BOARD OF TRUSTEES CITY OF CREEDE, COLORADO – A TOWN

September 5, 2017 REGULAR MEETING

The Board of Trustees of the City of Creede – a Town, County of Mineral, State of Colorado, met in regular session in the Creede Town Hall at the hour of 5:30 p.m. There being present at the call of the roll the following persons:

OFFICIALS PRESENT: Lori Dooley [by phone], Kay Wyley, Catherine Kim, Teresa Wall, Dana Brink, Frank Freer

OFFICIALS ABSENT: Jeffrey Larson

Mayor Pro Tem Wall, presiding, declared a quorum present. Those members of staff also present were as follows: Clyde Dooley, Manager

Randi Snead, Clerk/Treasurer

REVIEW AGENDA Permission to move the train in Basham Park was added to the agenda under New Business. Trustee Kim

moved and Trustee Wyley seconded to approve the agenda as amended. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

CONSENT AGENDA The consent agenda contained the following items:

a. Consider August 1, August 2, August 15, 2017 Minutes b. Review/Consent of August 2017 Check Detail Report c. Consider September 5, 2017 Unpaid Bills Report [Avail. 9/5] d. Consider Parade Permit Headwaters Mountain Bike Race 9/9/17 e. Consider Memorial Bench Application Merle Knous

Trustee Kim moved and Trustee Freer seconded to approve the consent agenda as presented. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

PUBLIC HEARINGS AND RELATED ACTIONS CONSIDER ORDINANCE 403 VACATING PORTIONS OF CAPITOL AVENUE AND AUTHORIZING THE CONVEYANCE OF PROPERTY

Mayor Pro Tem Wall opened the public hearing. No one spoke in opposition or support and no correspondence was received regarding the ordinance. Trustee Wall moved and Trustee Brink seconded to close the public hearing. The vote was unanimous. Mayor Pro Tem Wall closed the public hearing. Trustee Kim moved and Trustee Freer seconded to approve Ordinance 403 Vacating Portions of Capitol Avenue and Authorizing the Conveyance of Property. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

CONSIDER RESOLUTION 2017-08 EGOLF RE-PLAT OF TRACT 1R, BLOCK 46, SOUTH CREEDE Trustee Brink moved and Trustee Kim seconded to approve Resolution 2017-08 Egolf Re-Plat of Tract 1R,

Block 46, South Creede. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

CONSIDER RESOLUTION 2017-09 JACKSON RE-PLAT OF TRACT 2R, BLOCK 46, SOUTH CREEDE Trustee Brink moved and Trustee Kim seconded to approve Resolution 2017-09 Jackson Re-Plat of Tract

2R, Block 46, South Creede. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

OLD BUSINESS CONSIDER MUNICIPAL JUDGE RFPS

One proposal was received from David A. Thompson. Mr. Thompson was present to answer questions and introduce himself. Attorney Lintott was directed to contact the references listed in his proposal. Trustee Kim

moved and Trustee Freer seconded to appoint David A. Thompson as Municipal Judge contingent on positive reference checks. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. CONSIDER 2016 AUDIT – BLAIR & ASSOCIATES Clerk Snead explained that there had been some miscommunication and the extension had not been filed correctly by the auditor, causing the State Auditor to remove the ability to get an extension for the 2017 Audit next year. Making sure its completed in a timely manner will need to be a priority next year. Trustee Kim moved and Trustee Wyley seconded to accept the 2016 Audit as presented. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. CONSIDER RESOLUTION 2017-10 ADOPTING AGENDA POLICY AND MEETING RULES OF PROCEDURE Clerk Snead explained a correction as suggested by Mayor Pro Tem Wall to strike the portion of item 3 of meeting rules of procedure that read “until it is apparent that no other member of the Council will do so” and Trustee Kim requested that agenda approval be removed. It was replaced by language requiring that the agenda be “presented for the meeting absent any objections.” Trustee Kim moved and Trustee Brink seconded to approve 2017-10 Adopting Agenda Policy & Meeting Rules of Procedure as amended. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. CONSIDER DIRECTION - REMOVING 72-HOUR RESTRICTION OF RVS AND EXCESS WEIGHT VEHICLES FROM CREEDE DEVELOPMENT CODE The Council directed the Planning & Zoning Commission to prepare the final recommendation on the ordinance amending the Creede Development Code to legislate tiny homes for review by the January 16, 2018 work session. Trustee Brink moved and Trustee Kim seconded to extend the Krueger Special Exception Use at 111 E Wall Street to September 5, 2018. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. NEW BUSINESS CONSIDER RESOLUTION 2017-11 APPOINTING KAREN E. LINTOTT AS TOWN ATTORNEY Trustee Kim moved and Trustee Freer seconded to approve Resolution 2017-11 Appointing Karen E. Lintott As Town Attorney. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. CONSIDER HARRISON PROFESSIONAL SERVICES AGREEMENT FOR CONSULTING ON FLUME PROJECT Trustee Kim moved and Trustee Freer seconded to approve the Harrison Professional Services Agreement restricted to bid review services only and not to exceed $750. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. CONSIDER RESOLUTION 2017-12 AMENDING ACH AGREEMENT WITH DEL NORTE BANK

