APPLICANT: Renaissance Holding Co., LLC PROPOSAL: A conditional use permit to allow an automobile repair facility in a portion of an existing office warehouse building. ZONE: B-2, General Business District SIC CODE: 75 LOCATION: 3315 Military Highway, South TAX MAP SECTION/PARCEL: 0252011000481 BOROUGH: Deep Creek

PLANNING COMMISSION RECOMMENDATION:

Planning Commission recommends that UP-13-23 be APPROVED with the following stipulations: (9-0; Williams/Perry)

1. The owner/applicant agrees to construct the outdoor storage area with opaque fencing, minimum 6 feet in height, and to install a Buffer Yard “D”, minimum 15 feet in width, as required by Section 19-610 of the City Zoning Ordinance, as generally shown on the sketch plan, Planning date stamped November 5, 2013, prior to the issuance of a Certificate of Occupancy. The owner/applicant further agrees to obtain a Development & Permits Civil right-of-way permit prior to the installation of a fence in a city drainage/access easement.

2. The owner/applicant agrees that all repair work shall be conducted inside of the building and there shall not be any outside storage of junked or dismantled motor vehicles, merchandise, parts, tires, batteries, debris or other articles.

3. The owner/applicant agrees to take all available measures to prevent the leakage of fluids from motor vehicles brought on the site, including but not limited to, the following:

a. All motor vehicles shall be inspected for leakage when first brought to the site. The drainage of motor vehicle fluids shall only occur within a building in compliance with EPA and DEQ regulations.

b. Oil absorbent chemicals shall be kept readily available on site at all times and shall be used whenever needed to clean up spills or leaks of automotive fluids or other potential harmful substances.

Mrs. Hanson read UP-13-23 into the record for Commission review and action.

Mrs. Hanson stated that based on sound planning practices, Planning staff recommended that UP-13-23 be APPROVED with the stipulations as listed in the official agenda.

COMMISSION VOTE:

Commissioner Williams moved that UP-13-23 be APPROVED with the stipulations as listed in the official agenda and as recommended by staff. Commissioner Perry seconded the motion. The motion was carried by a vote of 9 - 0.
