Dear Mr. Kalman:
In August 2003, Cimarron Corporation (Cimarron) submitted a license amendmentrequest proposing the deletion of License Condition 22. Condition 22(c), which wasissued with License Amendment #9 (dated December 30, 1992) reads, "CimarronCorporation (Kerr-McGee) shall provide to the Oklahoma State Department ofHealth whatever information is required to satisfy state requirements on thepresence/absence of potentially toxic substances or any other nonradioactiveconstituents of the fill and cover soil." NRC recently requested documentationdemonstrating that Cimarron has fulfilled this license condition.
On February 25, 1993, Cimarron met with Oklahoma State Department of Health(OSDH) personnel to discuss metal concentration data that had been provided toOSDH. OSDH required additional sampling and analysis for organic compounds.This meeting and the data needs were documented by OSDH in a letter dated March30, 1992 (it is erroneously dated 1992).
On April 7, 1993, Cimarron personnel met with OSDH to identify the specificsamples needed, and to develop a list of the compounds for which they would beanalyzed. Cimarron documented that meeting in a letter dated April 8, 1993.

The samples were collected on May 4, 1993 and submitted to Armstrong ForensicLaboratory for analysis. Cimarron reported the results of the sampling and analysis,and submitted the laboratory analytical report to OSDH on June 1, 1993.
Cimarron has enclosed a copy of all three letters and the laboratory data package,which demonstrate that license condition 22(c) has been fulfilled. If you havequestions or comments, please call me at 405-642-5152.

This letter is to confirm the Solid Waste Management Service's (SWMS) position regardingthe soil you intend to use for the closure of the "Burial Ground" and the "Old SanitaryLagoon" at the Cimarron Corporation's Cresent, Oklahoma site that we discussed in ourFebruary 25th meeting at the Oklahoma State Department of Health.
The Solid Waste Management Service's involvement in this closure is primarily to satisfyparagraph C of Condition 22 of Cimarron Corporation's Nuclear Regulatory License #SNM-928. The selection of an undeveloped area of the Cresent site as a source of cover materialfor the closure of its "Burial Ground:" and "Old Sanitary Lagoon" greatly simplifys the SolidWaste Management Service's task of determining "the presence/absence of potentially toxicsubstances or any other nonradioactive constituents of the fill and cover soil."
The metals analysis of the proposed "fill and cover soils" that Kerr McGee has providedindicates that the metals content of the proposed "fill and cover soils" are not contaminatedwith quantity of metals that would be considered toxic. However, the Solid WasteManagement Service would like a more detailed description of the location where the "filland cover soils" will be obtained and the activities which have occurred in that area in thepast to verify the validity of this conclusion.
The anylisis that has been provided to the SWMS to date, does not fully adress the potentialfor the presence of organic constituants in the "burial ground", the "old sanitary lagoon", orin the proposed "fill and cover soils". The SWMS requests that you obtain representativesamples of the soil currently left in the "burial ground" and "old sanitary lagoon" areas aswell as your proposed "fill and cover soils" and preform a GC/MS scan to determine if thereare any potentialy toxic constituants present.

Dear Mr. Houts:
Thank you for meeting with me on April 7 to discuss theDepartment's March 30 letter concerning the cover and fill of theformer sanitary lagoons and waste burial area at the Cimarronfacility. As summarized below, the additional information theOklahoma State Department of Health (Department) would likeCimarron to provide was clarified and acceptable sampling andanalytical procedures were defined.
Additional Information
The Department acknowledges adequate sampling has been done todemonstrate the absence of radiological and most non-radiologicalsubstances of potential concern. The Department notes, however,that the extensive sampling and analytical program has not focusedon certain organic substances, such as hydrocarbons and solvents.Thus, before backfilling the structures, the Department would liketo have soil from the bottom of the lagoons and the burial trencharea analyzed for volatile constituents that were or may have beenused in the facility operation. The backfill material also will beanalyzed for these constituents. Cimarron agrees to analyze soilfrom these locations and provide the results to the Department.
Samplino and Analysis
A random number table will be used to select aidintersections in the lagoons and burial area at which aliauots ofsoil will be removed and comDosited to provide separate samples foreach.. The area from which necessary backfill material will beobtained will also be sampled similarly.
The three comoosite samples will be taken in accordance withEPA approved Procedures as described in 'PA SW-846. The sampleswill be submitted so a laboratory meeting QA/QC requirements as

specified by EPA Method 8240. The analysis will be performed usingthe TCLP and Method 8240 for volatile organics. The attached liststhe substances that will be analyzed.
Cimarron will inform the Department at least a day in advanceof collecting the samples. The Department may at its conveniencehave a representative present when the samples are obtained.However, a Department representative is not a requirement.

Dear Mr. Houts:
Cimarron Corporation has completed the soil testing discussedwith you on April 7, 1993 and summarized in my letter to you onApril 8, 1993. The results of the analyses are attached for thesamples from the two lagoons, the former waste burial area and thedesignated backfill material area.
The analyses show listed RCRA volatile organics are notdetectable. In addition, priority pollutant volatile organics arenot detectable, with the exception of 1,1,1- Trichloroethane, whichwas indicated in three of the four samples at 0.03 to 0.05 partsper million (ppm).
To our knowledge, 1,1,1- Trichloroethane was not used in theprocessing activities previously carried out at the Cimarronfacility. The very low levels noted also are far below the U.S.Environmental Protection Agency's lifetime health advisory level of0.2 ppm for drinking water.
In light of these data, we plan to proceed with backfillingthe lagoons and former waste burial area in accordance with theU.S. Nuclear Regulatory Commission license amendment previouslyprovided to you.
