On behalf of the Commission, I Disapprove this ordinance insofar as it does not conform to the latest action of the City Planning Commission and recommend that the City Council Disapprove this action and uphold the July 21, 2009 Planning Commission's action. The attached ordinance establishes and corrects the (T)RE11-1 Zone for privately ownedproperties at the easterly terminus of Dearborn street and at the intersection of Dearborn Streetand Moonbeam Avenue within the Mission Hills - Panorama City - North Hills Community Plan.

Discussion

Zone Ordinance No, 181,053, establishes the zone for Parcel No, 2639-031-001 with(T)(Q)RD3-1 and RE11-1 zone classifications (parcel fronting Woodman Avenue) and RE11-1for Parcel No. 2639-031-002. fronting the easterly terminus of Dearborn Street at the intersectionof Dearborn Street and Moonbeam Avenue,

The zone designation intended for the parcels zoned RE11-1 was intended to include offsiteimprovements; and therefore, the Tentative Classification should have been included as part ofthe Planning Commission and Council action to reflect the proper zone as (T)RE11-1.

The Planning Department prepared an ordinance including the offsite improvements for theeasterly portion of the site having a maximum of ten multiple family dwellings within the(T)(Q)RD3-1 zone but omitted the offsite improvements for the single family portion zonedRE11-1.

The purpose of the Tentative (T)RE11-1 Zone for the subject single family parcel is to provideconsistent regulations for the dedications and improvements in conformance with Citystandards,

The subject correction ordinance rectifies that error consistent with the intent of the CityPlanning Commission and the City Council of applying the (T)RE11-1 Zone to the parcelslocated at the easterly terminus of Dearborn Street and at the intersection of Dearborn Streetand Moonbeam Avenue.

HistoryThe History of the proposed entitlement requests for the subject property is as follows:

December 18, 2008: The City Planning Commission took the following actions:

1) Disapproved and recommended that for the Applicant siteat 9225 North Woodman Avenue and 9168 MoonbeamAvenue the City Council not adopt a General PlanAmendment to the Mission Hills - Panorama City - NorthHills Community Plan from Very Low Density Residentialand Low Medium I Density Residential to Low Medium IDensity Residential over the entire project site.

2) Disapproved and recommended for the six (6) City-initiatedAdded Areas that the City Council not adopt a GeneralPlan Amendment from Very Low Density Residential toLow Medium I Density Residential.

3) Disapproved and recommended that the City Council notadopt a Zone Change from RA-1 (One Family Zone) to(T)(Q)RD3-1 (Restricted Density Multiple Dwe.lling Zone)over the entire project site; and

4) Approved and recommended that the City Council adopt aZone Change from RA-1 (One Family Zone) to (T)(Q)RD3-1 (Restricted Density Multiple Dwelling Zone) for theApplicant site at 9225 North Woodman Avenue (portion of

the project site designated Low Medium I DensityResidential in the Community Plan).

The determination of the City Planning Commission was issuedreflective of their action of December 18, 2008.

The applicant, C andS Hsieh Family Trust, appealed CityPlanning Commission's entire determination.

The Planning and Land Use Management (PLUM) Committeeheard the appeal by the applicant and resolved to grant the appealfiled by C & S Hsieh Family Trust from the entire decision of theCity Planning Commission, and thereby APPROVE, as amended:

a) General Plan Amendment to the Mission Hills-PanoramaCity-North Hills Community Plan from Very Low DensityResidential to Low Medium I Density Residential for theapplicant site at 9225 North Woodman Avenue;

b) General Plan Amendment to the Mission Hills- PanoramaCity-North Hills Community Plan from Very Low DensityResidential to Low Medium II Density Residential for theapplicant site at 9225 North Woodman Avenue over theentire new boundary of the RD3 portion; and

c) Zone Change from RA-1 to (T)(Q)RE-11 for 9168 NorthMoonbeam Avenue;

d) Zone Change from RA-1 to (T)(Q)RD3-1 for 9225 NorthWoodman Avenue; and

e) Zone Boundary Line adjustment extending the RD3 portion,for the proposed demolition of an existing 1,036 squarefoot single-family dwelling and the construction of 10detached townhouse-style condominium units withattached 2-car garages for the property at 9225 NorthWoodman Avenue and 9168 North Moonbeam Avenue,subject to Conditions of Approval.

Additionally, PLUM Committee recommended the City Councildeny the Plan Amendment for the six (6) City-initiated AddedAreas at 9165 North Woodman Avenue (western half of a lotoccupied by a church), and 9120, 9140, 9144, 9156, and 9164Moonbeam Avenue, consistent with the action of CPC dated July21, 2009. Portions of their action were inconsistent wi,th the actionof the CPC.

The City Council approved the appeal as recommended by thePlanning and Land Use Management Committee on November17,2009 above.

CONDITIONS FOR EFFECTUATING (T)TENTATIVE CLASSIFICATION REMOVAL

Pursuant to Section 12.32 G of the Municipal Code, the (T) Tentative Classification shall beremoved by the recordation of a final parcel or tract map or by posting of guarantees throughthe B-permit process of the City Engineer to secure the following without expense to the City ofLos Angeles, with copies of any approval or guarantees provided to the Department of CityPlanning for attachment to the subject planning case file.

