamentally changes the very successful federal-state relationship in managing National Wildlife Refuges (NWR), by removing the authority of the Alaska Department of Fish and Game to manage Alaska fish and wildlife for both non-subsistence and subsistence use. Without the passage of H.J.Res. 69, the final rule could set a precedent and be applied nationally, which would universally remove state fish and wildlife agencies’ authority to manage fish and wildlife, adversely impacting Americans who pursue fish and wildlife on refuges. NSSF Position: SUPPORT

4. On the Nomination (Confirmation Neil M. Gorsuch, of Colorado, to be an Associate Justice of the Supreme Court of the United States). Vote on Judge Neil M. Gorsuch, of Colorado, to be an Associate Justice of the Supreme Court of the United States (Roll Call Vote 111). Gorsuch is a lifelong hunter and angler. NSSF expressed confidence that his service would honor the legacy of the late Justice Scalia, including protecting the Second Amendment rights of law-abiding Americans. NSSF Position: SUPPORT

5. On the Nomination (Confirmation David Bernhardt, of Virginia, to be Deputy Secretary of the Interior). Vote on David Bernhardt, of Virginia, to be Deputy Secretary of the Interior (Roll Call Vote 166). Having grown up hunting and fishing in rural western Colorado on public lands outside the town of Rifle, Bernhardt remains an active sportsman and recreational shooter. In his previous capacity as the Solicitor of the Department of the Interior under then-Secretary Dirk Kempthorne, Bernhardt, who was unanimously confirmed to

serve, proved himself to be a champion for sportsmen, shooters and wildlife. NSSF expressed confidence that we could expect no different if afforded the opportunity to serve as Deputy Secretary. NSSF Position: SUPPORT

6. On the Nomination (Confirmation Brett M. Kavanaugh, of Maryland, to be an Associate Justice of the Supreme Court of the United States.Vote on Judge Brett M. Kavanaugh, of Maryland, to be an Associate Justice of the Supreme Court of the United States (Roll Call Vote 223). Kavanaugh is among the most highly qualified individuals

ever nominated to serve on our nation’s highest court. He has dedicated much of his life to public service. He is an originalist in the mold of Justice Scalia, his role model. His judicial philosophy is straightforward; a judge must be independent and must interpret the law, not make the law. He believes a judge must interpret statutes and the Constitution as written, informed by history and tradition and precedent. NSSF expressed confidence that Kavanaugh would make decisions that will serve to protect the Second Amendment and other Constitutionally guaranteed rights of law-abiding Americans. 1. Third Grijalva of Arizona Amendment to H.R. 2822. Vote on Congressman Raul Grijalva (D-AZ) H.Amdt. 584 to H.R. 2822, the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2016 (Roll Call Vote 405). H.Amdt. 584 would have defunded a restriction blocking the U.S. Fish and Wildlife Services (FWS) from implementing a near complete ban on the transfer of lawfully acquired ivory in the United States. FWS’s proposal to make it illegal to sell any firearm or other item that contains ivory and is less than 100 years old, would be disastrous for American firearm owners, retailers, and manufactures. NSSF strongly believes in conservation and opposes poaching as well as the illegal commerce in wildlife; however, restricting the trade in items made from ivory taken from elephants long ago would do nothing to further current anti-poaching efforts or to reduce the illegal trade in Africa, Asia, and elsewhere. NSSF Position: OPPOSE

2. Deutch of Florida Amendment No. 4 to H.R. 1927. Vote on Congressman Ted Deutch (D-FL) H.Amdt. 898 to H.R. 1927, the Fairness in Class Action Litigation and Furthering Asbestos Claim Transparency Act of 2016 (Roll Call Vote 25). H.Amdt. 898 is duplicative of The Protection of Lawful Commerce in Arms Act, 15 U.S.C. §§ 7901-7903, which provides an avenue for an aggrieved plaintiff or plaintiffs such as those described in this amendment to seek relief. NSSF opposed this amendment due to the fact that is duplicative and unnecessary. Despite recent anti-gun rhetoric, nothing in law prevents a gun owner from suing a firearms manufacturer for a defective product. Furthermore, it is intellectually dishonest and unjust to single out one single industry simply because one disagrees with its product. NSSF Position: OPPOSE

3. H.R. 766, Financial Institution Customer Protection Act of 2015 – On Passage. Vote on Congressman Blaine Luetkemeyer (R-MO) measure H.R. 766, the Financial Institution Customer Protection Act of 2016 (Roll Call Vote

H.R. 766 would have ended an Obama Administration initiative called “Operation Choke Point,” an effort to close or deny business accounts that the Federal Deposit Insurance Corporation (FDIC) classified as “high risk” or “reputational risk” for the financial institution. Law-abiding firearms and ammunition businesses have had accounts terminated, loans denied and other negative actions taken against them. The bill dictated that agencies such as the FDIC and the Office of the Comptroller of the Currency, among others, could not request or order a financial institution to terminate a banking relationship unless the regulator has material reason. 4. Beyer of Virginia Amendment No. 2 to H.R. 2406. Vote on Congressman Don Beyer (D-VA) H.Amdt. 947 to H.R. 2406, the bipartisan Sportsmen’s Act (Roll Call Vote 92). H.Amdt. 947 would have prohibited an individual who is prohibited from possessing a firearm by the Gun Control Act from using a public target range. The amendment is unnecessary. 5. Griffith of Virginia Amendment No. 12 to H.R. 2406. Vote on Congressman Morgan Griffith (R-VA) H.Amdt. 957 to H.R. 2406, the bipartisan Sportsmen’s Act (Roll Call Vote 96). H.Amdt. 957 would have allowed for the transport of a firearm or ammunition used for lawful purposes by an individual who is not prohibited from possessing, transporting, shipping, or receiving a firearm or ammunition if certain conditions are met. 6. Ribble of Wisconsin Amendment No. 14 to H.R. 2406. Vote on Congressman Reid Ribble (R-WI) H.Amdt. 959 to H.R. 2406, the bipartisan Sportsmen’s Act (Roll Call Vote 97). H.Amdt. 957 would have provided for reissuing the 2011 U.S. Fish and Wildlife Service (FWS) decision to delist the gray wolf in the Western Great Lakes and Wyoming from the Endangered Species Act (ESA). Between 2011 and 2012

