    Dear Members,

    The recreational facilities and campground amenities here at Cloud 9Ranch Club, Inc. are designed for the enjoyment, convenience, andentertainment of Ranch members and your guests. As with any socialorganization, Rules and Regulations are necessary so that each of youmay attain the maximum enjoyment and use of Cloud 9 Ranch.

    It is the responsibility of the Board of Directors to establish rules andregulations and to set applicable fees for the various activities. These

    Rules are designed to safeguard the individual rights to maximize theyour enjoyment and safety during your stay at Cloud 9 Ranch.

    Whether you are a new member or have been here since Cloud 9Ranch began, the Board of Directors recommends each Member takethe time to read through this revised set of Rules.

    1. POOL: The swimming pool in the BigTop Recreation Center is open to

    members and guests on the Ranch.Rules and Hours are posted. Poolattendant scheduled during open poolhours throughout the pool season. See9-Lines for pool schedule.

    2. BATTING CAGES3. SNACK BAR (limited schedule)4. No alcohol or glass containers.

    E. T-TOP: This center is designed for social events.Please contact the office for reservations.

    F. TEEN ACTIVITIY AREAS: Facilities are set asidefor teenagers and young adults (Ages 13 through 19)and offers the usual games, music, etc. No glasscontainers permitted in this area. No alcohol permittedin this area. No attendant scheduled at any time. Rulesand hours are posted.

    G. CLUB HOUSE POOL: The swimming pool is for useby members and guests 18 years and older. Rule hourswill be posted. No glass containers. No pets. Noattendant on duty.

    H. PAVILION: This building is used for a variety ofrecreational activities including a snack bar, ice cream,free family movies and other social activities.

    I. PLAYGROUNDS: The following unsupervisedactivities for all ages are scattered throughout theRanch.

    6. RIDING STABLES MEMBERS AND GUESTSA. RANCH TRAIL RIDES

    1. All members and guests wanting to ridemust sign up and purchase a Horsebackriding ticket ahead of time. Purchasetickets at the Trading Post. Tickets needto be purchased no later than 1 hour

    before the scheduled ride time.2. The number of riders that can be taken

    on each ride is limited.3. All ticketed riders are required to ride

    on supervised trail rides.4. Each person riding must sign a Release

    of Liability Form. A Parent or legalguardian must also sign if rider is lessthan 18.

    5. All riders must wear long pants andfully enclosed shoes.

    6. All children 12 and under must wear ariding helmet furnished at Stables.

    7. Children must be at least age 8 to ride.Doubles are not allowed.

    8. Check the annual fee schedule for thecurrent fee.

    9. Riders should be at the stable hourbefore the ride is scheduled to start.

    10. One (1) hour and two (2) hour rides areoffered.

    11. No alcoholic beverages and/or smokingpermitted on trail rides.

    B. MEMBER OWNED HORSES:1. You must call ahead of time and inform

    the Head Wrangler that you would liketo bring your own horse He will let youknow if space will be available.

    2. A daily fee will be charged for eachhorse

    3. State Law requires that you have acurrent Negative Coggins Test (withinthe last year). No horse will be admitted

    on the Ranch without a current CogginsTest in hand.

    4. All horses must also have proof ofrabies vaccination.

    5. Upon arrival the Head Wrangler willdetermine a place where you can keepyour horse. He will also give you therules on where you can ride etc.

    6. You must be checked in and stay on theRanch, feed, take care of and be liablefor your own horse.

    7. No horseback riding in campgrounds.8. Stock trailers must be parked in

    designated areas.

    7. SWIMMINGA. BIG TOP AND CLUBHOUSE POOLS:

    1. These pools are open to all membersand guest. Rules and hours are posted.

    2. When the NO Pool Attendant OnDuty sign is up, be especially carefuland help look after others.

    3. Swimming is done at your own risk4. No alcohol is permitted in the Big Top

    and Big Top Pool area.

