Regular Meeting December 11, 2017

The regular meeting of City Council was held this date in City Hall Council Chambers at 6:00 pm. In attendance were Mayor Terence Roberts, Mayor Pro Tem John Roberts, Council Members Thompson, Chapman, Laughridge, Harbin and Newton. Councilmen Buck Roberts and Stewart were not present. Also in attendance were Assistant City Manager, David McCuen; Finance Director, Peggy Maxwell; City Attorney, Frankie McClain; Public Works Director Kerry Stalnaker; and Police Chief, Jim Stewart. The invocation was given by Council Member Thompson and respect to the flag were given by Councilman Laughridge.

Mayor Terence Roberts recognized Peggy Maxwell for 30 years of service and Kerry Stalnaker for 42 years of service and their commitment to the City of Anderson Community with a plaque and kind words. City Manager, Linda McConnell also spoke words of appreciation to Peggy Maxwell and Kerry Stalnaker for their dedication to the City of Anderson and their friendship through the years.

SPECIAL PRESENTATION

Comprehensive Annual Financial Report for FY 2016-2017 Greene Finney, LLP

Mr. David Phillips, Audit Partner, stated that the City received an unmodified opinion which is the best opinion that the City can receive. He also stated that the City had received the GFOA Award for Excellence in Financial Reporting for 22 years in a row. Also, Mr. Phillips shared the following highlights:

• General Fund – Fund balance increased $1,100,000. The unassigned fund balance is $9,600,000.

• Hospitality Fund – Fees increased $61,000. • Sewer Fund – Net position increased $1,300,000. • Water Fund – Net position increased $524,000. • Good financial position at June 30, 2017. • Single audit was performed on CDBG program.

APPROVAL OF MINUTES A motion by Councilman Harbin seconded by Councilman Laughridge carried unanimously (7-0) to approve the minutes of the November 27, 2017 meeting as presented.

REQUEST SECOND READING OF ORDINANCE 17-14 ESTABLISHING THE APRIL 2018 GENERAL ELECTION

City Manager, Linda McConnell said the next general election is scheduled for Tuesday, April 3, 2018 for the Municipal Council Seats for Mayor, Seats One, Three, Five, and At-Large Seat Seven. Candidates for this election shall be elected to serve a four-year term. The filing period for candidates is noon Thursday, January 18, 2018 to noon Thursday, February 1, 2018. The filing for candidacy shall be initiated at the Anderson County Registration and Elections Office at 301 N. Main Street. Upon completion of the necessary candidacy forms, payment of the $300 (Mayor) $200 (Council) filing fee shall be submitted to the City Clerk and Treasurer at City Hall, 401 S. Main Street. The last day to register to vote in the April 3, 2018 election is Saturday, March 3, 2018 A motion by Councilman Chapman seconded by Councilman Newton carried unanimously (7-0) to approve Ordinance 17-14 establishing the April 2018 General Election on Second Reading.

REQUEST CONSIDERATION OF AN APPOINTMENT TO THE MUNCIPIAL ELECTION COMMISSION

City Manager, Linda McConnell said the Municipal Election Commission is composed of three people who serve six-year terms. The Commission is charged with the task of conducting the municipal elections. However, in 1994, the City transferred responsibility for the actual conduct of the elections to the Anderson County Registration and Elections Commission. This was done in an effort to provide for the uniformity in the conduct of municipal elections statewide. Thus, the MEC now serves more in an oversight capacity by certifying ballots, election results, etc. Time commitment is minimal due to the election process occurring every two years. However, the MEC members are required to attend local training as well as state wide training thus some travel is required. The current three-member Commission is composed of David Ford, Clara Humphrey, and Mrs. Renee Fields York. Mr. Ford’s term extends through December 31, 2017, Ms. Humphrey’s term extends through December 31, 2019, and Mrs. Renee Fields York’s term extends through December 31, 2022.

Mr. Ford is willing to continue serving in this capacity. The staff recommends his reappointment to the MEC for a term of service through December 31, 2023. A motion by Councilman Laughridge seconded by Councilman John Roberts carried unanimously (7-0) to approve re-appointment of David Ford to the Municipal Election Commission for a term of service through December 31, 2023.

