As Austin’s black population falls, a question of repre-sentation rises By Jody Seaborn - American-Statesman Staff

African-Americans once represented about 15 percent of Austin’s overall population, but over the past few dec-ades, the city’s black popula-tion has decreased steadily as African-Americans have moved outside Austin. Today, the African-American share of Austin’s population is 7 per-cent, according to city esti-mates. Eric Tang, a professor of African and African Dias-pora Studies at the University of Texas, produced an atten-tion-grabbing report two years ago which found that Austin, despite growing 20.4 percent between the 2000 and 2010 censuses, was the country’s only large, fast-growing city to record a de-cline in its black population: 5.4 percent, from 64,259 in 2000 to 60,760 in 2010. With the help of UT doctoral stu-dent Bisola Falola, Tang re-cently produced a new report asking African-Americans who have moved to the suburbs why they left Austin. I won’t dwell on Tang and Falola’s results, which the American-Statesman’s Dan Zehr covered last week, other than to note that a majority of African-Americans — 56 percent — said they left Austin because they no longer could afford to live in the city. Many said they would move back if they could. The significance of this “outmigration?” The report

briefly goes over several noteworthy effects on those who have left Austin. Public amenities and services often are harder to access in the suburbs than they are in the city. People feel a loss of community and a sense of social disconnection as they move from neighborhoods where their families have lived for generations. Economic segregation worsens, further weakening economic mobility. These effects frequently are discussed and debated in stories about Austin’s declin-ing African-American popula-tion. But there is one effect that often is overlooked. It is worth revisiting, for it will be much discussed in about five years, when it becomes clear how the African-American migration from Austin to the suburbs potentially affects the makeup of the Austin City Council. One of the main reasons the City Council has 10 members is because 10 was the minimum number needed when the district-based council was created in 2012 to draw a district in which black voters would have an opportunity to elect an African-American council member. Yet, even with 10 districts, creating an African-American opportunity district was barely possible given the movement of African-Americans out of Austin. The best the independent commis-sion that drew the new dis-tricts could do was District 1 in East and Northeast Austin. District 1 is — or rather was at the time of the 2010 census — 28.2 percent African-American. If drawing an African-American opportunity district was barely possible a couple of years ago, it might be impossible when new district boundaries are drawn after the 2020 census. Sure, an African-American can be

elected in any district and does not have run in District 1. And after the U.S. Supreme Court invalidated part of the Voting Rights Act in 2013, the need to create a black oppor- tunity district may no longer be felt. But if the city wants to maintain council diversity and continue to give its re-maining African-Americans a chance to elect one of their own, it will face some tough choices. Either voters will have to be asked to increase the number of council districts to make it possible to draw an African-American opportunity district, or they will have to be asked to add a couple of at-large seats to the council. Either way, it’s conceivable that a version of the so-called gentlemen’s agreement that designated one seat on the old at-large council for an African-American member will have to be revived for the district-based council. Or, it’s conceivable Austin’s African-American population will have shrunk so much the city will have to consider a different question: At what low per-centage point does a group’s numbers no longer justify gerrymandering a district to give them an opportunity to elect their own council repre-sentative? And deciding the answer to this question will have to occur against a differ-ent group’s rapid growth: Asian-Americans were 6.8 percent of the city’s popula-tion in 2014, according to city estimates. This was just below African-Americans’ 7 percent. Given current trends, Austin’s Asian-American population will be greater than its black population after the 2020 census. Asian-Americans are widely dispersed throughout the city, but they made up 13.3 percent of District 6, in Northwest Austin, in 2010. When new districts are drawn after 2020, shouldn’t the next opportunity first be theirs?