    5. No glass containers permitted insidefenced in pool areas.

    6. Must be 18 years and older to be in theClubhouse pool area.

    B. SWIMMING HOLE AND CREEK:1. Swimming is done at your own risk:2. Swimming is allowed only during

    daylight hours.3. Swimming, wading, floating on inner-

    tubes, rubber mattress etc. above thehandicap ramp to spring is strictlyprohibited.

    8. TRADING POST AND RESTAURANTProper attire required in these facilities. No wet bathing suitsallowed. Infants must have clothing over diapers in thesefacilities.

    9. SPEED LIMITS AND SAFETY PRECAUTIONPlease use extreme caution when driving anywhere on theRanch. There are many people who like to walk or hike alongthe main roads as well as the back roads and trails. On thesewinding roads sometimes a vehicle is virtually upon the hiker

    before they can be seen. Crossing of the creek is stronglydiscouraged in anything but 4-wheel drive vehicles. There is a

    fee set by the Board of Directors for towing a stalled vehicleout of the creek. Members and guests are also asked to strictlyobserve the various speed signs and give particular attentionto those on horseback, motorcycles, and bicycles. Generalspeed limits are listed below:

    SPEED LIMITS:A. 35 MPH on Cloud 9 DriveB. 25 MPH on all hard surface roads inside the Main

    Gatehouse except where otherwise posted.C. 20 MPH on all gravel roadsD. 15 MPH in Big Top area in season as posted.E. 10 MPH in all campgrounds and along the stream.F. 20 MPH on all trails, using common sense and

    depending on the terrain.G. Speeding violations may result in fines assessed

    against a member. Members are responsible for

    guest violations.In case of an accident notify a Ranger or Ranch Managementas soon as possible.

    10. STORAGE COMPOUNDSThe Ranch has three types of storage compounds, Lockedstorage, Open storage and Temporary storage. The areas arewell lighted and patrolled regularly by Ranch Rangers. Amember is limited three (3) spaces in the storage compoundscombined. MEMBERS HAVING MORE THAN ONE (1)MEMBERSHIP SHALL STILL BE LIMITED TO 3SPACES.

    A. LOCKED STORAGE:

    1. No one is allowed inside the Lockedcompounds without being accompanied

    by a Ranger.2. Parking spaces in Locked compounds

    are allocated according to size and typeof unit.

    3. The management reserves the right torefuse to allow the storage of anyvehicle, equipment, or other items thatin their opinion would cause a hazard to

    the other vehicles or that are consideredunsightly or unacceptable to themembership.

    4. The Club assumes NO responsibilityfor anything parked in the compounds,although as stated above, they makeevery effort to assure the security ofsame.

    5. Anytime you put your camper or anyother item in or out of a Lockedcompound there will be a nominalcharge. Trailers or other types ofequipment hauling multiple items willbe assessed as only one item. Itemsbeing towed by another vehicle will beassessed as an individual item.

    6. Items left in Locked compounds storagemust be removed within three (3) years.For items not removed within a three(3) year period, a $1.00 per day storagefee will be assessed prior to January 1,2007 and $3.00 per day thereafter.

    D. Pets are not permitted inside any Ranch building or inpool or food areas except for service animals.

    E. You are requested to observe the privacy of others andare required to restrain your pet from being a nuisanceto your neighbors. This especially applies to dogsbarking in the campgrounds.

    F. Members are responsible for cleaning up after theirpets. Dont walk your pets in or through othercampsites.

    G. No pets are allowed in large Ranch rental units. If a

    person rents a large Ranch unit and violates the petpolicy they will be charged the daily rental fee for the3 days necessary to detoxify it.

    H. Owners are responsible for their pets actions.I. PENALTIES:

    1. FIRST OFFENSE: (written warning)If a violator is written up for the ruleviolation the violator MUST sign this

    citation. Refusal to sign this citationwill automatically cause the violator(and/or member) to receive a Petsuspension, subject to review by theRanch Manager.

    2. SECOND OFFENSE: Ten dollars($10.00) fine. Refusal to pay the finewill automatically cause the violator(and/or member) to receive a petsuspension, subject to review by theRanch Manager.

