After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, April 25,
2017 at 6:30 PM in the City Council Chambers located in City Hall, 6800 Main Street, The
Colony, Texas, at which time the following items were addressed:

Commissioner Hebb moved to approve Item 2.1 as stated, Commissioner Pool seconded the
motion. Motion carried (6-0).
3.0 PUBLIC HEARING ITEMS
3.1 SUP17-0001 Pappy’s Pet Lodge Specific Use Permit (SUP) Revision
Conduct a public hearing, discuss and consider making a recommendation to City
Council regarding a request for amendment to Specific Use Permit (SUP) Ordinance #
2016-2221 with regards to outdoor play area surface treatment for Pappy’s Pet Lodge at
4000 Paige Road.
Chairman Hames read the public hearing item 3.1 into record.
Ms. Sen presented the staff report.
Chairman Hames requested the applicant to come forward to address Commissioners’ questions.
Chairman Hames asked if the turf pads are going to be taken inside and cleaned every day?
Peter Nguyen, franchise owner of Pappy’s Pet Lodge - The Colony location, answered that they
will be cleaned every day and they have installed two sewer inlets in that area that are connected
to the City sewer line. 3

Commissioner Molina asked for clarification if the inlets were connected to the storm drain
system or the sewer system.
Mr. Nguyen confirmed that they are connected to the sewer line.
Ms. Sen added that staff wasn’t fully aware of the sewer connection situation and Engineering
will have to review the plans and make sure that is acceptable.
Ron Hartline, Director of Engineering addressed the Commission and stated that their primary
concern was regarding the storm water runoff getting polluted by animal waste. They weren’t
aware of the sanitary sewer connection and it probably will not be allowed per code to have
ground inlets to city sewer in a parking lot. That will allow storm water to run through sewer
line.
Mr. Nguyen added that the two inlets can be covered to avoid storm water getting through.
Commissioner Buffington asked how often the sealant is applied to the concrete to prevent
seepage of animal waste.
Mr. Nguyen responded that this type of sealant is good for years before they have to be re-
applied.
Commissioner Hebb asked if the applicant could create a natural outdoor space with grass for the
play area.
Ms. Sen responded that the applicant and the property owner did not intent to tear up the
concrete and place natural sod to maintain the site for re-use if this particular business did not
work out. The owner did not want to lose the portion of the parking lot in case its needed in
future.
Commissioner Hebb asked how will the applicant ensure that the pets are only going to go in the
turf area.
Commissioner Rockenbaugh stated that given the code requirement of keeping waste water and
storm water separate there has to be some form of separation between the outdoor play area and
the rest of the parking lot to stop unwanted run-off.
Ms. Sen added that the Engineering department had mentioned that they will need to install some
sort of absorbent material all along the wood fence surrounding the play area.
Mr. Hartline stated that the absorbent material should prevent run-off and the drains that were
installed should not be there, Engineering wasn’t aware of the two inlets being installed.
Commissioner Hebb asked that the drains could be connected to an interim holding area and then
treated accordingly.
Mr. Hartline agreed.
Commissioner Pool stated that there are two issues here really, where the pets are going to play
and where they are going to go for restroom.
Chairman Hames opened the public hearing at 6:50 p.m.
Mr. Bill Kinder, with Pappy’s Pet Lodge corporate approached the Commission and introduced
Bonny Allen who is the president of the company and graduated from Texas Tech University.
Mr. Kinder stated that play time is inside on rubber mat and if the pets go outside it will be under 4

