1) New Antipollution Policy - Sludge & Garbage Management at Chinese Ports - Effective 1st March 2011. It is compulsory for all foreign flag vessels to join a contract with local companies for the disposal of sludge and garbage These local companies must be authorized and licensed by the MSA (Maritime Safety Administration) In case there is no sludge o/b, the vessel should provide with the Oil Record Book as supporting evidence. However, customs preserve the right to investigate further and attend o/b to verify the actual situation The relevant Certificate is to be issued from the authorized companies’ side, regardless whether Sludge/Garbage has been indeed disposed Without the relevant certificate, the MSA will not issue Port Clearance The regulation doesn›t make any notice for the treatment of bilge The below information is provided with all due diligence, as it derives solely from our experience gained so far in daily operations, concerning the subject in matter: The implementation of the new regulation hasn't been enforced equally to all Chinese ports, and also the perception of the regulation varies among different ports in a way that forms the following three main categories: 1) Ports where the new regulation is not in force at all yet 2) Ports where both Sludge and Garbage Disposal is compulsory 3) Ports where either Sludge or Garbage Disposal (Owner›s option) is compulsory High attention must be paid from the agent’s side for the monitoring of the actions and formalities linked to this regulation. The reason is because many sludge companies are not certified and/or will not report to MSA to avoid associated tax dues, and/or neglect to execute necessary paperwork in a timely manner to obtain the necessary certificate, which in turn may lead into sailing delays In practice when the quantity is very limited and it is not profitable for the sludge company to collect, what is being done can only be perceived as pure trading of the certificate, meaning virtual statement by the sludge company that sludge has been disposed against some fee, in order same to be endorsed by MSA and consequently enable the smooth process of port clearance. At the same time, the vessel has to make an appropriate record in the oil record book, in accordance to the figures indicated on the certificate The cost varies according to the quantity of sludge, the oil density and the prevailing competition locally.
