January 5, 2015
Call to order at 6:00 PM at the Cascade Town Hall Baord Room.
Members present: Supervisors Heathman, Atkinson, and Laures, Clerk/Treasurer Brown
Attendees present: Jim and Judy Larsen, Don and Ardith Ottman, Jim and Sandy Hoss, Chuck Wallace,
Lou and Judy Ohly, Gary and Joanne Sieck, Char Brown.
Chairman Laures called for additional agenda items. Clerk Brown requested an item be added to review
the proposed Auditor contract.
Township Board Continuing Business.
Mr. Heathman requested the December 1, 2014 minutes as distributed be amended to add a
statement that Clerk Brown notified the board that he had retained private counsel in response to
the questions posed by the board regarding the audio/video recording of meetings (item 10). A
motion by Mr. Atkinson to approve the minutes from the December 1, 2014 town board meeting
as amended. Second by Mr. Laures.

A motion by Mr. Atkinson to approve and pay the Joint Powers bill (claim # 1742) of $24,138.01
provided a description is added to JPB claim 29 for CHS per the request of Mr. Heathman.

Clerk Brown discussed the lateness of claim sheets from the supervisors and the need for earlier
submittal to facilitate processing of payroll and claims. A discussion of accounting practices
related to year end claims and tax filing ensued.
A motion by Mr. Laures to set the submittal deadline as close of business the Thursday
preceding the board meeting for supervisor claim sheets. Second by Mr. Heathman.

Clerk/Treasurer Brown reviewed the financial reports.
Total receipts in December 2014 were:

5. Farmland LLC. Eng. & Attny. Fees $12,978.25
6. MMB Town aid & MV Ag credit $578.65
The Premier Bank account balance as of December 31, 2014 was $394,574.30
The CTAS balance as of the start of this meeting is $394,574.30
The total outstanding checks are:

Mail Review
Clerk Brown reviewed the mechanic’s lien release received from Farmland LLC (Majestic
Meadows).

Mr. Heathman attended the county board meeting.
Mr. Laures attended the TCPA meeting
Township Board New Business
10. Wilmar Investments; Mr. Fitzgerald
Mr. Fitzgerald appeared before the board to inquire about the resolution denying his previously
submitted re-zone application. Additional questions were asked by Mr. Fitzgerald regarding the public
hearings and the development of the various applicable ordinances and plans. The board chose to defer
the matter to the township attorney. Mr. Fitzgerald was requested to send his list of questions to the clerk
for transmission to the township attorney for response. Mr. Fitzgerald requested a copy of the comments
and response from the attorney.
11. Ordinance concerns R1 district; Mr. Hegreness
Mr. Hegreness provided the board with documentation describing his concern about the use of a
residence in an R1 district for an apparently commercial auto repair/service operation. Per TCPA no
CUP is on file to permit this activity.
o A motion by Mr. Heathman to request TCPA to send a letter to the address of concern
noting the applicable ordinance restrictions. Second by Mr. Atkinson.

12. Planning Commission - Mr. Heathman
Planning Commission Chair Brown submitted a request to the board to waive the minimum meeting
frequency requirement (at least bi-monthly) of the current Planning Commission Policy as there is no
business to conduct at the January meeting. Mr. Heathman provided a prepared amendment to the
Planning Commission Policy removing the meeting frequency requirement and adding mechanisms for
calling a Planning Commission meeting.
o A motion by Mr. Atkinson to amend the Planning Commission policy as suggested by
Mr. Heathman. Second by Mr. Laures.

The modified policy satisfies the waiver requested by the Planning Commission chair.
13. Fire Contract
The board discussed the previously circulated contract for fire services with the city of Rochester. The
board discussed contacting the city of Elgin to be detached from their fire service area so that the town
hall and maintenance shop would receive primary service from the city of Rochester along with the
remainder of the township. Mr. Laures will work with Elgin to get the township facility detached.
o A motion by Mr. Laures to accept the City of Rochester fire contract. The township
facility will be included in the service area if allowed by Elgin and Rochester. Second by
Mr. Heathman.

