Circular No 007/2021 Dated 12 Jan 2021 To Members of the Malaysian Bar and pupils in chambers Update: Law Firm Operations During the Movement Control Order We refer to Circular No 005/2021 entitled “Law Firm Operations During the Movement Control Order” and the media statement issued by YB Dato’ Seri Mohamed Azmin Ali, Minister of International Trade and Industry (“MITI”) earlier today. We draw Members’ attention to the “Lampiran 1, Category C, item 27” where it is mentioned that the lawyers and law firms are allowed to operate during the MCO with adherence to Standard Operating Procedure (“SOP”) and operating guidelines for the legal sector from the relevant authorities. The Bar Council is in communication with the Legal Affairs Division of the Prime Minister’s Department (Bahagian Hal Ehwal Undang-Undang Jabatan Perdana Menteri, “BHEUU”) for the SOP and operating guidelines for the legal sector.     SENIOR MINISTER

    MINISTER OF INTERNATIONAL TRADE AND INDUSTRY

    ECONOMIC SECTORS IN THE ESSENTIAL SERVICES ALLOWED TO OPERATE THROUGHOUT THE PERIOD OF MOVEMENT CONTROL ORDER (MCO) IN

    PULAU PINANG, SELANGOR, WILAYAH PERSEKUTUAN (KUALA LUMPUR, PUTRAJAYA, LABUAN), MELAKA, JOHOR AND SABAH

    1. Since 2019, the COVID-19 pandemic has impacted health and livelihoods not

    just in Malaysia, but throughout the world. As a consequence of the third wave

    of the COVID-19 pandemic, many countries around the world have tightened

    movement controls, in response to current developments and situations.

    2. The Government has always been committed in mitigating the spread of

    COVID-19. The Government will continue to adopt a proactive and responsive

    approach taking into into account the advice and views of public health experts

    in introducing firm and effective measures in order to break the chain of

    infections of the COVID-19 virus. At the same time, the Government will

    continue to take all efforts to ensure the continuance of economic activities to

    bring prosperity and well being to the rakyat.

    3. The Ministry of International Trade and Industry (MITI), as the ministry

    responsible for the development and growth of industry, trade and investment

    in the country, is always receptive of views from the industry associations and

    chambers of commerce. These views are pertinent in facilitating the

    Government to strike a balance between the imperative of health protection and

    the need to generate and revitalise the country's economic sectors. As a result

    of continuous engagements and constructive consultations with industry

    associations, chambers of commerce and other stakeholders, MITI has

    formulated a set of comprehensive, relevant and practical Standard Operating

    Procedures (SOPs). These SOPs will enable the smooth flow of operations and

    ensure effective implementation of Business Continuity Plan, particularly for the

    duration of MCO, beginning 13 January 2021 until 26 January 2021.

    4. The Government's decision to allow five (5) essential economic sectors

    including manufacturing to operate is to ensure the country's economic

    recovery process, business sustainability, avoid high unemployment rates

    among Malaysians and ensure people continue to gain access to basic and

    critical neccesities, throughout the MCO period. The six (6) states under MCO

    are the main drivers of the country's economic activities and major contributors

    to the country's Gross Domestic Product (GDP), totalling 66.3 per cent of the

    total GDP. The state of Selangor’s contribution to GDP is at 24.2 per cent,

    Federal Territories (16.9 per cent), Johor (9.4 per cent), Penang (6.7 per cent),

    Sabah (6.0 per cent), and Melaka (3.1 per cent).

    5. This proactive action by the Government will have a positive impact on the

    country's economic growth, local and foreign investment flows as well as the

    sustainability of Small and Medium Enterprises. Among the important

    considerations also taken into account by the Government is the need to ensure

    the stability of the country's export activities as Malaysia is one of the key

    players in the global supply chain ecosystem. The sectors of the economy in

    essential services that are allowed to operate during the MCO period are

    detailed in Appendix 1. This Appendix covers the manufacturing sector under

    the oversight of MITI, and the construction, services, trade and distribution

    sectors, as well as plantations and commodities under the jurisdiction of other

    ministries and agencies. SOPs for the manufacturing sector under the purview

    of MITI can be downloaded from the MITI website at www.miti.gov.my.

