The decision of Judge NJWarren to quash the Gam-

bling Commission’s initial deci-sion to refuse Greene King’sapplication for a bingo licenceformed a priority point of discus-sion at the most recent quarterlyboard meeting of the Bingo Asso-ciation (BA).

“It’s fair to say that the GreeneKing ruling featured quite promi-nently at our December board,”said the trade body’s chief execu-tive, Miles Baron.

With the regulator preparingits own appeal against the ruling,the eventual outcome ofwhether bingo operation willsuccessfully integrate withinGreene King’s 1,000 site opera-tion remains unclear. Even if per-

mitted, just how many of thecompany’s premises would actu-ally establish a permanent bingopresence is unknown, but theprospect enough to give jitters tocurrent operators.

“Obviously some of our mem-bers in the short-term are goingto be concerned about competi-tion, and I understand that,”Baron conceded. It’s concernthat will be reflected in theagenda of the organisation’s firstquarterly board meeting for2015. “First and foremost, we’llbe keeping a close eye on thebingo pubs and clubs issue.”

“As we said in the LCC consul-tation when we completed thequestion on bingo in pubs andclubs: if Greene King or anyoneelse like them are serious aboutplaying bingo and meeting thelicensing requirements then wedon’t see any reason why theyshouldn’t be able to,” heremarked.

In his own words, for Baron,the cross over and potentialgrowth in the scope and appealof the game is a development thatboth he and the directors of theBA “cautiously welcome”.

“We exist to support and rep-resent anyone who operates alicensed bingo premises,” hestated. “On that basis, there’severy reason for us to welcomeand support them.”

having been forced to approvepubco Greene King’s licence tooperate bingo on its premises.

Despite initially rejecting theapplication, the Commission’s handwas forced by Greene King’s ownsuccessful appeal in the First-TierTribunal, at which the breweryargued that the regulator had over-stepped its responsibilities in refus-ing the initial request.

Judge NJ Warren overturned theCommission’s decision on thegrounds that it did not have theauthority to dictate whether or notGreene King should be awarded alicence, stating that it should simplyprovide guidance to the relevantlocal authority, as had been dictatedby Parliament.

In the view of the Gambling Com-mission, this is a position that placesthe body in a regulatory strait-jacket,effectively hamstringing theirexpress purpose.

“We are seeking permission toappeal the decision of the First-TierTribunal requiring the GamblingCommission to allow (license) a pubchain to introduce commercial gam-bling with potentially large numbersof gaming machines into pubs,” saida spokesperson. “This ruling appearsto handicap the Commission indoing what it was set up to do - thatis, react to new developments andprotect the vulnerable.”

The Commission has also raisedconcerns regarding the potential forblurring lines between a pub and adedicated gambling venue. “We areclear, and this view is strongly sup-

ported by the government, that com-mercial betting, gaming and bingoand any associated high stakes andprize machines should be providedonly in separate premises licensedfor that specific purpose,” added thespokesperson, “premises that adultsmake a deliberate choice to visit inorder to gamble.”

The court ruling also entitlespubs to feature machines that arecurrently limited to bingo and AGCpremises. The potential for £2/£500B3 machines entering UK pubs, is adevelopment that the Commissionis extremely keen to prevent.

“A judgment from the Upper Tri-bunal should hopefully clarify whatwe can and can’t do by way of oper-ating licence conditions,” continuedthe spokesperson. “Meanwhile, we

are working closely with theDepartment for Culture, Media andSport to see how we can both useour various powers to keep com-mercial gambling in dedicatedlicensed premises and stop itspreading to pubs.”

The industry, on the other hand,wears the lines of concern across itsface.

In the view of BACTA chief exec-utive, John White, this episode willeventually result in a law changethat returns things to the status quo.“My own very personal view is thatrather like the Luxury Leisure case,”said White, “if a ruling goes againstthe Gambling Commission, in alllikelihood the law will ultimatelyget changed to accord with the viewthe Commission has.”

As part of the deal, GalaRetail will continue to oper-ate the bingo halls and act asa tenant in 25 year leaseswith M&G. Additionally, GalaCoral has paid of £34m ofrent on its bingo locations,reducing rent to between£9m and £15.5m a year.

