Kroger Sues LidlOver Private Label

Kroger Co. is suing a new ri-val in the U.S. supermarket sec-tor, accusing German discounterLidl of using a private label too

similar to its own.Kroger said Lidl’s “Preferred Se-

lection” brand infringes on the “Pri-vate Selection” label the Cincinnati-based grocer uses on thousands ofproducts that brought in nearly $2billion in sales last year.

“This mark will confuse custom-ers,” Kroger wrote in a complaintfiled last Friday in U.S. DistrictCourt in Virginia. The company saidthe strategy undermined Lidl’spromise to offer U.S. shoppers anovel shopping experience.

Lidl is opening 20 stores inthe U.S. this summer, with 10now operating and four more tobegin running next week.

A Kroger spokeswoman saidthe company is “extremelyproud” of its store brands. A Lidlspokesman declined to commenton the case but said Lidl’s U.S.offerings have been “positivelyaccepted by our customers.”

Audi Ex-ManagerCharged in Scandal

A former engine-developmentmanager at Audi was charged inthe U.S. for his role in a wide-ranging emissions scandal atVolkswagen AG that has al-ready led to the indictment ofsix others and a $2.8 billion finefor the German auto maker, U.S.authorities said Thursday.

Giovanni Pamio worked ashead of thermodynamics fordiesel engine development atAudi, Volkswagen’s luxury unit.He was accused of working tohelp implement software de-signed to cheat U.S. emissionstests in thousands of Audi“clean diesel” vehicles. He wascharged with conspiring to de-fraud the U.S., violating theClean Air Act, and wire fraud.

Mr. Pamio, described by theJustice Department as a 60-year-old Italian citizen, couldn’t be lo-cated for comment. A Volks-wagen spokeswoman said thecompany “continues to cooperatewith investigations by the U.S.Department of Justice into theconduct of individuals. It wouldnot be appropriate to commenton any ongoing investigations orto discuss personnel matters.”

The Association for Accessi-ble Medicines, which repre-sents more than 20 generic-drug companies includingTeva Pharmaceutical Indus-tries Ltd. and Mylan NV, filedits lawsuit in federal court inMaryland against the state’sattorney general and secretaryof the health department.

The lawsuit argues the lawoverreaches because it wouldaffect pricing decisions inother states and that it toovaguely defines what consti-tutes price gouging. It also al-leges the law violates the U.S.Constitution’s commerce anddue-process clauses.

The new law defines pricegouging as an increase that is“excessive and not justified bythe cost of producing the drugor the cost of appropriate ex-pansion of access to the drug

to promote public health.”The lawsuit says the law

amounts to a “sweeping pricerestraint” with terms “sovague as to leave the state of-ficials tasked with implement-ing and enforcing the lawnearly unbounded discretion.”

The lawsuit asks a federaljudge to issue an injunctionagainst the implementationand enforcement of the law,and a declaration that it is un-constitutional and invalid.

A spokeswoman for Mary-land Attorney General BrianFrosh, a Democrat, said the of-fice is reviewing the lawsuit.Maryland Gov. Larry Hogan, aRepublican, allowed the law tobecome enacted without hissignature because he had con-cerns it wouldn’t withstand le-gal challenges, he said in a let-ter to the speaker of theMaryland House of Delegatesin May.

A trade group for the ge-neric-drug industry filed alawsuit Thursday seeking toblock Maryland’s new lawaimed at curbing steep priceincreases for generic drugs,the first law of its kind in theU.S.

Among other exceptions described below, theGeneral Claims Bar Date does not apply to claims of any governmental unit (as defined in section 101(27) of title 11 ofthe United States Code (the “Bankruptcy Code”)). 1. THE BAR DATES The Bar Date Order establishes the following bar dates for filing proofs of claim in these cases(collectively, the “Bar Dates”): (a) The General Claims Bar Date Pursuant to the Bar Date Order, except as described below, all entities holding claims

against the Debtors that arose or are deemed to have arisen prior to the commencement of these cases are required tofile proofs of claim by the General Claims Bar Date (i.e., by August 8, 2017 at 5:00 p.m. Eastern Time). These cases werecommenced on January 29, 2017 (the “Petition Date”). The General Claims Bar Date applies to all types of claims againstthe Debtors that arose prior to the Petition Date, including secured claims, unsecured priority claims (including, withoutlimitation, claims entitled to priority under sections 507(a)(4) and 507(a)(5) and 503(b)(9) of the Bankruptcy Code) andunsecured nonpriority claims.
