Newsletter 2015-22 June 19, 2015 CAWV ANNUAL MEETING SOLD OUT; WAITING LIST STARTED Attendance is great for this year’s CAWV Annual Meeting which will be held July 9-12 at The Greenbrier. The CAWV’s room block is sold out although the hotel has superior rooms available at a higher rate. Members wishing to attend can be placed on a wait list if rooms become available. The association has booked additional rooms at the Hampton Inn in Lewisburg for those wishing to be guaranteed accommodations for the meeting. The CAWV Program Committee has put together an excellent schedule of events. Senate President Bill Cole, House Speaker Tim Armstead, AGC President Chuck Greco and Secretary of Transportation Paul Mattox will be part of the business sessions. Golf, trap and fishing tournaments are scheduled for Saturday. Receptions will be held Thursday and Friday evening with the President’s Banquet on Saturday evening. Members have received information on sponsorship opportunities. “I am glad so many members will be attending this year’s meeting,” said Program Committee Chairman Roger Thomas. “We have a number of issues affecting our industry that we need to discuss. The meeting gives us the opportunity to learn from one another and address our members’ concerns,” he said. To be added to the wait list, please contact Wendy Long at [email protected] or call (304) 342-1166. 2015-2016 BOARD OF DIRECTORS BALLOTS SENT TO CONTRACTOR MEMBERS Contractor members received an official ballot for election of officers and directors of the CAWV for 2015-2016. For each office, the nominee with the largest vote will be declared elected at the association's General Business Session at the Annual Meeting, July 19-12, at The Greenbrier, White Sulphur Springs. Please mark and return the ballot by July 3, 2015. OVER 5,000 CONTRACTORS RECEIVE PREVAILING WAGE SURVEY The state’s new prevailing wage law requires WorkForce West Virginia to determine prevailing wage rates for public works construction projects. As part of this determination process, WorkForce mailed over 5,200 surveys on June 16 to all construction contractors in the state. WorkForce notes that all information will be kept confidential and will not be published to allow identification of firms. The survey requests companies report non-owner labor and non- residential construction hours performed on the construction site for the work weeks of August 12, November 12, February 12 and May 12. Information about the wages and benefits paid to construction workers defined in the survey must include: the geographical location where the work was performed; all construction workers by skill level (except apprentices); all non- residential construction work performed during the survey period, both prevailing and non- prevailing work; and all fringe benefits. WorkForce wants contractors to return the survey by June 26 but they indicate contractors can take more time if necessary.

As reported in the CAWV June 12 CAWV Newsletter, the Joint Committee on Government and Finance questioned WorkForce West Virginia’s decision to conduct a survey instead of using U.S. Bureau of Labor Statistics published wages. Legislators did not agree with WorkForce’s methodology and did not extend the July 1 deadline for establishing 2015 prevailing wage rates. The question is whether prevailing wage on public projects will be in effect for projects after July 1. Discussions are still being held and it is expected this question will be resolved by July 1. AGC OF AMERICA OFFERING FREE TWO-PART WEBINAR ON CONFINED SPACES AGC of America is offering a two-part webinar on confined spaces which is free to CAWV members. Part one, titled “The New Confined Spaces in Construction: What’s Different”, will be held on Tuesday, June 23 from 2:00-3:00 P.M. Part two, titled “The New Confined Spaces in Construction: The Big Picture”, will be held on Tuesday, June 30 from 2:00-3:00 P.M. For more information, please refer to this week’s CAWV Municipal/Utility Bulletin. CAWV SUMMER OUTING AT KING'S ISLAND, JULY 24 - REGISTER NOW FOR THE FUN! The CAWV is pleased to invite members to join fellow members and their families at Paramount’s King’s Island on Friday, July 24. Each ticket includes a full day’s admission to the theme park and water park along with lunch at the incredible price of $62 per adult (ages 3+), or $40 for children (ages 0-3). A buffet style lunch will be served from 2:30 pm - 4:30 pm in the picnic grove. The all-you-can eat buffet includes southern fried chicken, Montgomery Inn pulled pork barbeque sandwiches, hot dogs, hamburgers, macaroni and cheese, baked beans, pasta salad, soft drinks, juice boxes and much more. For additional information contact Wendy Long at (304) 342-1166 or [email protected]. 2015 AGC OF AMERICA WORKFORCE SURVEY IS AVAILABLE AGC of America has released the 2015 AGC Workforce Survey. They continue to hear from many members that the labor market has become tighter since they last surveyed its members about the extent of workforce shortages. While it is clear that worker shortages are a growing concern, and in some cases a significant problem, for many contractors, it is important to continue efforts to better quantify where these shortages are taking place, how severe they are, and what steps firms are taking to both cope with tight labor markets and improve the supply of new, qualified workers. Survey responses will help better define the problem to elected and appointed officials, the media, educators and peers within the business community. CAWV encourages all members to participate in the survey. The deadline is Friday, July, 17. Please take a few minutes to complete the workforce survey by clicking here. FAYETTE COUNTY SCHOOL BOND DEFEATED The Fayette County School Bond was defeated despite a groundbreaking voter turnout and the closest bond tally since 1974. While typical special elections see a voter turnout of only 10 percent, the election saw a 26.5 percent turnout. The $39 million bond, along with an expected $25 million from the state School Building Authority, would have been used to build a new elementary school in Mount Hope, a new middle school in Oak Hill, while renovating Midland Trail, Oak Hill and Valley high schools. About 61.9 percent of voters opposed the bond call Saturday, as 4,662 ballots rejected the measure and 2,870 supported it. Total voter turnout was 7,532, significantly more than the 5,856 who voted in 2001 and 5,980 in 2009. JOINT ARCHITECTS COMMITTEE MEETING JUNE 24 Chairman Tripp Dailey has scheduled a meeting of the CAWV Joint Architects Committee on Wednesday, June 24, at 10:00 A.M. at the CAWV headquarters. Several industry issues will be on the agenda including: the recently proposed changes to the School Building Authority of West Virginia Policy and Procedures Handbook; the recent ruling by the Legislative Auditor’s office that deals with the change order approval and payment processing; and West Virginia Division of Highways Maintenance Division Director Kyle Stollings will attend the meeting to discuss details of the nine WVDOH maintenance headquarters building projects that are being developed as Public-Private Partnership (P3) projects. Committee members will also receive updates from the various committee task forces. Heavy Equipment

