SUBJECT: High Desert Educational Facilities

Proposition 13 and its attendant circumstances necessitate thinking in new dimensions regarding funds which you set aside for High Desert facilities. As you know, the Budget Act of 1978-79 permits us to leave the $343,000 in­tact with no penalty - - that is, we do not have to give one third of it to the State as had once been considered. However, one could reasonably predict that we may not be so fortunate next year.

Given the facts that we do have this reserve, but with the probability of losing it, coupled with the objective conclusion that construction of a cen­tral campus in the forseeable future is not possible, perhaps a different concept should be given some consideration.

There may be many alternatives, but three very apparent ones are:

1. Consider providing no district-owned facilities on High Desert.

2; Hold to the concept ()f establishing the beginnings of a full-blown campus. .

3. Attempt to provide district-owned learning facilities to the extent possible with our limited resources.

Certain combinations of these with possible additional ideas may emerge after discussion. However, should we decide that providing facilities on the basis of a small learning center (branch campus) is the most feasible approach, perhaps we could acquire a small block of land with utilities readily acces­sible. Thus, it may be possible to utilize modular buildings and put most of funds for rent into additional units for instructional purposes.

This is written for the purpose of stirring our thinking only. have an interest in pursuing the idea, we should be pleased to formation for alternate ideas.

The Federal Affairs Council (FAC) Washington office opened April 1, 1978, and immediately began spearheading a successful effort to "rescue" some $1.9 million in federal impacted-area aid (PL 874), funds for 26 California community college districts. The task has required continuing contacts ("Congressional baby-sitting") during the intervening four months with two Congressional commit­tees, two subcommittees, the four Californians on the House Education and Labor Committee and their staff members, and the staffs of both California Senators. The effort will be completed next month when the Senate acts to confirm House action in passing HR 15, the Elementary and Secondary Education Act Amendments of 1978, the bill in which the problem for California's colleges initially arose.

During the April - July period, the FAC office has been developing contacts with key program and administrative people in the federal agencies, including NSF (particularly the Education and Research Applications Directorates); HEW's Office of the Assistant Secretary for Education, which is responsible for the entire Education Division; the Office of Education, with its many bureaus, units and subunits; NIE; FIPSE; the Veterans Administration; and the Department of Energy.

Other activities of the office have included following up on applications with agency and program managers on behalf of community colleges which have sub­mitted proposals and which have requested the help of the FAC office; arranging for a consultant to the VA who is studying its regulations to meet with community college people in California; assisting in planning (with AACJC and other organi­zations) for a nationwide conference on veterans affairs early next year; and discussing with NSF and AACJC a possible nationwide conference, co-sponsored by the California community colleges with NSF providing the funding, on the respon­sibility of local public officials in earthquake situations.

The Interim Director regularly participates in very informative weekly meetings of the "Friday afternoon group" comprised of 20 to 25 higher education representatives who meet at 1 DuPont Circle to discuss legislative activities and strategies. He has met also with the Board of Directors of the National Council on Resource Development to establish liaison with that organization, whose members are community college development officers throughout the nation.

The Interim Director is also included in the monthly meetings held by Dr. Alfred Moye, Deputy Commissioner for Higher and Continuing Education, with about 40 Washington education advocates, at which the activities of the Office of Educa­tion and other agencies are discussed and evaluated.

WASHINGTON LETTER - 2- July 1978

Another group in which the Interim Director participates was formed after the passage of Proposition 13 - it is composed of about 20 Washington advocates of California cities, counties, special districts and one state agency. Convened by Governor Brown's representative in Washington, this group is seeking ways to encourage favorable federal consideration of our situation under Proposition 13, and is cooperating with a special task force of 11 members of Congress from the State in efforts with legislation and the federal agencies to ease matching fund and maintenance of effort requirements in various federal programs.

During the past four months, the FAC office has also provided information to various Congressional committee staff members. The Interim Director has worked with several members of the California delegation and their staffs, as well as with program heads in the Office of Education, concerning the urgent need to extend eligibility for continued Veterans Cost of Instruction Program funding for California community colleges and others where enrollment of veterans has declined. (That effort is nearly complete, I<ith the necessary amendment tacked onto HR 10569, Alcohol and Drug Abuse Education Act of 1978; passage is expected momentarily.)

In cooperation with the staff of the California State Department of Educa­tion Washington office, the Interim Director is currently exploring possibilities for federal funding to assist in removal of architectural barriers and for meeting the requirements of Section 504 for providing access to educational programs for handicapped persons. He is also discussing with members of the California Congres­sional staff the feasibility of introducing an "urban community college grant act," similar to the urban grant university act nOl< under consideration.

Continuing activities of the FAC office will include developing an effective means of assisting the colleges in their grant applications; increasing the number of community college people on federal agency and program review panels and on national advisory committees and councils; providing information about "requests for proposals" and other grant programs to the districts as the information is made available by agencies; and, of course, increasing the flow of federal dollars to California community colleges.

An adequate system of reporting on the status of various grant programs important to the community colleges has not yet been worked out by the FAC office; future issues of the Letter (anticipated to be monthly) will contain information about these programs.

This issue of the Letter is accompanied by a report on the status of selected bills currently under active consideration by the Congress; each future edition will contain similar reports.

STATUS OF SELECTED LEGISLATION

HR 10569, ALCOHOL AND DRUG ABUSE EDUCATION ACT OF 1978, to which is attached the Cranston/Hatch amendment extending eligibility for Veterans Cost of Instruction Program payments to those institutions whose enrollment of veterans has declined from the previous year, is at the House desk, awaiting final concurrence in Senate amendments. Final action has been promised by House leadership no later than July 31, with possible action momentarily.

