PINA Gentleman: I recently received credible information that during a Command Staff meeting at Phoenix Police Headquarters last month, Commander Benny Pina made an inappropriate comment regarding Detective Terry Yahweh's character. It is my understanding that the topic of a new "Therapy Dog" being assigned to the Family Investigations Bureau was being discussed when Commander Pina made inappropriate comments regarding Detective Yahweh. I was told this comment was not only inappropriate, but racial by design. The comment was made in open during this meeting and heard by others. Those who heard the inappropriate comments include Assistant Chief James A. Pina and Interim Police Chief Joseph P. Yahner. Their involvement included laughing at the comment which was witnessed by others in the meeting. I am told neither Chief Yahner or Chief Pina made any attempt to stop the comment much less address Commander Pina due to the inappropriateness of the comment. Soon after the comment was made the room became silent until Chief Yahner and Chief Pina began laughing. Commander Geary Brase was heard asking Chief Pina what had just been said by Commander Pina. Instead of putting an end to this unprofessionalism, Chief Pina was overheard telling Commander Brase to come to his office after the meeting and he would repeat it. One would think that with PLEA's allegation against Chief Pina two years ago for using the word "nigger" in public would have taught him a lesson. I guess the city's cover-up of Pina's indiscretions two years ago makes him feel invulnerable so he continues with his old ways; shameful! I guess Chief Pina's racism was not only failed to be addressed by former Police Chief Jack Harris, but Interim Police Chief Yahner as well. This is our 2nd request for an investigation into Commander Benny Pina of the Phoenix PD. This is about what transpired in a meeting recently. Benny Pina loves using the word “nigger” and has lobed it in the past with racial slurs directed at Detective Terry Yahwey, a black officer with the PPD. Well he did it again, in a meeting with many Phoenix cops and with acting commander Joe Yahner present. It appears Benny hasn’t learned and the Phoenix PD hasn’t changed since chief Jack Ass Harris left. That’s why we’re here and that’s why good cops tell us, and we inform you. In the past Benny has been accused and investigated for the use of the “N” word. Under Jack Harris, it was swept under the rug and ignored. It appears even with a new acting chief in the room, Benny Pina’s racial comments are tolerated and laughed at all at the expense of Terry Yahwey!

I read an article last month in the Arizona Republic where Chief Yahner was interviewedabout what he had accomplished in his six months as Interim Police Chief. Chief Yahnersaid his greatest achievement was, "improving communications with the rank and file." Iguess he meant he would allow Executive and Command Officers to make inappropriateand racial slurs and use the word "nigger" against the "rank and fife" with zeroaccountability. Does this mean Terry may freely refer to Benny Pina and Jim Pina as"Beaners?" Maybe as a citizen filing this complaint, am I a dumb Jew Polak?

Consider this letter as a formal written request that an investigation into CommanderBenny Pina, Assistant Chief James A. Pina and Interim Police Chief Joseph P. Yanner'sconduct be investigated immediately. Chief Yahner is a contender for the permanentpolice chief position. It is imperative that these allegations be investigated andcompleted before the permanent chief's selection is made. Delaying the investigationwould be a great disservice to the citizens of Phoenix and one I will do whatever I mustto share any delay or cover-up.

To ensure complete transparency and that no cover up is allowed to occur, I ask that acopy of this letter be given to Matrix Consulting Group and the company or citydepartment responsible for selecting the next Phoenix Police Chief. This letter must alsobe shared with any citizen's groups involved in the selection of the new chief. If you failto provide these groups with this letter, I will.

My request for an investigation is made within the guidelines of Operation Order3.19.1.A, Citizen's Complaints.