    6. Companies that have registered with the MITI database, namely COVID-19

    Intelligent Management System (CIMS) through the link

    https://notification.miti.gov.my do not need to re-register to operate during the

    MCO period. These companies are only required to download the notification

    of registration confirmation, beginning today, 12 January 2021, at 3.00 pm.

    7. Manufacturing companies in essential services that have not registered with

    CIMS can do so at the link https://notification.miti.gov.my from 3.00 pm, 12

    January 2021. The notification of registration confirmation can be downloaded

    by the company upon completion of registration.

    8. The afore-mentioned process of registration (via CIMS) only applies to

    companies in the manufacturing sector under the purview of MITI. It is the

    responsibility of the employer to download the notification of registration

    confirmation in order to enable the movement of their employees during the

    MCO period. Employees of the company who are allowed to be at work

    according to the specified times are required to bring along a copy of the

    notification provided by the employer together with the employee pass /

    employer confirmation letter. This is to facilitate the movement of commercial

    vehicles as well as the movement of workers between residence and work

    place. MITI has informed the Royal Malaysia Police regarding this matter to

    facilitate movement during roadblock operations.

    9. In line with the objective of curbing the spread of the COVID-19 pandemic, only

    30 percent of employees in the management group are allowed to be in the

    office. The number of support staff and employees directly involved in the

    production line will be determined by their respective employers, taking into

    account strict compliance to the SOP.

    10. For work that does not require physical attendance, the Work From Home

    (WFH) directive will apply. The Government calls on the industry and the private

    sector to enhance the implementation of WFH as a new norm, in line with the

    advances of the latest technologies and online applications.

    11. In order to prevent the pandemic from becoming more critical, the Government

    and the private sector must work together to control and break the chain of

    transmission. This is essential to protect the health and safety of the people

    and accelerate the economic recovery process.

    12. It cannot be over-emphasised that it is the duty and responsibility of the industry

    to comply with the MCO and SOP set by the Government. MITI, in collaboration

    with the relevant state authorities, will conduct periodic enforcement throughout

    the MCO period on companies to ensure compliance with SOPs and will take

    action to compound offences in accordance with Section 25 of the Prevention

    and Control of Infectious Diseases Act (Act 342). Employers who fail to comply

    with the SOP will be subject to legal action, including closure of premises.

    13. MITI has also provided a list of frequently asked questions (FAQ) to assist the

    industry in obtaining detailed and accurate information on SOPs set by the

    Government to enable the manufacturing sector to operate during the MCO

    period.

    14. As the country's economic front liners, MITI will continue to foster a conducive

    and business-friendly environment that enables economic activities to operate

    and grow.

    LABUAN), MELAKA, JOHOR DAN SABAH

    1. Pandemik COVID-19 yang menular sejak tahun 2019 telah memberi kesan

    kesihatan dan kelangsungan hidup bukan sahaja di Malaysia, tetapi di

    seluruh dunia. Berikutan penularan gelombang ketiga pandemik COVID-

    19, banyak negara-negara di seluruh dunia telah mengetatkan kawalan

    pergerakan mengikut perkembangan dan situasi semasa di negara

    masing-masing.

    2. Kerajaan sentiasa bertanggungjawab dalam menangani penularan wabak

    COVID-19. Kerajaan akan meneruskan pendekatan proaktif dan responsif

    dengan memperhalusi semua nasihat pakar-pakar kesihatan awam untuk

    melaksanakan tindakan yang tegas dan efektif bagi memutuskan rantaian

    jangkitan penularan virus COVID-19. Pada masa yang sama, Kerajaan

    akan terus berusaha untuk memastikan kelangsungan aktiviti ekonomi

    dicapai bagi menjamin kemakmuran negara dan kesejahteraan rakyat.

