 State and Federal Lobbying Restrictions Federal and state laws restrict the use of public funds for lobbying activities.  The use of federal funds for lobbying expenses is prohibited.  State law requires the reporting of lobbying activities and restricts activities paid for with public funds.  However, activities such as research and recommendations on public policy, providing information to legislators when requested, educating the public, and working with state and federal agencies are not considered “lobbying” and are allowed.  What is Lobbying? "Lobbying" is an attempt to influence the passage or defeat of laws, appropriations, resolutions, or similar items by Congress or a state or local legislative body; or to influence the adoption of an agency rule or regulation.  Prohibited Activities Two types of activities are generally considered to be lobbying:   Direct lobbying is communicating with a member or an employee of Congress or a state or local legislative body, or with a government official who may participate in the formulation or amendment of legislation, in an attempt to influence the passage, amendment, or defeat of legislation, budget appropriations, or agency regulations.  Direct lobbying involves expressing a view on the passage of a specific bill, budget item, or other measure. Direct lobbying also includes advocating for increasing one’s own funding from the federal government.  "Grassroots" lobbying is communicating with the general public concerning proposed legislation when the communication calls upon members of a particular group or of the public to contact legislators or government officials to support or oppose specific legislation or regulations. This type of “call to action” is also referred to as “third party lobbying.”  Allowable Activities Activities related to the development and adoption of public policy and budgets are allowable if they do not attempt to influence passage or defeat of a particular legislative measure or rule. For

example, meetings with legislators or staff to provide objective and educational information about health issues or the need for particular health insurance services, and other general information, is not considered to be lobbying.  Similarly, responding to requests from a Member of Congress or Legislator for information or data is also not considered to be lobbying.  Working with state agencies to develop or analyze policy proposals, and educating the public about issues and potential solutions, are also usually not considered lobbying.  Whether an activity is allowable or is prohibited “lobbying” often depends on the facts of a particular situation.  If you are unsure or have questions, you can contact the Legislative Team for advice.
