CENTERARTS/UNIVERSITY CENTER/fflJMBOLDT STATE UNTVERSITY/A.S. PERFORMANCE RIDER THIS AGREEMENT is hereby made a part of the attached contract. 1. rNDEMNIFICATI0Ns. THIS AGREEMENT is hereby made a part of the attached contract.

1. rNDEMNIFICATI0Ns. Artist(s) and Artist’s Representatives shall hold harmless, indemnify, anddefend the State of California, the Trustees of the California State University, Humboldt State University,CenterArts, University Center, HSU Associated Students, and the officers, employees, volunteers andagents of each of them from and against any and all liability, loss, damage, expenses, costs of everynature, and causes or actions arising out of or in connection with the Artist’s use or occupancy of thepremises, provided that such claims, demands, losses, liabilities, Costs or expenses are due or are claimedto be due to the willful or negligent acts or omissions of Artist or Artist’s personnel.

8. UNIVERSITY POLICY PROHIBiTS ALCOHOLIC BEVERAGES OR CONTROLLEDSUBSTANC~ES ON CAMPUS.

9. Total catering budget shall not exceed the amount budgeted and accepted by the performer’srepresentative in the original offer.

10. ORAL REPRESENTATION AND AlNv~~’s No representation warranty, condiUon, oragreement of any kind or nature whatsoever shall be binding upon the parties hereto unless incorporatedinto attached Contract and this RIDER. 11. CenterArts/TJnjversity Center will not pay for hotel, any services (including but not limited to groundtransportation, the cost of backline equipment), or any equipment not listed as available in the Van DuzerTheater technical specifications packet, regardless of whether or not they are listed as requirements in theArtist’s rider, unless these requirements are specifically written into the payment section of the contractface for this engagement, as well as the deal memo for this engagement, if a deal memo has been issued.

12. CenterAJts/TJniversjty Center will withhold appropriate California State Franchise Tax in accordancewith the laws of the State of California, as directed by the California State Franchise Tax Board. Suchwithholding tax, if required, shall be deducted from the artist’s guarantee.

13. AGREEMPNT CONSTRUED This Agreement shall be construed and endorsed according to thelaws of the State of California. Waiver of any default shall not constitute waiver of any subsequent orother default. All rights of the parties hereto shall insure to the benefit of their successors and assigns,and all obligations of any of the parties hereto shall bind his, her, or its heirs, executors, personalrepresentatives successors and assigns. A fully executed contract for this engagement shall be deemed anacceptance of the terms in this rider, regardless of whether or not this rider has been countersjgned by theartist or an authorized representative of the artist.

GQNDWANA RIDER1. All basic and correct specifications annexed to this Rider are indispensable for the show tobe successful and run smoothly.

This RIDER is an “Annex of the Contract”, therefore any change, omission or non-compliance ofthis Annex, shall be considered as “Breach of Contract”.

Some of the technical specifications may be adapted to each different Venue, however,reasonable changes may be considered if notified in advanced (at least five days prior toshow date), suggested changes should be made in only writing

STAFF FOR THE ARRIVAL AT THE VENUE:

The PROMOTER will make sure that everything is ready at the venue when Artist staffarrives in order to begin setting up the equipment on stage without delay. There must be 3carpeted pallets located as per stage plot which is being sent with the RIDER. The lightingplant must be ready and working properly. Backline should be mounted per RIDER. Soundalso should be working at this time with every channel ready per RIDER.At this time each person who is responsible for the Venues electric plant, audio equipment,lighting equipment, backline, production manager and stage manager, should be present atthis time.

LIGHTING AND MONITOR TECHS:The PROMOTER shall provide a lighting tech and monitor tech for the show ofGONDWANA, he shall be responsible for the costs of both. They should be present upon ~Q~1 ~v”staff arrival to the Venue.

OBSERVATIONSThe PA system that is chosen should be installed, tested and ready to function atleast two hours prior to sound check time.After the sound check the system may not be moved, disconnected or readjustedwithout previous approval from the band sound engineer, road manager or artistmanager.The system must have sound amplification (Crown, Crest or similar), AC cables (live,neutral and ground), electricity and light plant of 100KW at 220 Volts.
