Abstract of Part I - PreliminaryInterpretation of “factory”.All premises (factories)are covered under this act [details of the interpretation can be found in the Act] unless;a)any premises used for the purposes of housing locomotives or vehicles where only cleaning, washing, running repairs or minor adjustment are carried out.b)Any premises where five or less persons carry on any work in which machinery is not in used.

“Machinery” includes steam boiler [1], unfired pressure vessels [2], fire pressure vessel [3],

pipelines [4], prime movers [5], gas cylinders [6], gas holders [7], hoisting machines [8] [ eg lift,

escalator, crane] and hoisting tackle [9] [ eg. Chain, ring, pulley block], transmission

machinery [10], driven machinery [11], material handling equipment [12] , amusement

device [13] , or any other similar machinery and any equipment for the casting, cutting, welding or electro-deposition of materials and for the spraying. By means of compressed gas or air of materials or other materials but does not include;a)Any machinery used for the propulsion of vehicles other than steam boilers or steam enginesb)Any machinery driven by manual power other than hoisting machinesc)Any machinery used solely for private or domestic purposesd)Office machines

[1] any closed vessel in which for any purpose steam is generated under pressure greater than atmospheric pressure and includes any economiser used to heat water being fed to the vessel, and any superheat used for heating steam, and any pipes and fittings connected thereon.

[2] any enclosed vessel under pressure greater than atmospheric pressure by any gas or mixture or combination of gases and includes any vessel under pressure of steam external to the steam boiler and any vessel which is under pressure of a liquid or gas or both, any vessel subject internally to a pressure less than atmospheric pressure but does not includes gas cylinder

[3] means an enclosed vessel under pressure greater than atmospheric pressure which is subjected to direct firing, but does not include a steam boiler

[4] means every engine, motor or other appliance which provides mechanical energy derived from air, steam, water, wind electricity, combustion (fuel pr other sources)

[5] means the physical facilities or any part of the physical facilities through which dangerous substances which may cause fire, explosion or adverse health effects to any person (other than petroleum or petroleum products) in the form of liquid or vapour or any combination of liquid or vapour are transported, and includes pipes, pumps, compressors, meters, regulators and fabricated assemblies.

[6] means a steel cylinder or bottle used for the storage and transport of compressed, dissolved or liquefied gases

[7] means any bell-shaped structure floating in a tank of water, in which gas is collected for distribution[8] means lifts, escalator, hoist, crane, sheer legs, gin, crab, winch, excavator, teagle, runway, transporter or

piling frame and allied equipment.[9] includes a chain or rope sling, ring, link, hook, shackle, swivel, eyebolt, chain, rope, pulley block and chain

block.[10] means every shaft, wheel, drum, pulley, system of fast and loose pulleys, coupling, clutch, driving belt or

other device by which the motion of a prime mover or other source of mechanical power is transmitted to or received by any machine or appliance.

[11] includes any machine or appliance where motion is received from transmission machinery.

Part I - Glossary

[12] means any power driven equipment for handling materials, and includes forklift, conveyor, stacker, excavator, tractor, dumper or bulldozer but does not include hoisting machine;

[13] means any contrivance or a combination of contrivances, or rides, equipment or plant or any other similar device which are designed or intended to entertain or amuse people and which can be installed repeatedly without loss of substance, whether temporarily or permanently, at fairs, amusement parks or other locations;

Abstract of Part II – Safety, Health and WelfareProvisions relating to “SAFETY”.

a) Foundations and floor shall be of sufficient strength to sustain the loads.

b) Roofs shall be of sufficient strength to carry where necessary suspended loads.

c) All floors, working levels, platforms, decks, stairways, passages, gangways, ladders and steps shall be safe construction.

d) Every opening, sump, pit or fixed vessel in a floor, or working level shall be securely covered or securely fenced to prevent risk of persons falling.

e) All goods, articles [14] and substances which are stored and stacked shall be ;-

(i) Best ensure stability and prevent any collapse of the goods, articles or

substances or their supports; and(ii) not to interfere with the adequate distribution of light,

ventilation, proper operation of machinery, and etc.

Abstract of Part II – Safety, Health and Welfare

Provisions relating to “HEALTH”

a) Every factory shall kept in a clean state and free from offensive effluvia arising from any drain, sanitary convenience or other source.

b) The maximum number of persons employed (at any time, any work-room and in any factory) shall not be less than cubic feet of space/ superficial feet of floor area per person.

c) Securing and maintaining adequate ventilation by the circulation of fresh air.d) Securing and maintaining such temperature to ensure condition of comfort

and prevention of body injury.e) Securing and maintaining sufficient and suitable lighting, whether natural or

artificial in every part of a factory in which persons are working or passingf) Sufficient and suitable sanitary conveniences shall be provided and maintained

for the use of persons in a factory

Abstract of Part II – Safety, Health and WelfareProvisions relating to “WELFARE”

a) Persons employed shall be provided;(i) adequate and suitable accommodation for clothing not worn during

working hours; and(ii) such arrangement as are reasonably practicable for drying that clothing

b) Suitable places shall be provided and maintained reasonably accessible to all persons employed therein;(i) an adequate supply of safe and wholesome drinking water; and(ii) adequate and suitable facilities for washing which shall be kept in clean

condition

c) Accessibility of a first-aid box or cupboard of the prescribed standards

d) First-aid room shall be provided and maintained when there are more than one hundred and fifty persons (150) are employed at any one time.

Abstract of Part IV – Notification of Accident, Dangerous Occurrence and Dangerous Diseases

a) Need to report to the nearest Inspector whenever any accident as follows;(i) causes loss of life of person (fatal)(ii) causes bodily injury to any person that preventing him from working for

more than four (4) days.(iii) causes serious damage to machinery or other property.

Abstract of Part VI – Generala) Penalties;- any person who contravenes sections 19(1), 31, 34(1), 36(1), 37,

38(1), 39(1), 40(3) be liable to a fine not exceeding five thousand dollars (5,000)

Note;S31-Report of accidentS40(3)- every engineer or dredgemaster [15] in charge of any machinery and every occupier of a factory

shall as soon as he becomes aware of any defect therein which is likely to cause bodily injury to any person or damage to any property. Make a good or remove the said defect, and if the engineer, dredgemaster or occupier is unable to make good or remove the said defect he shall cease to operate such machinery or use such part or parts of the factory and forthwith make a report thereon to an Inspector

b) Any person who contravenes any other provision of this Act, be liable to a fine not exceeding two thousand dollars (2,000)

c) Continuing offence, be further liable to a fine not exceeding one hundred dollars (100) for each day .

Note: [15] dredgemaster means a person who hold a dredgemaster’s certificate of competency. Dredge means any floating structure used for the winning of tin ore, for the dredging of rivers and water-ways or for purposes of land reclamation and includes the bucket type dredge and the cutter-suction type dredge

ExemptionAny factory or machinery operated;-a) By the armed forcesb) By agreement with the Government c) Any machinery which is subject to the law relating to merchant shipping.

Any factory and machinery operated bya) The Federation Government & State Government shall be exempted form

provision of sections 34, 35, 38 & 48.b) Section 36,37,39,40 & 43 only in respect of machinery other than steam

boilers, steam receivers and lifts; andc) The Railway Administration shall be exempted from provisions of sections 34,

35, 38 & 48 and Sections 36, 37 only in respect of machinery other than lifts.