13.5 Rochester Fire Department MOU.
Concerns raised by the supervisors regarding facility use have been addressed. The city of Rochester
will send a revised MOU for consideration.
14. Auditor Proposal
Clerk Brown reviewed with the board the three year service proposal received from Smith Schafer for
annual audit services.
o A motion by Mr. Laures to accept the three year proposal contingent upon Rochester
Township also accepting a proposal from Smith Schafer due to the overlap of the
townships in the Joint Powers Board. Second by Mr. Atkinson.

15. Road Maintenance
No significant items
16. Town Hall Building Concerns
Mr. Heathman met with KBS. KBS will fix the front entry. KBS is not able to identify a resolution to
the gaps and corner cracking resulting from the expansion/contraction of the panelized construction. Mr.
Heathman will draft a letter to KBS re-iterating the request for resolution.
17. Town Hall Rentals
The only pending reservation is for August of 2015. In response to Mr. Heathman’s request to revisit at
a future meeting the policy as it relates to reservations by one party for multiple dates the board
discussed the reservation history and intent of having the town hall available. Per board discussion, until
the reservation requests result in multiple requests for the same date or other conflict, the policy of first
come, first served will remain. The current fee structure will remain.
18. Upcoming Meetings
OCTOA on January 22 at Oronoco
19. Call to Audience
Mr. Wilson addressed the board to state his interest in contributing to the township through volunteer
positions (e.g. Planning Commission). Mr. Wilson reviewed his background and provided the board
with his resume.
No additional comments/questions from the audience.
Mr. Laures noted that the township will receive a petition for the naming of a small creek that traverses a
portion of the township. No action is required.

ANNUAL ELECTION
WHEREAS, a Township Annual Election will be held on Tuesday, March 10, 2015, and
polls must be open from 5:00 p.m. to 8:00 p.m.; and
WHEREAS, Minnesota Statute 204B.21, subd. 2 requires Election Judges for precincts in a
municipality be appointed by the governing body of the municipality at least 25 days before
the election; and
WHEREAS, the following individuals have agreed to serve as Election Judges for the
Annual Elections and have agreed to perform all statutory duties related to the election
process.
NOW THEREFORE, BE IT RESOLVED, by the Town Board of Cascade Township,

To the Residents of Cascade Township:
Township Elections will be held on March 10, 2015 between the hours of 5:00 p.m. and 8:00 p.m. at the Cascade
Town Hall, 2025 75th Street N.E., Rochester. One Township Supervisor position will be elected this night. Write-in
votes are permissible. Additionally, the electorate will be asked to vote on 1. Expanding the board to five supervisors
(added by resident petition) and 2. Making the clerk/treasurer an appointed position (added by board motion).
At 8:15 p.m. the Annual Township Meeting will take place at the same location.
The 2016 Town Budget will be presented at the annual meeting, at which time the electors will have a chance to discuss,
modify, amend, and vote on the proposed budget. The general areas of tax money spent are for general fund, road repair,
fire protection, public safety, capital improvement and reserve fund.
Items on the Annual meeting agenda, subject to modification by township residents, will include:
1) Approval of 2014 annual meeting minutes
2) Board of Audit report
3) Proposed town budget for 2016
4) Gopher bounty.
5) Introduce Public Safety representatives if available. (Deputy Miller)
6) Permits – burning, buildings, driveways, & TCPA.
7) Cascade Township Website (www.cascadetownship.us)
8) Review Storm Water Pollution Prevention Program with residents for good housekeeping measures.
9) Concerns and comments from the electorate.
10) Road report and issues of concern (trash containers, snow, parking, etc.)
Storm Water Education:
Report to Township Officers any illicit discharge and dumping in ditches to help prevent storm water pollution. We
are required by state and federal law to establish programs and reporting mechanisms to reduce the discharge of non-
storm water and pollutants into our waterways. For more information please see the Storm Water link at

Road Maintenance and Snow Removal:
Please help our road crews maintain and clear our roadways. Place your trash containers at the end of your driveway
off the road. Also, when there are more than 2 inches of snow or ice, vehicles must be removed from the roadway.
Our plow drivers and your neighbors will thank you.