favorable weather condition and for very short amount of time. If the turf is placed on the whole
area, it becomes unsanitary.
Chairman Hames closed the public hearing at 6:51 p.m.
Commissioner Molina stated that one option for the Commission is to revoke the existing SUP
and direct staff to work with the applicant to arrive at a solution on the storm water and animal
waste contamination.
City Attorney, Mr. Ed Voss and Ms. Sen agreed to that observation. Ms. Sen also added that the
city wants this organization to stay in the Colony and have a viable business. Staff is trying to
work out a solution where they can still use the outdoor area as the applicant requested as long as
this run-off issue is addressed.
Commissioner Pool asked if the area outside is still a play area or just for the pets to go out for
restroom purposes?
Ms. Sen replied that SUP approval was needed for this outside run only. If the applicant did not
want to use this as an outdoor play and have a very small area for restroom, outside the building,
similar to their Plano location, then no SUP approval is needed.
Commissioner Molina asked if during the process, when the applicant is working with staff to
arrive at a solution, if the applicant change the name of the area from outdoor play area to
outdoor exercise area, will they still come back to the Commission for approval or will they be
okay at that point by giving it a different name.
Ms. Sen stated that the Zoning Ordinance refers this as “outside runs”. So irrespective of what
the area is called/labeled staff will bring the SUP request back to the Commission.
Commissioner Molina moved to recommend revoking the existing SUP Ordinance #2016-
2221, allowing the applicant to work with staff and present a solution to the Commission at
a later date, Commissioner Rockenbaugh seconded the motion. Motion carried (6-0).
3.2 Z17-0001 Brentwood Court Townhomes Phase II - Zoning Change from Shopping
Center (SC) to Townhouse Dwelling (TH) Zoning District
Conduct a public hearing, discuss and consider making a recommendation to City
Council on a request for Zoning Change from Shopping Center (SC) to Townhouse
Dwelling (TH) zoning district allowing town homes development at 5600 N Colony
BLVD being 1.4384 acres of land described as portion of Colony Park Baptist Church,
Volume 1407, Page 435, DRDCT and all of Colony Park Baptist Church, Volume 1407,
Page 431, DRDCT.
Chairman Hames read the public hearing item 3.2 into record.
Ms. Sen presented the staff report.
Applicant’s representative, Fernando Quintana gave another presentation to the Commission.
Commissioner Hebb asked why the applicant is proposing a solid masonry wall next to the child
care facility on the east boundary line, whereas a wrought iron semi-transparent fence on the
west property line next to the church.

Mr. Quintana answered that during this concept plan stage for the zoning change, applicant is
proposing this screening plan. During site plan review applicant will address these questions in
more detail.
Commissioner Buffington asked who will maintain the 8’ tall wood fence at the back of this
property.
Mr. Quintana answered that there will be a Home Owners Association (HOA) established and it
will be the HOA’s responsibility to maintain the fence.
Chairman Hames opened and closed the public hearing at 7:28 p.m.
Commissioner Buffington moved to approve Item 3.2 as stated, Commissioner Hebb
seconded the motion. Motion carried (6-0).
There being no further business to come before the Commission, Chairman Hames adjourned the

EXISTING CONDITION OF PROPERTYThe property at 4000 Paige Road previously housed Cheers Liquor. The business has been closed for some time and the building has remained unoccupied. Last year Pappy’s Pet Lodge got approval from City Council on July 5, 2016 to operate a kennel in this location and also have an “outside run” for the pets through a S.U.P. Currently Pappy’s Pet Lodge is operating under a Temporary Certificate of Occupancy (C.O.) from April 11, 2017.
PRIOR ACTION/REVIEW (Council, Boards, Commissions)April 25, 2017 – The Planning and Zoning Commission voted (6-0) to recommend revoking the SUP Ordinance #2016-2221 and coordinate with Planning and Engineering Department staff regarding the outdoor play area issues and bring the application back to the Commission with revised proposal for reconsideration.
DEVELOPMENT REVIEW COMMITTEE (DRC) REVIEWThe Development Review Committee (DRC) recommends revoking the S.U.P Ordinance #2016-2221 as the development did not meet the intent of the Ordinance and authorize a new S.U.P to operate with the designated “outdoor play area” with stipulations concerning surface treatment and storm water pollution prevention as stated in the new SUP Ordinance (Attachment 8).

