SUBJECT: PRIMA FACIE CITYWIDE SPEED LIMITS — ORDINANCE
Recommended Actions:
1. Find that this Ordinance is subject to CEQA categorical exemption Class 1
pursuant to the CEQA Guidelines, respectively, Title 14, California Code ofRegulations Sections 15301; and
2. Introduce an Ordinance of the City Council of the City of Aliso Viejo, California,Amending the Aliso Viejo Municipal Code Declaring Prima Facie Speed Limits onCertain City Streets.
Fiscal Impact:
The only fiscal impact resulting from this ordinance is the cost of replacing speed limitsigns which will be approximately $ 1, 000.
Background:
The California Vehicle Code is specific in its mandate for the performance of
engineering and traffic surveys in regard to speed limits. In particular, Chapter 7 of theState Vehicle Code provides that " prima facie" speed limits established under Sections
22352, 22354, 22354. 5, 22357, 22358, 22358. 3 may not be enforced by radar unlessthe speed limit has been justified by an engineering and traffic survey within the last fiveyears. All local agencies must conduct engineering and traffic surveys to provide thefollowing:
1. Raise State dictated " prima facie" limits above 25 miles per hour;2. Lower the otherwise permitted maximum speed of 65 miles per hour; and
3. Enforce speed limits by the use of radar equipment.
The City Council must adopt the results of the engineering and traffic study and mustprovide copies of the study to anyone who requests them.
Aliso Viejo City Council most recently adopted speed limits on City streets by ordinanceon January 16, 2013.

Section 22350 is the basis of all speed zone legislation in that it states, "No person shall
drive a vehicle upon a highway at a speed greater than is reasonable or prudent..."considering external conditions such as road conditions, weather, and other traffic.Secondly, the Vehicle Code has established certain " prima facie" speed limits ( Section22352), which may not be exceeded unless the operator of a motor vehicle can provethat it is safe to do so under the Basic Speed Law. Specifically, these prima facie limitsare:
1. 15 miles per hour in traversing a railroad grade crossing;2. 15 miles per hour in an alley;3. 15 miles per hour at an uncontrolled intersection with restricted sight distances;
4. 25 miles per hour in business or residence districts;
5. 25 miles per hour in school zones when children are present; and
6. 25 miles per hour when passing a senior center.
The local agency may reduce the standard 25 mile-per-hour school speed zonesbetween 20 and 15 miles per hour, if justified by an engineering and traffic studySection 22358.4), but in no event may it be raised above 25 miles per hour.
Additionally, the local agency may raise speed limits in business and residence districtsto 30, 35, 40, 45, 50, 55, 60 or 65 miles per hour, if justified by an engineering andtraffic survey. Finally, all other speed limits are set by an engineering and traffic studywhich determines the " reasonable and prudent" speeds at which the majority of driverstraverse a given street.
The recommended..posted speed limits are based on CA MUTCD Section 2B. 13 which
states: "When a speed limit is to be posted, it shall be established at the nearest 5 mphincrement of the 85th-percentile speed of free-flowing traffic, except as shown in the twoOptions below:
1. The posted speed may be reduced by 5 mph from, the\ nearest 5 mph incrementof the 85th- oercentile speed, in compliance with CVC Sections 627 and 22358.3.
2. For cases in which the nearest 5 mph increment of the 85th-percentile speed
would require a rounding up, then the speed limit may be rounded down to the.nearest 5 mph increment below the 85th percentile speed, if no further reductionis used."
Discussion:
Staff along with Police Services is recommending adoption of these engineeringand traffic surveys in advance of their expiration date of 1/ 16/20. The speedsurveys were conducted by RK Engineering under contract to the City. In
conducting those speed surveys, vehicle speeds were measured in the field using aspeed- measuring device that had been properly calibrated according to theCalifornia Department of Transportation ( CALTRANS) Traffic Manual. In addition,
the operator of the speed- measuring device was properly trained and operatedunder the direct supervision of a California Licensed Professional Engineer. In all
cases, the City Engineer reviewed and determined that the speed surveys are valid.

The existing speed limit, recommended speed limit, 85th and 50th percentile speeds,and 10 mph pace speeds for each segment of roadway studied are shown in Table1. Collision rates for these segments are shown in Table 2.
Three ( 3) existing speed limits are recommended to be raised 5 mph by adoption ofthis ordinance.
1. Eastwing — 35 to 40 mph2. Hopseed —25 to 30 mph
3. Pacific Park Drive (Aliso Viejo Parkway to Alicia) —45 to 50 mph
It should be noted that all allowed rounding reductions were utilized so any furtherreductions would make the posted speed invalid in a court of law. A court could also
rule the City has knowingly created an unlawful speed trap which could bring uponpenalties and unnecessary liability.
There is one ( 1) segment recommended to be reduced from current posted speeds
by 5 mph based upon the measured 85th percentile speeds.
1. Enterprise ( Pacific Park to Aliso Viejo Parkway) —40 to 35 mph

AN ORDINANCE OF THE CITY COUNCIL .OF THE CITY OF ALISO
VIEJO CALIFORNIA, DECLARING PRIMA FACIE SPEED LIMITS ON
CERTAIN CITY STREETS.
WHEREAS, the City' s arterial, collector and local roadways are intended for thesafe movement of motor vehicles; and
WHEREAS, Sections 22352, 22354, 22354.5, 22357, 22358, 22358.3 of the
California Vehicle Code ( CVC) establish prima facie speed limits on all the roadways inthe State; and
WHEREAS, Sections 22352, 22354, 22354.5, 22357, 22358, 22358.3 of the
California Vehicle Code ( CVC) allows local agencies to post speed limits on city streetswhich are less than prima facie speed limits after completion of an engineering and trafficsurvey; and
WHEREAS, the City Council of the City of Aliso Viejo last established by ordinanceprima facie speed limits on City roadways in 2013; and
WHEREAS, the engineering and traffic studies used to determine prima faciespeed limits have been recently updated per the CVC, and
WHEREAS, the City Council does hereby approve the revised prima facie speedlimits on certain City streets.
WHEREAS, this Ordinance is subject to CEQA categorical exemption Class 1

SECTION 2. The Public Works Department is hereby authorized and directed to ,install and/ or upgrade any or all immediately appropriate signs giving notice of said speedlimits.
SECTION 6. This Ordinance, is enacted to update prima facie speed limits on
existing streets. Therefore, it can be seen with certainty that adoption of this Ordinancewill not have a significant adverse effect on the environment and is therefore exempt fromCalifornia Environmental Quality Act pursuant to Section 15301( c) of the_ CEQAGuidelines.
SECTION 3. This Ordinance No. 2019-XXX shall become effective when
appropriate signs giving notice of the new speed limit are posted upon the street affectedby this ordinance.
SECTION 4. The City Clerk shall certify to the adoption of this ordinance and shallcause the same to be published as required by law.
