CITY OF DELAFIELD PLAN COMMISSION MEETING MINUTES Call to Order Mayor McAleer called the meeting to order at 7:00 P.M. Pledge of Allegiance The Pledge of Allegiance was recited. Delafield Citizen’s Comments Pertaining to Subjects on This Agenda
Lynn Morrison, Alderperson District 6, had looked at the maps in hall for public display. She noted the C-1 conservancy had been removed and she thought that was great. She liked this and wanted to make sure the City removed the C-1 conservancy as a formal action. R. Dupler explained that the C-1 conservancy had been removed around the lake where parcels were larger than 10 acres. Charles Holland, 741 Milwaukee Street, questioned whether the American Legion property had been changed from C-1 zoning back to its original zoning. R. Dupler explained the original zoning would remain for this parcel as there had been a misunderstanding regarding ownership of the property. C. Holland thanked the Commission for its efforts in remedying this error. In addition, he supported of the expansion of the CBD-2 zoning district in the downtown area. R. Dupler then shared an illustration of the newly proposed CBD-2 area to be expanded in the Downtown District. He noted some areas were removed in this expansion as a result of comments received at the Public Hearing on this matter. Steve Gilbert, 714 Milwaukee Street, stated he thought the City’s actions were hypocritical in proceeding with business expansions in the Highway 83/Interstate 94 area and was concerned about the impact this was now having in the downtown area. He thought the City was now being greedy in wanting to expand the downtown area when there were many empty businesses currently. He thought the housing area should be left alone. He thought the City should work with downtown business owners to lower the rent in the buildings downtown so businesses would be attracted to work with available properties in the downtown instead of expanding into new areas in the City. There were many homeowners against the expansion into their residential areas, and the City should listen to residents that actually lived in the expansion area in this case.

R. Dupler explained that in response to comments heard at the Public Hearing, the proposed CBD-2 district expansion had been revised. He then explained the locations on the map, noting the Single-Family housing area on Mill Street facing north had been eliminated. This would equate to a change in land use at the back lot line for some of the lots in that area, and would give a unified neighborhood appearance with these various exempted. Dan Collins, 726 Milwaukee Street, stated he was in favor of the proposed zoning change in the CBD-2 expansion area. He had lived in the area for many years. While he wanted to keep it residentially zoned, he also wanted the ability to use the lot and have less setback issues. At the last hearing, he had presented a petition in favor of the expansion and he provided four additional names this evening to that petition. Charles Holland, 741 Milwaukee Street, noted his parents had owned a gas station in the proposed expansion area many years ago and no one had objected to this business operation during that time. He saw no reason to object now. Attorney Peter Kafkas, requested clarification on the updated map with regard to his property. R. Dupler noted the location of the Kafkas parcel and confirmed the removal of the Kafkas parcel as part of the elimination of the C-1 conservancy designation decision to keep parcels ten acres and over as conservancy land. P. Kafkas thanked the Commission for listening to all comments and he appreciated the action being proposed in this matter. Scott Kreager, House Agent and First Vice Commander of the Legion Post No. 196, hoped that the Legion zoning designation would be allowed to remain as its original intent as there were many veterans that had put a lot of work into the Legion Post and to change the zoning would take away from all that hard work. He would like to see the original zoning remain for this parcel. Chloe Wandschneider, 834 Mill Street, appreciated what was being proposed with the CBD-2 expansion. While the Commission was looking at colored squares on a map, she thought it was important to consider the people involved. She was concerned that at the end of Milwaukee Street, properties to the north would be zoned commercial and she wondered how to control what would go into that area. R. Dupler explained that protection to the area was provided by zoning requirements as those requirements specified the intent of the City and also preserved architectural character that would not happen with other types of zoning. D. Curtis Costa suggested C. Wandschneider consult the City’s zoning ordinances for information on permitted uses that were allowed within each zoning district to alleviate concerns. C. Wandschneider stated she still thought the area being expanded would allow people to move in and out of the area frequently and she wished the action would not take place. Jay Theisen, 817 Milwaukee Street, stated he thought the Commission should check with the police department regarding an anticipated increase in calls as a result of the proposed CBD-2 expansion into the residential area prior to taking formal action in this matter. He anticipated the calls would increase as a result of the change in zoning.

