Subject: Source Protection Committee – Replacement of Municipal Members

One municipal member on the Source Protection Committee (SPC) representing the Nottawasaga Valley Source Protection Authority term has expired as part of a natural replacement process to allow for new members and new perspectives. The member is from Wasaga Beach and has requested to continue representing Nottawasaga Valley Source Protection Authority watershed on the Source Protection Committee.

A brief description of his Source Water Protection (SWP) experience is provided below for your consideration:

Town of Wasaga Beach- Stan Wells. Stan has over 12 years of SWP experience as a Source Protection Committee Member. Stan holds a Master of Education degree and is retired, having had 30 years’ experience in education as a Teacher, Principal and Supervisory Officer with the local school board and the Ministry of Education. Stan is presently a Councillor in the Town of Wasaga Beach. As a resident of Wasaga Beach, Stan has always had a keen interest in source and groundwater protection and

demonstrates commitment to personal integrity and to a collaborative, cooperative approach to issue resolution and problem solving.

While the continuation of the existing municipal member from Wasaga Beach has been offered, the change in membership provides an opportunity for municipalities in the Nottawasaga Valley Source Protection Area to nominate their own staff or member of council to the position. Please consider this email a request for expressions of interest in nominating a member to the SPC.

Should other nominations be received, the selection of members will be achieved through an election. The process for nominating a candidate and for selection of the one municipal representative is outlined below, along with some background on the role and commitment of SPC members.

SPC Member Selection Process The Clean Water Act stipulates that the process for replacing a member on the SPC must be that which was used to select the member originally. As you may recall, for municipal members representing the Nottawasaga Valley Watershed, the process involved:

1. Notifying all municipalities in the watershed of the membership opportunity (thepurpose of this letter).

2. Requesting all 18 municipalities:• Put forward the name of a candidate IF interested in doing so;• Authorize someone to ‘vote’ for the municipal representatives in the event

there are more interested candidates than the one seat available.

3. Holding an ‘election’ if required;• All lower tier municipalities in the watershed receive one vote.

4. Affirming election results at the Nottawasaga Valley Source Protection Authoritymeeting following the election, and formally appointing the new members to theSPC.

Next Steps: What We Need from You: By January 31, 2020, please email Ryan Post at [email protected] indicating the name of the person your municipality wishes to nominate or indicating that you do not wish to seek a seat on the SPC, and the name of the person authorized to vote on behalf of your municipality.

In the event there are more interested municipalities than the one seat available, an election will be held via electronic ballot (email). For the election, quorum will be 50% plus one (9 municipalities).

Background The Clean Water Act is legislation put forward by the Ministry of the Environment and Climate Change (MOECC) aimed to prevent the overuse and contamination of municipal drinking water supplies. This legislation divested much of the responsibility to local stakeholder groups, known as SPCs. Locally, the SPC is comprised of 1 first nation, 7 municipal, 7 public, and 7 economic members intended to represent the various interests from across the watershed region, and ensure a balanced and practical approach to drinking water protection.

The SPC has been meeting since December 2007, and was responsible for three deliverables:

• A Terms of Reference describing the work to be done, who was responsible, andthe approximate timelines and costs,

• Technical Assessment Reports describing vulnerable areas specific to municipalwater quality and quantity, and risks to water supplies, and

• Source Protection Plans that include strategies and policies intended to manageexisting risks and prevent new risks from occurring.

The MOECC approved the Source Protection Plan (SPP) on January 26, 2015, at which time the function of the committee transitioned primarily to evaluating the implementation of the SPP policies and conducting periodic updates to ensure the plan is supporting the desired protection to the sources of municipal drinking water.

Commitment Members are asked to make a five year commitment to serve on the SPC. During this period, the committee will meet 2 to 3 times per year in the Barrie area. Meetings are typically held on a weekday afternoon. SPC members are reimbursed for their time (a per diem) and travel (mileage) when attending meetings.

