here are three principal ways to im-migrate to the United States. Theseare: 1) through a family relation-

ship, 2) through employment, and 3)through investment. In all cases, the im-migration process requires a petition to befiled on the migrant’s behalf. The petitionis usually fi led in the United Statesthrough the Immigration and Naturaliza-tion Service (INS) having jurisdiction overthe residence or employment area of thepetitioner. After the petition is approved,it is forwarded to the consulate or embassywhere the beneficiaries reside and wherethey will submit applications for their im-migrant visas. The visas will allow themto enter the United States for permanentresidence which will be evidenced by a“green card” issued by INS.

There are numerical limits on the num-ber of immigrant visas that can be issuedin a single year. Priorities are based on thetype of visa. The applicant’s place of birthalso affects the process, as there are limitsto the number of visas that can be issuedper country. This means that in some visacategories there are waiting periods beforean immigrant visa can be issued. It is alsoworth pointing out that there are fees as-sociated filing the petition, for processingthe application, and for receipt of the im-migrant visa.

Family Sponsored ImmigrationAmerican citizens can file petitions on be-half of close family –parents, children (un-der age 21), spouses, siblings, and sons anddaughters (regardless of age). These peti-tions are filed at the Immigration andNaturalization Service (INS) in theUnited States having jurisdiction over theAmerican citizen petitioner’s residence.Once INS approves the petition, it willnotify the petitioner and forward the ap-proved petition through the State Depart-ment to the overseas post where the rela-tive resides.

For spouses and fiancé(e)s of Ameri-can citizens, the process is the same; how-ever, if the American petitioner is in the

Philippines, it is possible to file the peti-tion for a spouse at the American Consu-late in Manila. Legal permanent residentsof the US, can file petitions for spouses andtheir children and unmarried sons anddaughters. They must file petitions in theUnited States through the INS. The ap-proved petitions will be forwarded throughthe Department of State to the Embassyor Consulate where the beneficiaries re-side.

Employment based ImmigrationBased on job skills, professional expertiseand employment needs in the United States,a US employer can file an employment-based petition to bring workers and theirimmediate families permanently to theUnited States. The employer must file a pe-tition with the INS office having jurisdictionover the place of proposed employment. Inaddition to obtaining INS approval, certainemployment categories requires a certifica-tion by the Department of Labor that pre-vailing wages are met and that the local la-bor market in the US cannot fill the employ-ment need claimed in the petition. The pe-tition and the certification must be done inthe US. Once approved, the petition will beforwarded through the State Department tothe Embassy or Consulate where the benefi-ciaries reside.

Investment based ImmigrationInvesting in a business that creates em-ployment is another method of immigrat-ing to the US. Applicants for this visa mustinvest in a new commercial enterprisewhich will create full-time employment forat least 10 persons other than theinvestor’s spouse and children. The usualminimum investment is US$1 million, butmay be as low as US$500,000 if the in-vestment is in a rural or high unemploy-ment area. On the other hand, the re-quired amount can be higher if the invest-ment is made in an area of high employ-ment. A person wanting to immigrate byinvestment must file a petition with INSoffice in the US having jurisdiction overthe area where the new commercial enter-prise will be principally doing business.

Migrating to the USA

he National Statistics Office (NSO) es-timates that there are at least 3 mil-lion Filipino and Filipino-Americans

living and working in the United States. Infact, the US Embassy Manila in Manila is con-sistently among the 3 busiest consulatesworldwide in terms of immigrant visa issu-ance. The United States remains the pre-ferred immigrant destination of choice andmost Filipinos today find it easy to integratewith American society. Culturally, the Phil-ippines is the most “Americanized” countryin Asia – and maybe even the world. Unlikemost other minorities living in the US, Fili-pino Americans largely share mainstreamAmerican beliefs and values.

