The Five Essentials of Training

1 WHY do we need training?Aside from the fact that it is legally required, training serves many purposes. Most importantly, it ensures your shipments are fully compliant with the regulations. This serves to avoid:

1. Fines and other penalties

2. Carrier refusal, causing delays in shipment

3. The possibility of spills or other incidents that may cause death, injury, or environmental damage

4. Confusion and inconsistencies in the workplace

2 WHO needs training?Both US Department of Transportation (DOT) and Transport Canada require anyone involved in handling, offering for transport, or transporting dangerous goods to be trained. An employee who has not been trained may work under the direct supervision of a trained individual. This supervisory status is only valid for 90 days in the United States.

3 WHEN do we need training?Training must be done when employees start working with dangerous goods. Recur-rent training must be provided after three years for ground and sea transport and after two years for air transport. Anyone changing employers or functions may require recurrent training.

4 WHAT training must be done?Both US Department of Transportation (DOT) and Transport Canada have strict requirements for training. The requirements clearly state that the training is to be function specific and done to the level where the employer is satisfied that the training is adequate for the job requirements.

Plant AuditIn order to ensure companies are compliant with hazardous material regulations, US Department of Transportation or Transport Canada randomly inspect plants and warehouses for health and safety violations.While we at ICC The Compliance Center can’t prevent an inspection, we can certainly help you pass it with flying colors. Shipping Dangerous Goods by Air

Additional RequirementsIATA requires the Shipper’s Declaration for Dangerous Goods to be completed in English. Two copies must be provided to the airline. The shipper and transporter must retain a copy for two years in Canada and at least 375 days in the United States.

6.1 – Toxic Substances (Inhalation Hazards only)Any material with a subsidiary “Poison Inhalation When 454 kg (1001 lbs.) or more of Uranium hexafluoride is transported, a corrosive subsidiary placard must be used. The Class 7 placard is also required for exclusive use shipments of low specific activity (LSA) material, in accordance with 173.427(a). The Elevated Temperature Sign is required in addition to the primary class placard for the following products: UN3256, ELEVATED TEMPERATURE LIQUID,

FLAMMABLE, N.O.S. UN3257, ELEVATED TEMPERATURE LIQUID, N.O.S. UN3258, ELEVATED TEMPERATURE SOLID, N.O.S.

The Fumigation Sign is required at each entryway of a large means of containment that has been fumigated.

The Marine Pollutant Mark is required for dangerous goods that are marine pollutants transported by ship, (other than roll-on roll-off ship and short run ferry) except if they:a) Do not contain Class 1 (other than 1.4), 5.2, 6.1 or 7;

AND i) Are in a large means of containment with a

capacity less than or equal to 500 kg AND are transported between two points in Canada; or

ii) Are in a small means of containment with quantities less than or equal to 500 mL or 500 g for severe marine pollutants or less than or equal to 5 L or 5 kg for marine pollutants

DANGER Placard

The Danger placard can replace certain required placards in the case of:

a) Dangerous goods having different UN numbers, none of which require an ERAP

b) Dangerous goods in different primary classes

The Danger placard must NOT replace subsidiary or Class 1placards, or placards for dangerous goods for which an ERAP is required.

Additional US Placard Requirements

In addition to the Canadian placards, Poison Gas (Class 2.3) or Poison Inhalation Hazard (Class 6.1) placards are required on dangerous goods that meet the definition of “materials toxic by inhalation” in 49 CFR when transported into the United States.

Shipping Dangerous Goods by Air

Additional RequirementsIATA requires the Shipper’s Declaration for Dangerous Goods to be completed in English. Two copies must be provided to the airline. The shipper and transporter must retain a copy for two years in Canada and at least 375 days in the United States.

Most Common Variations for USAUSG 04 “RQ” must be shown in association with the proper shipping name on package, and either before or after the shipping description on the document, if a hazardous substance.USG 08 “Inhalation Hazard” and “Hazard Zone A, B, C or D” must be shown on documentation, if required. Inhalation Hazard Label must also appear on the package(s).

USG 12 Emergency 24-hour number must be shown on document. Written emergency response information, in English, must be provided with the documentation.

Most Common Variations for CanadaCAG 14 Information required on a document must be easy to identify, legible, and in indelible print.CAG 15 The words “24-Hour Number,” followed by the phone number, where emergency information is available 24/7 without breaking the telephone connection, must appear on the document.CAG 16 Emergency Response Assistance Plan (ERAP) number and the telephone number to activate the ERAP must appear, when required, on the document.

