Attached is an external budget amendment request to transfer funds from reserves to 104-7160.571.60-62 (Technology). The expenditures will cover the costs of replacing staff computers at the Main Library. I will use funds already in 7150 to replace the staff computers at the West. Branch. The total order quotation was obtained by Todd Manning. I would appreciate it very much if the request. could be placed on the next BCC agenda.

The budget amendment number was obtained from Bookkeeping.

RESOLUTION NO. 20 I OR-29

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLUMBIA COUNTY, FLORIDA CONCERNING AN APPLICATION FOR A SPECIAL PERMIT FOR BULKHEADS, DOCKS AND SIMILAR STRUCTURES TO BE LOCATED ON PERENNIAL RIVERS AS AUTHORIZED UNDER SECTION 14.6 OF ORDINANCE 98-1, AS AMENDED, ENTITLED COLUMBIA COUNTY LAND DEVELOPMENT REGULATIONS, AS AMENDED; APPROVING A SPECIAL PERMIT FOR A DOCK TO BE LOCATED ON A PERENNIAL RIVER ON CERTAIN LANDS WITHIN THE UNINCORPORATED AREA OF COLUMBIA COUNTY, FLORIDA; REPEALING RESOLUTIONS IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE

WHEREAS, Ordinance 98-1, as amended, entitled Columbia County Land Development Regulations, hereinafter referred to as the Land Development Regulations, empowers the Board of County Commissioners of Columbia County, Florida, hereinafter referred to as the Board of County Commissioners, to approve, approve with conditions or deny special permits for bulkheads, docks and similar structures to be located on perennial rivers as authorized under Section 14.6 of the County's Land Development Regulations;

WHEREAS, an application, SP 0017, for a special permit for a dock to be located on a perennial river, as described below, has been filed with the County;

WHEREAS, pursuant to the County's Land Development Regulations, the Planning and Zoning Board of Columbia County, Florida, hereinafter referred to as the Planning and Zoning Board, held the required public hearing as part of a previously prepared agenda, on said application, as described below, for a special permit for a dock to be located on a perennial river and considered all comments received during said public hearing concerning said application, as described below, for a special permit for a dock to be located on a perennial river and recommended to the Board of County Commissioners approval of said application, as described below, for a special permit for a dock to be located on a perennial river.

WHEREAS, the Board of County Commissioners, held the required public hearing, as part of a previously prepared agenda, on said application, as described below, for a special permit for a dock to be located on a perennial river and considered the recommendation of the Planning and Zoning Board, all comments received during said public hearing concerning said Application, as described below, for a special permit for a dock to be located on a perennial river.

WHEREAS, the Board of County Commissioners, has found that they are empowered under Section 14.6 of the County's Land Development Regulations to approve, approve with conditions or deny a special permit for a dock to be located on a perennial river.

WHEREAS, the Board of County Commissioners has determined and found that the application for a special permit for a dock to be located on a perennial river on the property described below is in compliance with the provisions of Section 14.6 of the County's Land Development Regulations.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLUMBIA COUNTY, FLORIDA, THAT:

Section I. Pursuant to an application, SP 0017, an application by Robert F. Jordan, requesting a special permit be granted as provided for in Section 14.6 of the Land Development Regulations to allow the location of a dock to be located on a perennial river in an ENVIRONMENTALLY SENSITIVE AREA-2 (ESA-2) zoning district, to be located on property described, as follows:

A parcel of land lying within Section I, Township 6 South, Range 15 East, Columbia County, Florida. Being more particularly described, as follows: Lot 5, Unit I, Three Rivers Estate, Inc., as recorded in the Public Records of Columbia County, Florida.

Containing 1.54 acres, more or less.

The Board of County Commissioners approves a special permit for a dock to be located on a perennial river for said property subject to the conditions hereinafter specified.

Section 2. A site plan, submitted as part of the application, dated I June 2010 as indicated on the application and is made part of the resolution by reference, shall govern the development and use of the above described property. Any deviation from the site plan shall be deemed a violation of the County's Land Development Regulations. In addition, any activities to be conducted within the area described within this application shall meet any additional requirements of the County, regional agencies, the State of Florida and the United States of America.

Section 3. The use of land approved by this special permit shall be in place within eighteen ( 18) months of the effective date of this resolution. If such land use is not in place is not in effect, within eighteen (18) months of the effective date of this resolution, this resolution approving such special permit is thereby revoked and of no force and effect.

Section 4. All resolutions in conflict with this resolution are hereby repealed to the extent of such conflict.

Section 5. This resolution shall become effective upon adoption by the Board of County Commissioners.

Please be advised we are requesting Board approval to enter onto the private property of Gerald Koneig, 158 CR 238, Columbia County, Fl for the sole purpose ofremoving two (2) large trees that are in danger of falling onto the roadway possibly causing hann to the traveling public.

I am attaching photos reflecting these large trees that are dead and leaning toward the road.

Upon notification of Board approval to remove these trees at 158 CR 238, all appropriate documents will be obtained including a General Release and Hold Harmless Agreement executed by Gerald Koneig prior to the commencement of work.