The steady migration of Filipinos to theUS should continue going forward especiallyin view of the current shortage of health careworkers in the United States. The AmericanMedical Association has deemed medical andhealthcare education in the Philippines toequal the level of medical and healthcareeducation in the United States. It is easy forFilipino nationals to enter the Americanhealthcare workforce, inspiring them to settleand seek United States citizenship upon ar-rival. In fact with the shortage of Americannurses created in the 1980s, clinics and hos-pitals in the United States have been hiringdirectly from the Philippines offering substan-tial salaries – and immigrant visas.

Life in America, however, is not all bliss.There is an issue over pay parity in non-healthcare professions in the United States.Filipino Americans architects and engineersare paid less than their Latino and AfricanAmerican counterparts. This is also true forthose working in the corporate environs andeducation. The discrimination is found to beworse among Filipino Americans seeking en-try-level positions and for those who join thehospitality industry. Even more dishearten-

ing is the treatment Filipino War veteranshave received from the US government. Dur-ing World War II, over 200,000 Filipinosfought in defense of the United States againstthe Japanese in the Pacific theater of militaryoperations. More than half died. As a com-monwealth of the United States before andduring the war, Filipinos were legally Ameri-can nationals. With American nationality,Filipinos were promised all the benefits af-forded to those serving in the armed forces ofthe United States. In 1946, Congress passedthe Rescission Act which stripped Filipinosof the benefits they were promised. Of the 66countries allied with the United States dur-ing the war, only Filipinos were denied mili-tary benefits.

Since the passage of the Rescission Act,Filipinos had migrated to the United Statesto lobby Congress for the benefits promisedto them in lieu of their sacrifices. Over 30,000of such veterans live in the United States to-day, most are United States citizens. Sociolo-gists introduced the phrase “Second ClassVeterans” to describe the plight of these Fili-pino Americans. Since 1993, numerous billswere introduced in Congress to return thebenefits taken away from the Filipino Ameri-can veterans. Each time, the bills died in com-mittee. The struggle continues today.

Sociologists also refer to Filipino-Ameri-cans as an “invisible minority”. Unlike mi-grants from other countries who tend to formclose-knit neighborhood communities of theirown in the United States (eg. Chinatown),sociological field studies show that FilipinoAmericans however have a tendency to settlein a more dispersed fashion, settling down –or blending in - in communities across thecountry without a need for establishing tieswith other Filipino Americans in a locality.The label of “Invisible Minority” also extendsto the lack of political power and representa-tion of, by and for Filipino Americans. In theyear 2000, only 100 Filipino Americans heldelected office. All except for one served at themunicipal or state legislative level.

he Black Eyed Peas was a crew thatsat content with what they did. Theysimply rocked. But in 2003, will.I.am,

Fergie, Taboo and apl.de.ap rocked the wholeworld! They released “Elephunk,” their fourthalbum in their 10-year career. It sold morethan 7½ million copies. Suddenly, they foundthemselves playing in front of large crowdslike the Superbowl. And the Grammy’sweren’t far away too. But, hold on a minute.Is that rap in the background in tagalog? Isn’tthat chorus a song from Asin? No, your earsdon’t deceive you. The reason? One of thedriving forces of the group is from the Philip-pines.

Black Eyed Peas member apl.de.ap is Fili-pino. Proudly Filipino. Apl is Allan PinedaLindo. He called Angeles, Pampanga homewhen he was young. He rode carabaos anddid some farming with his grandfather. He hada father he never met. When he reached 14years old, it was a whole new world for him.

From One Angeles to AnotherAt the age of 14, he was adopted by a familyfrom the US. From Angeles, Pampanga, hemade a new home in Los Angeles, Califor-nia. A new guy in town, apl was shy and barelyspoke English. He could have easily joined agang. But as fate would have it, he metwill.I.am. They shared a common interest:dancing. This laid the groundwork for theformation of the Black Eyed Peas.

The Big AplThe Black Eyed Peas is known for songs likeShut Up and Where is the Love. But one songreally sticks out, The Apl Song. is actually atribute to our homeland. According to apl,he wanted to show people a little bit of wherehe’s from. “I dedicated that song to my brotherwho committed suicide in the Philippines,”apl.de.ap says sadly in many interviews.