    3. Kementerian Perdagangan Antarabangsa dan Industri (MITI) sebagai

    sebuah kementerian yang bertanggungjawab ke atas pembangunan dan

    perkembangan aktiviti industri, perdagangan dan pelaburan negara

    sentiasa terbuka menerima pandangan yang dikemukakan oleh

    persatuan-persatuan industri dan dewan-dewan perniagaan. Pandangan

    industri adalah penting untuk membantu Kerajaan mencapai

    keseimbangan di antara perlindungan kesihatan dan keperluan menjana

    serta merangsangkan semula sektor ekonomi negara. Hasil daripada libat

    urus dan kerjasama dengan persatuan industri, dewan perniagaan dan

    lain-lain pihak berkepentingan, MITI telah merangka Prosedur Operasi

    Standard (SOP) yang komprehensif, relevan dan praktikal. SOP ini akan

    membantu kelangsungan operasi serta pelan kesinambungan syarikat

    (business continuity plan) dan industri khususnya dalam tempoh Perintah

    Kawalan Pergerakan (PKP) bermula 13 Januari 2021 sehingga 26 Januari

    2021.

    4. Keputusan Kerajaan membenarkan lima (5) sektor ekonomi perlu

    (essential economic sectors) termasuk pengilangan dan pembuatan untuk

    beroperasi adalah bagi menjamin proses pemulihan semula ekonomi

    negara, kemampanan perniagaan, mengelak kadar kehilangan pekerjaan

    yang tinggi di kalangan rakyat Malaysia dan memastikan rakyat terus

    mendapat akses keperluan asas dan kritikal sepanjang tempoh PKP.

    Enam (6) buah negeri yang dikenakan PKP merupakan pemacu aktiviti

    ekonomi utama negara dan penyumbang yang besar kepada Keluaran

    Dalam Negara Kasar (KDNK) negara iaitu 66.3 peratus daripada jumlah

    keseluruhan KDNK. Negeri Selangor menyumbang kepada KDNK negara

    sebanyak 24.2 peratus, Wilayah Persekutuan (16.9 peratus), Johor (9.4

    peratus ), Pulau Pinang (6.7 peratus ), Sabah (6.0 peratus ), dan Melaka

    (3.1 peratus).

    5. Tindakan yang bertanggungjawab ini akan dapat memberi impak positif

    khususnya dalam usaha Kerajaan memastikan pertumbuhan ekonomi

    negara, pelaburan tempatan dan asing serta kelangsungan Perusahaan

    Kecil dan Sederhana. Di antara pertimbangan penting yang turut diambil

    kira oleh Kerajaan adalah keperluan untuk menjamin kestabilan aktiviti

    eksport negara memandangkan Malaysia merupakan salah satu negara

    utama dalam eko-sistem rantaian bekalan global. Sektor-sektor ekonomi

    dalam perkhidmatan perlu yang dibenarkan beroperasi dalam tempoh

    PKP adalah seperti yang diperincikan di Lampiran 1. Lampiran ini

    merangkumi sektor pengilangan dan pembuatan di bawah kawal selia

    MITI serta sektor-sektor pembinaan, perkhidmatan, perdagangan dan

    pengedaran, serta perladangan dan komoditi di bawah bidang kuasa

    Kementerian dan Agensi lain. SOP bagi sektor pengilangan dan

    pembuatan yang di bawah tanggungjawab MITI boleh dimuat turun dari

    laman sesawang MITI di www.miti.gov.my.

    6. Syarikat-syarikat yang telah berdaftar dengan pangkalan data MITI iaitu

    COVID-19 Intelligent Management System (CIMS) melalui pautan

    https://notification.miti.gov.my tidak perlu membuat pendaftaran semula

    untuk beroperasi dalam tempoh PKP. Syarikat-syarikat yang berkenaan

    hanya perlu memuat turun surat notifikasi pengesahan pendaftaran yang

    boleh dimuat turun mulai hari ini, 12 Januari 2021 bermula jam 3.00

    petang.

    7. Syarikat-syarikat sektor pengilangan dan pembuatan dalam perkhidmatan

    perlu yang belum berdaftar dengan CIMS boleh berbuat demikian di

    pautan https://notification.miti.gov.my mulai pukul 3.00 petang, 12 Januari

    2021. Surat notifikasi pengesahan pendaftaran boleh dimuat turun oleh

    syarikat selepas pendaftaran.

    8. Pendaftaran ini hanya terpakai untuk syarikat-syarikat dalam sektor

    pengilangan dan pembuatan di bawah seliaan MITI. Majikan

    bertanggungjawab untuk memuat turun surat notifikasi pengesahan

    pendaftaran untuk membolehkan pergerakan pekerja dalam tempoh PKP.

