Michael T. N. Fitch

Michael Fitch is Senior Counsel in Keller and Heckman’s telecommunicationspractice group. Mr. Fitch has over 40 years of experience in wireless,international, infrastructure and other telecommunications regulatory areas,and he advises clients on a wide range of issues in these areas.

Mr. Fitch began his career at the Federal Communications Commission,where he advanced from staff attorney to Bureau Chief and Senior Legal andInternational Advisor to the Chairman. He also served as a PresidentialExchange Executive from the FCC to the Westinghouse Electric Corporationin Pittsburgh for one year. He moved to the U.S. Department of State, wherehe was an Office Director and Deputy Assistant Secretary of State in theCommunications and Information Policy Bureau. He led U.S. delegations toInmarsat, Intelsat, and International Telecommunication Union meetings.

Mr. Fitch then became the Vice President of Regulatory Affairs and SpectrumManagement at Hughes Communications, part of Hughes Electronics in LosAngeles.

When Hughes Space and Communications was acquired by Boeing, he continued his telecommunicationsresponsibilities as well as new programs involving Homeland Security. While at Boeing, he was VicePresident of the U.S. ITU Association.

From 2005-2012, he was President and CEO of PCIA – The Wireless Infrastructure Association. After PCIA,Fitch was a consultant on wireless, infrastructure, and technology matters. He is a member of the Board ofDirectors of the California Wireless Association and a Fellow in the Radio Club of America.

Manesh K. Rath

Manesh Rath is a partner in Keller and Heckman’s litigation and OSHApractice groups. He has been the lead amicus counsel on several casesbefore the U.S. Supreme Court including Staub v. Proctor Hospital and Vancev. Ball State University.

Mr. Rath is a co-author of three books in the fields of wage/hour law, laborand employment law, and OSHA law. On developing legal issues, he hasbeen quoted or interviewed in The Wall Street Journal, Bloomberg, SmartMoney magazine, Entrepreneur magazine, on "PBS's Nightly BusinessReport," WAVY-TV and C-SPAN. He was listed in Smart CEO Magazine'sReaders' Choice List of Legal Elite.

Mr. Rath has extensive experience representing industry in OSHArulemakings. He has successfully represented employers—including some ofthe largest in the country—in OSHA citations and investigations before federalOSHA in regions across the country and in state plan states.

Mr. Rath currently serves on the Board of Advisors for the National Federation of Independent Business(NFIB) Small Business Legal Center. He served on the Society For Human Resources (SHRM) SpecialExpertise Panel for Safety and Health law for several years.He is the editor and co-author of the OSHA chapter of the Employment and Labor Law Audit (9th and 10th

Editions) and a co-author of the book Occupational Safety and Health Law Handbook (2001).

Mr. Sarvadi practices in the areas of occupational health and safety, toxicsubstance management, pesticide regulation, and product safety.

Mr. Sarvadi represents clients before a variety of federal and stateenforcement agencies in legal proceedings involving OSHA citations, EPANotice of Violations, TSCA consent orders, CPSC Notices, FIFRA StopSale Use and Removal Orders, and EEOC Charges of Discrimination. Heworks with clients in developing, reviewing, and auditing complianceprograms in all of these areas, and in obtaining agency rulings on proposedor novel activities and questions, seeking interpretations of regulations asthey apply to specific sets of facts. He has been counsel to the NationalCoalition on Ergonomics from its inception.

He has a background in occupational safety and health, having worked as an industrial hygienistfor more than 15 years and became a Certified Industrial Hygienist in 1978, a designation he helduntil he voluntarily relinquished it in 2010. Prior to becoming an attorney, he managed a corporateindustrial hygiene program for a Fortune 500 company. Mr. Sarvadi was selected by the NationalAcademy of Sciences to participate in a panel of the Institute of Medicine that was asked to reviewa NIOSH study on the use of respirators. He was asked to participate because of his expertise inlaw and industrial hygiene.