It’s my pleasure to bring you a brief update from the Source Protection Committee since the last Nottawasaga Valley Source Protection Authority Board meeting.

The Source Protection Committee has met twice since I have spoken to you. At the October 2019 meeting, the Committee discussed a proposed amendment to the Source Protection Plan to allow York Region to add a new well to their drinking water system. Amendments of this sort are now required before the Ministry of Environment, Conservation and Parks will issue an amended Drinking Water Works License, in order to ensure that all new wells receive the same level of protection under the Source Protection Plan as pre-existing wells do. I understand, in working with your staff, that similar amendments will be initiated to support municipalities in the Nottawasaga Valley watershed in the coming months.

Since last fall, I have been working with Doug Hevenor, and representatives of the other two Source Protection Authorities in our Region, to appoint new members to

the Source Protection Committee. Unfortunately, many of the Committee members saw their terms end last December, and 15 new members needed to be appointed, to ensure that the committee could continue to function. I’m happy to say that many of our long-standing members were reappointed, giving continuity to the work of the committee. Several other members took the opportunity to retire from the committee, and while I will miss working with them, I certainly respect their decision to do so. We have been able to recruit new committee members to fill those vacancies however, and I’m excited with the skill sets and life experience these new members bring with them.

At our most recent meeting, on April 30th, we discussed the 2019 annual report on implementation progress. This report tracks the work that municipalities, Risk Management Officials and Provincial Ministries have done to implement our Source Protection Plan. The Committee was very impressed by the amount of work done to date in Significant Drinking Water Threats, but is also concerned about the pending July 2020 deadline for completing all Risk Management Plans. The Committee endorsed a proposal by staff to seek a two-year extension on that deadline, to help manage delays caused by the COVID-19 pandemic, and to ensure that municipal Risk Management Officials have sufficient time to build relationships with all affected landowners.

Recommendation

RESOLVED THAT: the Board of Directors receive Staff Report No. 02-01-20-NVSPA regarding the appointment of Stan Wells to the South Georgian Bay Lake Simcoe Source Protection Committee be approved.

Purpose of the Staff Report The purpose of this Staff Report is to seek the Nottawasaga Valley Source Protection Authority’s approval of the appointment of the municipal member to the Source Protection Committee.

Background The Clean Water Act is legislation aimed to prevent the overuse and contamination of municipal drinking water supplies. The Clean Water Act directs all Source Protection Regions to establish a Source Protection Committee (SPC), the members of which shall be responsible now for monitoring the implementation of a Source Protection Plan. In the case of the South Georgian Bay – Lake Simcoe Source Protection Region, the committee has been defined as being composed of a Chair, plus 22 members. Locally, the SPC is comprised of 1 first nation, 7 municipal, 7 public, and 7 economic members intended to represent the various interests from across the watershed region, and ensure a balanced and practical approach to drinking water protection.

In the case of Source Protection Regions, the Lakes Simcoe/Couchiching Black River Source Protection Authority (SPA) as the lead SPA is responsible for appointing public and economic members to the Source Protection Committee, while NVCA is responsible for appointing two of the municipal members, to represent the Nottawasaga Valley watershed.

Currently, there is one municipal representative vacancy in the Nottawasaga Valley Source Protection Area.

Issues/Analysis As per direction provided by Provincial Regulation (O. Reg. 288/07), nominations for the one vacant Nottawasaga Valley Source Protection Authority (NV SPA) municipal representative on the SPC are to be made by municipalities within the Source Protection Area, with municipalities voting if there are more nominations than vacancies.

On November 25, 2019, Doug Hevenor, NVCA’s CAO, sent a letter to the Nottawasaga Valley Source Protection Area municipal CAOs notifying that the term of one municipal member on the SPC representing the NV SPA term has expired.

The member from Wasaga Beach, Councilor Stan Wells, has requested to continue representing NV SPA on the SPC.