Gala Coral’s program ofsales, which has alsoincluded eight casinos,forms part of an overall strat-egy to double down on itsbetting shops, which con-tinue to drive profits. Bingooperator Gala Retail is toremain part of the largerGala Coral whole for now,but may itself be up for salein the near future.

“We remain pleased withthe turnaround in the per-formance of Gala Retail andhave recently embarked ona process to explore a poten-tial sale of the division,” saidchief executive Carl Leaverwhen announcing thebingo club sales in August.Indications are that thecompany remains on thelookout for a likely buyer.

Ingoldmells arcade tightens upprocedures following test failures

An amusement arcade inIngoldmells has been

ordered to tighten its agerestriction practices after itfailed two mystery shoppertests over the summerseason.

Sun City Amusements, atIngoldmells Point, failed atest on July 23 and anotheron August 27.

East Lindsey DistrictCouncil’s licensing com-mittee ruled the businessshould enforce the “Think21” rule and undergo inde-pendent testing once amonth for 12 months ofbusiness.

Tony Kelly, a Sun City rep-resentative, told the EastLindsey Target: “It’s veryembarrassing to be here,

this is the first time we havebeen to a licensing review.

“We don’t want this tohappen again. We arehaving test purchasing, weare trying our best tocomply with the law.

“We rely massively onour reputation, we will doeverything that we can tocorrect this.”

Licensing and environ-ment officer Neil Brookstold the committee heinstructed the underageindividual to make contact

with staff and stay for atleast seven minutes.

On both occasions thatSun City was tested duringthe summer, the underageindividual was not chal-lenged on entry to anadults-only section and wasallowed to stay.

Kelly told the commit-tee that no employee hadtaken responsibility forthe first offence and thatduring the second theemployee responsible hadnot been confident in

making a challenge.He also suggested that

the adults-only section ofthe premises could bemoved to make itsentrance more visible tostaff. The committee said itwould support such anapplication.

In response to theoffences, Kelly said SunCity’s management hadnow adjusted its recruit-ment procedure to ensureall employees understoodbest practice regardingunderage gambling andthe consequences of fail-ing to carry out theirresponsibilities.

Brooks said: “I have neverasked them to be in front ofa committee before andthey are some very goodoperators.”

announced that it plans toinvest over £400m to open200 pubs over the next fiveyears, many of which willbe located in the Republicof Ireland. The move isexpected to create 15,000jobs throughout bothcountries.

The expansion planscome at the end of a bounti-ful sales year for the pubcompany. Whilst fourth-quarter financial results forthe pub company’s gamingmachines division showeda like-for-like decrease of3.1 per cent, total sales rev-enue for the companyincreased 10 per cent to£1.4bn.

Wetherspoons currentlyoperates over 900 pubsthroughout the UK. 2014saw the company take itsfirst steps within the Irishmarket, opening its first pubin the country in Blackrockearlier in the year, and a

second in Dublin in Decem-ber. The Irish pub sector isnotable for its diverse own-ership structure that seesbrewers wield significantlymore power than their UKcounterparts.

The company has statedthat it will aim to open a fur-ther 30 pubs throughoutIreland before 2020.

“We are looking forwardto opening the new pubs,many of which will be inareas where Wetherspoonis not yet represented,”stated JD Wetherspoons’

chairman Tim Martin. “Wehave already acquired anumber of sites and willcontinue to search for newsites throughout 2015 andbeyond.”

Fair fortune for the newpubs will see the companyalmost double its tax con-tribution. “Wetherspoonspaid more than £600 mil-lion in taxes in our lastfinancial year,” addedMartin. “This will rise toapproximately £1 billion inthe course of the next fiveyears.”

It’s in these crucialweeks that Britain’sarcades, piers and amuse-ment venues deliver aneasy, cheap and fun leisureoption to families of allincomes up and down thecountry. And it’s in this cru-cial time slot that the for-tunes of the amusementsindustry can often depend.

Could this all be about tochange?

