NEW DOCUMENTATION REGULATIONS – ALL TRADES To our esteemed customers An increasing amount of Carriers are time being implementing profound changes to their documentation deadlines. In the desire to streamline documentation processes, in view of the European 24 Hour Advanced Manifest Rule, which will be enforced as from dec. 31

st, 2010 as well as in regards to the EU Compliance requirements, Ocean

Carriers need to receive B/L instructions latest on the FCL closing date. Thus, in order to comply with their requirements and to enable us to conduct Compliance assessments in due course, we consequently have to inform you of the following changes to our B/L deadlines:

This number is an unique Tax Identification Code. The new regulation requires that every import shipment into the Argentinian territory, must be show the Tax Identification Code (CUIT)into the field of consignee and notify in both Master B/L and each single HB/L without exception. NCM (Harmonized Code) – For each single shipment and each commodity the 6 first digits must appear into the each HOUSE bill of lading (not into the MASTER bill of lading) Please note that if this information does not appear on the documents listed, the Customs will not allow cargo registration and it will then be blocked. This will result in a Customs Fine which will be billed to origin customer/shipper and will also create a delay which might cause more additional destination charges such as storage charges. The system will grant the Brazilian authorities complete automated access to all data of imported and transshipped cargoes. All Shipping Lines, NVOCC's and freight forwarders will be forced to input the essential data of the shipments into the system to fixed deadlines. Violating these deadlines will lead to heavy fines imposed by the Brazilian authorities as well as an automatic blocking of the shipments from import clearance. All later amendments can only be arranged by an official correction letter to the Brazilian Customs Authorities and may result in additional fines being imposed by the authorities. BILL OF LADING CORRECTIONS

With the implementation of Siscomex Carga there are two possible ways to send a BL Correction Request:

a) Correction e-mail can be sent until 72 (seventy-two) hours after vessel's departure. In these cases a new set of Original BL will be reissued and exchanged by the previous set of Original BL already delivered to Shippers b) Any correction send after 72 (seventy-two) hours after vessel‟s departure must be sent via official Correction Letter form, which will be delivered to Brazilian Customs after vessel‟s berthing. Note - Brazilian Customs only accepts Correction Letters to a maximum period of 30 running days after vessel‟s arrival at discharge port, as long as there is no Customs entry by consignee.

The system will automatically be blocked 48 hours prior to vessel arrival, and no further input is possible later.

FINES AND CHARGES

Depending on the kind of violation of Brazilian laws, fines may reach a level of upto BR$ 50.000,-. A catalogue of fines in English language is available upon request. Cost for B/L amendments will be as follows EUR 180,00 / Amendment Re-issuing of Bills of Lading at destination EUR 35, / Bill of Lading With immediate effect, the packaging in Bills of Lading has to be completely detailed. Example as per below: Now reads: 10 packages spares 1210,- kgs - NO LONGER ALLOWED Needs to read: 2 wooden pallets 560,- kos 2 plastic drums 220,- kos 1 wooden crate 200,- kos 5 cardboard boxes 230,- kos It is mandatory to mention every single package type separately (including the material, the packaging is made of...plastic...wood...cardboard etc.) with the single weight for every package type !! Non-compliance with this regulation will result in correction letters, which are due to be fined by Brazilian customs with BR$ 5000,- (USD 2900,-) per package amendment !!!

Implementation of Chinese Advanced Manifest System (filing): The trial period of early presentation of the manifest is currently applied. Chinese Customs has made it mandatory for

carriers to present their complete cargo manifests 24 hours before arrival of the vessel in the port of loading. For this reason our shipping instruction (manifest) to the carrier is required 72 hours before arrival of the vessel in the port of loading. Chinese Customs informed the carriers that timely presentation of the instructions will be strictly controlled...... meaning no instructions /no load. In order to comply to these regulations, please make sure to send us your shipping instructions no later than 12.00 hrs on day of cargo delivery as mentioned on our booking confirmation. In case shipping instructions are missing at time of container stuffing, we have no other alternative than to transfer your shipment to the next sailing.