REQUEST CONSIDERATION OF APPOINTMENTS FOR MUNICIPAL JUDGES

City Manager, Linda McConnell said Josh Allen, Richard E. Thompson, Jr., Robert B. King, Jr., Goetz Eaton and Stacy Blair were previously appointed to 2-year terms beginning July 1, 2015 and ending June 30, 2017. Josh Allen has been designated Chief Judge for the Municipal Court. These judges have received training and held their respective terms of court and assigned responsibilities. City Code Sec. 58-2 specifies that municipal judges shall be appointed by Council for a term not less than 2 years nor more than 4 years. No additional funding is required. The Public Safety Committee and staff recommend that Josh Allen, Richard E. Thompson, Jr., Robert B. King, Jr., Goetz Eaton and Stacy Blair be reappointed for a two-year term to run from July 1, 2017 to June 30, 2019. It is also recommended that Josh Allen continue as Chief Judge of the Municipal Court. Note: The City contracts with Anderson County for the judicial services of Matt Lollis and no changes or terms are necessary for him to continue to serve. A motion by Councilman Chapman seconded by Councilman Laughridge carried unanimously (7-0) to approve Josh Allen, Richard E. Thompson, Jr., Robert B. King, Jr., Goetz Eaton and Stacy Blair be reappointed for a two-year term to run from July 1, 2017 to June 30, 2019.

REQUEST CONSIDERATION TO PURCHASE MOBILE PRINTERS FOR THE POLICE DEPARTMENT

City Manager, Linda McConnell said the Anderson Police Department seeks Council funding authority in order to purchase (50) HP Office Jet 200 mobile printers and (50) HP62 black ink cartridges. The department also requests funding for (57) vehicle printer stands. Police Chief, Jim Stewart said the roadmap that the Information Technology Department has developed for the Anderson Police Department includes the implementation in July of 2017 the new and much improved RMS system along with tablet/laptops with the help of mifi hotspots which give officers remote access to retrieve and enter criminal justice information without the need to come into the department headquarters. This has allowed for more time out in the field, patrolling and less time in the office. Beginning January 1, 2018, the state of South Carolina is requiring all state law enforcement agencies to begin implementing the entering of electronic traffic tickets, also called e-ticketing, from the patrol car. In order to facilitate e-ticketing, the implemented tablets and mifi hotspots will utilize mobile printers for all patrol and traffic vehicles in use by the APD. The Information Technology department has state contract pricing Hewlett Packard Columbia, SC for the purchase of the (50) HP Office Jet 200 mobile printers and (50) HP62 black ink cartridges. The department has also secured (3) bids for printer stands. The IT department has previous experience with GPScity.com and recommends the bid for purchase.

1. GPScity.com $15,973.45 – Las Vegas, NV. 2. GPSCheap $15,463.41 – Van Nuys, CA. 3. Just Mounts / GPSZone $16,810.95 – Ardmore, OK.

The Anderson Police Department and Information Technology staff recommend to purchase (50) HP Office Jet 200 mobile printers and (50) HP62 black ink cartridges for $12,902.50 from Hewlett Packard and printer stands from GPScity.com for $15,973.45, total $28,875.95. Funding will be provided from the police department budget. A motion by Councilman Laughridge seconded by Council Member Thompson carried unanimously (7-0) to approve the purchase of (50) HP Office Jet 200 mobile printers and (50) HP62 black ink cartridges for $12,902.50 from Hewlett Packard and printer stands from GPScity.com for $15,973.45, total $28,875.95.

REQUEST CONSIDERATION OF ORDINANCE 17-15 REGARDING THE SALE OF CITY OWNED PROPERTY LOCATED AT THE CORNER OF EAST MARKET AND SOUTH MAIN STREETS

City Manager, Linda McConnell said this is consideration of a proposal and to negotiate a contract for the sale of city owned property located downtown with boundaries of the property fronting South Main, East Market, and South McDuffie Streets. The property is currently serving as part of the East Church Street parking lot. Pursuant to the Procurement Code for the City of Anderson, the City of Anderson publicly advertised for requests for proposals (RFPs) to purchase parcels located in the East Church Street parking lot. Based upon the proposals received, the City Council has agreed to sell the property. The sale of the property will benefit the City of Anderson because it will enhance the activity base of the Central Business District in a way that meets a desired niche for downtown. In addition, the property will be returned to the tax books. The details of this will be addressed during Executive Session.

EXECUTIVE SESSION

A motion by Councilman Newton seconded by Councilman John Roberts carried (7-0) to move into Executive Session to discuss Section 30-4-70(a)(2) – Discussion of negotiations incident to proposed contractual arrangements and proposed sale of property owned by the City of Anderson located at the corner of East Market and South Main Street. A motion by Councilman Laughridge seconded by Council Member Thompson carried unanimously (7-0) to move out of Executive Session. City Attorney, Frankie McClain will continue negotiations on the sale of the property. A motion by Councilman Harbin seconded by Councilman Laughridge carried unanimously (7-0) to approve Ordinance 17-15 regarding the sale of City owned property located at the corner of East Market and South Main Streets on First Reading.

ORDINANCE NO. __18-01______ AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON AUTHORIZING THE APPROVAL OF A CONTRACT AND THE EXECUTION OF A DEED TO CONVEY REAL ESTATE LOCATED AT EAST CHURCH STREET PARKING LOT

WHEREAS, the City of Anderson has previously determined that parcels of land located at the East Church Street Parking lot in the City of Anderson is surplus property, and

WHEREAS, pursuant to the Procurement Code of the City of Anderson, the City

of Anderson publicly advertised for requests for proposals to purchase the property; and WHEREAS, City Council has directed that a contract be negotiated for the sale of

the property. NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL

FOR THE CITY OF ANDERSON THAT: 1. The Mayor of the City of Anderson is hereby authorized to execute a contract, to be negotiated, for the sale of the property and, upon closing, to execute a deed conveying the property located in the East Church Street parking lot with boundaries of the property fronting South Main, East Market, and South McDuffie Streets and further identified as Anderson County Tax Map Numbers 123-30-29-012, 123-30-29-011, 123-30-29-010, 123-30-29-009, majority portion of 123-30-29-008, south side portion to the line of the common drive on 123-30-29-007. Title/Description: New Business Request: Consideration of an ordinance to annex and zone to RM-18, Multi-Family Residential 520/522 and 524/526 Simpson Road. ________________________________________________________________________ Executive Summary: Background: The applicant requests to annex and zone 2 parcels of land, each with a duplex building. These properties have been in the ownership of Calvary Home for Children for ten years, and they would like to annex them so they will be under the same jurisdiction as their campus. The majority of the Calvary Home for Children property is already inside the city limits. The portion of the Calvary Home for Children that is inside the City is already zoned RM-18, Multi-Family Residential, which allows such a campus. Therefore, designating the RM-18 classification on the subject parcels will allow them to be in conformance for campus-related uses. It also allows multi-family uses, so the duplexes can remain for residential occupancy. Benefit: N/A Funding: N/A Recommendation: Approval. Date: January 8, 2018 Agenda Item No: B-2 City of Anderson Council Agenda Title/Description: New Business Request consideration of resolutions authorizing execution and delivery of an agreement between the City of Anderson and the City of Clemson; Town of Williamston; and Town of West Pelzer to provide for the transfer of law enforcement officers on a temporary basis to work in law enforcement in the other municipality. ______________________________________________________________________________ Executive Summary: Section 23-1-210 of the Code of Laws of South Carolina (1976, as amended) provides that law enforcement officers may be transferred on a temporary basis to work in law enforcement in other municipalities or counties in this state under the conditions set forth in said section and pursuant to an agreement entered into by the entities stating the conditions and terms of the temporary employment of officers to be transferred. Background: Municipalities are authorized by the South Carolina Code of Laws to enter into Mutual Aid Agreements for the benefit of the citizens. Section 23-1-210 of the Code of Laws for South Carolina specifically authorizes an agreement for the transfer of law enforcement officers to work in law enforcement in any other municipality or county in the state. Prior to any transfer, the concerned municipalities are required to enter into a written agreement stating the terms of the temporary employment of all officers to be transferred. The City of Clemson; Town of Williamston; and Town of West Pelzer desires to enter into such agreement with the City of Anderson Police Department for the purpose of securing to each other the benefits of mutual aid in the event of natural disaster, disorder, or other emergency situations. *All three Mutual Aid Agreements read the same with the exception of the name of the city. Benefit: The citizens of the City of Anderson and the City of Clemson; Town of Williamston; and Town of West Pelzer will benefit by having enhanced law enforcement response in the event of natural disasters, disorder, or other emergency situations. Funding: General Fund Recommendation: It is recommended that Council pass the resolutions authorizing the execution of the Mutual Aid Agreements with City of Clemson; Town of Williamston; and Town of West Pelzer. _____________________________________________________________________________ Action Requested: X Resolution

