The Committee of Adjustment of the Township of Adjala-Tosorontio was called to order on Wednesday, November 20, 2019, at 7:00 PM, in the Municipal Office Council Chambers, with the following members present:
Members Present: Bob Meadows, Chair, Elizabeth Rogacki, Committee Member, Margaret Bricknell, Committee Member, and Deborah Hall - Chancey, Committee Member

The Chair advised that only Members Meadows, Hall-Chancey and Bricknell were able to participate in this application as they were the only members in attendance at the Public Meeting.
The Chair read the verbal Planning Report as provided by the Secretary/Treasurer. In the report he noted that the Committee Members will remember deferring this application until not later than November 20, 2019 at the May meeting to give the applicant an opportunity to provide a Natural Hazard Assessment to the satisfaction of the NVCA. The County of Simcoe had also requested that the applicant work with the NVCA and Township to scope any necessary studies in order to determine whether the proposal conforms with Section 3.1 of the PPS.
Mr. Cox is here tonight with an update on his application and has provided a letter requesting further deferral of his application along with a hardcopy presentation, which has been provided to the Committee.
Planning has been in further correspondence with the NVCA regarding this application and they have advised that a topographical survey was submitted for review and provided the following engineering comments:
“It has been proposed to sever the existing lot. The lot is regulated for a flood hazard, associated with Lisle Creek. The estimated Regional flood elevation for the property is approximately 226.8m based on the NVCA HEC-RAS model and using NVCA DEM. A Topographic Plan for the lot was submitted with spot elevations. In completing a comparison of 20 elevation points, it has been determined that an average difference of 16cm was found. Therefore, a revised estimated flood elevation is 226.96m. A majority of the property is located within the floodplain, based on this revised flood elevation. The applicant has the option to hire a qualified professional to complete a flood analysis to determine a more refined flood elevation and extent. A flood study may or may not determine a different flood elevation, there is no guarantee that a more favourable flood elevation will be determined.”
The NVCA provided an illustration (which I have provided to the Members) showing that ¾ of the property, including the existing house is within the floodplain using the topographic survey. The NVCA advised that both the Planner and the Engineer verbally conveyed this information to Mr. Cox. They also advised that as of November 14, 2019, they have not received any flood study for their Engineering staff to review.

Planning would remind the Committee that in order for the consent application to be supported, it must be consistent with and conform to the policies of the Provincial Policy Statement. PPS requires that any potential severed parcels must be free from natural hazards such as flooding.
Planning would suggest to the Committee that the proposal does not meet the general intent of the Township Official Plan. Section 6.2.1 of the Township Official Plan states that development and site alteration should be directed away from hazardous lands and sites and significant natural heritage features. The application does not meet the definition of infill which is found in Section 4.2.5.1 which states that a lot may be considered infilling where a residential lot is created between two non-farm residences which are on separate lots of similar size and which are situated on the same side of the road and are not more than 100 metres apart. Planning would suggest to the Committee that the proposal does not meet the general intent of the OP.
Neither the severed parcel or the retained parcel will meet frontage requirements of Zoning By-law No. 03-57 and the severed parcel will be deficient in area and will require a condition of a successful minor variance if the consent is approved.
Public Works provided comments for the May Public meeting advising that they had concerns related to the location of an entrance on the severed portion as it would be directly across from the existing street, (Depot Street). The Director of Development, Infrastructure, and Public Works further advised today that his comments have not changed.
Conclusion
Based on the current technical information provided and reviewed by the NVCA, the majority of the subject parcel is located within a flood hazard. Planning staff is not able to support approval of the consent application and would also suggest that the application is premature.
The Committee will have to determine whether it is appropriate to defer the application again to a date sometime in the year 2020 to allow the applicant an opportunity to provide a flood analysis study to the satisfaction of the NVCA and Township or whether the Committee will make a decision on the application tonight based on the information available to date.
The Chair invited Mr. Cox to provide any additional information and comments.
Mr. Cox provided an update on the application with regards to the topographical survey which was provided to Members prior to the meeting. Mr. Cox also provided a hard copy presentation for Committee Members prior to the meeting.

Mr. Cox advised that the NVCA had reviewed them but the property was still within the flood hazard. He advised he hired Tim Keen (engineer) of Burnside & Associates who reviewed the NVCA HEC-RAS modelling, but was waiting further comments from the NVCA on how to move forward.
Chair Meadows voiced concerns with the application not meeting PPS which prohibits lot creation in the floodplain. After the topographical survey, 3/4 of the property was still in the floodplain.
Mr. Cox's engineer states that even with modelling refinement, there is a good chance that the Regulatory Floodline would still be located on the southern limits of the subject property.
Member Bricknell was concerned with the applicant incurring considerable cost for studies that did not guarentee the removal of the property from the floodplain area.
Member Bricknell also had concerns with the entrance location, and that Public Works had issues with the location as well.
Mr. Cox suggested this Committee was not in favour of housing.
Chair Meadows explained that the concern was creating a property in a floodplain which is prohibited.
Member Hall-Chancey commended Mr. Cox on his workmanship, however advised there are issues with the application. She stated that the agencies know what they are doing, and Committee also had concerns with the application not conforming to the PPS, the OP, and the County OP.
Chair Meadows voiced his opinion about considering future residents and not build in the floodplain.
A motion was made by Member Hall-Chancey and seconded by Member Bricknell and carried that the request for Consent B/03/19 under The Planning Act be DENIED.
Reasons for the decision: After taking into consideration all the written and oral submissions, it is the opinion of the Committee that:
1. The application does not conform to Section 3.1 of the 2014 Provincial Policy Statement;
2. The application does not conform to the policies of the Simcoe County Official Plan;
3. The application does not conform to Section 6.4.7 or Section 4.2.5.1 of the Township Official Plan;
4. The topographical map provided by the applicant and reviewed by the NVCA did not remove the subject property from the flood hazard;

5. The application does not comply with Zoning By-law No. 03-57, Schedule B, Section 18.1, Hamlet Residential (HR1) on private services, Minimum Lot Frontage and Minimum Lot area; and,
6. The application does not meet Public Works guidance regarding an entrance meeting a T intersection.

It was determined that OACA memberships for all members and staff of the committee would be purchased in 2020.
