CASE

The business profit of T LDT,. A tea growing and manufacturing company , rs 120 lacs (before deduction under section 33AB) for the A.Y 2013-14. it deposits Rs.50 lacs with NABARD for claiming deduction under section 33AB.its want to claim set-off of brought forward business loss of RS 40 lacs . Find out the taxable income for the A.Y 2013-14

ANSWER

An assessee engaged in growing and manufacturing tea in india ,is entitled to a deduction under section 33AB, in respect of the amount deposited by assessee to an account maintained with NABARD as per scheme approved by tea broad ,to the extent of lower of the following two amounts—

I. Amount deposited to the account maintained with NABARD within 6 month from the end of the previous year or before the due for filling the return of income , whichever is earlier ;

II. 40% of profits of such business computed under the head “profits and gain from business or profession” before making any deduction under this section .

The above deduction will be allowed before setting off brought forward business loss under section 72

The balance business loss of rs 11.20 lakhs (i.e rd40lakhs - rs 28.80) can be carried forward to the next year , assuming that the time limit of 8 years for carry forward of business loss has not expired.