If plans unveiled byformer Secretary of Statefor Education MichaelGove in 2013 are put intoaction, these summerbreaks could be slashed,with the missing weeksredistributed throughoutthe year.

Under the proposals,school kids may will begranted the same volumeof holidays, but spread outmore evenly throughoutthe year.

For amusement opera-tors, all weeks are not madeequal and the loss of a weekin summer, to be replacedby a longer winter break,would be devastating.

Trade associationBALPPA are leading thecharge against this legisla-tion, which, having suc-cessfully passed throughthe Commons, currentlysits in the House of Lords.Termed the DeregulationBill, it would bring in newlaws which allow schoolsto decide the length oftheir own holidays, allow-ing them to slash thesummer break from six tofour weeks.

“Evidence from aroundthe world shows thatreducing the length of

summer holidays is devas-tating for tourism,” says aBALPPA mission statement,“which is reliant on tradein peak periods to offsettougher winter months.Reducing this length - ormoving holidays outside ofthe peak period - has a hugeimpact on these businessesand the local economies ofareas that rely on tourismspending.”

BALPPA’s hope is thatthey can intercept the billas it passes through the var-ious stages of the House ofLords and add amend-ments that protect theleisure and amusementindustry.

Party members fromacross the political spec-trum have backedBALPPA’s cause, with con-cerns raised in the Houseby both Conservative LordNaseby and Liberal Demo-crat Lord Clement-Jones,while opposition

spokesperson BaronessHayter mentioned issue inher summing up forLabour.

BALPPA also maintainsthat the introduction ofthis bill does not match upwith the government’scommitment to bolstertourism in the UK. Seasidetowns, many of which fea-ture some of the finestamusement arcades in thecountry, would be hugelyimpacted by the loss of twosummer holiday weeks andno manner of pro-tourismpolicies will be able tomake up for that shortfall.

The selection of whichdays are removed from thestandard school holidaywill also make a massiveimpact. Not all days in Julyand August are equallyprofitable and the mostdamaging holiday cutscould see businesses loseup to 75 percent of theircurrent summer trade.

Are school holidaysheading for the chop?The fight againstschool holidayderegulationcontinues, withBALPPA leading thecharge as theamusement industryapproaches a makeor break 2015.

How are your discussionswith the House of Lords

progressing?We have a number of sup-porters in the House ofLords and our concernshave been discussed severaltimes in debates. At the laststage, the committee stage,we also tabled an amend-ment in an attempt toremove the offending partof the bill, however, thisdidn’t pass. We intend totable another one at thenext stage, the report stage.

Have you been given anykind of timetable for theDeregulation Bill?The timetable is highly flex-ible as it depends on howlong the debates go on for,but we expect the nextstage to take place at theend of January with thefinal stage, the third readinga short while after. At thispoint the Commons has toagree the Lords amend-ments and the bill needsroyal assent, so we expect itcould be law in a fewmonths’ time.

What support have yourlobbying efforts receivedfrom BALPPA members orother trade and tourism

associations?We work closely with anumber of associations on arange of issues, but thesummer holidays one is ofclose concern to our mem-bers. It is something thatconcerns associationsacross the board such asBACTA and the Cinemaassociations, but more pres-sure is needed.

How central to the fortunesof a seaside arcade, forexample, is that lucrativesummer period whenschools are out?The summer peak is whenour businesses take most oftheir money, which helpsthem survive the longer,colder months whentourism is reduced. Seasidearcades have been strug-gling for years and the gov-ernment’s decision not toraise stakes and prizes hasreally hit them hard. If theywere to then introducethese, lots of these busi-nesses would be less able toinvest in local economiesand boost struggling sea-side communities. Summerholidays are crucial for thesuccess of seaside attrac-tions and these proposalsendanger this.

howman Allan Stokes hasexpressed his satisfactionwith the new location

Shropshire Council has found forOswestry’s historic March funfair.

However, he is still awaiting theoutcome of the council’s search fora new site for the caravans he livesin, and hopes to remain close to thetown itself.

The move was made necessaryafter the funfair’s previous site, nearcattle market on Shrewsbury Road,was sold to become part of a newleisure and retail complex.