The Austin metro area has made progress on economic growth but that success has evaded people of color and low income, according to an an-nual report released Thursday. The Community Advancement Network dashboard, a study that measures 17 socioeconomic indicators in the greater Austin and Travis County area, found that greater Austin has made progress in reducing the violent crime rate, increasing the rate of health care coverage and reducing the unem-ployment rate to an unprecedented 3.2 percent in 2015. However, when many of those successes were broken down by race, eth-nicity, income level and geographic location, the study found broad dispar-ity based on those factors. The unemployment rate for African Americans, for example, was 8.9 percent in 2014 and had been the slowest to recover since the end of the recession. Black people were also disproportionately over-represented in Travis County jail bookings, making up 21 percent of those bookings in 2014 de-spite being only 8 percent of the county’s adult population. People of color were also more likely to be poor, the study found. In 2014, Hispanics in Travis County had a poverty rate of 27 percent, three times that of white residents. The African-American poverty rate was 22 per-cent. “When we look at this report card, there are good things that we see but also challenges,” said Mayor Steve Adler at a news event Thursday morn-ing. “We know that as supercharged as our economy is … not everybody is participating.” In a nod to the city’s history of moving black and Hispanic people into East Austin in the early 20th century, Adler said there are “obvious racial ineq-uities” in Austin that the city had helped institutionalize. “The city helped create this problem and they city needs to help solve this

problem,” Adler said. Adler said his proposed $720 million city bond would work to address the economic divide by increasing mobility and affordability. A Tennessee road and bridge builder has agreed to pay $2.25 million to settle a whistle-blower lawsuit that accused the firm of fraud by putting its own employees on the payroll of a dis-advantaged business enterprise it used to get contracts for 12 projects in Ten-nessee. Mountain States Contractors LLC, an affiliate of Jones Brothers Inc., Mt. Juliet, Tenn., also will be in a monitoring agreement with the Federal Highway Administration, says a May 16 announcement by the acting U.S. Attorney for the Middle District of Tennessee. The government claimed Mountain States and HMA Contractors LLC, prime contractors that shared the same address as Jones Broth-ers, subcontracted with G&M Associates as a disadvantaged business enterprise (DBE) for 11 state road projects and one airport job. The U.S. attorney also charged that employ-ees were “loaned” to G&M to do and be paid for the DBE work, even though Mountain States and HMA covered their health insur-ance, and that the two companies also “improperly leased” equipment to G&M to meet DBE goals. The alleged fraud occurred between 2007 and 2014, according to docu-ments. The whistle-blower was Ron Meadows, a 20-year Mountain States employee who was fired in 2011 after complaining to the com-pany and state inspectors. He was awarded $500,000, plus $8,363.20 for expenses and costs. Neither he nor his attorney could be reached for comment. Meadows in a 2012 lawsuit charged that he and other workers were put on the G&M payroll, even though

they had not applied or agreed to work at the firm. In a statement, Mountain States said it was “pleased this matter has been settled for an amount that it would have cost to further litigate it, and we continue to believe we have complied with all the [DBE] laws and regulations.” “Mountain States fully cooperated with the inquiry from the first day we learned of it nearly two years ago, providing hundreds of documents to the government,” the firm said. In the agreement, the company does not admit guilt and specifically denies putting its employees on the G&M payroll. In separate previous enforcement actions, Mountain States was fined $60,000 last year after an administrative law judge upheld and increased a U.S. Occupational Safety and Health Administration fine for safety viola-tions. The contractor and another affiliated company, Britton Bridge LLC, were issued a statewide work-suspension notice by the Tennessee Dept. of Transportation in 2011, after two fatalities occurred four months apart on a Knoxville bridge job. The state OSHA also fined Mountain States $135,000 in 2005, after a fatal trench collapse. Mountain States, Jones Brothers, HMA Con-tractors and other affiliated companies cur-rently are working with the state DOT on 14 contracts that have a total value of $84.8 million. “We are not currently seeking to drop any of the affiliated companies from our list of qualified bidders,” a TDOT spokesperson told ENR, adding that the firm remains under a state safety-compliance agreement follow-ing the worksite deaths.