    Pekerja syarikat yang dibenarkan untuk berada di tempat kerja pada satu-

    satu masa adalah wajib membawa sesalinan surat notifikasi pengesahan

    pendaftaran yang dibekalkan oleh majikan bersama pas pekerja/surat

    pengesahan majikan. Ini bertujuan mempermudahkan pergerakan

    kenderaan komersial dan juga pergerakan pekerja antara kediaman dan

    tempat kerja. Pihak MITI telah memaklumkan kepada pihak PDRM

    berhubung perkara ini bagi memudahkan pergerakan di operasi sekatan

    jalan raya (SJR).

    9. Selaras dengan objektif untuk mengekang penularan pandemik COVID-

    19, hanya 30 peratus pekerja dalam kumpulan pengurusan dibenarkan

    berada di pejabat. Manakala jumlah pekerja kumpulan sokongan dan

    pekerja-pekerja yang terlibat secara langsung dalam production line akan

    ditentukan oleh majikan masing-masing dengan mengambil kira

    pematuhan ketat SOP yang ditetapkan.

    10. Bagi kerja-kerja yang tidak memerlukan kehadiran secara fizikal, arahan

    Bekerja Dari Rumah (BDR) akan berkuatkuasa. Kerajaan menyeru pihak

    industri dan swasta mempertingkatkan pelaksanaan BDR sebagai norma

    baharu selari dengan kecanggihan teknologi terkini dan aplikasi atas

    talian.

    11. Kerajaan dan pihak swasta perlu berganding bahu untuk membendung

    dan memutuskan rantaian penularan jangkitan COVID-19 daripada

    menjadi lebih kritikal demi melindungi kesihatan dan keselamatan rakyat

    dan mempercepatkan proses pemulihan ekonomi.

    12. MITI ingin menegaskan kewajipan dan kebertanggungjawaban pihak

    industri untuk mematuhi arahan PKP dan SOP yang ditetapkan oleh

    Kerajaan. MITI dengan kerjasama Pihak Berkuasa Negeri akan

    menjalankan penguatkuasaan secara berkala di sepanjang tempoh PKP

    ke atas syarikat-syarikat untuk memastikan pematuhan SOP dan akan

    mengambil tindakan mengkompaun kesalahan selaras dengan Seksyen

    25 Akta Pencegahan dan Pengawalan Penyakit Berjangkit (Akta 342).

    Majikan yang didapati melanggar dan tidak mematuhi SOP akan dikenakan

    tindakan undang-undang termasuk menutup premis berkenaan.

    13. MITI juga telah menyediakan senarai soalan-soalan lazim (FAQ) untuk

    membantu pihak industri dalam mendapatkan maklumat terperinci dan

    tepat mengenai SOP yang ditetapkan oleh Kerajaan bagi membolehkan

    sektor-sektor pengilangan dan pembuatan untuk beroperasi dalam

    tempoh PKP.

    14. Sebagai barisan hadapan ekonomi negara, MITI akan terus memastikan

    persekitaran dalam negara yang kondusif dan mesra-perniagaan bagi

    merancakkan aktiviti-aktiviti ekonomi beroperasi dengan lancar dan terus

    berkembang.

    CADANGAN SENARAI PERKHIDMATAN PERLU

    ii. Entiti-entiti pasaran modal yang dilesen, didaftar atau

    dikawalselia oleh Suruhanjaya Sekuriti Malaysia.

    21. Perkhidmatan perbandaran dan kerajaan tempatan:

    i. Pajak gadai/kredit komuniti (syarikat peminjam wang berlesen);

    ternakan adalah pada waktu malam);

    input ternakan dan produk berkaitan industri ternakan (termasuk

    eksport dan import); dan

    iii. Pengurusan kesihatan, diagnosa penyakit dan rawatan haiwan.

    26. Utiliti (air dan tenaga);

    27. Perkhidmatan profesional (termasuk akauntan/ peguam/ auditor/

    jurutera/ arkitek), saintifik (termasuk R&D) dan teknikal (termasuk

    penyenggaraan);

    28. Perkhidmatan Kawalan Keselamatan (Security Services);

    29. Keselamatan dan Pertahanan;

    30. Pengangkutan melalui darat, air dan udara;

    31. Perkhidmatan dan pengusahaan pelabuhan, limbungan dan