MAJOR FUNCTION:

This position serves as a working supervisor. In addition to working a dispatch position, performing the full range of Telecommunicator Dispatcher duties to include call taking and dispatching functions, Supervisors also direct and supervise subordinate staff, including assigning and delegating work projects, scheduling employees to ensure proper staffing levels, and performance management including evaluating work performance, coaching, mentoring and/or implementing corrective action for performance and conduct issues.

The Telecommunicator Supervisor is distinguished from the Telecommunicator I and II by the supervisory work performed. Supervisory responsibilities include general supervision of specific assigned employees and daily oversight of any Telecommunicator working on the Supervisor's shift. Incumbents provide technical assistance to staff, resolve minor work or personnel problems, and give input regarding discipline, training, and major job reassignments to the 911 Communications Center Manager.

Incumbents work under general supervision of the 911 Communications Center Manager, who makes assignments by defining objectives, priorities and deadlines and assists with unusual situations or problems with no clear precedent. Supervisors plan and carry out the work independently and are expected to resolve problems in accordance with instructions, policies, procedures and applicable laws and regulations.

ESSENTIAL FUNCTIONS:

• Performs all key tasks and duties of the Telecommunicator II classification (refer to Telecommunicator II job description for full list of requirements), plus;

• Supervises personnel and plans work assignments to ensure that the Board's service and production expectations are achieved

• Evaluates shift operations through personal observation of telecommunicators and recommends improvements or modifications to work practices and employee performance

• Works proactively with staff to resolve performance or personnel issues at the lowest level

• Conducts employee evaluations, reviews and approves employee timesheets, and investigates and resolves complaints or problems

• Identifies issues and implements basic corrective actions including oral counseling and oral warnings; discusses need for further corrective action with 911 Communications Center Manager.

• Coordinates major incidents to ensure that proper notifications are made; assists in call handling if necessary and coordinates with Incident Command

• Stays regularly aware of employee actions and behavior for signs of stress, coping and general emotional well-being; specifically watches for these signs during or any time after high stress and major incidents

• Responds to law enforcement requests for information, monitors several public safety authorities to coordinate dispatching of services between two or more agencies

• Ensures technical equipment is properly maintained, regularly serviced and fully functional

• Reviews Law Enforcement/Fire/EMS calls for compliance to protocol, citizen evaluation surveys, etc.

• Completes a variety of reports and correspondence relating to dispatch activities in a timely manner, such as investigations, inquiries or preparation of documents for court purposes including CAD reports, ANI/ALI reports, etc.

• In case of emergency or other necessity, transfers Operations to and sets up the Dispatch Operations back up center and shuts down dispatch activities at main location

NON-ESSENTIAL FUNCTIONS:

Performs other tasks as assigned.

WORK ENVIRONMENT:

Work is performed in an indoor, open-space environment and stationary setting. Incumbents work with and are surrounded by computerized control panels that require detailed dexterity. The majority of time is spent in a seated position; however, telecommunicators have freedom to stand and move in a limited area. Incumbents are expected to manage over-the-phone interactions and confrontations with angry, hostile, depressed and/or otherwise emotionally distraught members of the public. As a result, work requires quick, independent action and alertness in emergency and possible life threatening situations. Work entails extensive keyboarding and manual dexterity, and also entails regular reaching, stretching, and lifting of standard dispatch supplies and materials, such as maps, binders, and flip cards.

TRAINING AND EXPERIENCE:

Any equivalent combination of education and experience that provides the applicant with the knowledge, skills and abilities required to successfully perform the job. A typical way to obtain the knowledge and abilities would be:

• At least three years of progressively responsible communications dispatching experience in a comparable public safety dispatching center. To be considered comparable, experience must show proficiency with the same state laws and regulations, same equipment and programs, and

• Successful completion of the probationary period at the Telecommunicator 1/11 level is required.

Qualifications • Candidates applying for this position through an internal

It is understood and agreed that the rights and privileged herein set out are granted only to the extent of the County's right, title and interest in the land to be entered upon and used by the PERMITTEE, and the PERMITTEE will, at all times, and to the extent permitted by law, assume all risk of and indemnify, defend, and save harmless the Columbia County Board of County Commissioners from any and all loss, damage, cost or expense arising in any manner on account of the exercise or attempted exercise by said PERMITTEE of the aforesaid right and privileges.

9. During construction, all safety regulations of the County shall be observed and the PERMITTEE must take measures, including placing and the display of safety devices that may be necessary in order to safely conduct the public through the project area in accordance with the Federal Manual on the Uniform Traffic Control Devices, as amended for highways.

10. Should the PERMITTEE be desirous of keeping its utilities in place and out of service, the PERMITTEE, by execution of this permit acknowledges its present and continuing ownership of its utilities located between

NA and NA within the County's right of way as set forth above. PERMITTEE, at its sole expense, shall promptly remove said out of service utlities whenever Columbia County Public Works Director and/or County Engineer determines said removal is in the public interest.