Stokes said that Oswestry’s 100-year-old funfair could now becomeeven more successful, owing to thenew site’s more central location at thetown’s Oswald Road coach and carpark.

He told Coinslot: “It’s much closerto the town itself then the cattlemarket is, and we’ve always said thatthe closer you can get to a towncentre, the better the atmosphere

for the funfair.“Because we have done business

with Shropshire Council for manyyears, it has pulled all the stops outto find us somewhere to go.

“The March funfair was held inthe centre of town for 88 yearsbefore it was moved to make way forSainsburys around 20 years ago, andit was always a very successfulevent.”

Stokes said his involvement withthe funfair goes back 60 years, butit was founded by his grandfatherand has since passed on to his sons.

He was still frustrated by the lackof progress made in finding a newlocation for his caravans, which havestood for on the cattle market sitefor the past 15 years.

He commented: “It’s one thinghaving nowhere to take the funfair,but it’s a bigger problem havingnowhere to live.

“The council has been trying tofind us somewhere for the last 15

years, and really they haven’t got veryfar at all. But now because of the newretail park and coverage in the localmedia it has started to pull its fingerout and find me somewhere to go.

“Hopefully in the New Year I willhear more about it, and hopefully itwill still be in this area, as I have threegrandchildren at local schools, so wedon’t want to have to move very far.”

Stokes also told Coinslot that theway funfairs are operated havealtered a great deal over the lastdecade.

Gone are the days when a funfairwill set up in a town for two or threeweeks with the showmen’s cara-vans in tow.

He explained: “It’s all one dayevents all over the country now, andit’s too costly to move all the cara-vans to an event just for one day.

“Parents used to give their chil-dren money to come down to a fun-fair every weekend, but with therecession we’ve had over the last

ten years they don’t have that kindof money any more.

“If we take a fair into a town for acouple of weeks and charge just 50pthe children don’t seem to come, butif we come for just a day and charge£2 we are busy.”

At 70-years-old, Stokes’ appetiteto stay in the industry remains ashungry as ever, fuelled by thedemand he perceives people stillhave for the type of entertainmenthis family provides.

He said: “If a time came when weopened the funfair and nobodycame, then you could say it has hadits day, but it isn’t like that at all - lotsof people continue to enjoy ourevents throughout the year.

“I do about 20 different events inthis area without travelling out ofShropshire, and the locals arealways excited to see me and thechildren are always glad to come tothe fair, so I feel like I want to keepgoing for a few years yet.”

new report, entitledClosing Time -Who’s killing the

British pub? claims that tax-ation, regulation anddeclining real wages as aresult of the recession havebeen responsible for theclosure of more than 6,000

pubs in the past eight years.Author Christopher Snow-den argues that the blameattached to pubcos for clo-sures has been overstated.

The report states thatpubco pubs have been clos-ing at almost exactly thesame rate as independents.

“The All-Party Parliamen-tary Save the Pub Group,amongst others, has beenguilty of misrepresentingtransfers as closures in aneffort to support theirclaim that ‘the non-man-aged (largely leased/ten-anted) sector has seen

many more net closuresthan those of independentfreehouses’ and that ‘pubcopubs are being sold off foralternative use and bull-dozed in their thousands’.”

The report continues:“The mere fact that pubcoshave sold large numbers ofpubs to the independentpub sector does not meanthat the tied pub model isa major contributingfactor to an increased rateof pub closures.”

Recent years have beencharacterised by a flurry ofpolicies which have‘severely damaged’ thepub industry. The rise inalcohol duty and introduc-tion of a duty escalator,combined with theincrease in VAT to 20 percent and falling real wagesduring the recession haveresulted in drinking outbecoming less affordable.

Snowden puts forwarda number of solutions,including:

• Halve alcohol duty.British drinkers pay 40 percent of EU’s entire alcoholduty bill - the governmentshould halve alcohol dutyto bring it in line with theEuropean average, whichwould reduce both the costof living and alcohol fraud.

• Reduce VAT from 20 percent to 15 per cent and intro-duce a lower rate of VAT forfood sold in pubs and restau-rants, as happens in manyEuropean countries.