Trustee Kim moved and Trustee Freer seconded to approve Resolution 2017-12 Amending ACH Agreement with Del Norte Bank. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried.

CONSIDER VCMF PUNCHING BAG INSTALLATION The Council had no objections to installing a punching bag at the VCMF and staff was directed to proceed. CONSIDER TRAIN MOVE Clerk Snead explained that in order to reduce the chance of destroying either the new pavers or the new pavilion in Basham Park, it would be better to relocate the yellow train as soon as the Historical Society Library was relocated. The Basham Park Committee selected a location along the north edge of the park next to Coffee on the Fly. Trustee Kim moved and Trustee Brink seconded to approve the relocation subject to location approval by the adjacent property owner. The vote was unanimous. RIO GRANDE STREET Manager Dooley requested and received direction to proceed with the street closures as proposed in the Rio Grande Subdivision Plan with large boulders. Trustee Freer moved and Trustee Kim seconded that the Board of Trustees of the City of Creede, a Colorado Town, hereby declares Rio Grande Street between West Third and West Fifth Street closed to thru traffic and such area shall hereafter be used by the City as common or open ground. The vote was unanimous. Mayor Pro Tem Wall declared the motion carried. AGENDA ITEMS The Council directed Manager Dooley to make sure that all items being considered by motion are placed on the posted agenda rather than only being included in the Manager’s Report in the future. RIO GRANDE STREET PARKING LOT Manager Dooley inquired about whether we wanted to start discussing property use and pursuing special exception use for a parking lot in the new subdivision. The Council felt that it would be best to get all the property straightened out first. RIO GRANDE STREET VACTIONS AND PROPERTY TRANSFERS Manager Dooley requested and received direction to proceed with individual property work on Rio Grande Street. CDOT PROPERTY Manager Dooley explained the CDOT request to purchase part of Eleventh Street and would be presenting more information as it is received. SIMON PROPERTY

Manager Dooley requested and received direction to proceed with a proposed land use application and replat process with the Simons in North Creede. ADJOURN There being no further business to come before the Board of Trustees at this time, Trustee Brink moved and Trustee Wyley seconded that the meeting be adjourned at 7:15 p.m. The vote was unanimous. EXECUTIVE SESSION EXECUTIVE SESSION FOR THE PURPOSE OF DETERMINING POSITIONS RELATIVE TO MATTERS THAT MAY BE SUBJECT TO NEGOTIATIONS, DEVELOPING STRATEGY FOR NEGOTIATIONS, AND/OR INSTRUCTING NEGOTIATORS, UNDER C.R.S. §24-6-402(2)(E) RELATED TO FLUME PROPOSALS

Trustee Wall moved and Trustee Brink seconded to convene into executive session for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators, under C.R.S. §24-6-402(2)(e) related to flume proposals. The vote was unanimous. Mayor Larson declared the motion carried.

Trustee Brink moved and Trustee Wall seconded to move out of executive session. The vote was unanimous. Mayor Larson declared the motion carried.

OLD BUSINESS SELECT FIRST CHOICE PROPOSAL WILLOW CREEK FLUME DESIGN-BUILD

Trustee Wall moved and Trustee Brink seconded to select Mays Construction & SGM for the Willow Creek Flume Design Build. After discussion, Trustee Wall withdrew the motion, and the council tabled selection to the October 3rd, 2017 meeting.

ADJOURN There being no further business to come before the Board of Trustees at this time, Trustee Brink

moved and Trustee Kim seconded that the meeting be adjourned at 5:59 p.m. The vote was unanimous. Mayor Larson declared the motion carried.