Further, the November 25, 2019 correspondence also indicated that the change in membership provides an opportunity for municipalities in the Nottawasaga Valley Source Protection Area to nominate their own staff or member of council to the position.

No nominations were received for any other municipal candidate.

As the number of nominations equalled the number of vacancies, a vote amongst municipal members was not required and Mr. Stan Wells is recommended for appointment as the NV SPA municipal representative.

Relevance to Authority Policy/Mandate The NV SPA is responsible for the nomination of the two municipal representatives on the SPC that represent the Nottawasaga Valley Source Protection area, of which one is vacant.

Impact on Authority Finances The nomination and approval of the NV SPA municipal representative has no implications on the finances of the Authority.

Purpose of Staff Report

The purpose of this Staff Report is to bring the attention of the Source Protection Authority Board of Directors to work required by Provincial Regulation which appears to be unnecessary, and to seek Board Resolution requesting the Minister of Environment, Conservation and Parks initiate a review of the Regulation.

The Clean Water Act establishes a framework for reporting on the progress in implementing Source Protection Plans. Under the Act, all implementing bodies (including municipalities) are to report to the Source Protection Authority (SPA) by February 1 of each year, and the SPA is to compile this information and submit a Region-wide report to the Director of the MECP’s Source Protection Program Branch by May 1.

The annual reporting questions posed to implementing bodies come from three sources: 1) Regulation 287/07 under the Clean Water Act, 2) MECP staff, and 3) questions developed for local implementers by the South Georgian Bay-Lake Simcoe Source Protection Committee. It is important to note that only those questions posed by the MECP form the basis of the May 1st report, while answer to questions under the Regulation do not need to be submitted unless specifically requested, which to date has not occurred.

This annual reporting process is an extremely valuable part of the Source Protection program, as it ensures that SPA staff remain aware of the state of progress made by implementing bodies, and supports staff in providing this information in a presentation to the Board of Directors, and Source Protection Committee, on an annual basis.

Issues/Analysis

Risk Management Officials (RMOs) who are responsible for completing these reports have indicated that meeting the reporting requirements is a significant workload taking multiple days to complete. In addition, the large reporting burden combined with regular RMO duties and a lack of clarity in some of the questions asked, resulted in concerns that the quality of some answers may have been compromised.

As a result of these concerns, staff worked with the Source Protection Committee and MECP to reduce the number of non-regulated questions. These efforts have led to the list of questions being reduced by approximately one-half from 121 to 60.

While the reduction in question has lessened RMO workload there a significant workload remains in answering questions required under O. Reg. 287/07, which neither the SPC nor MECP staff have the authority to revise.

These questions include a requirement that RMOs report, on an annual basis, the details of every:

Risk Management Plan rejected by the RMO, Order issued, Notice issued, Inspection carried out, and Prosecution carried out.

In each case, ‘details’ include the location, including well or drinking water system that it pertains to, and which of the designated activity it addresses. As there is an estimated 372 Risk Management Plans required in our Source Protection Region, and as each plan will require periodic inspections, this represents a significant and on-going workload in data entry for Risk Management Officials.

These details have been required to be submitted by Risk Management Officials since 2016. NVCA, working with LSRCA, has developed mechanisms for Risk Management Officials to meet these reporting requirements. In that time however, MECP has not asked to have this information submitted to the Province, which suggests that the time spent filling in this data has not been a good use of Risk Management Officials’ time.

Source Protection Authority staff are of the opinion that the Regulation could be revised to read that Risk Management Officials must retain this information, and make it available upon request by the Province. Staff is of the opinion that this would achieve the same goal, with a reduction in what appears to be unnecessary red tape.

Summary & Recommendations

The Clean Water Act creates a framework for implementing bodies to report annually on progress being made in implementing the Source Protection Plan. This reporting process is valuable; however, some questions which exist in Regulation require extensive amount of time for data entry, and do not appear to be used by the Ministry.