• Relax the smoking ban.The UK has one of mostuncompromising smokingbans in the world. There isclearly a market for venuesthat allow smoking in oneor more ventilated rooms.

“British pubs may be suf-fering from long-term cul-tural shifts, but governmentpolicies have exacerbatedthis trend. Taxation and reg-ulation have been the lead-ing causes of the

decimation of the UK pubindustry since 2006. Thelevel of alcohol duty in theUK is hugely regressive, hit-ting the poorest the hard-est. Taxes must be lowered,and one-size-fits-all policieslike the current smokingban must be reconsideredif we are to temper the rateof decline of the Britishpub,” stated Snowden.

Greg Mulholland MP,chair of the ParliamentarySave the Pub Group,responded: “The Save thePub Group are all for sensi-ble changes to reduce reg-ulatory burdens onbusiness and have fairertaxation for pubs, but it isextraordinary that thissomeone who claims tobelieve in market econom-ics is defending the veryinstrument responsible forrestricting licensees withthe hugely burdensometerms of the pubco tie. ForMr Snowdon to defend thisanti-competitive modeland the closed shop it hascreated is just bizarre.

“This is another desper-ate last gasp in the deaththroes of one of the mostanti-competitive and anti-free market businessmodels in modern UK his-tory and if this is the bestthe anti-reform brigade cando with this flawed unsub-stantiated nonsense, thenthe many credible organi-sations backing reformhave little to worry about.”

he Jim GoddenMemorial CancerTrust has missed out

on an estimated £450,000after a mural by street artistBanksy failed to sell at anauction in Miami.

The mural, dubbed ‘ArtBuff’, originally appearedon an outside wall of PalaceAmusements in Folke-stone, but was removed inSeptember and shippedover to the US.

The Godden family, whoown the arcade throughoperating firm DreamlandLeisure, had hoped it wouldraise significant funding forthe charity, which was set

up by Rochelle Godden inmemory of her husband,Kent amusement industrygiant Jimmy Godden.

Hrag Vartanian, editor-in-chief and co-founder of artblog Hyperallergic, toldKent Online that Art Buffhad failed to sell because ithad not been authenticatedby Pest Control, a companythat issues paperwork forgenuine Bankys.

He said: “They [theworks] aren’t approved byBanksy’s Pest Control,which means no reputableauction house will touchthem.

“This impacts the value.

I’m not sure I know of anymajor museums that showsnon-Pest Control approvedpieces.

“Considering there’s‘official’ Banksys available,I can see why few want tospend on unofficial ones.”

The removal of the muralcaused considerable con-troversy at the time, withmany Folkestone residentsdismayed to see a work bya world-renowned artisttaken from public view.

Folkestone and HytheMP Damian Collins calledon Dreamland Leisure toreturn the mural, and theincident even reached

debate in the House ofCommons, where Ed Vaizey,minister of state for cultureand the digital economy,said he wanted to see theBanksy piece donated tothe people of Folkestoneinstead.

At the time, the Goddenfamily listed the cost ofmaintaining the mural asone of the reasons for itsremoval, as previously ithad been defaced, either byvandals or, as somerumours suggested, byBanksy himself.

American art dealerStephan Keszler, who ownsthe New York art gallery

currently in possession ofArt Buff, said the Goddenshad been right to remove it,arguing it was “unreason-able” to expect street art toremain in situ.

He commented: “It’s veryunreasonable. Every com-plainer would stop com-plaining if Banksy wouldpaint on their property.”

Asked if it matteredwhether the work wasremoved from its originallocation, Keszler said: “Notat all. Without our involve-ment this and 90 per centof Banksy’s street workswould have beendestroyed.”

Southend’s Golden Milecould be about to see the

addition of a new £60mdevelopment that stake-holders hope will boosttourism at the resort.

Goldfield Developmentsis hoping to create a largeleisure and residential com-plex, Marine Plaza, on thefamous seafront stretch -home to many amusementarcades, fish and chip shopsand pubs - and it wants tosecure planning permis-sion next February.

Plans for the brownfieldsite include 282 flats

divided between sixblocks, restaurants, shops, aspecially designed publicarea and an undergroundcar park.