1. Dedication(s) and Improvement(s). The applicant shall comply with all the requirements ofthe Bureau of Engineering, including the dedication and improvement requirements for theproject. Prior to the issuance of any building permits, public improvements and dedicationsfor streets and other rights of way adjoining the subject property shall be guaranteed to thesatisfaction of the Bureau of Engineering, Department of Transportation, Fire Department(and other responsible City, regional and federal government agencies, as may benecessary), the following:

A. Responsibilities/Guarantees.

(1) As part of early consultation, plan review, and/or project permit review, theapplicant/developer shall contact the responsible agencies to ensure that anynecessary dedlcations and improvements are specifically acknowledged by theapplicant/developer.

(2) Prior to issuance of sign offs for final site plan approval and/or project permits by thePlanning Department; the applicant/developer shall provide written verification to thePlanning Department from the responsible agency acknowledging the agency'sconsultation with the applicant/developer. The required dedications andimprovements may necessitate redesign of the project. Any changes to projectdesign required by a public agency shall be documented in writing and submitted forreview by the Planning Department.

2. Engineering - Sewer Facilities. Construction of necessary sewer facilities to thesatisfaction of the Bureau of Engineering. All Sewerage Facilities Charges and BondedSewer Fees are to be paid prior to obtaining a building permit.

3. Engineering - Drainage Facilities. Construction of necessary drainage facilities to thesatisfaction of the Bureau of Engineering.

4. Public Works - Street Trees. Construction of tree wells and planting of street trees andparkway landscaping to the satisfaction of the Street Tree Division of the Bureau of StreetMaintenance.

5. Engineering and Transportation -:- Driveway and Parking Plans. Preparation of aparking area and driveway plan to the satisfaction of the appropriate VaUey District Office ofthe Bureau of Engineering and the Department of Transportation. A parking area anddriveway plan shall be prepared for approval by the appropriate district office of the Bureauof Engineering and the Department of Transportation. Emergency vehicular access shall besubject to the approval of the Fire Department and other responsible agencies.

6. Transportation - Site Access and Internal Circulation. A final DOT approval shall beobtained prior to issuance of any building permits for the driveway, internal circulation, andparking scheme for the proposed Project. This shall be accomplished by submitting adetailed and fully dimensioned site plan and parking layout, with a minimum scale of 1"=40',to the DOT Valley Development Review Section at 6262 Van Nuys Boulevard, Suite 320,Van Nuys, 91401, before submittal of building plans for plan check to the Department ofBu.ilding and Safety.

7. Public Works - Street Lighting. Installation of street lights to the satisfaction of theBureau of Street Lighting. The applicant shall be responsible for street lighting modificationsrequired at an intersection if there are improvements by the Department of Transportation(also for off site improvements).

8. Fire Department. The applicant shall a plot plan for approval by the Fire Department eitherprior to the recordation of a final map or the approval of a building permit. The plot planshall include the following minimum design features: fire lanes, where required, shall be aminimum of 20 feet in width; all structures must be within 300 feet of an approved firehydrant, and entrances to any dwelling unit or guest room shall not be more than 150 feet indistance in horizontal travel from the edge of the roadway of an improved street or approvedfire lane, (Env'l)

9. Department of Telecommunications - Cable Television Franchise. Making anynecessary arrangements with the appropriate cable television franchise holder to assurethat cable television facilities will be installed in City rights of way in the same manner as isrequired of other facilities, pursuant to Municipal Code Section 17.05N, to the satisfaction ofthe Department of Telecommunications.

10. Police Department. The applicant shall a plot plan for approval by the Police Departmenteither prior to the recordation of a final map or the approval of a building permit. The plansshall incorporate the design guidelines relative to security, semi-public and private spaces,which may include but not be limited to access control to building, secured parking facilities,walls/fences with key systems, well-illuminated public and semi-public space designed witha minimum of dead space to eliminate areas of concealment, location of toilet facilities orbuilding entrances in high-foot traffic areas, and provision of security guard patrol throughoutthe Project Area if-needed. Please refer to Design Out Crime Guidelines: Crime PreventionThrough Environmental Design published by the Los Angeles Police Department's CrimePrevention Section (located at Parker Center, 150 N. Los Angeles Street, Room 818, LosAngeles, (213) 485-3134. These measures shall be approved by the Police Departmentprior to the issuance of building permits ..(Env'l)

11..Engineering -' Notice of Payment of All Engineering Fees. Prior to issuance of aclearance letter by the Bureau of Engineering, all engineering fees pertaining to OrdinanceNo. 176,077 adopted by the City Council, must be paid in full at the Development ServicesDivision office.

12. Engineering - Notice of Completion of Construction of All Public Improvements:Certificates of Occupancy for the subject property will not be issued by the City until theconstruction of all the public improvements (streets, sewers, storm drains, etc ..), as requiredherein, are completed to the satisfaction of the City Engineer.

13. Planning - Covenant. Prior to the issuance of any permits relative to this matter, anagreement concerning all the information contained in these conditions shall be recorded bythe property owner in the County Recorder's Office. The agreement shall run with the landand shall be binding on any subsequent owners, heirs or assigns. Further, the agreementmust be submitted to the Planning Department for approval before being recorded. Afterrecordation, a copy bearing the Recorder's number and date must be given to the CityPlanning Department for attachment to the subject file.

14. Department of Recreation and Parks - Recreation and Parks Dedication/Fee. PerSection 12.33 of the Los Angeles Municipal Code, the applicant shall dedicate land for parkor recreational purposes or pay the applicable Quimby fees for the construction ofcondominiums, or Recreation and Park fees for construction of apartment buildings. Section 12.04 of the Los Angeles Municipal Code is hereby amendedby changing the zones and zone boundaries shown upon a portion of the zone mapattached thereto and made a part of Article 2, Chapter 1 of the Los Angeles MunicipalCode, so that such portion of the Zoning map shall be as follows:
