Minutes of the Belton City Council June 16, 2020 City Hall Annex 520 Main Street, Belton, Missouri Mayor Davis called the work session to order at 6:00 p.m. Carolyn Yatsook, Economic Development Director, introduced Brent Miles and Brad Haymond from NorthPoint Development. They presented information about the proposed multi-family development at 163 rd St. and Givan Ave. Dave Clements, Planning and Building Director, presented information from last week’s Planning Commission Meeting where this project was discussed. Sid Douglas, Gilmore and Bell, presented information about the plan incentives, including the PILOT and two-year construction schedule. Being no further business, Mayor Davis adjourned the work session at 6:48 p.m. and called the special meeting to order. Councilmember Peek led the Pledge of Allegiance to the Flag. Councilmembers present: Mayor Davis, Tim Savage, Gary Lathrop, Chet Trutzel, Dean VanWinkle, Dave Clark, Ryan Finn, Stephanie Davidson, and Lorrie Peek Staff present: Alexa Barton, City Manager; Padraic Corcoran, Attorney; and Andrea Cunningham, City Clerk CONSENT AGENDA Councilmember Lathrop moved to approve the consent agenda consisting of a motion: approving the minutes of the June 9, 2020, City Council Meeting. approving Resolution R2020-26: A resolution of the City of Belton adopting the 2020 Multi-Jurisdictional Hazard Mitigation Plan for Cass, Clay, Jackson, Platte and Ray Counties. approving Resolution R2020-27: A resolution formally accepting the Belton High School addition new public infrastructure of 720 feet of 8” water line with various valves, tees, and bends; two (2) fire hydrant assemblies; and one (1) sanitary sewer manhole installed into the existing sanitary sewer line with a two-year maintenance bond in the amount of $75,000.00. approving Resolution R2020-28: A resolution approving Change Order No. 1, No. 2, No. 3, and No. 4 with Superior Bowen Asphalt Company, LLC for the 2020 Street Preservation Project Cooperative Agreement in the amount of $370,764.29. Councilmember Clark seconded. All voted in favor. Consent agenda approved. PERSONAL APPEARANCES Brent Miles, NorthPoint Development, provided the City Council with an upate/overview of the Southview Commerce Center project timeline.

Mayor Davis called the work session to order at 6:00 p.m.

ORDINANCES

Andrea Cunningham, City Clerk, read Bill No. 2020-27* 2020-30: An ordinance approving an amendment to the City’s zoning map from C-2 (General Commercial) District to R-3A Planned Unit Development district, for 11.64 acres of the parcel located on the south side of 163rd Street, midway between Markey Parkway and Givan Avenue, Belton, Cass County, Missouri. Presented by Councilmember Finn, seconded by Councilmember Lathrop. Vote on the first reading was recorded with all voting in favor. First reading passed. Councilmember Trutzel moved to hear the final reading. Councilmember Lathrop seconded. After considerable discussion, Councilmember Trutzel rescinded his motion. Councilmember Finn moved to hear the final reading. Councilmember Lathrop seconded. Vote to hear the final reading was recorded with all voting in favor except for Councilmembers VanWinkle, Clark, Davidson, Savage, and Mayor Davis who voted no. Motion failed. The final reading will be June 23, 2020. Ms. Cunningham read Bill No. 2020-28: An ordinance approving a plan for a commercial project and a development and performance agreement between the City of Belton, Missouri and NorthPoint Development, LLC; and authorizing certain agreements and other actions by the City. Presented by Councilmember Lathrop, seconded by Councilmember VanWinkle. Councilmember Davidson said she was in favor of the project, but in concerned the incentives are too high. Councilmember Trutzel sated he understood the need, as it’s a matter of return on investment by the Developer. Pursuant to RSMo 100.059, Mayor Davis invited affected taxing jurisdictions to submit public comments for the record.

• No one was present to represent the Belton School District • Ms. Yatsook was present to represent the City of Belton. Ms. Yatsook read two letters of

support from the taxing jurisdictions: Cass County, and Mt. Pleasant Township Special Road District. Ms. Yatsook had five additional letters of support from Cass County Corporation Economic Development; Belton Chamber of Commerce; Belton Regional Medical Center; Downtown Belton Main Street, Inc; and Belton-Cass Regional Transportation Development District. These letters are attached as Exhibit A.

Mayor Davis read an email he had received from a citizen supporting the apartment project stating, it’s time for this type and level of housing option. Councilmember VanWinkle asked Mr. Douglas how Belton’s incentives compare to other similar projects’ incentives. Mr. Douglas said Belton’s may be a little higher, but not completely out of line with other projects’ incentives. Each community is different. Vote on the first reading was recorded with all voting in favor except Councilmember Davidson who voted no. First reading passed. Ms. Cunningham read Bill No. 2020-29: An ordinance approving a Public Service Agreement between Oats, Inc. and the City of Belton, Missouri to provide site transportation for individuals to and from the Belton Senior Center. Presented by Councilmember Trutzel, seconded by Councilmember Lathrop. Vote on the first reading was recorded with all voting in favor. First reading passed. Councilmember Trutzel moved to hear the final reading. Councilmember Finn seconded. Vote to hear the final reading was recorded with all voting in favor. Motion passed. The final reading was read. Presented by Councilmember Trutzel, seconded by Councilmember Lathrop. Vote on the final reading was recorded: Ayes: 9 Mayor Davis, Savage, Davidson, Trutzel, VanWinkle, Lathrop, Finn, Clark, Peek Noes: 0 Absent: 0 Bill No. 2020-29 was declared passed and in full force and effect as Ordinance No. 2020-4575, subject to Mayoral veto. CITY COUNCIL LIAISON REPORTS Councilmember Davidson gave a Park report.

• There was a softball tournament this past weekend. • The outdoor waterpark has been very busy. • Swim lessons are available in July. • Summerfest is August 21-22 – Memorial Park.

The Farmer’s Market will open Thursday, June 18, at 4 p.m.

MAYOR’S COMMUNICATIONS Ms. Yatsook said last week, Councilmember Clark asked about the economic impact of tournament visitors to Belton. She said the Park did a study on this in 2017. It ranges from $35/day/person to $78/day/person. Mayor Davis said there has been growth on Main Street with the Chamber of Commerce’s Meet Me on Main rental hall. James Person, Police Chief, said the Governor opened the state back up. There aren’t any restrictions or laws regarding operations of businesses, there are only guidelines. Although, individual businesses may have restrictions in place. Please continue to wash your hands, practice social distancing, and use a face mask, if you wish.

Chief Person said Belton High School graduation will be on June 27 at Southwick Stadium. There will be 2 ceremonies so people can social distance.

At 7:56 p.m. Councilmember Clark moved to enter Executive Session to discuss matters pertaining to Legal Actions, according to Missouri Statute 610.021.1; and to discuss matters pertaining to negotiated contracts, according to Missouri Statute 610.021.12; and that the record be closed, and the meeting adjourned from there. Councilmember Finn seconded. The following vote was recorded. Ayes: 9 Savage, Trutzel, Davidson, Lathrop, VanWinkle, Peek, Finn, Clark, Mayor Davis Noes: 0 Absent: 0 Being no further business, the meeting was adjourned following the executive session. This letter is to express full support of NorthPoint Development’s apartment project located at 163rd St., and Turner Rd. in the City of Belton. NorthPoint is a proven developer and manager of high-quality multi-family projects throughout the metropolitan area, developing 3,500 apartments in the last eight years with an outstanding track record. Belton is an established first tier suburb that has many existing employers who will benefit from this project. A brand-new apartment product of this caliber will assist in attracting talent. Contemporary market preferences suggest greater interest in high-quality apartments that afford connectivity and public spaces. which this project affords. This is a product that Belton does not currently have. The complex will be comprised of studio units to two bedrooms with a den in six four-story buildings and amenities include garage spaces, a clubhouse with a pool, a public dog park and a walking trail. This apartment development responds to a finding in the city’s 2017 housing study – a lack of diversity in housing choices. The study points out that a lack of contemporary, high-quality apartments can lead to the conversion of single-family homes to rental property. Northpoint Apartments will deliver a product that fills a void for renters by choice and will help ensure that homeowners remain as occupants of our single-family stock. This project is a high-quality development located on a main corridor directly off one of the region’s most prominent interstate corridors, I-49 and will improve the housing choices not only in Belton, but all of Cass County.