Dawn Jeakings, chair-man of Southend BusinessImprovement District,thought the project had thepotential to increase foot-

fall in the town.She told the Southend

Echo: “We are pleased tohear of further confidencein the town with excitingnew developments such asMarine Plaza.

“Investment in the town,and specifically theseafront elevation, just

shows the area has greatpotential to attract evenmore than the average sixmillion visitors each year.

Opened in 1987, the leisurecentre offers ice-skating, ten-pin bowling andan indoor children’s play arena and attractsapproximately 600,000 visitors every year.Renovation plans would have seen the intro-duction of a brand new bowling alley and thecreation of a new soft play area. “Local gov-ernment is currently undergoing unprece-dented reform which will take effect from 1stApril 2015,” claimed a spokesperson fromCastlereagh borough council. “ConsequentlyLisburn City and Castlereagh District Councilis currently considering the associated costs

committee opts to remove anyreference to gender from thevenue’s title. Club secretary, BrianSkelton, told the local press thathe hopes the rebranding willhelp dispel some of the stuffystereotypes associated withworking men’s clubs.

What will now be known asWolstanton High Street Club canalready boast as many femalemembers as male and at a gath-ering of the venue’s 600 mem-bers, a vote was also passed lastyear to leave the Working Men’sClub and Institute Union. “Ispoke to two or three memberson the club committee and wethought we’d take that step for-ward to change the name,” saidSkelton. “Someone suggested theWolstanton High Street Clubname because that’s wherewe’re located.”

It is hoped that, after a lean year,the name change will help attractnew members. “We’re trying toimprove on what we already

have,” said Skelton. “For the lastcouple of years, we’ve brokeneven and with money in the bankwe can afford two or three badyears but obviously we don’twant that.”

darts, pool and a space for livemusic. Skelton says that it’s aselection which surprises manyvisitors, as he discovered duringa recent visitor from a potentialbooker. “When she came in, shesaid: ‘I didn’t think working men’sclubs were like this, I didn’t thinkthey were as nice as this’. I askedif her friends had the same per-ception and she said ‘yes’.”

s the industry gears up for EAGand ICE and one of the largesttrade-show opportunities in the

annual calendar, coin-op businesses largeand small are spending large to place theirrespective products in the limelight. Thecosts involved are, as you would expect,not insignificant, but the returns - well,these could be business defining.

First, though, we need to consider thedown-side. Combining exhibition priceswith the logistics required in transportinghigh volumes of advanced, heavy or deli-cate products, stand design and assem-blage, not to mention accommodationcosts for personnel and trade-show exhi-bition adds up to a significant commit-ment, particularly for smaller businesses.

In an age where social media providesan unprecedented global marketing plat-form free-of-charge, some might betempted to ask of the large-scale tradeexpo: is it still all worth it?

Well, businesses seem to think so. Arecent study by the Center for Exhibition

Industry Research (CEIR) drew upon fourkey metrics to analyse the sector’s overallperformance since the turn of the millen-nium: net floor-space sold, visitor atten-dance, exhibitor number and grossrevenue. Across all sectors, the collectedtrade-show industry grew 1.09 per cent:but behind this figure lies a more complexand optimistic outlook. “Even though 2013only showed incremental growth, therewas positive movement across a majorityof the sectors and there was growth in allmetrics,” said Dr Allen Shaw, chief econo-mist for Global Economic Consulting Asso-ciates. “Each metric measured sawpositive growth in 2013, and the numberof attendees finally exceeded the previ-ous peak in 2007.”

What’s more, amusement trade-showscontinued to outperform the industrystandard: growing nearly 3 per cent in2013 across combined analysed metrics.

So much for the figures. One need onlyspend five minutes chatting to exhibitorsat October’s Autumn Coin-op Show to find

a sector basking in an opportunity to meetand network face-to-face. “It’s been a won-derful networking opportunity,” enthusedAstra’s sales and marketing director AlanRogers. “You quickly realise that you haven’tmet face to face with some of your cus-tomers for a couple of months because ofthe summer season, and then holidays, thatkind of thing.” For Wexel gaming, showcas-ing at ACOS brought another vital elementof customer interaction: product feedback.“We’ve been given feedback from atten-dees as to how they’d like to see us improveour current designs in the future,” productdeveloper Dan Smedley told us. “That sortof thing’s really invaluable.”