Staff AnalysisSummary of RequestThe applicant, Pappy’s Pet Lodge proposed to lease the building at 4000 Paige Road with a dog boarding/kennel facility with outside play area. The building is 5,541 sf in area and 22.5’ tall. The applicant proposed to fence a portion of the parking lot and convert the area to an outdoor play area for dogs. The concrete was to be kept in place and sealed for sanitation with artificial turf pads. The artificial turf pads are removable for cleaning and to be sanitized. An 8-foot-tall solid cedar wood fence was planned to be constructed to fully enclose the space for safety and additional sound buffering. A shade structure for the comfort of the animals was also added as recommended by the Planning and Zoning Commission on June 14, 2016 meeting.
The applicant was requesting to allow them to cover a portion of the outdoor play area (approximately 10% of the play area square footage). The pets will be allowed to use that section of synthetic turf for restroom purposes and the rest of the partly shaded concrete play area will be used sporadically depending on weather condition.
Revised ProposalSince Planning and Zoning Commission meeting on April 25th, Pappy’s Pet Lodge owner and staff have met and discussed possible solutions for the outdoor play area to still be effective and usable without creating storm water contamination through animal waste. The applicant is proposing to allocate a 10’x8’ area exclusive of the outdoor play area as the pets’ “restroom area”. This area is adjacent to the exterior wall of the building next to the door that opens into the overall outdoor area. This “restroom area” is separated from the outdoor play area via a wrought iron fence. The 10’x8’ area will be covered with removable synthetic turf pads that are going to be taken inside and cleaned/sanitized on a daily basis and more than one time during the day. The applicant has also agreed to install an attached canopy/awning over the “restroom area”, that way chances of rainwater getting infused with animal waste is eliminated or vastly reduced. This canopy/awning will require a building permit submittal and review before installation.
Once the pets utilize the “restroom area” they will be allowed into the outdoor play area that has the shade structure. If any “accidents” happen (which is likely) the staff will address the affected area immediately. The outdoor play/walk area procedure document (Attachment 5) has been provided by the Pappy’s Pet Lodge that requires pets in the outdoor area to be monitored at all time. The cleanup protocol regarding “accidents” are also listed.
Staff also addressed the situation with two in ground inlets in the outdoor play area connected to the sewer line. Staff has required Pappy’s Pet Lodge to close both inlets and disconnect them from the sewer line. Building Inspector will inspect this process and make sure it follows required procedure.
NotificationThe Zoning Ordinance requires newspaper notification a minimum of ten (10) days prior to the Planning and Zoning Commission meeting. Notice for this SUP Public Hearing was published in The Dallas Morning News on April 28, 2017. In addition, Zoning Ordinance also requiresnotification of property owners located within 200 feet of the subject property a minimum of ten

(10) days prior to the public hearing. Notices were mailed on April 27, 2017 to six (6) property owners.
Development Review Committee ReviewWith the proposed changed as mentioned Development Review Committee (DRC) feels confident that the outdoor play area can be utilized for the desired function (play/walk the pets) without contaminating the storm water drainage system. The DRC recommends revoking the S.U.P Ordinance #2016-2221 as the development did not meet the intent of the Ordinance and authorize a new S.U.P to operate with the designated “outdoor play area” with stipulations concerning surface treatment and storm water pollution prevention as stated in the new SUP Ordinance (Attachment 7).

Mr. Quintana answered that during this concept plan stage for the zoning change, applicant is
proposing this screening plan. During site plan review applicant will address these questions in
more detail.
Commissioner Buffington asked who will maintain the 8’ tall wood fence at the back of this
property.
Mr. Quintana answered that there will be a Home Owners Association (HOA) established and it
will be the HOA’s responsibility to maintain the fence.
Chairman Hames opened and closed the public hearing at 7:28 p.m.
Commissioner Buffington moved to approve Item 3.2 as stated, Commissioner Hebb
seconded the motion. Motion carried (6-0).
There being no further business to come before the Commission, Chairman Hames adjourned the
Regular Session of the Planning and Zoning Commission at 7: 29 p.m.