CREEDE TOWN BOARD MEETING OCTOBER 3. 2017

THE CREEDE FARMERS AND LOCAL ARTISAN MARKET FOR 2018 SEASON

We are submitting the Private Event Permit Application for Karen Mi Iler and Ed Vita to host the 2018 Creede Farmers and Local Artisan Market along with a check for $50.00 to the Town.

The 2017 market started slow but got better and better as the summer progressed and after we moved from the Days of '92 Event area. This area was on a side street in back of Basham Park and slowly but surely we got down to one vendor because there was no activity for the market at that location. Once we moved to 1st street between Centurylink and San Juan Sports, the couple of vendors we had were selling things before they even got set upl!! Soon, word of mouth got out and we ended the season after Crusin' the Canyon Car Show with at least five to seven vendors who were doing quite well! At this event, we were also able to work with the Elks who set up in our area and did hamburgers. We feel that we were very accommodating for last minute changes and we all benefited from our open air market and the other events.

We are asking if we can continue at this location and do have a backup of the RG Triangle should anything occur where we weren't able to be at the Centurylink location. After a town meeting in which Ed, Karen, a couple vendors and Amy and Michael McNeil from San Juan Sports attended, we talked with Amy and Michael in the parking lot and decided all of us can work together for events that the market or San Juan Sports has and we got first hand experience with this on a couple weekends and it worked out very wel I. There were lots of folks for both events in the same area and everybody prospered. The hours will change from 10-2pm to 9-2pm because of customers coming early to buy. We would also appreciate a little flexibility as far as specific days go. We will continue to do every Friday from around Memorial Day to after the Crusin' The Canyon Car Show but people are asking for Saturdays for the bigger weekends rather than Sundays and we feel we might pick up more vendors with Saturdays. We will never have more than two days but would like to add a Saturday if we think it would do well.

We would really appreciate keeping this location, working with the Town, San Juan Sports and Centurylink to have a very successful 2018 season. We appreciate your consideration. If needed, a copy of the market insurance can be provided in May of 2018.

Resolution No. 2017-13

VARIANCE FOR THE NORTH 35’ OF LOTS 6, 7, AND 8, SOUTH OF THE NORTH 35’ OF SAID LOTS,

IN BLOCK 6, SOUTH CREEDE WHEREAS, Sharon Vick has applied for a variance in accordance with Sec. 9-03-090 of the Creede Development Code (hereinafter “Development Code”) for the construction of a replacement residence on the North 35’ of lots 6, 7, and 8, south of the north 35’ of lots 6, 7, and 8, in Block Six, South Creede; and WHEREAS, this property neither meets the minimum 5,000 square feet requirement for construction of a residence nor meets the minimum lot or frontage widths. However, the property has had a residence on it since the late 1890’s or early 1900’s; and WHEREAS, the front and rear set-backs for a residence per the Development Code are 15’ and 20’ respectively while the replacement residence will be 1’2” from the front property line and 13’10” from the rear property line; and WHEREAS, the north side yard set-back is currently out of compliance with the Development Code. However it will be within compliance with the proposed replacement residence; and WHEREAS, there are exceptional or extraordinary circumstances applicable to this site that do not apply generally to other properties in Creede; and WHEREAS, the granting of this variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity and the strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same neighborhood; and WHEREAS, the Planning Commission conducted a public hearing on September 12th, 2017 and Board of Trustees conducted a public hearing on October 3rd, 2017 after providing notice and after consideration of all information and public comments before taking action on such application.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE CITY OF CREEDE, A COLORADO TOWN, THAT:

The Board of Trustees hereby grants the following deviations from the Creede Development Code to allow Sharon Vick to replace her current residence:

1. A new residence may be constructed on the lot even though the minimum 5,000 square foot is not met; and

2. The front yard set-back will be reduced to 1’2” instead of the 15’ as stated in the town’s Development Code; and

3. The rear yard set-back will be reduced to 13’10” instead of the 20’ as stated in the town’s Development Code; and

4. The replacement residence will be constructed within one (1) year to ensure that the stated purpose of the variance request is realized.

5. The City Manager shall notify the applicant of this Variance within five (5) days after the Board of Trustees decision has been rendered.

6. This Resolution will be recorded in Mineral County and will run with the property unless otherwise amended by the Board of Trustees for the City of Creede, a Colorado Town.