Perhaps it was sentiments such as thesewhich imbued EAG with the confidenceto expand its 2015 event to include theentirely new Visitors Attraction Expo(VAE). Regardless, it’s more than fair to saythat ours is an industry that continues toderive great benefit from the tried andtested formula of the stand, the introduc-tion and the handshake.

EXHIBITIONS

On theworthof theexpo Despite the costs involved and apost-recession economy, thetrade-show industry continuesto grow. One of its healthiestsectors? Step up, amusements.

According to a FaceTime report byOxford Economics, the UK exhibi-tions industry generates in excessof £11bn in spending and con-tributes £5.6bn in value added to theUK economy. As of 2010, the sectorsupported nearly 150,000 jobs andattracted more than 13m visitors.Over a third of all UK expo exhibitorsexpect to generate between £10,000to £50,000 in additional sales.

The demise of Germany’s once great IMAshow is testament to the fact that irre-

spective of need and popularity, exposi-tions are vulnerable if their correlatingindustry falls victim to hostile legislation.Once one of the sector’s leading tradeevents in Europe, the future of the IMAevent has been placed in long-term jeop-ardy due to current local governmentefforts within Germany to drastically reducethe number of permitted games machineswithin German arcades and bars. That said,Dusseldorf’s loss is London’s gain: at leastaccording to the managing director of BallyWulff, one of the principal German gamesmachine manufactures. Lars Rogge claimsthat the cancellation of the IMA trade showoriginally scheduled for January 2015 willeffectively make the upcoming ICE TotallyGaming event in London the German indus-try's trade show of choice. “I would expectthere to be at least 300 of the most impor-tant German operators visiting London forthe show,” he said. “For us - and our fellowmachine-makers in Germany - ICE willtherefore become our principal interna-tional showcase.”

t comes as no shock to thesystem that the GamblingCommision has decided

to challenge the successful appealby Greene King to facilitate bingoin pubs. In a way, it also comes aslittle surprise that the courtsgranted GK’s appeal in the firstplace. And, to most observers, itmost probably wouldn’t causemuch surprise if the Commissiongets somewhere with its latestchallenge to the appeal decision.

Which beggars the question:when is a court decision the rightdecision?

The industry will, competition

notwithstanding, stand firmlybehind Greene King: it’s good foroverall business, it’s good forgrowth and it’s good for customerchoice. At the same time, theindustry will almost certainlyunderstand the stance of theGambling Commission in protect-ing its remit to regulate.

But where does that leave us all- the legal fees mount up, theimpasse stagnates businessopportunity, and the dividebetween regulator and regulatedremains just that.

With Greene King and theGambling Commission backed by

such proficient legal teams,where does this conflict actuallystem from? Is it over zealous regu-lation, greedy commercialism orjust badly crafted legislation? Well,we all think regulators are overzealous - it’s their job, so that pointdoesn’t have any gravitas. As forbingo in pubs, that’s simply agood idea, so we can knock greedoff the list. So could we possiblybe suggesting that the legislationis simply not fit for purpose?

We waited nearly 40 years fornew gambling legislation - you’dthink we could have got it right inthat time!

n the battle to stop thederegulation of schoolholidays, there’s more at

stake than just politics and goodbusiness. Long idyllic summerbreaks are a part of nearly everyBritish adult’s fondest childhoodmemories. They form a part ofour culture, and lopping morethan 30 percent off the standardsummer break will do more thanjust impact profits, it will

damage a way of life.The facts and figures make it

plain, this is something that thecoin-op industry must fight. Theimpact on coastal businesses inparticular will be catastrophicand the tourism sector must alsojoin the battle. But if BALPPA andits allies are to win this fight,there must be engagement withthe wider public. There’s a realsocial principle at stake and

awareness of the threat is low. Amusement operators don’t

need to be told how serious thisissue is, but the potential forengagement from the generalpublic is massive and if pitchedcorrectly, could see the tide turnagainst Michael Gove’s divisiveproposal. With the bill currentlymaking its way through theHouse of Lords, the time tostrike is growing slim.

price of one, no IMA in Germany,the best expo venue in London,well, what a bargain.