11. Special instruction: Minimum cover of thirty inches (30") will be required at all locations. Columbia County will not be financially responsible for any damage to facilities with less than thirty inch (30") cover. Cables shall not be located within driveway ditches.

AGREEMENT

THIS AGREEMENT made and entered into this __ day of , 2010, between MALCOLM PIRNIE, INC., whose mailing address is 1300 E. 81h Ave., Suite FlOO Tampa, FL 33605 hereinafter referred to as "Engineer;" and COLUMBIA COUNTY, FLORIDA, a political subdivision of the State of Florida, whose mailing address is Post Office Box 1529, Lake City, Florida 32056-1529, hereinafter referred to as "County."

RECITALS

WHEREAS, Engineer is a Florida licensed professional engineer properly registered in the State of Florida to provide such services, including consulting, design and other engineering services; and

WHEREAS, County desires to retain the services of Engineer to accomplish a wide range of engineering, architectural, technical, management, consulting, and administrative services to assist bringing to completion as expeditiously as possible various projects as determined by the County Manager; and

WHEREAS, Engineer will be an independent contractor, but paid on an hourly basis, or on a lump sum basis per project within the agreed upon rate structure, for the services rendered to County. No benefits will be provided to Engineer and no payroll or other taxes withheld as Engineer is an independent contractor.

NOW, THEREFORE, in consideration of the mutual covenants and agreements between the parties as set forth herein, and other good and valuable considerations, the receipt and sufficiency of which is hereby acknowledged by the parties, they agree as follows:

1. The foregoing recitals are true and correct.

2. Engineer agrees to perform professional engineering services for the County, including but not limited to those services described in the Scope of Services in RFQ 2010-A, attached hereto and incorporated herein by reference, and such other tasks as may be specifically assigned to the Engineer and accepted by the Engineer as may be directed by the County Manager.

3. The County's responsibilities in connection with the work are as follows:

(a) provide to the Engineer available information, reports and other data in possession or available to the County to assist Engineer in performing his tasks herein described;

(b) designate a person to act as County's representative with respect to the work to be performed under this agreement;

(c) upon proper billing to the County, pay Engineer the agreed hourly rates as per Exhibit "I" attached hereto and incorporated herein by reference for services performed. The parties acknowledge no additional benefits will be provided by the County to the Engineer, and Engineer shall be responsible for all payroll tax and other withholding as to Engineer and/or Engineer's employees or representatives; and

4. The responsibilities of Engineer in connection with the work are as follows:

(a) Engineer shall be an independent contract and not an employee of the County;

(b) Engineer shall not perform any work outside the scope of services described herein without prior written authorization from the County, and any such additional work shall be reimbursed at the rates as per Exhibit "l" attached hereto and incorporated herein by reference.

(c) Engineer shall perform all the work and services described herein, and shall not be authorized to subcontract any of the work without the prior written authorization from the County;

(d) during the term of this Agreement, Engineer will maintain his status as a properly licensed engineer in the State of Florida; and

(e) Engineer will maintain during the term of this agreement the following insurance coverage:

• Comprehensive General Liability for a minimum limit of $2,000,000 per occurrence on an occurrence policy form, and property damage liability for a limit of $1,000,000 per occurrence.

• Professional Liability for $1,000,000. • Comprehensive Auto Liability for a minimum limit of $1,000,000

per occurrence. • Workers Compensation coverage in the statutory amounts for the

prime firm and each partner or subconsultant firm.

5. Engineer shall provide the County with the original and minimum of two (2) additional copies of documents, drawings and data summaries and such additional copies as the County may request at the County's expense for the reproduction of such documents. The original of such documents are produced for the benefit of the County and shall be the County's property, except the County agrees it will not sell or improperly publish or display the documents in any manner. The County shall be allowed to use and reproduce the documents for its own use without further consent of the Engineer and without further compensation to the Engineer provided, however, that such use and reproduction shall be without liability to the Engineer and at the sole risk of the County.

6. The County agrees to pay the Engineer in a timely manner within thirty (30) days of submission of properly completed, documented, and signed invoices from the Engineer to the County.

7. Engineer, at his own expense, indemnifies, defends and holds harmless the County from any against any and all claims arising out of or relating to personal injury (including death), or property damage which is caused by any negligent act, error or omission or willful misconduct of Engineer, his employees or subcontractors.

8. This agreement is effective from the date it is signed by both parties and will remain in effect for the initial term of three years provided either party may terminate this agreement with written notice to the other effective immediately if the other party is in material breach of this agreement and, in the case of a breach capable of remedy, fails to cure the breach within thirty (30) days of receiving written notice of the breach. Either party may cancel this agreement upon thirty (30) days prior written notice to the other party without cause. This agreement may be extended annually upon mutual

written agreement of the parties.

9. This agreement shall be governed and interpreted in accordance with the laws of the State of Florida and Columbia County, Florida shall be the sole and exclusive venue for any legal action between the parties.

10. In the event of a breach of this agreement, the defaulting party shall be liable to the prevailing non-defaulting party for all reasonable costs and attorney's fees, including appellate fees.