7. The Variance may be revoked for failure to comply with the conditions stated

herein after conducting a hearing on such revocation and providing written notice to the property owner of the time and date of the hearing at least ten (10) days in advance and describing the nature of the alleged violations.

Sharon Vick submitted a Land Use Application requesting a variance on her property including front and back yard setbacks. I think once you see the survey and property description you’ll understand.

This has got to be one of my favorite property descriptions – are you ready?:

“THE NORTH THIRTY-FIVE FEET OF LOTS SIX, SEVEN AND EIGHT, SOUTH OF THE NORTH THIRTY-FIVE FEET OF SAID LOTS IN BLOCK SIX, SOUTH CREEDE.”

Gotta love it – don’t ya. Anyway, once it all sinks in, I think you’ll all agree it makes sense under the circumstances. If you look at one of the 1905 pictures of Creede, this house is in it. So is the old Kulyk’s house, but the Dresser house is not. I think crowding people in to tight spots has always been an issue with the housing problems we still face today.

As you can see from the survey these houses were built on the western edge of their lots [the fences actually extend into La Garita Avenue] and situations like this are considered legal non-compliance or more commonly referred to as “grandfathered-in” when new regulations create the problem. I think it’s fair to allow this “grandfathered-in” situation to continue with new construction – again because of the circumstances.

One of the things about the “due process” is it allows neighbor’s and the general public to comment on our thinking prior to the Board of Trustees decision in the form of two (2) public hearings.

And speaking of the two public hearings, I’m planning the public hearing for you to be on September 19th and for the Board of Trustees October 3rd.

Randi reminded me yesterday that if all goes according to plan, I’ll miss the next two Planning & Zoning meetings. So I’ve included our Variance regulations and review criteria to help answer any of your questions, followed by a draft of the resolution I plan on presenting to the Board of Trustees for their consideration in October.

9-03-090 Variance.

In order to prevent or to lessen such practical difficulties and unnecessary physical hardships inconsistent with the objectives of the Development Code as would result from strict or literal interpretation and enforcement, variances from certain regulations may be granted. A practical difficulty or unnecessary physical hardship may result from the size, shape, or dimensions of a site or the location of existing structures thereon; from topographic or physical conditions on the site or in the immediate vicinity; or from other physical limitations, street locations, or traffic conditions in the immediate vicinity. Cost or inconvenience to the applicant of strict or literal compliance with a regulation shall not be a reason for granting a variance. It is not the intent of this section to allow variances in the classification of uses of property.

(a) Review Procedures. Applications for a variance shall follow the general review procedures set forth in §9-03-020, General Procedures and Requirements. Applications for variance may be initiated by the owner of property for which a variance is desired.

(b) Review Authority. The Board of Adjustment shall review and render a decision on an application for a variance after conducting a public hearing. The decision of the Board of Adjustment may be appealed to Board of Trustees [see pg. 70] pursuant to §9-03-130, Appeal.

(c) Review Criteria. The Board of Adjustment shall use the following review criteria as the basis for a decision on an application for a variance:

1. The degree to which relief from the strict or literal interpretation andenforcements of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity, or to attain the objectives of the Development Code without grant of special privilege;

2. The effect of the requested variance on light and air, distribution ofpopulation, transportation and traffic facilities, public facilities and utilities, and public safety;

3. Such other factors and criteria related to the subject property, proposeddevelopment, or variance request as the decision-making body deems applicable to the proposed variance.

(d) Required Findings. The Board of Adjustment shall make the following written findings before granting a variance:

1. That the granting of the variance will not constitute a grant of special privilegeinconsistent with the limitations on other properties classified in the same district;

2. That the granting of the variance will not be detrimental to the public health, safety,or welfare, or materially injurious to properties or improvements in the vicinity;

3. That the variance is warranted for one or more of the following reasons:

(i) The strict, literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Development Code;

(ii) There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the same zone; or

(iii) The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same zone district;

(e) Conditions. A variance granted by the Board of Adjustment may contain limitations as to time or disposition or use of the tract in question in order to ensure that the stated purpose of the variance request is realized.

(f) Action Notice. The City Manager shall notify the applicant for a variance in writing of the Board of Adjustment’s action within five (5) days after a decision has been rendered.

(g) Expiration. The variance approval expires if a building permit is not obtained within one (1) year of the approval.