There is always the sense aheadof EAG - and its predecessor ATEIfor that matter - that UK amuse-ments enters the year full of highhopes and aspirations. Just how tofulfill this dream remains the elu-sive killer application.

A good show will help - and

BACTA will certainly make surethat will happen.

But the business environmentholds the key: and in an electionyear everything is up for grabs.

Is it too much to hope for thatthe industry finally gets some qual-ity legislation, friendlier govern-ment and sound businessopportunities?

That’s the wish list for 2015.

South Hylton Workingmen’sClub, which suffered a freak firecaused by an ice machine, hasundergone a £300,000 refurbish-ment. The club’s success, andthe way its top-class teamensured functions still wentahead, has put it among thecontenders for a What’s On

Where award.The club is no stranger to the

competition as it won the socialclub of the year category in lastyear’s event.

Assistant secretary PeterAnderson, who works at the clubas a volunteer, said: “We are overthe moon and it is wonderful thatpeople have nominated us. It hasbeen a pretty difficult year butwe have got great customers.The members have been brilliantand really rallied round. Theyhave supported us through a dif-ficult time.”

The nomination for the clubsaid: “All the staff and membersrallied round to make sure thatpeople who came for a night outstill enjoyed the experience.

“The bar is now open againafter a total refurb and all isback to normal. During the dis-ruption there was still the usualhigh standard of entertainmentand any bookings for privatefunctions still went ahead.”

Accompanied by David Ger-shlick and Andy Deacon, we

had a very useful meeting withthe Gambling Commissionbefore Christmas where wewere able to demonstrate howcompensators worked incranes when they were oper-ated as games of chance asopposed to prize every time.

The Gambling Commissionhas been trying to ascertain viaquestionnaires, which I knowa number of members havereceived, the answers to ques-tions about compensation.These conversations are ongo-ing but physically seeing thecompensation unit reallyhelped their understanding.

As you will know the issuearose principally because ofconcerns about cranes in shop-ping centres not being prop-erly permitted and operated.The GC issued advice to LocalAuthorities on the matterabout which we advised mem-bers a few weeks ago. We alsospoke about LAs requiring anew licence when pubsreplace a Cat C machine with aCat D. We think this is wrongand will be writing to Division2 in the New Year with legaladvice on how to go aboutmaking sure both are covered.

We have also met withGraham Wason and his teamfrom the Campaign forReduced Tourism VAT to 5%.We support this campaign andwe were able on Tuesday towork out how BACTA and itsmembers can help make thecase. I will soon be sending outmaterial that Division 1 mem-bers in the main can use tolobby local MPs and otherstakeholders. In the meantimeI would encourage all mem-bers to go to their website and

BACTA took its place at theIGRG meeting whichincluded the Commission totalk about self-exclusion. Asyou will know BACTA has cre-ated a compliance committee.This will be on the agenda forthat meeting which is fixednow for 10th February. Ifanyone is interested in sittingon that committee then pleaselet me know.

Our Mancom held its lastmeeting of the year and I alsohad the opportunity to take ourDCMS civil servants to see thetypes of machines you can findin pubs, arcades, and LBOs.

Amongst other things, wediscussed the recent GreeneKing case which effectivelygave the green light to bingo inpubs - with associated machineentitlement. The judgment inthe case was not on the desir-ability of bingo in pubs butrather more simply the processby which Greene King weredenied a licence. Essentially theGambling Commission wasadjudged to have acted beyondits powers, powers that prop-erly resided with the localauthority. I would be interestedin members' view of this case.

Finally, can I say thank youto all members for their sup-port during the past fivemonths since I rejoinedBACTA as CEO. It has beenhectic and challenging but Ifeel we are getting traction onthe strategic and policy initia-tives we have developed. TheConvention was a great suc-cess and I am very much look-ing forward to renewing ourengagement with policymakers in the New Year.