    3. THIRD OFFENSE: Twenty-fivedollars ($25.00) fine. Refusal to paythe fine will automatically cause theviolator (and/or member) to receive a

    pet suspension, subject to review bythe Ranch Manager.

    4. FOURTH OFFENSE: Suspension ofbringing and/or having any pets onthe Ranch under the violatorsinterest number and/or the ownersinterest number for up to twelve (12)months.

    5. If the nature of the offense is seriousenough the Ranch Manager may

    invoke Penalty #4 at any time, plus a$25 fine.

    6. Suspensions over thirty (30) day maybe appealed to the Board ofDirectors.

    J. To make the member responsible, violations will goagainst the membership number. Violations will bemaintained in the members file for a period of 24

    months13. USE OF MOTORIZED NON-STATE LICENSED UNITS

    including motorcycles, ATVs, golf carts, mini-bikes and dirtbikes. A set of rules will be furnished at the time ofregistration.

    A. AUTHORIZED UNITS:1. Cloud 9 Ranch permits the use of

    certain motorized non-state licensedunits in various designated riding areas.The Ranch permits the use of ATVs,golf carts, motorcycles, dirt bikes andmini-bikes.

    2. Throughout these Rules the ATVshall mean and refer to anycommercially manufactured four-wheel

    c. Children 9 and over must ride inback of the ATV operator.

    ADULTS: Two adults are permitted toride on one (1) ATV3. Six-wheelers will be allowed to have

    three (3) persons, one (1) operating theATV and two (2) in the back.

    4. AN OPERATOR LESS THANSIXTEEN (16) CANNOT CARRY APASSENGER. The exception is

    children 13-15 may carry a parent orguardian (only) as a passenger on Golfcarts & ATVs

    5. Maximum of three (3) people will beallowed per seat on a golf cart as longas the operator is sixteen (16) years ofage or older with a valid drivers licenseand all occupants are seated.

    6. No passengers are allowed to ride inany wagon, trailer, cart, etc. that isattached or pulled by any ATV.

    D. RELEASE OF LIABILITY: After reading the ATVpolicy, a Release of Responsibility form MUST besigned and kept on file at the Ranger Station. AllATVs must be inspected at the Ranger station forlights, mufflers, and brakes. A license plate bearing themembers interest number and an annual registrationsticker (see fee schedule) will be issued and attachedto each member ATV.

    E. VIOLATIONS The following violation may result inpenalties as outlined below for the member andoperator:

    1. Speeding

    2. Reckless driving3. Underage drivers

    4. More than the allowed number per unit.5. Riding in hayfields6. Driving across other members pads7. Blazing new trails8. Riding after dark without lights9. Spinning wheels and riding recklessly10. Inadequate muffler system11. Passing of other vehicles unless they

    pull on to the shoulder of the road.12. Side-by-side riding13. Operating without license plate and/or

    registration sticker14. Intoxication15. No destruction of stream bed.

    F. PENALTIES:1. FIRST OFFENSE: (verbal/written

    warning) If a violator is written up forthe rule violation the violator MUSTsign this citation. Refusal to sign thiscitation will automatically cause theviolator (and/or member) to receive anATV suspension, subject to review bythe Ranch Manager.

    2. SECOND OFFENSE: Ten dollars($10.00) fine. Refusal to pay the finewill automatically cause the violator(and/or member) to receive an ATVsuspension, subject to review by theRanch Manager.

    3. THIRD OFFENSE: Twenty-five dollars($25.00) fine. Refusal to pay the fine

    Violation go against the membership, to make the memberresponsible for anyone riding an ATV with his number on itViolations will be maintained in the members file for a periodof 24 months.

    14. HUNTINGA. HUNTING RULES:

    1. Cloud 9 Ranch hunting permits arerequired and must be visible at all timesfor all hunting on Cloud 9 Ranch.

    2. A Missouri State Hunting PermitMUST be shown to obtain a Ranchpermit. One (1) permit covers all game.

    3. All Missouri Game Laws will beobserved, including road hunting.

    4. Hunting season on Cloud 9 Ranchconform to Missouri Dept. ofConservation.

    5. ALL WEAPONS (GUN & BOWS)WILL BE UNLOADED & ENCASED

    WHILE BEING TRANSPORTED ONTHE RANCH IN OR ON ANY

    VEHICLE, INCLUDING ATVS.SIDE ARMS SHALL NOT BE WORNIN CAMPGROUNDS OR RANCHFACILITIES.