Reason for Variance Application:

Owner seeks to entirely demolish the existing residence and replace with a new single family residence. The lot is 35 wide by 75' deep and, therefore does not conform to City of Creede R-1 Zoning standards in terms of lot size minimum square footage and minimum lot width or frontage.

In addition to relief from lot size minimum requirements, we seek relief from two setback requirements. The first is relief from the front setback requirement of 15'. We would like to be able to follow the same setback as the existing home, which is currently only 1 '-2· from the existing property line; however this distance is 11 ' -8" from the existing fence line. We are working with our neighbors to put together a group application for a boundary adjustment which, pending approval, will make the fence line the actual property line and, therefore, the resulting front setback would be 11' a· and not 1' 2". Because the structures on both the north and south sides of the subject parcel are set back the same distance (also roughly 1 ') from their respective front property lines, granting relief from this setback requirement will not alter the nature of the neighborhood, and will not cause any harm to the neighbors. The second setback requirement we seek relief from is the rear setback requirement of 20'. We wish to build within 13' 1 O" of the rear setback. The City of Creede does allow accessory buildings or alley loaded garages to be within 5' of a rear setback. This lot is a bit unusual for the City of Creede in that it does not have an alley on the rear lot-line, so an alley loaded garage will not be possible for this parcel. Because the R-1 Zoning standards do allow construction within 5' of a rear setback, we feel that our request to build within 13' 1 O" of the rear setback given the space constraints of the lot is also not unreasonable, and does not change the essential character of the neighborhood. We fully intend to abide by the side setback requirements of 5'. It is worth noting that the existing residence does encroach 1' e· into the north side setback and this setback encroachment will be cured as a result of the construction of the new residence.

The existing residence is in very poor condition and lacks a proper foundation and insulation, making it suitable for summer use only. To remodel the existing residence and bring it up to modern standards would be cost prohibitive. If this variance is granted, the resulting residence, which will be designed for year­round use will have an economic benefit for Creede as the owner intends to use it in the winter. It will be an upgrade to the general housing stock in Creede and it will be an opportunity for the City to have another residence equipped with a water meter. Thank you for your consideration.

To the City Trustees of Creede, Colorado:

Thank you for the opportunity to provide input for the requests for variance.

The city of Creede is a unique and special place for many of its citizens. Most of its homes are small

dwellings on small lots that reflect the unique history of Creede. The lot in question is located on 112 La

Garita Street and sits on a row of small lots and one-story homes.

Construction restrictions on small lots are vital to the quality of our neighborhoods. They maintain the

unique look and spirt of Creede. These restrictions provide a control and balance for new construction in

relationship to the other homes in the area.

We also support the growth of our town and we welcome the economic opportunities for employment

the new construction would provide to our citizens.

With these thoughts in mind, our neighborhood would support the issuing of a variance restricted to a

Dear Planning Commission Members,

In response to the City of Creede, Notice of Public Hearing regarding variance's for the middle 35 feet of

lots 6, 7 and 8, Blocks 6 of South Creede:

Lots 6, 7 and 8 are each 100 feet long. The variances request seeks to change only the middle 35 feet of

each of the lots. The remaining 65 feet of the three lots are not included in the variance request.

The request, if granted, would set a precedent for the abandonment of the R-1 zoning standards that

the city and planning commission established for the citizens of Creede. Since the variances would only

be applied to the middle 35 feet of lots 6, 7 and 8, acceptance of the variances request will create a

selective bias and unfair treatment to the owners of the other 65 feet of lots 6, 7 and 8.

We request the variances be amended and applied to the full 100 feet of lots 6, 7 and 8 and applied to

any other middle lot in the city of Creede. This action will terminate the need for R-1 zoning rules.

The variance request should now read: Setbacks will be 7.5 feet from the current western boundary of

lot 6 and eastern boundary of lot 8. North and side setbacks will be 5 feet for each of the 3 parcels.

Setbacks will be applied to all of lots 6, 7 and 8 as well as to any other multiple cross lot ownerships.

Applying this precedent will eliminate varying zoning standards within existing lots.

Clyde, The 2 story portion of house on submission is l 6x60x2 stories = 1920 sq ft plus an estimated one story portion of 30x9=270 sq ft. Grand total estimated as 2190 sq ft which completely overpowers a 2625 sq ft residential lot.

