MR. BLANCO: Mr. Chair, if I may
interrupt real briefly, we have a full
quorum. We have the full Board here.
CHAIRPERSON ZAPATA: Okay.
MR. BLANCO: So it's all yours.
CHAIRPERSON ZAPATA: So we can
conduct business. Okay.
First item on the agenda was the
consideration and adoption of
recommendations of Special Magistrates as
the written decisions of the VAB for the
remaining uncertified property assessments
(folios) for tax year 2015.
MR. MARTINEZ-ESTEVE: Mr. Chair, at
this time on behalf of the Property
Appraiser, he would like to raise an issue
with regard to the certification. There's
a number of agendas that were heard during
this 2015 tax year. The Property
Appraiser raised an objection as to the
Value Adjustment Board's ability to hear
the type of case, which are equitable
ownership cases.

The Property Appraiser sent in a memo
and argued that there was no jurisdiction,
and received -- that was on June 23rd --
received and e-mail back from Mr. Blanco
on July 20th, 2016 informing the Property
Appraiser and the taxpayers that
Mr. Blanco was in full agreement, as he
said, and agreed that the Value Adjustment
Board did not have jurisdiction.
Subsequent to that, the Property
Appraiser has learned, and I can turn it
over to Mr. Solis, if he has anything to
add, but has learned that the -- I think
the Value Adjustment Board is now
preparing to include these folios and
these agendas within the certification.
So the Property Appraiser, out of
concern for the taxpayers and the proper
certification of the rule, and following
procedure, wishes to inquire prior to this
Board certifying those results, whether or
not those folios are going to be included
in the certification.
COMMISSIONER DIAZ: Mr. Chairman?
CHAIRPERSON ZAPATA: Yes.

COMMISSIONER DIAZ: Mr. Solis, could
you explain what that means to us?
MR. SOLIS: Sure. One thing that
we'd like to emphasize, we're bringing up
the concern not for discussion in terms of
the merits of the case. This is probably
not the correct venue.
However, the concern comes from
the -- just like the VAB Board is
certifying the tax roll today, we are
required by state law to certify the tax
roll as well. So in our certification, we
just want to get clarity as to whether
these cases should be included as part of
the changes or not.
Again, the confusion comes from we
have an e-mail from Mr. Blanco stating
that he has agreed with our position,
however, those cases have not been
vacated. So it raises the question of,
are they part of the certification or are
they not part of the certification? And
we just want to try to get some clarity so
that when we certify the tax roll as
Property Appraiser, and you as the Value

Adjustment Board, are these cases being
considered?
COMMISSIONER DIAZ: Okay. I still
don't have clarification. I need to
understand what that reconsideration means
to the time and the people at this moment.
How long do you think it will take?
MR. SOLIS: Well, again, we thought
we had a decisive decision from the Value
Adjustment Board attorney stating that he
had agreed with the PA's position in terms
of whether these cases -- if the VAB had
jurisdiction or not.
BOARD MEMBER REGALADO: Just as a
point of order really quick.
I fail to see how the Attorney of the
Value Adjustment Board has the right to
make the decision regarding jurisdiction
without consulting the Board.
COMMISSIONER DIAZ: That's why I --
BOARD MEMBER REGALADO: I'm kind of
stuck there. Before we get into the
backing it out -- and nothing against you
having a legal opinion. I just think
procedurally speaking, you should have

issued a legal opinion to the Members of
the Board, asked us to meet for us to take
a vote on that so that we can have a
determination. And then, as a second
part, remind us that we have to back that
out. So it appears that something went
amiss there, because I do not believe that
he has the right to bind us.
So before we continue further, I
think that he needs to tell us what that
legal opinion is, we need to take a vote,
and then we need to instruct him to back
it out, and see what we do about the
timing.
MR. SOLIS: Well, before we do that,
I would just like clarification. Talk
about going to the throat.
All right. I was trying to get to
where she's at, okay, but a little more
subtle. But she went straight to the
throat.
BOARD MEMBER REGALADO: As a heart
attack -- I'm subtle as a heart attack.
MR. SOLIS: Again, I don't belief
that this would be the right moment for us

to get into the technical merits of the
case. It could be very enlightening.
The issue is --
CHAIRPERSON ZAPATA: Whether we
include it or not.
MR. SOLIS: Whether we include it or
not. And based on an e-mail that we got
from Mr. Blanco --
CHAIRPERSON ZAPATA: So we need to
know from Mr. Blanco, do we include it or
not?
MR. SOLIS: Now, Ms. Regalado, to
address your issue, and this is something
that you'll need to discuss with
Mr. Blanco --
THE COURT REPORTER: Excuse me --
CHAIRPERSON ZAPATA: One at a time.
MR. SOLIS: My limited
understanding -- and I'm not an attorney.
I will put that out there -- is that this
Board, when it had the prior
organizational meeting, may have -- and I
say may because I don't know for sure.
May have delegated that authority to the
VAB Attorney as well as in terms of a case

by case basis.
These questions arise on a regular
basis where the VAB Attorney has to make a
quick decision in terms of whether a case
goes to a hearing or it doesn't go to a
hearing. But that is an internal
discussion that this Board needs to have.
I'm only putting it out there as an
outside observer based on prior history.
So I have to assume that that's it.
Again, I don't want to --
CHAIRPERSON ZAPATA: We're not going
to go back and forth on it.
MR. SOLIS: -- muddy up the waters
anymore than we need to. The simple
question was, we have an e-mail from
Mr. Blanco stating that he has agreed with
our position, however, as of this morning
those cases have not been vacated.
So, for us, in terms of the
certification of the tax roll, we need to
know whether we include that change in the
tax roll, or we do not include that change
in the tax roll.
And, again, it was more a

question for the --
CHAIRPERSON ZAPATA: So I think
Mr. Blanco, do you want to chime in?
MR. BLANCO: Yes.
CHAIRPERSON ZAPATA: Where do we
stand on those cases?
MR. BLANCO: Yes. My memorandum that
was sent to them was actually -- it's a
little dubious the way I wrote it. I may
have miswritten it. But it was regarding
one folio, one agenda number, not all the
agenda numbers. It appears that they're
not possibly all the same type of cases.
The original one dealt with only three
cases.
CHAIRPERSON ZAPATA: Well, how many
cases are we talking about?
MR. BLANCO: We're talking about
seven cases, but they're big cases,
because we're talking about the Metrorail
Stations, I believe which are huge.
BOARD MEMBER REGALADO: What is the
legal basis of not including it in our
jurisdiction?
MR. BLANCO: Excuse me?

BOARD MEMBER REGALADO: What is the
legal basis for not including it in our
jurisdiction?
MR. BLANCO: What they're stating --
what the Property Appraiser's Office
position is that we have no jurisdiction,
because we may not determine ownership.
However, this may not be an issue of
ownership. The County owns the underlying
land, and there's long term leases. It's
not perpetual, but as far as I understand,
the Magistrate took a big look at it, and
made a decision after requesting
memorandums from both sides of the -- both
sides. The Magistrate -- the Property
Appraiser's Office and the agent's office
or the taxpayer's office and, you know,
made a decision.
This was actually presented to me at
the 12th hour yesterday. I spent a good
two hours speaking to the agent's office
Mr. Mandler's Office yesterday and today
another hour and a half where they have
sent me information that was sent prior to
speaking to them that was sent to the

Magistrate that I was not privy to,
involving case law et cetera that may
support their side.
Therefore, I refrained from taking a
full decision today until -- I was kind of
hoping we could all meet before that, and
you know, try to make a decision.
The Magistrate has made a decision.
So, in other words, it's done. That
decision is final unless it's, you know,
filed in circuit court.
BOARD MEMBER REGALADO: For that
folio --
MR. BLANCO: For those folios.
BOARD MEMBER REGALADO: -- but not a
determination of blanket lack of
jurisdiction for several folios. That's
two very different things.
Back to your point about, you know,
that Board does give our attorney the
right to -- just like we give the
Magistrates a right to make a
determination on one folio. What you're
asking for is a blanket determination on
several folios.

BOARD MEMBER REGALADO: And I think
that that is very different from what
we're discussing.
Furthermore, not to get into the law
about, you know, a 99-year lease, and what
becomes fee simple, I mean these are all
evidentiary issues that has to be looked
at case by case.
MR. BLANCO: Correct.
BOARD MEMBER REGALADO: And the
development of those Metrorail property is
going to result in the construction of
condominiums, and is going to eventually
come before the Value Adjustment Board in
the determination of the values of those
units.
So my -- I would move to not back it
out. I mean I think we could talk about
it later on when we have our
organizational meeting. I think we should
put it on the agenda. If we want to talk
about a blanket jurisdictional question,
we can, but I don't think that the
attorney had the authority to make that

kind of representation for your request.
I don't know if anyone wants to
second that.

CHAIRPERSON ZAPATA: Listen, the last
time we did this, I was on the Board. The
issue, it was kind of -- the way that --
you know, we had a process. The process
really wasn't, I think, the way it should
have been. There was some hiccups, and I
think, at the end of the process it kind
of got politicized, because of some issues
there somehow got injected into the whole
process. I think it's always healthy to
kind of go through the process again and
make sure that we have, you know, the best
possible candidate in that position. I
think it's a, as you an all see, we defer
and delegate a lot of responsibilities to
that position. So I think we should go
through that process.
COMMISSIONER DIAZ: And I think that
him applying again, he could be the best
possible candidate for the position.
CHAIRPERSON ZAPATA: Yes, absolutely.
COMMISSIONER DIAZ: So I want to be
very clear on that too. But it moves
the -- shuffles the deck and people --

everybody is happy.
BOARD MEMBER REGALADO: I think we
should be clear on the record as to the
timeline. You know, we don't meet every
month. So, obviously, you know I think
that Mr. Alfaro has to figure out timing
wise so that we can approve the timing of
that at our next meeting. That way we can
know when the application period opens,
when the screening is going to be done,
when that going to close so that there is
no gap there.
CHAIRPERSON ZAPATA: We can have the
Clerk's Office collect the resumes, and
open up the process. Then from there
bring before us those candidates. Then we
can make the decision of which candidate
we're going to pick. Then we can then
figure out the timeline on that.
BOARD MEMBER REGALADO: I understand,
but just logistically, speaking as an
attorney, an attorney wouldn't apply for a
position that starts in six months. You
get my point?