    6. Memberships may have one (1) hunterguest per calendar year. Sponsoringmember or associate member must beon the Ranch for the guest hunter to

    hunt.7. The use of rifles for any hunting will be

    limited to the Rifle Deer Hunting area.This includes hunting game with a 22rifle. Vehicles must have the Cloud 9Ranch issued vehicle tag hanging on therear view mirror.

    8. All persons hunting outside the gate

    must check in and check out with theGatehouse daily that they are huntingand give their name, license numberand make of vehicle.

    9. All game taken MUST be reported tothe gate.

    10. No permanent deer stand or anythingelse that will damage the tree will beallowed. Portable stands may be erectedproviding they do not deface trees.Each stand must have the name, interestnumber, & date of set-up securelyattached. Stand MUST be removedafter deer hunting season.

    five (5) trout will be on the samestringer or creel per day. Possession is

    ten (10) per permit holder or twenty(20) trout per family, whichever issmaller.

    4. Catch & Release will only be allowedwhen fishing with artificial lures orflies.

    5. Please do not clean, gut or scale yourfish in the stream. Clean your fish at

    your campsite and dispose of theremains in a sealed plastic bag.

    6. No swimming or wading in markedareas. Fishermen are not allowed towade on the spring side of the markedarea. No fishing within 25 yardsupstream or 25 yards downstream of theFogey Hollow tubes swimming area.

    Floaters and fisherman are asked torespect each others activity.

    7. Your fishing permit is issued subject toyour observance of the rules andregulation of Cloud 9 Ranch and theMissouri Wildlife Code. The GameWardens and Rangers have the powerto enforce all of these rules.

    8. No fishing or frogging will be allowedin the fishing areas of the stream afterlegal fishing hours.

    9. Chumming (feeding) of fish to assistcatching is not permitted.

    10. Deliberate snagging or foul hooking oftrout and unsportsmanlike conduct is

    strictly against the rule. Fisherman willbe limited to the use of one (1) pole

    with one (1) lure or hook.11. One Person may assist another bynetting the fish.

    12. All day Saturday, Sunday and Holidaysfrom the Saturday preceding MemorialDay until the Tuesday following Laborday, fishing will be reserved forchildren 12 years of age and under at

    the Fogey Mudhole only. Adults maybe with their children at this site, butwill not be allowed to fish there duringthese hours. Persons over the age of 12may fish in the other areas of the streamduring this time.

    13. Children 5 and under may fish for troutin the stream.

    14. Members guests may purchase fishingpermits, see Fee Schedule for types andfees. Member must accompany guestwhen purchase is made. Day guestsmay be issued one (1) 7-day GuestFishing Permit per year.

    15. Fishing will be closed in the stockedareas of the stream from the time ofstocking until Saturday morning.

    16. Night fishing for Rainbow Trout is notpermitted. Fishing hours for RainbowTrout are as follows:March 6:30 am 6:00pmApril 6:00am ---6:30pmMay 6:00am ---8:15pm

    I. VIOLATION OF RULES: Any act or omissionwhereby any of these rules is violated in whole or part

    by a voting member can result in such voting memberbeing assessed for the cost of correcting suchviolation. In addition, his/her rights and privileges asan owner of the Ranch and a member of Cloud 9Ranch Club, Inc. may be suspended. However, nosuspension for a violation hereof shall be effective formore than 30 day without a hearing before acommittee designated by the Board of Directors of

    Cloud 9 Ranch Club, Inc. For purposes of thisprovision, the violation of these rules by an associatemember or guest shall be deemed to be a violation bythe voting member from whom such associate memberderives his associate membership in cloud 9 RanchClub, Inc. or the voting member who invited suchguest.