Ross Wandschneider, 834 Mill Street, thought restrictions should be in place with the new CBD-2 expansion regarding runoff issues associated with increased use of pavement in that area. He noted no one had complained about the gas station discussed by C. Holland because there was no where else to go at that time and people thought it handy to have it nearby in those days. He was glad to see the Commission had heard the concerns of residents and had removed some of the area to be expanded. He thanked the Commission for its consideration on these matters. Jackie Valde, 816 Mill Street, thanked the Commission for patience while listening to residents and she was glad to see the change in the CBD-2 expansion area alleviating Mill Street. M. DEYOE MOVED TO CLOSE CITIZEN’S COMMENTS PERTAINING TO SUBJECTS ON THIS AGENDA AT 7:24 P.M. K. FITZGERALD SECONDED THE MOTION. THERE WAS NO FURTHER DISCUSSION. ALL WERE IN FAVOR. MOTION CARRIED.

ITEM C-1 - MULTIPLE PARCELS THROUGHOUT DELAFIELD R. Dupler explained the C-1 Conservancy property changes previously proposed were related to a change in boundary to reflect the mandatory requirements of zoning ordinances. After the Public Hearing on this matter and further review by Staff, the new proposal included properties that included conservancy land in excess of ten acres. He then reviewed the parcels on the map around Nagawicka Lake that were slated for inclusion with the currently proposed C-1 Conservancy designation for zoning.

With regard to the next parcel listing of the Geeson property, K. Fitzgerald thought the underlying zoning should be made to match the conditional use due to the fact that if the conditional use expired, then the parcel was bound to the R-3 zoning designation, and the R-3 zoning would not be consistent with the City’s boundary agreement. He thought the parcel should be zoned in a manner that would be consistent with the underlying district. Mayor McAleer questioned why the parcel could not be left zoned as B-5. Discussion ensued regarding the possibilities of whether the parcel should be zoned R-3, B-5 or RE-1. R. Dupler stated he appreciated the observations being discussed and noted that the underlying zoning could be made to be consistent with the City’s boundary agreement as a conservative measure. K. DEYOE STATED SHE WAS NOT COMFORTABLE MOVING FORWARD WITH ANY DECISION ON THIS MATTER AND WOULD LIKE IT REMOVED FROM THE AGENDA UNTIL FURTHER UNDERSTANDING COULD BE GAINED FOR ALL INVOLVED. She explained they had come to the conclusion independently of the decision by Staff to request the parcels on Mill Street to be removed from the proposed rezoning. She appreciated the reconsideration by Staff as she did not think it necessary to have the district extend across Lake Street to include only one major business operating under a conditional use at this time. She thought Lake Street to be windy, narrow, and residential in nature. Since Milwaukee Street included blended blocks, that area would be appropriate for rezoning.