The primary sources of injury to operators and other personnel working around heavy equipment are:

1. Repairing and servicing equipment in dangerous positions. 2. Striking individuals or other vehicles with the equipment, particularly its blade. 3. Unexpected violent tipping of the equipment. 4. Uncontrolled traffic within or through the work area. 5. Unexpected violent shocks or jars to the machine. 6. Sudden movement of a power unit while it is being attached to earth moving equipment. 7. Limbs of trees or overhead obstructions. 8. Leaving earth moving or other equipment in dangerous positions while unattended. 9. Failure of lifting mechanisms.

General Operating Precautions:

1. Machines should be maintained in good working order. All vital parts such as motors,

chassis, blades, blade holders, tracks, drives, hydraulic and pneumatic mechanisms, and transmissions should be thoroughly inspected each day.

2. Before starting a job, the operator should be given instructions regarding the work to be done.

3. Before using the starting motor, the operator should check to make sure that all operating controls are in the neutral position.

4. Machines should be operated at speeds and in a manner consistent with conditions on the particular job.

5. At no time should a piece of equipment be left unattended while the motor is running, especially if the machine is on an inclined surface or on loose material.

6. If possible, equipment should be driven entirely off the road at night. When any portion of the machine projects into the road, it should be adequately marked with red lights or flares. Red flags should be used in daytime.

7. Personnel should stop motors and refrain from smoking during refuelling operations. 8. The operator should keep deck plates or steps on equipment free from grease, oil, ice

and mud. Corded soles shoes are recommended. 9. Employees, other than operator, should not ride on equipment. 10. Operators should not wear loose clothing, which can get caught in moving parts of

equipment.

WVBT BOARD TO MEET The Board of Directors of West Virginians for Better Transportation will meet Tuesday, June 23, to elect new directors and chart a course of action for the next 12 months. WVBT is comprised of over 300 companies and organizations that have joined together to express concerns about West Virginia’s transportation crisis and to call on state leaders to develop long-term solutions. The group sponsors “Transportation Day at the Capitol” which brought over 200 people to Charleston January 19 to promote the need to invest in West Virginia’s highways. Many CAWV members have contributed to WVBT’s efforts to properly fund a safe and modern highway system in the state. Members who would like to become involved in WVBT can sign up on their website at www.keepwvmoving.org STILL NO SELECTION OF FIRM TO AUDIT WVDOH OPERATIONS H.B. 2008 was passed this session of the legislature which will require a full audit of the operations of the WVDOH, including the ten districts. Legislative leaders said it is necessary to see how the division is spending its dollars before providing additional money. The audit, which can cost up to $500,000, must be completed by December 31, 2015. The CAWV expressed concern that the bill’s original completion date of February 1, 2016 would preclude any action on highway funding in next year’s legislative session. Four firms, mostly accounting and financial companies, have expressed interest is submitting proposals for the audit. As of this week, there is no timetable for selecting the firm. Given the amount of work that would be associated with this type of audit, meeting a December 31 deadline could be an impossible task if an award is not made soon and work begins quickly. WVDOH AGGREGATE PO CONTRACTS - CURRENT AND FUTURE ISSUES - INPUT NEEDED The WVDOH and the state Purchasing Division are still working on the award of the three Aggregate Purchase Order (PO) contracts that were bid on April 9. As vendors know, the current contracts expired on March 31. The bids are reportedly at Purchasing and/or the Attorney General’s office for final approval. If approved by the end of the month, which appear likely, the new contracts will only have three months remaining in their six month term. The move to wvOasis appears to be the primary source of delays associated with the award of these contracts. The WVDOH Maintenance Division, the division that originates and administers these contracts, is proposing that the next contract be for a term of one year. This would be a one-time only basis and the WVDOH would return to six month contracts upon completion of the one-year contract. This contract would be advertised in the very near future with an effective date of October 1, 2015, running until September 30, 2016. Again, this would be a new contract and bidding opportunity with a term of one year. The goal of moving from a six month to one year term would be to give the state more time to adapt to the new wvOasis system.