In an early interview (Talk It Out with

Jodi Leib, 2003), apl points out the things thatmotivated and drove him. “What drives meis my family, cause I’m from Philippines, I’madopted. My whole goal is to bring my familyover here, so they can have a better living,cause it’s hard in the Philippines to have thislifestyle.”

And what more of his family? “My sib-lings will get a better education. My sister, Iput her through Nursing School in the Phil-ippines, but I want her to get a job over here,because, you know, the pay is much better,and, just get my other siblings into a betterschool so they can be whatever they want tobe.”

How about opportunities? “I think for meit comes from where I’m from, like when I goback over to Philippines and I see how life islike over there, that’s what grounds me. WhenI come back over here, it’s like, damn, I’vegot opportunities that a lot of people don’thave, you know? So I just try to take all thatopportunity and work it, you know, cause younever know when it’s going to end, youknow?”

Hopefully, the opportunity will never end.And apl will keep on working at it. And hope-fully, the same thing will happen to other Fili-pinos.

The Philippine OverseasEmployment Agency(“POEA”) is the principalregulatory agency in mattersof overseas employment,and is likewise the agencyauthorized to issue licensesto operate a land-based re-cruitment agency to allqualified applicants.

Primarily, under the La-bor Code of the Philippines,only Filipino citizens or cor-porations, partnerships, orentities at least seventy-fivepercent (75%) of the autho-rized and voting capitalstock of which is owned andcontrolled by Filipino citi-zens shall be permitted toparticipate in the recruit-ment and placement ofworkers.

DocumentaryRequirements andFiling FeeThe POEA may issue a li-cense to operate a recruit-ment agency valid for four (4)years to all qualified appli-cants, subject to compliancewith the following documen-tary requirements:

1. Submission of writtenapplication for issuance of li-cense (POEA-LRO Applica-tion Form);

2. Proof of registrationwith the Securities and Ex-change Commission, in caseof corporations and partner-ships (i.e., certified true copyof Articles of Incorporationor Partnership), or Depart-ment of Trade and Industry,in case of sole proprietorships(i.e., certified true copy ofCertificate of Registration);

3. Proof of financial ca-pacity consisting of the fol-lowing:•Minimum capitalization ofPhP2,000,000.00;•Bank certificate showing anaccount balance of not lessthan PhP500,000.00;•Authority for POEA to ex-amine bank deposit(s);

•Verified income tax returns(ITRs) of the proprietor/cor-poration/partnership andpartners for the past twoyears. In case of newly-formed corporations/part-nerships, the verified ITRs ofthe stockholders/partners forthe past two years are re-quired;

4. Proof of marketing ca-pability, which consists of thefollowing:• Duly executed SpecialPower of Attorney and/orduly concluded RecruitmentAgreement authenticated bythe Philippine Embassy near-est the prospective employerand verified by the Philip-pine Overseas Labor Officenearest the jobsite;• Manpower request or visacertification from new em-ployers for not less than 100workers, duly verified by thePhilippine Overseas LaborOffice nearest the jobsite;and• Certification from thePOEA Pre-Employment Ser-vices Office (PSO) on theexistence of a new market;

5. Duly notarized under-taking by the proprietor/president (in case of corpo-rations)/managing partner(in case of partnership) stat-ing, among others, that theapplicant company shall:• select only medically andtechnically qualified recruits;• assume full and completeresponsibility for all liabilitieswhich may arise in connec-tion with the use of the li-cense;• assume solidary liabilitywith the employer for all li-abilities which may arise inconnection with the imple-mentation of the employ-ment contract;• guarantee compliance withlabor laws of the Philippinesand of the country of employ-ment of the recruited work-ers;• assume full responsibilityfor all acts of its officials,employees, and representa-tives;• negotiate for the best termsand conditions of employ-ment;• disclose the full terms ofemployment to the applicant(Full Disclosure Policy);• deploy at least 100 work-ers to the new market withinone year from the issuance ofits license;• provide orientation on re-

cruitment procedures, termsand conditions, and otherrelevant information to itsworkers;• repatriate the deployedworkers and his personal be-longings when the needarises;