When a placard is required for more than one division of Explosives, only the placard with the lowest division number must be displayed [172.504(f) (1)]. For shipments of Explosives by aircraft or by vessel, the applicable compatibility group letter must be displayed on the placard.** Division number and, when required, the

compatibility group.

Any material with a subsidiary risk of 4.3 must beplacarded with a 4.3 subsidiary placard [172.505(c)].

Placards must be displayed for any quantity of UN3111, Organic Peroxide Type B, Liquid, or UN3112, Organic Peroxide, Type B, Solid.

Bulk Packages*

Any material with a subsidiary “Poison Inhalation Hazard” must display subsidiary “PIH” placard [172.505(a)].

When 454 kg (1001 lbs.) or more of Uranium hexafluoride is transported, a corrosive subsidiary placard must be used. The Class 7 placard is also required for exclusive use shipments of low specific activity (LSA) material, in accordance with 173.427(a).

IBCs(IntermediateBulk Containers)

* Bulk packaging means a packaging, other than a vessel or barge, into which hazardous materials are loaded with no intermediate packaging, and exceeding the following sizes: Liquids – 450 Liters internal capacity; Solids – 400 kg net mass and 450 Liters internal capacity; Gases – water capacity of 454 kg.

Subsidiary Hazard Placards

Must be used for hazardous materials that are subject to the “Inhalation Hazard” shipping paper requirement, when Division 2.3 or 6.1 is not the primary hazard [172.505(a)].

Must be used for materials with a Division 4.3 Dangerous When Wet subsidiary hazard [172.505(c)].

Must be used when transporting 454 kg (1,001 lbs.) or more of fissile or low specific activity Uranium hexafluoride [172.505(b)].

Special Placarding Provisions

Each rail car containing Division 1.1 or 1.2 explosives which are also Poisonous by Inhalation must display Explosives 1.1 or 1.2 and Poison Gas or Poison Inhalation Hazard placards. Note: Hazardous materials that possess subsidiary hazards may display subsidiary placards even when they are not required [172.505(d)].

Division 1.1 and 1.2 Explosives and materials in Division 2.3, Hazard Zone A or 6.1, Packing Group I, Hazard Zone A must display the corresponding hazard class placard in a white square background.

Each rail car containing Division 1.1 or 1.2 Explosives which are also Poisonous by Inhalation must display Explosives 1.1 or 1.2 and Poison Gas or Poison Inhalation Hazard placards.

Poison Inhalation HazardA transport vehicle or freight container loaded at one facility with 1000 kg (2205 lbs.) or more aggregate gross weight of a PIH material in Hazard Zone A or B in non-bulk packages marked with the same proper shipping name and identification number, must display that identification number. For different PIH materials in the same Hazard Zone, the ID number of the greatest aggregate gross weight must be displayed. The ID number for Hazard Zone A materials takes precedence over Hazard Zone B materials [172.313(c)].

Display of NumbersThe identification number may be displayed on a placard, an orange panel, or on a white square-on-point configuration [172.332].

Elevated Temperature MaterialsEach bulk package containing an elevated temperature material must be marked on two opposing sides with the word “HOT” [172.325(a)]. Bulk packages containing molten aluminum or molten sulfur must be marked “MOLTEN ALUMINUM” or “MOLTEN SULFUR” [172.325(b)].

Fumigant MarkingThe FUMIGANT marking must be prominently displayed if the transport vehicle (including a rail car) has been fumigated. For domestic transportation, an EPA authorized warning label may be used [173.9].

Except for Class 7 and the DANGEROUS placard text indicating a hazard is not required on placards [Section 172.519(b)(3)]

Shipping Dangerous Goods by Air

Additional RequirementsIATA requires the Shipper’s Declaration for Dangerous Goods to be completed in English. Two copies must be provided to the airline. The shipper and transporter must retain a copy for two years in Canada and at least 375 days in the United States.

Most Common Variations for USAUSG 04 “RQ” must be shown in association with the proper shipping name

on package, and either before or after the shipping description on the document, if a hazardous substance.

USG 08 “Inhalation Hazard” and “Hazard Zone A, B, C or D” must be shown on documentation, if required. Inhalation Hazard Label must also appear on the package(s).

USG 12 Emergency 24-hour number must be shown on document. Written emergency response information, in English, must be provided with the documentation.