Hello, 

I don't believe it would be a good idea to grant variances to build a 2‐story home on the single lot on La Garita. To build a 2‐story home there would require variances on 3 to 4 building codes. There are codes in place for a reason. It would set a very bad precedent. It would open the door to over building throughout the town. While I am all for more housing, it needs to be done on the proper scale.  

I don't think anyone has an issue with them replacing the existing cabin with a new 1‐story building, But if they want to build a bigger home, they need to find a bigger, more appropriate lot.

I, Terry A. Larson do not think it is proper or correct to give or authorize a variance from the R-1 zoning standards in this case. I understand that all the people I have talked to about this, and the people who live in that area are against the change in zoning standard in this case. It is not a standard size building lot, 50 ft. by 100 ft., it has a house already on the property and I think this is a summer home now! The houses on each side of the present house are also on substandard or small lots. If you give a variance to the above case, why have zoning standards?

You will only be doing your job if you go along with the present zoning standard and wishes of the present property owners in the area.

I own residence and a business property in Creede.

This non-conforming lot was deeded before the existing zoning regulations.

The deteriorating property is of little use to our family as it is. The lot and house

has been in the family for 48 years. It is our desire to build a structure that can be

used year round for multiple family members.

It is our intent that the house will not only be pleasing in appearance, be

functional and safe, but add to the property value of the neighborhood.

To the Creede City Council, Mayor and Planning and Zoning Committee, I am favor of the variance brought before you. I feel that the inability to build a better Creede is a detriment to the economic well being of the community. By changing the structure, it increases the valuation of the property. Increasing the tax base of that property and the economic well being of Creede. Also there is no basis for not having a two story structure, as there are a number of them in the area. There are a number of non conforming lots within the city limits. I feel this eventually needs to be re-evaluated by the planning and zoning committee. But this needs to be approved now, as it sets a precedence for the future and building in the City. CONTRACT SERVICES AGREEMENT FOR MUNICIPAL JUDGE SERVICES

CITY OF CREEDE, A COLORADO TOWN This CONTRACT SERVICES AGREEMENT FOR MUNICIPAL JUDGE SERVICES (hereinafter “Agreement”) is effective as of October 3, 2017, by and between David A. Thompson (“Judge”) and the City of Creede, a Colorado Town and municipal corporation, by and through its governing body (“Town”). 1. RETENTION Town hereby hires Municipal Judge to render such legal services customarily rendered by such official and as further specified herein. 2. SCOPE OF WORK AND DUTIES A. Judge shall perform all work necessary for the provision of municipal judge services, including, without limitation, the following: (i) Municipal Court: Judge will preside over the City’s Municipal Court as needed and to use

his independent judgment in enforcing violations of Municipal Ordinances or Codes that may come before the Court. The court is generally held once a month or on an as-needed basis.

(ii) Fines: Judge will impose fines in accordance with the City’s fine scheduled and will fulfill

all other duties of a Municipal Judge. (ii) Consultation: Judge will be available for consultation with Town or designated staff as

needed on legal matters which are within his area of operation on an as-needed basis. 3. TOWN DUTIES Town agrees to provide such information, assistance, cooperation, and access to books, records, and other information as is necessary for Judge to effectively render his professional services under this Agreement. Town further agrees to abide by this Agreement and to timely pay Judge as established by this Agreement. 4. COMPENSATION Compensation shall be on an hourly basis at $75/hour. Authorization shall be procured for expenses in excess of $100 that are incurred outside the scope of presiding over municipal court. Invoices for services shall be prepared and submitted on a monthly basis. Payment thereof is due within 30 days. 5. INDEPENDENT CONTRACTOR

Judge shall perform all legal services required under this Agreement as an independent contractor of Town, and shall remain at all times as to Town a wholly independent contractor with only such obligations as are required under this Agreement. Neither Town nor any of its employees shall have any control over the manner, mode, or means by which Judge renders the legal services required under this Agreement, except as otherwise set forth. 6. INSURANCE Judge maintains, at his sole cost and expense, in a form and content satisfactory to Town during the entire term of this Agreement, including any extension thereof, the following policies of insurance: Professional Liability Insurance: A policy of professional liability insurance written on a per occurrence basis in an amount not less than a combined single limit of One Million Dollars ($1,000,000.00).