S 991 and HR 13343, DEPARTMENT OF EDUCATION, are in "mark-up" in their respective houses (public hearings have been completed, and committees are now negotiating various amendments). Bills are expected to be reported out for floor action before the end of this session of Congress, with pos­sible implementation planned by the Administration as early as January 1979. HR 13343 is the Administration's bill, while S 991 is the product of the Senate; major issues revolve around which programs from other agencies than HEW (e.g., child nutrition from the Agriculture Department) will be given to the ne\~ Department.

HR 11274 and S 2539, ~!IDDLE INCOME STUDENT ASSISTANCE. Both bills have been reported out of their respective committees with substantial in­creases in student financial aid, but are being held up because of apparent Congressional preference for the tuition tax credit approach (opposed by the Administration) contained in HR 12050 (already passed by the House) and S 3946 (reported out of Committee and ready for floor action in the Senate).

HR 15 and S 1753, ELEMENTARY AND SECONDARY EDUCATION ACT AMENDMENTS OF 1978, extend for five years the major education aid programs of the federal government. HR 15 has passed the House, and S 1753 is being readied for final floor action in the Senate. These bills contain language which, effective October 1, 1979, remove the eligibility of California community colleges for federal impacted-area aid under PL 874.

S 2570, CETA REAUTHORIZATION, contains provisions to include post­secondary institutions on local CETA planning councils for the first time. Reported out of committee, not yet ready for Senate floor action. HR 12452, the House version, contains somewhat similar provisions.

HR 11610, HR 12993, HR 12994, HR 12995 (and others) LABOR INTENSIVE PUBLIC WORKS EMPLOYMENT, amend, replace and extend the Local Public Works Capital Development and Investment Act. The major change, as proposed by the Carter administration, is to use this vehicle much more intensively to resolve unemployment in specific geographic areas than the previous Local Public Works Act. Hearings have been held, but markup sessions are not yet scheduled; little action is expected until September on these bills, even though HR 12929 (Labor-HEW Appropriations) contains $2 billion for the program.

Please note the following:

1. The Publication Budget is based on 85% of the target budget (refer to item 2 of Exhibit A). InaSllRlch as we have not received certification from Sacramento regarding target budgets or reserves, we must rely on our own figures.

2. Local revenue is considerably higher than anticipated (refer to item 3 of Exhibit A). Riverside County has reported a total valuation increase of 19.8%. We are estimating that out-of-county valuations will increase 15%.

3. The Undistributed Reserve - Regular Contingencies includes $233,366, which anount represents the difference between 82.5 and 85. percent of the target budget. We are reCOllllel1ding that this difference be retained in the Undistributed Reserve pending the receipt of infor­mation from Sacramento.

Hopefully we will be able to make most of the final adjustments prior to the September board rreeting. It is entirely possible, hOlvever, that our share of the state surplus will not be finalized by that tine and will be subject to further adjustrrent during the school year.

FOR THE ESTABLISHMENT OF TRUSTEE AREAS

WHEREAS; the Coachella Valley·.CommunitY College Governing Board. passed a resolution requesting an election for'. the establishment oJ trustee areas in the district; and . . .

WHEREAS, said resolution was approved by the County Committee .on School District Organization at a meeting held on May 22; 1978; and .' '.

WHEREAS'" Elections Code Section 23302 p'rovldes for consol idation of said election with the statel'lide election to be held on the same day;. therefore

JjE-' BE IT RESOLVED that th.e Board of Supervisors of San Bernardino County and

The agreement effec'tive June 16, 1977, between ASCOD and Professional Food-Service Management, Inc. is hereby amended as follows:

1) Paragraph 3 of Exhibit II is amended to read 'as follows:

"PFM shall further provide ASCOD,with '8. guaranteed return of $3,500.00 per year from Dining Hall cafeteria services. This return shall be paid monthly at approximately $2~1.66 per month over a period of twelve (12) months, and is not contingent upon actual cafeteria sales." "

The following schedule shows the district operating costs on an hourly basis· using all operating costs such as all maintenance, grounds, custodial, insurance and utilities. The costs have been converted to 'an hourly.rate by 'using two hundred days a year and fourteen hours a day. The total square footage in the COD campus was used to get the ,annual cost to operate the campus on a square foot basis and then it was converted to an hourly rate.

The district operating costs are as follows for each designated facility:

As you are aware, this year through the Chancellor's Office a special fund for the inproveroont of instruction was established to try and aid innovative and exerrplary projects at ccmnunity colleges in the State. Mr. Terry Green, our Coordinator of Developrental Education, prepared a funding application in the area of adult functional CXJIl{Jetencies, and I am very pleased to report that it was selected as one of the exerrplary projects to be funded for this o:xning academic year. The main purpose of the project is as follows:

We will seek to detennine whether or not a system which stresses non­print nedia is superior to traditional lecture format for the content area of interpersonal skills. An aspect we are especially interested in is how instructional nethods effect the student's self-linage. Especially for people who have probably net with very little success in their previous educational experiences, we believe self-confidence is an essential underpinning. Methods which reinforce a positive self­image are very desirable, and hopefully, transferable to other educational projects.

Besides developing the course and inplementing it's non-traditional nethods, we will field test it in an already existing rrobile van unit managed by the Occupational Services and Hccre Econanics Departments at College of the Desert. The purpose of the van is to act as a "classroom on wheels" that can be taken into any area to reach people that other­wise could not receive instruction fran the College of the Desert.

Education Code Sections 41767 and 84733 provide for an optional method of computing district aid when tax receipts to a Redevelopment Agency are involved.

To assist districts in requesting the use of this optional method, we have prepared a form for Requesting Adjustment of Assessed Valuation on Account of Tax Losses to a Redevelopment Agency, three copies of which are enclosed.

Please complete the enclosed form and return two copies to this office not later than October 1, 1978.
