Background Information and Analysis

The proposed replat is a necessary step in moving forward on the development of a future Orthopedic

and Spine clinic. City staff has been working with the developer of this site since Winter 2019 on

review of a this replat, site plan, and civil engineering plans. During the review of the proposed site

plan, staff has identified necessary fire and access easements, which will be dedicated via this replat. In

addition to dedicating easements, this replat will help to define the boundaries and location for the

proposed Orthopedic and Spine center. To improve accuracy and efficiency of the development

process, pending approval, this plat will not be filed with Grayson County until construction of the site

is near completion. Doing so will provide flexibility to the developer and staff, allowing for minor

changes to any easements, boundary descriptions, or other miscellaneous amendments which may be

needed at a late time.

1. CALL TO ORDER

Chair Shearer called the meeting to order at 10:04 am.

2. ROLL CALL

Commission present were Chair Charlie Shearer, Mike Davis, Susan Arthur, and Spence Redwine.

Staff present were Director of Community and Development Services Kimberly Murray, Planner

Bill Medina, Community and Development Services Management Assistant Felecia Winfrey and

Deputy City Clerk Fanchon Stearns.

On motion by Commissioner Redwine, seconded by Commission Arthur, the motion to

approve the Minutes as presented passed unanimously.

A. Receive a report, hold a discussion, and make a recommendation on a request to rezone

Lots 1, 2, and 3, Block 4 of Stoneman’s Addition, Denison Texas, more commonly

known as 330 West Munson Street, from Neighborhood Services to Two-Family Duplex.

(Case No. 2020-039Z)

Commission Action

Mr. Medina explained that the 2018 Comprehensive Plan shows the neighborhood to be

residential, and that it includes a small triangle on the other side of a utility easement. The

applicant intends to replat the property if the rezone is successful to develop 2 duplex

lots. Chair Shearer opened the Public Hearing, and with no public comments, closed the

Public Hearing. On motion by Commissioner Arthur, seconded by Commissioner

Redwine, the Commission unanimously recommended to rezone Lots 1, 2, and 3, Block 4

of Stoneman’s Addition, Denison Texas, more commonly known as 330 West Munson

Street, from Neighborhood Services to Two-Family Duplex.

6. STAFF UPDATES

A. Receive a report and hold a discussion on the recently adopted Boards and Commission

Policy Manual.

Commission Action

Ms Murray introduced the Boards and Commissions Policy Manual. She said the manual

goes into the role of staff with boards, how residents can get involved in boards and even

a list of all City bodies. She said that also included the staff contact for each board. She

said she likes that the document goes into the state laws governing boards, and it even

delves into how Boards can be run. The manual also goes into how to run the boards and

how the meeting is to be conducted. She said ethics and the Open Meetings Act are covered,

including bribery and conflicts of interest, and that definitions are also noted. Chair Shearer

asked if everyone had taken the Open Meetings Act and Public Information Act trainings

required. Commission Arthur said she had not, and he asked that she contact the City Clerk

to take that. Ms Murray shared a Land Use Fundamentals training opportunity with the

Commission that would go over zoning, signs and design, and asked that interested

members reach out to staff. Commissioner Arthur asked if it would be recorded because

she is interested but will be on vacation. Ms Murray said she would find out and that Ms

Winfrey would email the Commission with the additional information. Chair Shearer

shared that the Conflict of Interest may be a of particular interest to the Commission

because of potential litigation. He said he’s worked hard to step aside in cases he has any

interest in, even if it’s not required. Ms Murray asked that the Commission reach out to

staff for more information.

The applicant is requesting approval of a site plan for a proposed Texoma Orthopedic and

Spine located along FM 691.

Staff has determined that the submitted site plan and associated documents meet City standards.

Due to the project’s location and use, this project is consistent with the 2018 Comprehensive

Plan.

Staff recommends approval.

Background Information and Analysis

City staff began meeting and working with the applicant to discuss site plan requirements, design, and

concepts of the project during the Winter of 2019. The applicant is requesting approval of a site plan

for a proposed Texoma Orthopedic and Spine located along FM 691, adjacent to Celebration Senior

Living. The existing lot size for the subject property is 1.93 acres. Staff is currently reviewing final

civil engineering plans. Staff has reviewed a Site plan to examine the location of customer parking,

landscaping, drainage, traffic circulation and access, fire/emergency services access, utility plans,

paving plans and elevations. Staff has determined that the submitted site plan and associated

documents meet City standards.

Landscaping – The proposed landscaping plan meets the minimum City landscaping and tree

requirements. According to 28.51.6. “Minimum landscaping requirements”, the general landscaping

requirement is 8% of the lot area. Of the required 17 trees, the developer is providing a total of 25

trees.

Parking – The proposed site plan shows to provide a total of 90 standard parking spaces and 10

handicap spaces. which is compliant with City requirements for a facility of this use as listed in Sect.

28.50.6.

Building locations and footprints - The proposed project consists of a combination offices and

clinics. The proposed new total building area equates to 14,567 square feet.

The Site Plan standards of approval, as listed in 28.13.16. are as follows:

1. Conformance with the zoning ordinance and other applicable regulations and previously approved,

valid plans for the property.

As this project is located within the Gateway Village Planned Development, the proposed use and site

plan is compliant with the Zoning Ordinance.

2. The design and location of off-street parking and loading facilities to ensure that all such spaces are

usable and are safely and conveniently arranged.

Off-street parking requirements are adequately met on the proposed site plan.

3. The width, grade and location of street designed to accommodate prospective traffic and to provide

access for firefighting and emergency equipment to buildings.

The proposed layout of parking and driveways will not impede the circulation of traffic. Additionally,

the 24’ fire lane easement will improve traffic flow and emergency access. The applicant is also

providing connectivity for future cross access for future development.

4. The use of landscaping and screening to provide adequate buffers to shield lights, noise, movement

or activities from adjacent properties when necessary, and to complement the design and location of

buildings and be integrated into the overall site design.

The proposed landscaping plan exceeds City requirements and should serve adequately to provide a

buffer between the proposed building, parking, and street.

5. The location, size and configuration of open space areas to insure they are suitable for intended

recreation and conservation uses.

6. The adequacy of streets, water, drainage, sewerage facilities, garbage disposal and other utilities

necessary for essential services to residents and occupants.

proposed site.

Due to the project’s location and use, this project is consistent with the 2018 Comprehensive Plan.
