Planning, Research, and WritingBefore applying for a business license with theCity of Whittier, consider and review the follow-ing questions. This list is provided in order toassist you as you embark on this businessenterprise.

Have you fully researched your business con-cept?Did you write a business and marketing plan?

Have you secured financing and capital foryour business?

Did you consult with a legalrepresentative/attorney and accountant todetermine the best business structure (i.e.Sole Proprietorship, Corporation, LimitedLiability Company, etc)?

Did you file a legal structure with theSecretary of State Business Filings Section?

Did you file a fictitious business name withthe LA County Registrar-Recorder/CountyClerk?

Did you apply for a federal tax identificationnumber with the Internal Revenue Service?

A key component to getting started is ensuringyou have fully researched your businessconcept. However, it also includes significantself-analysis.

Consider the following details about mostbusiness owners, especially new ones, anddetermine whether you are prepared for them.Most new business owners:

• Work 12-16 hour days, 6 or 7 days a week;• Don’t see any profits the first couple of

years; • Invest (or deplete) all savings on the new

business; • Sometimes must lower their standard of

living until the business is better established;and

• Experience emotional pressures which may affect the family.

This is only the beginning; read ahead for moreinformation!

Next, you must assess your employmentexperience and skills to determine whether theyare appropriate for the type of business youwant to open. Has your employment back-ground provided the necessary qualifications torun the business? Have you been in manage-ment and decision-making positions in the past?Do you already have a strong familiarity with theindustry? Have you found a niche in the market?Will you serve an unfulfilled need? Is there ademand in the market for your product orservice? Will you offer competitive prices on agood quality product? Who are your competi-tors? Who are your customers? How will youbring the customers in the door?

By taking all of these details into account, youwill be better prepared to write your businessplan which, in turn, will increase the chances ofa successful business.

The Business PlanWhile there is always a degree of risk associated

with starting your own business, the success ofthe business will depend on the level ofresearch, planning and execution of thebusiness plan. A business plan is a blueprint orroadmap of every aspect of your business.Management, sales goals, marketing, budgetand financial statements are just some of thenecessary components of the plan. The goalsshould include strategies for implementation andcompletion. Furthermore, a business plan is aliving document and should be reviewed andupdated often.

Things to Know Before You Sign a LeaseOnce you are ready to open your business andyou have a potential location in mind, you canobtain a Business License Application from theCity Clerk’s office located on the first floor in CityHall. The majority of new businesses will need totake the Application to the CommunityDevelopment Department for approvalsignatures from the Planning and Building staff.The following are additional steps which willassist you in opening your business in the City:

1. PlanningThe Planning Services Division of theCommunity Development Department ischarged with the administration ofordinances and policies related to zoning,land use and development within the City.The Division reviews and processesdevelopment plans for compliance withzoning and subdivision regulations andconditional use permits.

Zoning — Planning staff must verify thatthe location is appropriate for the desiredtype of business or use. Parking Requirements — Parking mustbe verified if the new use at the locationwill change. For example, if the last busi-ness at the site was a retail shop and youwant to open a restaurant, the parkingmust meet the minimum standards for arestaurant. If the parking standards are notmet, the new business may not beallowed. Development Review Including TenantImprovements — If you are makingimprovements to the building (interior orexterior), you must complete aDevelopment Review Application.Depending on the building and type ofbusiness, you may be required to gobefore the Historic ResourcesCommission and Planning Commissionfor approval. This may require severalmonths, so plan this into your schedule. Signage — A plan review and permit arerequired for any sign in the City. Avoidunnecessary spending of money on pro-hibited signs by being prepared to discussyour signage several months before theopening of your business. (More informa-tion on signage can be found on page 10).Conditional Use Permits — CUPs areissued when the use may be compatibleunder certain conditions with other exist-ing and permitted uses, but which are notallowed as a matter of right by the ZoningCode. CUPs require a Public Hearingbefore the Planning Commission and/orCity Council. The purpose of conditionson the CUP is to ensure that the activitypermitted will be conducted in a mannerconsistent with the peace, safety, and5

general welfare of the community. Forexample, a CUP is required for restaurantswith an on-sale alcohol beverage license.The CUP process typically requires threeto six months to complete.Temporary Use Permits — Certain activ-ities on property within the City of Whittiersuch as promotional sales, temporaryevents and fundraisers (including sidewalksales) will require a Temporary Use Permit.Promotional (sidewalk) sales are limited tothree per calendar year. Applications forTemporary Use Permits need to besubmitted at least one month prior to theactivity or event.

2. BuildingThe Building & Safety Division, also locatedin the Community DevelopmentDepartment, reviews construction plans forany site improvement or for interior/exteriorimprovements to buildings, issues buildingpermits, and conducts inspections.

Construction Plan Review — OncePlanning has approved the DevelopmentReview Application and developmentplans, the Building Division will review theconstruction plans for conformance withbuilding, energy conservation, disabledaccess and other codes. Please note, ifsubmitting building plans, four full sets ofplans are required (one set for Planningand three for Building). Time for reviewvaries, however, you should allow three tofour weeks for the first plan review. Someprojects may require separate review byFire, Health, Sanitation, School Districts,or SCAQMD. Please consult with Buildingstaff to verify applicability. Building Permits — Permits are issuedonce construction plans are approved and 6

all fees have been paid. Fees are based onthe valuation of project. Inspection Record Card — When youreceive a building construction permit,you will also receive an Inspection RecordCard. Your City Inspector will then inspectconstruction throughout the constructionperiod and work cannot proceed beyondeach designated inspection point asindicated on the Inspection Record Card.The first inspection must occur within sixmonths of the permit issuance or the per-mit will expire and the applicant will besubject to pay fees for review of any codechanges and to renew the permit.

3. Health Permit for Food FacilityIf the business is a food establishment(i.e. sit-down restaurants, take-out, includ-ing wine/beer establishments), you mustcontact the Los Angeles County PublicHealth Department, Environmental HealthDivision for permit requirements and for afood construction plan check. The HealthDepartment will assist in the planning andconstruction of kitchen and restroomfacilities for your type of food establish-ment. New food establishments within theCity of Whittier fall under the East LosAngeles District Office, located at 4801 E.3rd Street, Los Angeles, CA 90022. 4. Department of Alcoholic BeverageControl (ABC)If you plan on selling alcohol at your placeof business, you must apply for an AlcoholicBeverage License through the CaliforniaDepartment of Alcoholic Beverage Control(ABC). The ABC District Office is located at

5. Los Angeles County Fire DepartmentSome building improvements and develop-ment projects may require review of plans bythe Fire Department. Check with the City ofWhittier Building Division to determine if yourplans require Fire review. If advised by theBuilding Division that your project requires aFire review, you should contact the FireDepartment to confirm the review andrequirements for the review. If a review ofplans is required, you will be responsible forcoordinating/scheduling the review directlywith the Fire Department.

6. Disabled Access ComplianceState and federal laws give people with dis-abilities the right to access everyday activi-ties such as buying an item at the store,watching a movie in a theater, and enjoying ameal at a restaurant. Businesses (and prop-erty owners who lease to businesses) areobligated to provide access to all patrons forexisting facilities as well as when a facility isaltered or newly constructed. The valuationof the project may trigger full disabled accesscompliance. Projects below a certain

threshold are required to provide a mini-mum of 20% of the total project budget inupgrades that improve accessibility. Yourarchitect should be aware of the prioritiesfor improvements that the State recom-mends. Additionally, while improvementplans are being drawn up, your architectshould be able to tell you the valuation ofthe project and whether you will be expect-ed to comply with disabled accessibility.However, if not, please feel free to contactthe Building Division for that information.

7. Historic BuildingsWhittier is blessed with a number of won-derful historic buildings that date back tothe early 1900s. The Whittier communityhighly values our historic buildings andseeks to preserve and enhance them.Adaptive reuse, rehabilitation, and restora-tion of historic buildings are stronglyencouraged, especially in the UptownWhittier area. The City’s Historic ResourcesOrdinance sets forth the requirements forundertaking improvements to a historicbuilding. If you are proposing to locateyour business in a historic building andmake modifications to a historic building,please contact the Planning Division assoon as possible so we can assist inguiding you through the process ofcomplying with the City’s historic resourcerequirements.

8. Business LicenseOnce Planning and Building have signedyour Business License Application, youmay return it to the City Clerk’s office forprocessing and payment. Please note:some businesses may require approval

from the Police Department/CodeEnforcement and require finger printing;contact Business License at (562) 567-9880for more information. If your business willbe located in Uptown Whittier, generallybounded by Hadley Street on the north,Painter Avenue on the east, Penn Street onthe south and Pickering Avenue on thewest, membership in the Whittier UptownAssociation is mandatory. Uptown Whittieris designated as a business improvementdistrict (BID) and requires an annual assess-ment of businesses located in the district.Call the Whittier Uptown Association at(562) 696-2662 for information on howassesments are used to befefit the district.

Signage/Banners The City of Whittier recognizes and strongly sup-ports the needs of merchants and property own-ers to identify their businesses through signageand other means of advertisement. Size, place-ment, number and design of signs significantlyinfluence the general perception of both thecommunity’s visual environment and itseconomic health. The City desires to preserveand enhance the quality of life for residents bothin the residential areas and commercial corri-dors. Consequently, the Municipal Code allowsfor the use of signs that create a high-qualityvisual environment and regulates signs to ensuredesigns are proportionate in scale to surround-ing structures and commercial districts. Theintent is to eliminate visual clutter while providingreasonable opportunities for adequate identifica-tion of businesses and the goods and servicesthey offer. Furthermore, sign regulations reducepotential hazards and promote the safe move-ment of vehicles and pedestrians throughout thecity. Consequently, there are limitations on theamount of signage allowed per business and building.As previously mentioned, a permit is required

from the Planning Services and Building andSafety Divisions for any sign in the City including,but not limited to, permanent window signs, wallsigns, monument signs, awnings, and temporarysigns such as “Grand Opening” banners. Mostsign permits can be processed and issued overthe counter by the Planning Division. Banner per-mits are particularly easy to process. Be sure tobring in the actual banner to be hung (made ofvinyl or weather resistant material) and a pictureof the storefront or building where the banner willbe placed. Also, it is important to know the linearfootage of the storefront or building as themaximum size of the banner will depend on thatlength. Finally, please check with Planning stafffor specifics on temporary banner time limits.

The following types of signs are prohibited inthe City: • Pole signs• Balloon strings • Roof signs• Vehicle-mounted signs • Outdoor advertising structures • Animated signs • Signs that produce smoke, sound, or other

emissions• Can signs

Animated signs include any type of sign thatflashes, changes colors, moves or rotates.Additionally, neon lighting that frames a windowis also prohibited.