6. In case of a partner-ship or corporation, a dulynotarized undertaking bythe partner/corporate offic-ers and directors that theywill be solidarily liable withthe company over claimsarising out of the employer-employee relationship;

7. Proof of possession bythe proprietor/president (orchief executive officer[CEO])/partners of abachelor’s degree, as well asthree years business experi-ence;

8. List of all officers andpersonnel involved in the re-cruitment and placement,together with their respectiveappointments (Secretary’sCertificate in case directors),resume, and two (2) passport-size photos;

9. NBI clearance issuednot earlier than six (6)months prior to filing of theapplication for a license, andclearance from POEA Anti-Illegal Recruitment Branchof the proprietor/partners/directors, as well as all offic-ers and employees of thecompany who will be in-volved in recruitment andplacement activities (foreigndirectors or partners shallsubmit clearance from theircountry of origin in lieu ofthe NBI clearance);

10. Contract of lease orproof of building/unit own-ership, indicating the officeaddress and an office spaceof at least 100 square meters;

11. Proof of publicationin a newspaper of general cir-culation on the notice of theapplication with the name ofthe proprietor, partners, in-corporators, and officers ofthe applicant company; and

12. Certificate of atten-dance of the proprietor, part-ners, president (or CEO) in aPre-Licensing OrientationSeminar for Executive Offic-ers conducted by the POEA.

A filing fee ofPhP10,000.00 is required tobe paid upon submission ofthe above documentary re-quirements. Only those ap-plications submitted withcomplete requirements as

well as proof of payment ofthe filing fee shall be actedupon and processed by thePOEA. In case of denial ofan application, the filing feeshall be forfeited in favor ofPOEA.

They have been performing and choreo-graphing for cultural festivals in Mindanaoand abroad, winning many awards and ac-claim in a short period of time.

Against the OceanariumThe construction of the country’s first world-class oceanarium at the Luneta Boardwalkin Rizal Park has been delayed for the pastcouple of weeks after resistance from the con-cessionaires in the area affected by the con-struction. Recent developments indicate thatthe construction will finally start as the con-cessionaires have agreed to voluntarily leavethe premises.

Several stall owners initially opposed theproject, claiming it violated their earlier con-tract. Philippine Tourism Authority (PTA)General Manager Robert Dean Barbers said

the Philippines’ large Roman Catholic com-munity. On more than one occasion, Car-dinal Sin played a key role in the Philip-pines’ transition to democracy. (COGL), a Malaysian-Chinese consortium, for the construction ofan oceanarium in the Luneta boardwalk. Theproject amounts to about US$20 million withthe COGL paying the government PhP16.5million per annum in rental fees for the nextfive years.

The oceanarium would give Filipinos andforeign tourists an opportunity to experiencea saltwater walk-through aquarium, and asimulated beach fronting the facility for swim-mers.

Not Making the GradeThe National Police Commission(Napolcom) has announced that of the18,044 applicants for inclusion in the policeforce this year, 15,416 or 85.44 percent failedthe test. In the qualification exams for pro-motions, the same thing happened. Of the18,678 policemen who took the exam, 11,332or 60.67 percent were also unsuccessful. Thispassing rate is the lowest since 1999, whenonly 10.7 percent of examinees passed theeligibility and promotions exams.

The Napolcom said the high failing ratewas a result of the harder exams they weregiving, assuring that this was for improvementof PNP standards.

The 31-year-old Tarongoy, was workingas an accountant for a Saudi firm based inBaghdad, when he was seized from his work-place along with an American colleague inNovember last year. It was an anniversary giftof sorts for Tarongoy as the day of his releasewas also his third wedding anniversary.