Recommendation

RESOLVED THAT: Staff Report No. 04-01-20-NVSPA regarding the 2019 source water protection annual report to the Ministry be received; and

FURTHER THAT staff be directed to seek a two-year extension on the deadline for risk management plan completion.

Purpose of Staff Report

The purpose of this Staff Report is to provide an overview of the South Georgian Bay Lake Simcoe Source Protection Plan annual progress report, submitted under Section 46 of the Clean Water Act.

Background

The South Georgian Bay Lake Simcoe Source Protection Plan (the Plan) has been in effect since July 1, 2015. The local Source Protection Authorities (SPAs) are required to monitor and report on the implementation of the SPP policies. A primary objective of monitoring and reporting is to assess if threats to municipal drinking water sources (municipal systems) are being reduced through the implementation of the SPP policies. This information will help support any future amendments to the SPP and provide accountability and transparency to stakeholders.

The Clean Water Act (Section 46) requires that the lead SPA (Lake Simcoe Source Protection Area) report to the Director (MECP) on the implementation of all policies by

May 1st of each year. Essential implementation actions such as drafting policies for municipal Official Plans have been completed across the Source Protection Region. Most municipalities have successfully negotiated some of their required risk

management plans (RMPs). Ontario ministries have completed the task of reviewing previously issued provincial approvals (prescribed instruments such as Nutrient Management Plans) where they have been identified as a tool in the Plan to address existing activities that may pose a risk to sources of drinking water.

Issues

As presented at the April 30, 2020 Source Protection Committee meeting, key annual reporting findings include:

All municipalities submitted their annual reports to Source Protection Authority staff.

Most of the policies (98%) that address significant drinking water threats in the Plan have been or are in the process of being implemented in accordance with the timelines set out in our source protection plan.

It is estimated that 86% of the existing significant drinking water threats have been mitigated through policy implementation.

Two hundred and thirty-two (232) RMPs have been established and there are an estimated 140 RMPs remaining to be negotiated across the Source Protection Region.

The initial round of on-site sewage systems has been successfully completed in accordance with the Ontario Building Code.

Prior to the COVID-19 outbreak most, Risk Management Officials (RMOs) indicated a plan was in place to complete their Risk Management Plans by the 2020 deadline. However, the rate of RMP negotiation over the final 4 months before the deadline is and continues to be significantly impacted by the current COVID-19 pandemic. In support of the COVID-19 pandemic and associated work impacts, the Source Protection Committee recommended that SPA staff seek a two-year extension on the deadline for risk management plan completion.

The SPC noted that in the process of negotiating completed and in-progress RMPs, RMOs have provided education to businesses and landowners and have built strong

relationships that will help to ensure that drinking water sources are protected well into the future. Based on the above, the Source Protection Committee has indicated that it is satisfied with the current rate of progress on plan implementation.

Summary & Recommendations

The various implementers of the South Georgian Bay Lake Simcoe Source Protection Plan have submitted their 2019 annual reports to the Source Protection Authority, as required under the Clean Water Act. The reports show that implementation of the Plan is currently progressing at a satisfactory rate. Most of the source protection plan policies are progressing in accordance with the timelines specified in the source protection plan. The rate of RMP negotiation over the final 4 months before the 2020 deadline is and continues to be significantly impacted by the current COVID-19 pandemic.

Staff recommend that the Nottawasaga Valley Source Protection Authority endorse a request to the MECP for 2-year extension to the July 2020 deadline for RMP establishment in the Source Protection Region.

It is therefore RECOMMENDED THAT Staff Report No. 02-20-SPA regarding the 2019 source water protection annual report to the Ministry be received; and FURTHER THAT staff be directed to seek a two-year extension on the deadline for risk management plan completion from the MECP.

Impact on Authority Finances The receipt of the RMO annual reports by the NVSPA has no implications on the finances of the Authority.