Most Common Variations for CanadaCAG 14 Information required on a document must be easy to identify, legible, and

in indelible print.CAG 15 The words “24-Hour Number,” followed by the phone number, where

emergency information is available 24/7 without breaking the telephone connection, must appear on the document.

CAG 16 Emergency Response Assistance Plan (ERAP) number and the telephone number to activate the ERAP must appear, when required, on the document.

• The minimum dimensions of all hazard labels must be 100 mm x 100 mm.

• For small packages containing infectious substances, dimensions of hazard labels and handling labels may not be reduced smaller than 50 mm x 50 mm.

Shipping Dangerous Goods by Air

Additional RequirementsIATA requires the Shipper’s Declaration for Dangerous Goods to be completed in English. Two copies must be provided to the airline. The shipper and transporter must retain a copy for two years in Canada and at least 375 days in the United States.

Most Common Variations for USAUSG 04 “RQ” must be shown in association with the proper shipping name

on package, and either before or after the shipping description on the document, if a hazardous substance.

USG 08 “Inhalation Hazard” and “Hazard Zone A, B, C or D” must be shown on documentation, if required. Inhalation Hazard Label must also appear on the package(s).

USG 12 Emergency 24-hour number must be shown on document. Written emergency response information, in English, must be provided with the documentation.

Most Common Variations for CanadaCAG 14 Information required on a document must be easy to identify, legible, and

in indelible print.CAG 15 The words “24-Hour Number,” followed by the phone number, where

emergency information is available 24/7 without breaking the telephone connection, must appear on the document.

CAG 16 Emergency Response Assistance Plan (ERAP) number and the telephone number to activate the ERAP must appear, when required, on the document.

• The minimum dimensions of all hazard labels must be 100 mm x 100 mm.

• For small packages containing infectious substances, dimensions of hazard labels and handling labels may not be reduced smaller than 50 mm x 50 mm.

• The words “BIOLOGICAL SUBSTANCE, CATEGORY B” must be added adjacent to the “UN3373” marking.

Shipping Dangerous Goods by Sea Using Amendment 34-08Sea transportation is probably one of the most economical ways to ship dangerous goods over-seas. However, strict rules apply through the SOLAS (Safety of Life at Sea) agreement and the International Marine Organization (IMO). When a placard is required for more than one division of Explosives, only the placard with the lowest division number must be displayed [172.504(f)(1)]. For shipments of Explosives by aircraft or by vessel, the applicable compatibility group letter must be displayed on the placard.** Division number and, when required, the compatibility group.

Any material with a subsidiary risk of 4.3 must beplacarded with a 4.3 subsidiary placard [172.505(c)].

Placards must be displayed for any quantity of UN3111, Organic Peroxide Type B, Liquid, or UN3112, Organic Peroxide, Type B, Solid.

Bulk Packages*

Any material with a subsidiary “Poison Inhalation Hazard” must display subsidiary “PIH” placard [172.505(a)].

When 454 kg (1001 lbs.) or more of Uranium hexafluoride is transported, a corrosive subsidiary placard must be used. The Class 7 placard is also required for exclusive use shipments of low specific activity (LSA) material, in accordance with 173.427(a).

IBCs(IntermediateBulk Containers)

* Bulk packaging means a packaging, other than a vessel or barge, into which hazardous materials are loaded with no intermediate packaging, and exceeding the following sizes: Liquids – 450 Liters internal capacity; Solids – 400 kg net mass and 450 Liters internal capacity; Gases – water capacity of 454 kg.

Subsidiary Hazard Placards

Must be used for hazardous materials that are subject to the “Inhalation Hazard” shipping paper requirement, when Division 2.3 or 6.1 is not the primary hazard [172.505(a)].

Must be used for materials with a Division 4.3 Dangerous When Wet subsidiary hazard [172.505(c)]. Must be used when transporting 454 kg (1,001 lbs.) or more of fissile or low specific activity Uranium hexafluoride [172.505(b)].

Special Placarding Provisions

Each rail car containing Division 1.1 or 1.2 explosives which are also Poisonous by Inhalation must display Explosives 1.1 or 1.2 and Poison Gas or Poison Inhalation Hazard placards. Note: Hazardous materials that possess subsidiary hazards may display subsidiary placards even when they are not required [172.505(d)].