Reunion of SortsThe three overseas Filipino workers (OFWs) whowere held hostage were united for the first timein Malacañang. Ricky admits he was hesitant to go intofranchising as it was still a new conceptthen. “It was my wife who believed in it.Sabi ko, we don’t need other people’s money atthis point. Nagkataon lang na it’s a sort ofgrowing concept in business. A company cangrow faster. It seemed feasible. When westarted franchising, it took us a year before wechose a franchisee. It’s a long process.” That’sbecause Candy Corner is a bit selective inlooking for business partners. “We don’t likesomeone who’s all (about) money. Magkanoba kinikita? Makakabili ba ako ng kotseniyan? We’d rather have franchisees who feelgusto niyang palakihin. Natutuwa siyangpumunta sa tindahan. Natutuwa siya sa mgacandies. We don’t want people who are,minsan, napilitan lang ng magulang. Ito angnegosyo. Patakbuhin mo. We look for someonewho really likes the concept.”

Today, 99 % of Candy Corner’s productsare sourced abroad. There are around 300varieties of candies in stock with access toadditional 2,000 other varieties of confec-tionery. Shelf life of the candies average 2-3years but the turn over rate is such that it israre for the candies to even stay a month inthe store. Ricky says, “We give suggestions onwhat’s good selling or fast selling. It would benice if the franchisees know what they arebuying. In terms of purchasing, involved siya.”He believes this is easy enough as there isno dramatic shift involved in switchingfrom being an employee to being self-employed. “Our current franchisees are alsoprofessionals. When you talk to them, there isn’tmuch difference - having the foresight ofgrowing with the business, dealing with otherpeople, leadership. It’s just, now, you have moretime for your business.”

Ricky also encourages their franchi-sees to build their business. He gives aconcrete example, “Let’s say, you earn PhP15,000 net a month in a single outlet. It’sgood, yes. But it’s not enough to put yourchild through college. But if you own fouroutlets, that’s PhP 60,000 a month. Itsuddenly makes your life better. It makessense. Ang effort naman is all the same,whether you own 1 or 4 branches.”

Anybody can affordPhP 10 lollipops, up to the chocolates. Soit’s a very wide market in terms ofattracting customers. Other than that,we’re hitting our 10th year next year. It’sreally proven. So in terms of risk ofjoining us, I think the track record willspeak (for us).”

Dahil wala na siyang magagawa pa sanangyari, pinilit ni Paige na alisin sa isip angbinata sa pamamagitan ng pagliligpit ng mgadamit niya sa cabinet. “Ito na nga lang angaatupagin ko,” dagdag niya, “Nakakahiya katalaga, Paige Valencia!”

Pagkatapos niyang mag-ayos ng kanyangmga gamit, saka lang niya napansin nanapakarami na niyang missed calls sa cellphone. Mahina ang ring ng kanyang teleponokaya’t hindi niya ito napansin. Wala siyangganang malaman kung sino ang nagtitiyagang

tumawag para maka-usap siya. Sa mga orasna ito’y puro si Bajie lang ang nasa kanyangisipan. Paulit-ulit niyang inaalala angnangyari sa hapag-kainan. Nabasag lang angkanilang pagtitigan dahil dumaan ang isngkasambahay para iligpit ang kanilangkinainan. Doon lang nagbitiw ang kanilangmga mata. Kung CD ang kanyang alaala’ymalamang burado na ito sa paulit-ulit niyangpaggunita. Nasira ang katahimikan ngkanyang pag-iisip nang biglang may sumisigawng kanyang pangalan. Lumapit siya sabintana at nagulat nang makita si Bajie.

“Paige, please, I want to talk to you.”“Ha? Gabing-gabi na, a,” sagot ni Paige

na pilit itinatago ang pagkatuwa. Napansinniyang nakapag-palit na ito ng damit.Malamang naka-uwi na ito nang maisipangbumalik sa bahay niya.

“Sandali lang, okey?”Ang naging kasagutan niya sa hiling ng

binata ay isang kaway na senyas na mag-intaysandali ang binata. Kumuha ito ng bathrobe

na puti upang maitakip ito sa suot napantulog. Dali-daling bumaba at binuksanang gate para makapasok ang binata. “Maynalimutan ka ba?”