These contracts historically were a one year contract but were changed several years ago to a six month term at the request of industry. The state recognized industry’s concern with a volatile fuel market. Members may remember that the association tried to establish a fuel index for the aggregate contracts, similar to the asphalt PO contracts. No workable index solution could be found to address trucking and barge delivery. The solution at the time was to bid the contract twice a year, giving vendors another opportunity to update pricing. CHARLESTON MAYOR REQUESTS INCREASE IN CITY’S ROAD FUND Charleston Mayor Danny Jones wants council members to commit $1.1 million from the city’s stabilization fund into the city’s road fund. The current road fund is $1.6 million, which is all from its user fee. The stabilization fund, an account dedicated to emergencies or budget shortfalls, currently has over $5 million. “We want to lead in that arena,” Jones said of the proposal. Funding Charleston’s infrastructure is going to be a challenge Jones said. The Charleston mayor made the request after he and other city officials were sworn into the newest term. HOUSE WAYS AND MEANS CHAIRMAN WANTS REPATRIATION, NOT GAS TAX House Ways and Means Committee Chairman Rep. Paul Ryan (R-Wis.) said Wednesday that he is "against raising the gas tax" as lawmakers seek a solution for the looming gap in highway funding. Transportation advocates have pushed for a gas tax increase to help pay for a long-term extension of an infrastructure funding measure that is scheduled to expire on July 31. But Ryan started off a long-awaited hearing on the topic of infrastructure funding by ruling out such a hike. The gas tax, currently 18.4 cents-per-gallon, has been the traditional source of transportation funding since its inception in the 1930's. But the tax has not been increased since 1993, and improvements in auto fuel efficiency have sapped its purchasing power. The federal government typically spends about $50 billion per year on transportation projects, but the gas tax only brings in approximately $34 billion annually. The Congressional Budget Office has estimated it will take about $100 billion to close the gap long enough to pay for a six-year transportation funding bill, which is the length being sought by the Obama administration and transportation supporters. Despite that reality, Ryan said Wednesday that he is adamantly opposed to the idea of increasing the gas tax to help close the gap. Lawmakers have turned to other areas of the federal budget to close the transportation funding gap in recent years, resulting in temporary fixes such as the two-month patch that was approved by lawmakers last month. Transportation advocates have complained that the temporary extensions are preventing states from completing long-term infrastructure projects that are badly need. “This is not just an esoteric debate about a line item in a budget," American Trucking Associations President Bill Graves, who has advocated for a gas tax hike, told the panel in testimony submitted before Wednesday's hearing. "Congress’ actions have real consequences, and the decisions this committee makes will determine whether a business succeeds or fails and whether a job is created or eliminated," Graves continued. "And most importantly, these decisions will determine the safety of the motoring public as well as the safety and efficiency of the millions of professional drivers operating daily on our highway system.”

Ryan blamed Democrats for blocking efforts to pass a transportation funding extension that would have lasted until the end of the year, which he said would have given lawmakers more time to work on a permanent infrastructure funding solution. "I was hoping last month that we could have extended the highway trust fund through the end of the year, but that ran into last-minute opposition," he said. "It’s going to be difficult to reach consensus on a permanent solution." Ryan has previously signaled he would prefer an alternative plan that would tax overseas corporate revenue to pay for a long-term transportation bill. The proposal, known as "repatriation," calls for giving business a reprieve from penalties for avoiding prior taxes if they agree to move money back to the U.S. and pay a 6.5 percent tax rate on it. The Obama administration has also embraced the repatriation proposal, but the president has argued tax on overseas profits should be mandatory and collected at a higher rate.Democrats argued during Wednesday's hearing that a gas tax increase is long overdue since the fuel levy that pays for the nation's roads has not been raised in more than two decades. "We haven’t made any meaningful adjustment since 1993 to the gas tax, relying on short-term fixes, gimmicks – and no matter how you slice it, adding to the deficit," said Rep. Earl Blumenauer (D-Ore.), who has introduced legislation to increase the gas tax by 15 cents. The Oregon lawmaker noted that the idea of increasing the gas tax has been supported by both unions and business groups in a rare display of agreement between the two sides. “We have a unique alignment between business, labor, local government, professions, small business, truckers, AAA, bicyclists and transit," Blumenauer said.