Rail [172.510]

Division 1.1 and 1.2 Explosives and materials in Division 2.3, Hazard Zone A or 6.1, Packing Group I, Hazard Zone A must display the corresponding hazard class placard in a white square background.

Each rail car containing Division 1.1 or 1.2 Explosives which are also Poisonous by Inhalation must display Explosives 1.1 or 1.2 and Poison Gas or Poison Inhalation Hazard placards.

Permissible Placards

For domestic transportation of Oxygen, the OXYGEN placard may be used in place of a Non-Flammable Gas placard [section 172.504(f) (7)].

When Combustible placards are used to display an identification number, the lower half must be white for rail, and may be white for highway [172.332(c)(4)].

These texts are permitted on placards for Gasoline, Fuel Oil and Combustible Liquids [172.542, 172.544].

Bulk PackagesThe four-digit identification number must be displayed on IBCs, portable tanks, cargo tanks, tank cars, and other bulk packages [172.302, 172.326, 172.328, 172.330 or 172.331].

Non-Bulk PackagesA transport vehicle or freight container loaded at one facility with 4000 kg (8820 lbs.) or more aggregate gross weight of a single hazardous material in non-bulk packages, marked with the same proper shipping name and identification number, with no other materials, must display that identification number [172.301(a)(3)].

Poison Inhalation HazardA transport vehicle or freight container loaded at one facility with 1000 kg (2205 lbs.) or more aggregate gross weight of a PIH material in Hazard Zone A or B in non-bulk packages marked with the same proper shipping name and identification number, must display that identification number. For different PIH materials in the same Hazard Zone, the ID number of the greatest aggregate gross weight must be displayed. The ID number for Hazard Zone A materials takes precedence over Hazard Zone B materials [172.313(c)].

Display of NumbersThe identification number may be displayed on a placard, an orange panel, or on a white square-on-point configuration [172.332].

Marine PollutantsThis mark is required for Marine Pollutants when transported under the IMDG Code or by vessel [172.322(b) and (d)]. This mark is not required for road and rail transportation if the transport vehicle or freight container is already placarded with a Class placard [172.322(d)(3)].

Elevated Temperature MaterialsEach bulk package containing an elevated temperature material must be marked on two opposing sides with the word “HOT” [172.325(a)]. Bulk packages containing molten aluminum or molten sulfur must be marked “MOLTEN ALUMINUM” or “MOLTEN SULFUR” [172.325(b)].

Fumigant MarkingThe FUMIGANT marking must be prominently displayed if the transport vehicle (including a rail car) has been fumigated. For domestic transportation, an EPA authorized warning label may be used [173.9].

Except for Class 7 and the DANGEROUS placard text indicating a hazard is not required on placards [Section 172.519(b)(3)]

Shipping Dangerous Goods by Air

Additional RequirementsIATA requires the Shipper’s Declaration for Dangerous Goods to be completed in English. Two copies must be provided to the airline. The shipper and transporter must retain a copy for two years in Canada and at least 375 days in the United States.

Most Common Variations for USAUSG 04 “RQ” must be shown in association with the proper shipping name on package, and either before or after the shipping description on the document, if a hazardous substance.USG 08 “Inhalation Hazard” and “Hazard Zone A, B, C or D” must be shown on documentation, if required. Inhalation Hazard Label must also appear on the package(s).

USG 12 Emergency 24-hour number must be shown on document. Written emergency response information, in English, must be provided with the documentation.

Most Common Variations for CanadaCAG 14 Information required on a document must be easy to identify, legible, and in indelible print.CAG 15 The words “24-Hour Number,” followed by the phone number, where emergency information is available 24/7 without breaking the telephone connection, must appear on the document.CAG 16 Emergency Response Assistance Plan (ERAP) number and the telephone number to activate the ERAP must appear, when required, on the document.

• The minimum dimensions of all hazard labels must be 100 mm x 100 mm.

• For small packages containing infectious substances, dimensions of hazard labels and handling labels may not be reduced smaller than 50 mm x 50 mm.

• The words “BIOLOGICAL SUBSTANCE, CATEGORY B” must be added adjacent to the “UN3373” marking.

• Shipper’s and consignee’s name and address

• Cargo Aircraft Only label on same surface as hazard labels (only if applicable)

• Two orientation labels required, on opposite sides of package (required for liquids inside combination packaging)

• Net quantity for multiple package shipments or gross mass near shipping name (as applicable)

Additional requirements:

• Labels must be located on the same surface of the package and near the proper shipping name (if the package dimensions are adequate).