Currently the Seminary did not have its own tax key number that accurately reflected its ownership boundaries. In addition, the parcel boundary was incorrect and the parcels needed to be rezoned to be consistent with the current use and the Comprehensive Plan. M. R. DUPLER EXPLAINED THE SEMINARY WANTED TO PRESERVE THE SITES FOR PRIVATE FUNDING. MAYOR MCALEER QUESTIONED WHETHER PYRAMIDING WOULD OCCUR. R. DUPLER EXPLAINED THAT A CONDITIONAL USE WOULD BE REQUESTED FOR THOSE SITES, AND IF SUBDIVIDED THEN THE ZONING PROCESS WOULD DICTATE THE APPLICANT RETURN FOR CONSIDERATION ON THE MATTER. K. FITZGERALD CLARIFIED THAT WOULD MEAN THERE WOULD BE EIGHT LOTS NORTH OF THE RL-1A ZONING THAT WOULD HAVE TO GO FROM THE LAKE TO THE EDGE OF THE PROPERTY. D. CURTIS COSTA DID NOT ANTICIPATE THAT ACTION OCCURING. MAYOR MCALEER QUESTIONED WHETHER THE OPPORTUNITY EXISTED TO GET MORE DENSITY WITH LAKE ZONING. K. Dupler clarified the parcel in question in this matter. K. Fitzgerald stated this was a single parcel that had two zoning designations with the majority of the overall parcel being zoned RL-1A and the secondary smaller parcel piece being agriculturally zoned and it had not been previously rezoned when it should have been to provide consistency. R. Dupler went on to explain that the next Item, Item 26, was a reflection of a boundary change as certain portions of the Seminary rezoning that had been previously completed had not been accurately reflected on the map. The original Conditional Use took in all the property and as it was sold off the boundary had to be modified as defined by the Conditional Use that governed the property. Item 26 was a modification of the boundary of the mass of the Nashotah House Seminary campus on the map and this action would allow a graphic change to draw the correct boundaries on the map. M. Dupler explained that this issue had been brought to Staff’s attention by a concerned citizen that the language in Ordinance 619 could be interpreted incorrectly. D. Curtis Costa suggested variations to the proposed verbiage in resolution of this matter. Discussion ensued to provide clarification on the proposed changes. Mayor McAleer stated he thought public input should be received on this matter. K. ATTWELL MOVED TO RECOMMEND PROPOSED LANGUAGE FOR SECTION 17.35 (7)(A) OF THE ZONING CODE BE AS FOLLOWED: “…AREAS DESIGNATED AS BEING WITHIN THE ENVIRONMENTAL CORRIDOR MAY BE USED FOR LIMITED RESIDENTIAL PURPOSES, PROVIDED HOWEVER THAT RESIDENTIAL DENSITIES IN SUCH AREAS MAY NOT EXCEED ONE UNIT PER FIVE ACRES FOR PARCELS ENTIRELY WITHIN THE ENVIRONMENTAL CORRIDOR BOUNDARY AND THOSE PORTIONS OF PARCELS THAT LIE WITHIN THE ENVIRONMENTAL CORRIDOR BOUNDARY” AND TO RECOMMEND A PUBLIC HEARING BE HELD ON THIS MATTER. CITY OF DELAFIELD PLAN COMMISSION MEETING MINUTES Date: Mon, 28 Dec 2009 22:26:25 -6:00 Subject: Zoning Petition Clarification Dear Mayor McAleer, I would like to comment on a letter from Lisa Gilbert, e-mailed to you regarding proposed zoning changes on Milwaukee St. from R-4 to CBD-2. (see copy below obtained from City of Delafield website). She falsely states that my husband and I obtained Charles Holland's signature on a petition of residents in favor of the zoning changes, submitted Dec. 16, 2009. If you review the petition, you will see he did not sign it. However, Betty Holland did. She also implies that renters in the district are being added as token names just to make the petition list longer and as renters (not owners) their opinions and signatures should be disregarded as they should have no say in the matter. Before we acquired any signatures we spoke to Roger Dupler and asked him if only property owners were allowed to have input on zoning changes. He explained that renters have the same rights to speak in favor of or against any zoning changes. As Lisa Gilbert did not actually see the petition and signatures, she would not know that the majority who signed it are property owners. And I am sorry that she does not feel ALL residents who live in the city of Delafield should be counted or have a voice in the matter. She also proposes you verify the people who have signed it. By all means, please do. While I believe the opposition was more vocal during the Plan Commission Meeting on December 16th, the residents and businesses in favor of the proposal who signed petitions were actually larger in number. Jeannie Collins 726 Milwaukee St. Delafield, WI 53018 December 16, 2009 7:00 PM Page 24 of 24 CITY OF DELAFIELD PLAN COMMISSION MEETING MINUTES Dear Mayor McAleer, I am a property owner at 714 Milwaukee St in the proposed zoning change to CBD-2 area. I did sign a petition against the zoning change and it was submitted tonight at your hearing. I was unable to attend due to an illness. However, I did watch the hearing on the television. I would like to point out a few facts that I would hope you would consider before making your decision. One of the very few residential people in favor of the zoning change was Dan and Jeanie Collins. They spoke how it would benefit the community. They turned in a petition with signatures in favor of this and a few of the names were mentioned. Many of the signatures on that petition are NOT property owners in Delafield. Charles Holland who spoke in favor of the zoning change and signed the petition from Dan Collins is NOT a property owner. Nick and Tami Wirth also signed that petition. They are renters, NOT property owners. I would hope that when you review petitions turned in for favoring or objecting to the zoning change, you would verify that the people who have signed, are the property OWNERS who pay taxes and not just token names to make the list longer. I am against the zoning change because we need the actual business district downtown now to be operating at full capacity and making use of the properties available there. Extending the district will cause more vacant buildings and willnot make a happening tourist town of Delafield. It will show the tourists and potential shoppers that there isn’t enough business and interest here to make them want to come to Delafield.