“Paige, can I talk to you inside?”Pagsusumamong tanong ni Bajie, “Please.”

“Come on in,” sagot nito habang isinaraang gate. “Ano ba kasi ang kailangan mo?”

“Paige, I’m sorry if I’m bothering you,” aniBajie bago pa man nakapasok sa loob ng sala.

“What is it about that it cannot wait fortomorrow?”

“I can’t sleep.”“Bakit, Valium ba ‘ko?”“Please, I’m serious.”“I’m listening, Mr. Espiritu the third.”“I’ve been calling you but you were not

answering my calls. I just want to apologizefor what happened earlier.” Wala nangpagkakataong sumagot si Paige dahil patuloysi Bajie sa paghingi ng tawad, “I’m really sorryabout the ice cream incident.”

Tumalikod si Paige at tumungo papuntang

kitchen para kumuha ng maiinom. Naitagoniya rin ang pamumula ng kanyang pisngi. SiBajie pala ang tumatawag sa kanya. Walasiyang naging sagot kundi ang pag-ngiti.

“You’re sure?”“Okay na iyon, tapos na iyon, no?”“Don’t worry it won’t happen again,” ani

Bajie na halatang nabunutan ng tinik.“Ganoon?”“Promise,” dagdag ni Bajie sabay abot sa

baso ng malamig na tubig na alok ni Paige.“Talaga, promise.” Halatang gumaan angdibdib ng binata sa pagtanggap niya angpaghingi nito ng paumanhin.

Walang imik ang dalaga. Para siyang ro-bot nang inihatid niya si Bajie sa labas.Hanggang sa nakalayo na ang sasakyan nito’ynakatayo pa rin siya sa harapan ng gate.Nakatingin sa malayo. Kung kanina ay maynaramdaman siyang katuwaan sa biglangpagdating ni Bajie; ngayo’y tulala na siya.Paulit-ulit niyang iniisip ang nangyari sabuong araw.

“Akala ko pa naman na-miss niya ko.Hindi pala.” Kung kaya niyang suntukin angdingding sa garahe ay ginawa na niya. “Ewan,”sigaw niya habang padabog na pumasok saloob ng bahay, “Hindi na raw mauulit. Kainistalaga.”

Kinuha niya ang kanyang cellular phoneat tinignan kung totoong si Bajie nga angtumatawag sa kanya. “Iyon lang pala angsasabihin. Akala ko pa naman...” Kinuha niyaang kumot at nagtalukbong. Tila ginagamitniyang panangga sa kanyang isipan angkumot na bumabalot sa buo niyang katawan.

Kung inakala niyang nakauwi na si Bajienagkakamali si Paige. Ipinarada ng binata angsasakyan makalagpas ng ilang kanto. Dahilsa pag-aalalang baka siya mabangga sa kaiisipminabuti niyang tumigil muna. Binuksan angpintuan at bumaba. Tumingala sa kalangitan.

“Mukha yata akong tanga doon.” Isa itosa mga pagkakataon na gusto niyang mag-sigarilyo para mabawasan ang tensiyon ayginawa na niya. “Mukha namang bale-walasa kanya iyong ginawa kong paghalik, nag-sorry pa ako,” patuloy niya, “Promdi nganaman ako, eh, siya, Manileña, maganda,matalino. Sanay siya sa ganoon.”

Sumandal si Bajie sa gilid ng kotse naparang naghinhintay ng kasagutan mula samga tala. “Kung alam lang niya,” sabaybunting-hininga, “Siguro’y hindi niyakailangang malaman pa.”

“No, it’s just an agreement with Josh,”paglilinaw ni Kris.

“There is no pre-nup because I didn’twant it. While will you get married in thefirst place it you want a pre-nup. “For somepeople it’s really practical, pero feeling kolang kung yun ang pinasok mo, paranginiisip mo na maghihiwalay kayo.

“I don’t know what the term is, parang atrust fund in dollars and pesos, that will behandled by my sister and my cousin Rinafor Josh, that’s it, there’s nothing else.