• Primary and subsidiary risk labels must be displayed on the same surface of the package, as well as the Cargo Aircraft Only label.

• For class 6.2 and class 1, other requirements apply.

Special Placarding Provisions

Each rail car containing Division 1.1 or 1.2 explosives which are also Poisonous by Inhalation must display Explosives 1.1 or 1.2 and Poison Gas or Poison Inhalation Hazard placards. Note: Hazardous materials that possess subsidiary hazards may display subsidiary placards even when they are not required [172.505(d)].

Permissible Placards

Poison Inhalation HazardA transport vehicle or freight container loaded at one facility with 1000 kg (2205 lbs.) or more aggregate grossweight of a PIH material in Hazard Zone A or B in non-bulk packages marked with the same proper shipping name and identification number, must display that identification number. For different PIH materials in the sameHazard Zone, the ID number of the greatest aggregate gross weight must be displayed. The ID number for Hazard Zone A materials takes precedence over Hazard Zone B materials [172.313(c)].

Elevated Temperature MaterialsEach bulk package containing an elevated temperaturematerial must be marked on two opposing sides with theword “HOT” [172.325(a)]. Bulk packages containing moltenaluminum or molten sulfur must be marked “MOLTENALUMINUM” or “MOLTEN SULFUR” [172.325(b)].

Fumigant MarkingThe FUMIGANT marking must be prominently displayedif the transport vehicle (including a rail car) has beenfumigated. For domestic transportation, an EPA authorizedwarning label may be used [173.9].

Additional RequirementsIATA requires the Shipper’s Declaration for DangerousGoods to be completed in English. Two copies mustbe provided to the airline. The shipper and transportermust retain a copy for two years in Canada and atleast 375 days in the United States.

Most Common Variations for USAUSG 04 “RQ” must be shown in association with the proper shipping name on package, and either before or after the shipping description on the document, if a hazardous substance.USG 08 “Inhalation Hazard” and “Hazard Zone A, B, C or D” must be shown ondocumentation, if required. Inhalation Hazard Label must also appear on the package(s).

USG 12 Emergency 24-hour number must be shown on document. Writtenemergency response information, in English, must be provided with thedocumentation.

Most Common Variations for CanadaCAG 14 Information required on a document must be easy to identify, legible, andin indelible print.CAG 15 The words “24-Hour Number,” followed by the phone number, where emergency information is available 24/7 without breaking the telephoneconnection, must appear on the document.CAG 16 Emergency Response Assistance Plan (ERAP) number and the telephonenumber to activate the ERAP must appear, when required, on the document.

• The minimum dimensions of all hazard labels must be 100 mm x 100 mm.

TRAININGGHS – Globally Harmonized SystemIn today’s global business environment, regulatory differences between countries can be a serious cause of extra work, delays and costs. In recognition of this, the United Nations has put forward a model called the Globally Harmonized System (GHS) to help business cut through these problems. This revolutionary system will eventually become the standard for classification and hazard communication for: ■ Workplace hazardous chemicals

■ Transportation of dangerous goods

■ Hazardous consumer products

■ Pesticides

Already, many countries have started to adopt these new standards, or are making preparations to do so. As this progresses, many current standards such as OSHA’s hazard communication rules and WHMIS will be eliminated. The Globally Harmonized System of Classifi cation and Labeling of Chemicals (GHS) is forthcoming.Many countries such as Japan and New Zealand have begun to implement the GHS, whereas the USA and Canada are projecting implementation in the upcoming years. Right to Know REGULATIONS

EU Directives and REACHThe European Union has a series of directives establishing hazard communication require-ments within the member countries of the EU. The system is significantly different than those used in the USA and Canada—special symbols are required on labels and risk phrases are mandated based on the ingredients of the product.

OSHAThe Hazard Communication Standard (HCS) under OSHA requires that hazard informa-tion about chemicals in the workplace be provided by means of container labels.

WHMISControlled products sold to Canadian Workplaces must have WHMIS supplier labels, which differ from labels in the USA or Europe. They include a distinctive border and show symbols for each hazard class.

ANSIThis standard provides guidance for precau-tionary information on container labels in the USA.

ConsumerChemical products sold through retail outlets need to be labeled according to Consumer Chemicals and Container Regulations in Canada (CCCR) and Consumer Product Safety Commission Requirements (CPSC) in the USA.