the FWS delisted the gray wolf from the ESA, declaring the population recovered and no longer threatened, in the Western Great Lakes region (Minnesota, Wisconsin, and Michigan) and the Northern Rocky Mountains region (Montana, Idaho, Wyoming and eastern portions of Washington and Oregon). After being listed for decades on ESA, populations of gray wolves have recovered beyond expectations resulting in demonstrable declines in other wildlife populations, changes to big-game species behavior and continued losses to farmers, ranchers and sportsmen. State agencies are fully qualified and best positioned to responsibly manage wolf populations in accordance with the North American Model of Wildlife Conservation. Resuming state management for recovered wildlife species is the only way to maintain sustainable populations and provide for the predator, the prey and people’s needs. NSSF Position: SUPPORT

7. Young of Alaska Amendment No. 15 to H.R. 2406. Vote on Congressman Don Young (R-AK) H.Amdt. 960 to H.R. 2406, the bipartisan Sportsmen’s Act (Roll Call Vote 98). H.Amdt. 957 would have prohibited the Fish and Wildlife Service from issuing a final rule posted in the Federal Register in January 2016 that preempts State management

authority which is protected by law in Alaska and withdrew a final rule entitled “Alaska; Hunting and Trapping in National Preserves” (80 Fed. Reg. 64325 [October 23, 2015]) issued by the National Park Service on the same issue. The proposed rule could set a precedent and be applied nationally, which would universally remove state fish and wildlife agencies’ authority to manage fish and wildlife adversely impacting Americans who pursue fish and wildlife on refuges. 8. H.R. 2406, Sportsmen’s Heritage and Recreational Enhancement Act of 2015 – On Passage. Vote on passage of H.R. 2406, the bipartisan Sportsmens Heritage and Recreational Enhancement (SHARE) Act of 2015 (Roll Call Vote 101). The SHARE ACT is a package of legislation with 13 titles, including the Recreational Fishing and Hunting Opportunities Act; Hunting, Fishing, and Recreational Shooting Protection Act; Target Practice and Marksmanship Training Support Act; and the Recreational Lands Self-Defense Act, among others. This package would have enhanced America’s hunting and angling heritage, and promoted wildlife and habitat conservation. NSSF Position: SUPPORT

1. H.J. Res. 69, Providing for congressional disapproval

under chapter 8 of title 5, United States Code, of the final rule of the Department of the Interior relating to “Non-Subsistence Take of Wildlife, and Public Participation and Closure Procedures, on National Wildlife Refuges in Alaska” – On Passage. Vote on H.J.Res. 69 to provide for congressional disapproval under chapter 8 of title 5, United States Code, of the final rule of the Department of the Interior relating to “Non-Subsistence Take of Wildlife, and Public Participation and Closure Procedures, on National Wildlife Refuges in Alaska” (Roll Call Vote 98). In August 2016, the U.S. Department of the Interior published a final rule that preempts state management authority, which is protected by law in Alaska. Among other things, the U.S. Fish and Wildlife Service (FWS) final rule fundamentally changes the very successful federal-state relationship in managing National Wildlife Refuges (NWR), by removing the authority of the Alaska Department of Fish and Game to manage Alaska fish and wildlife for both non-subsistence and subsistence use. Without the passage of H.J.Res.69, the final rule could have set a precedent and be applied nationally, which would universally remove state fish and wildlife agencies’ authority to manage fish and wildlife adversely impacting Americans who pursue fish and wildlife on refuges. 2. H.R. 38, Concealed Carry Reciprocity Act of 2017 – On Passage. Vote on Congressman Richard Hudson (R-NC) measure H.R. 38, the Concealed Carry Reciprocity Act of 2017, as amended to include the Fix NICS Act of 2017 (Roll Call Vote 663). H.R. 38 would provide a solution to the confusing patchwork of concealed carry laws, particularly with regard to states where laws make unwitting criminals out of legal permit holders for crossing an invisible border. It would ensure that one’s Second Amendment rights do not end at the state line. It is a commonsense approach to eliminating the confusion of varying state-by-state laws and protect the Second Amendment rights of law-abiding Americans. H.R. 38, as amended, would also encourage and incentivize states to enter all applicable disqualifying records into the FBI's National Instant Criminal Background Check System (NICS) and help provide states the resources to do it. Furthermore, it would require federal agencies to properly report relevant records and hold those who fail to do so accountable. Federally licensed firearms retailers rely upon NICS to be accurate in order to prevent the sale and transfer of firearms to prohibited persons. There are currently several states and some federal agencies withholding applicable disqualifying records that if entered into the FBI’s NICS would help prevent prohibited persons from being able to purchase firearms from a federally licensed firearms retailer. The Fix NICS Act builds off of the successes of NSSF’s FixNICS® campaign. NSSF Position: SUPPORT