7. INDEMNIFICATION Town agrees to undertake its statutory duty and indemnify Judge against, and will hold harmless from, any and all claims or liabilities that may be asserted, or claims by any person, firm or entity arising out of or in connection with the work, operations or activities of Judge within the course and scope of her employment hereunder, but nothing herein shall require Town to indemnify Judge for liability arising from his own negligence. A. Town will promptly provide a defense and pay any judgment rendered against the Town, its officers, agency or employees for any such claims or liabilities arising out of, or in connection with, such work, operations, or activities of Town; B. In the event Judge is made a party to any action or proceeding filed or prosecuted against Town for such damages or other claims solely arising out of, or in connection with, the work operation or activities of Town, Town agrees to pay to Judge any and all costs and expenses incurred by Judge in such action or proceeding, including but not limited to, legal costs and Judges’ fees. 8. TERM, DISCHARGE AND WITHDRAWAL This Agreement shall commence on October 3, 2017 and shall remain in full force and effect until terminated by either party hereto. This agreement may be terminated by either party at any time. Withdrawal from any court or administrative proceeding shall be made in accordance with the Colorado Rules of Civil Procedure and Professional Conduct. In the event of such discharge or withdrawal, Town will pay Judge professional fees in accordance with this Agreement for all work done through the date of cessation.

9. CONFLICTS Judge represents that he has no present or contemplated employment adverse to Town. Judge agrees that he will not represent clients in matters adverse to Town while serving the Town. However, Judge may have past and present clients or may have future clients, which, from time to time, may have interests adverse to Town and reserves the right to represent such clients in accordance with the Colorado Rules of Professional Conduct.

10. INTERPRETATION OF AGREEMENT AND FORUM This Agreement shall be construed and interpreted, both as to validity and performance of the parties, in accordance with the laws of the State of Colorado. In the event of any dispute hereunder, forum shall be in Alamosa County. 11. INTEGRATED AGREEMENT; AMENDMENT This Agreement contains all the agreements of the parties and cannot be amended or modified except by written agreement. No prior oral or written understanding shall be of any force or effect with respect to the matters covered in this Agreement. This Agreement may be amended at any time by the mutual consent of the parties by an instrument in writing. 12. Manager’s Report

To: Mayor and Board of Trustees Date: October 3, 2017 From: Clyde Dooley 2018 Preliminary Budget – FYI Attached is the preliminary budget for 2018. Randi, Ben, AnnKate and I are going to meet Monday and I may have some changes to report. As you can see from the attached draft we had some confusion on what account numbers we were using and that’s something Randi and I can work our when we both get a breather. Once we get that sorted out, we’ll come up with a schedule of budget workshops to discuss the individual funds as we’ve always done. I’ve emailed Fred a couple times about a law enforcement contract but haven’t heard back from him. We should also discuss and decide what we want to do with the Rio Grande Street Subdivision. Last meeting, we tabled the discussion about going thru a formal process for public parking. Robert Hosselkus got back with me about closing Rio Grande Street to thru traffic and he’d prefer we wait until we develop 4th Street all the way to Loma. His concerns are of course being able to get a fire truck or ambulance to the five homes in the area. He’s okay for putting some rocks at 3rd and 5th Streets, but not at 4th. Rebecca & Caleb Simon – FYI Rebecca, Caleb, and I met with Toby from Davis Engineering last Monday to discuss a boundary line agreement for their and their neighbor’s property in North Creede. Toby is working on the survey of their requests and once I receive it, I will clarify everything for an application to start the process. Zero Error Network – FYI For the record Kenny Swinehart with Zero Error Network got with Ben last month to install the 2’ dish we agreed to back in July and they determined it was more practical and safe to install in on the building instead of the tank. August Finances – FYI Budget YTD General Fund (19,692) 48,717 Capital Improvement Fund (11,938) 45,445 Conservation Trust Fund 1 1,398 Virginia Christensen Fund 58 (177,066) Water & Sewer Fund 1,708 43,560 Net (29,863) (37,946) City Sales Tax: total $114,240 through the end of August. City Funds total $2,749,105 through the end of August. That’s up $199,423 for the same period last year and down $20,204 from last month. [This is the tool I use to keep track of the funds we have in the bank. I use this spreadsheet to not only keep track of our short term financial stability, but also the long term fiscal sustainability. Fiscal sustainability strategies build the capability of a government to consistently meet its financial responsibilities, both in the short term by adjusting spending to revenues and revenues to spending, and in the long term by protecting future capital improvement plans and future generations of fiscal abilities.] Budget Fund Balances: Budget fund balances are provided to us once a year after our audit.