RESOLUTION NO. ________ AUTHORIZING THE EXECUTION AND DELIVERY OF AN AGREEMENT BETWEEN THE CITY OF ANDERSON AND THE CITY OF CLEMSON TO PROVIDE FOR THE TRANSFER OF LAW ENFORCEMENT OFFICERS ON A TEMPORARY BASIS TO WORK IN LAW ENFORCEMENT IN THE OTHER MUNICIPALITY.

WHEREAS, the City of Anderson, South Carolina and the City of Clemson, South Carolina are incorporated municipalities located in Anderson and Pickens County, South Carolina, and as such have all powers granted to municipalities by the Constitution and general laws of this State; and

RESOLUTION NO. 17- A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON, SOUTH CAROLINA AUTHORIZING THE CLOSURE OF FIRST AVENUE TO VEHICULAR TRAFFIC AND ALTERING THE USE. WHEREAS, the Couth Carolina Code of Laws, as amended, Section 5-27-150 provides that Mayor and Council of the City of Anderson may lay out and open new streets, close up, widen or otherwise alter streets whenever it may be necessary for the improvement, necessity, or convenience of the City and its citizens, and WHEREAS, First Avenue has been closed to traffic for approximately 2 years due to the defective condition of the street, and WHEREAS, it is the desire of the City Council to permanently close First Avenue to vehicular traffic and alter its use to pedestrian and bicycle traffic for the convenience of the citizens of Anderson. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON THAT:

Title/Description: New Business Request consideration of a contract with Alliance Consulting Engineers, Inc. for engineering and administration services for the Under the Bridge Project. __________________________________________________________________________________________ Executive Summary: Background: The City has continued its public investment in Downtown based upon the Vision Plan’s premise that public improvements serve as catalysts for private investment and reinvestment. The City’s Capital Improvement Projects (CIP) serve as a roadmap to guide public investment that supports economic growth. The “Under the Bridge” project has been on the City’s CIP list since FY14. The City was awarded a grant of $30,000 from the SC National Heritage Corridor for this project. On June 26, 2017, City Council approved the funding of this project with a budget estimate of $145,809 (City funding of $115,809 and $30,000 from SCNHC). Benefit: The Murray Avenue Bridge/Under the Bridge Project is a stimulant to the ongoing vibrancy of downtown. The SCNHC grant provides a boost to another part of our economic ecosystem and strengthens the City’s position along the Heritage Corridor Discover Route. This puzzle piece that connects Main Street will showcase our City’s walkability, arts and culture, and serve as a continuing magnet for economic growth. It can create visual interest, a sense of place, and become an attraction amenity. Additionally, it can provide an opportunity to expand the east-west connections and development potential. Contract specifics: The proposed contract is with Alliance Consulting Engineers, Inc. for professional services. The contract price of $11,600 includes the boundary and topographic survey, conceptual design, and construction cost opinion for the Under the Bridge Project.

Funding: Total estimated budget funding was approved previously by City Council utilizing TIF and Hospitality funds and the grant funds received by the South Carolina National Heritage Corridor Grant. (City funding of $116,000 and $30,000 from SCNHC).