MEMORANDUM OF UNDERSTANDING THIS AGREEMENT is made and entered into this _____ day of __________, 201_, by and between the City of Rochester, Minnesota municipal corporation, ("City"), and Cascade Township, a Minnesota political subdivision (“Township”).
WHEREAS, Township owns a facility located at 2025 75th Street NE., Rochester, MN, 55906 (“Facility”); and, WHEREAS, the City may have a need to use the Facility in cases of natural or man-made disasters, emergencies or other serious incidents; and, WHEREAS, Township is willing to allow the City to use the Facility for these purposes; and, WHEREAS, the parties wish to enter into this Memorandum of Understanding so as to document the terms and conditions by which Township will allow the City to use this Facility. NOW, THEREFORE, in consideration of the mutual undertakings and agreements hereinafter set forth, the City and Township agree as follows: 1. Upon the City’s request, Township will permit and allow the City to share the
use Township’s Facility as part of the City’s response to natural or man-made disasters or other serious incidents where the city may have need of a facility.
2. The City will exercise reasonable care in the conduct of its activities in the
Facility. 3. The City will defend, hold harmless and indemnify Township, its officers,
agents, employees and volunteers, from and against any and all liabilities, claims, demands, costs or causes of action arising out of the City’s use of the Facility.
4. This agreement is revocable at each party’s sole discretion for any reason
with 30 days written notice to the other party. 5. Neither party may assign this agreement. 6. Nothing contained in this agreement is intended or should be construed as
creating an employment relationship between the City and the Township.

7. It is understood and agreed that the entire Agreement between the parties
is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter.

The Town Board fonrvarded me your letter dated January 5, 2015 addressed to Michael Brown-and asking various questions about Cascade Township Resolution 2014-10.
All of the process of the creation of the zoning ordinance, input and comments of neighbors, etc.can be found in the public record which is available to you through request to the Town Clerk.To my knowledge there is no part of that process that you wquld not be entitled to see or reviewupon request made to Mr. Brown. This would include meeting minutes, submissions fromanyone present, recordings, to the extent those are available in the Township's possession, etc.
Any information about the comprehensive plan would be best obtained from the County. Thecomprehensive plan used by the Township is the one provided by the County, and incorporatedby reference in the Township Zoning Ordinance.
You inquire about language of the ordinance as well. As you likely know, the Town has limiteddiscretion in its ordinance creation. The Town has to be at least as restrictive as the County andcan't be inconsistent with the County. The County's zoning process, too, is open. The County'sordinances and plans should be available readily from them or online. Similarly, the Town'sordinances and documents are also available either from the Town Clerk or online, as the casemay be. I am not specifically familiar where with everything is stored with regard to CascadeTownship but I am sure that Clerk Brown will be willing to assist you in locating any docurnentsyou might l ike.

It took us a while to dig into the question of what the Township should send out at public expenseregarding notice on valid questions. There is not a specific answer apparently available in Minnesota. Allresearch has to rely on a couple of other states and some Attorney General opinions. The long and short ofwhat we are finding is that we do not recommend the Township send anything that takes a position on theissue. The Town can spend money to provide facts and public information. The line between advocacy andinformation is of course subject to debate. But, the more factual and the less advocacy related a documentwould be, the better.
So, information like:
A petition was approved on XX which states XX. The petition will be voted on by the electors on _. If thevoters vote in favor of the question the town will go to a 5 member board. If the voters do not vote in favorof the question, the town structure of governance would not be changed.
If those facts are true (I don’t remember all the details) then that would be a pretty safe mailing. On theother hand, a mailing that advocates a result would not be.
Again I’m sorry it took us a while but there wasn’t much available by way of specific information. Thankyou.

It has come to my attention that Road Supervisor Laures, an employee of the Cascade and RochesterJoint Powers Board (JPB), is using his JPB subsidized cell phone for activities related to his re-electioncampaign as a Cascade Township Supervisor. As you are aware, the JPB funds are public monies. Theuse of public monies to subsidize the private campaign activities of any candidate is an inappropriate useof public funds. Additionally, the time spent in communications, electronic, in person, or by any othermeans, during paid work hours represents a loss of public funds.
Please be aware that the provision of paid time, and/or the use of JPB owned or subsidized tele-communication equipment and other resources, for campaign activities may be reported as a violation ofthe Fair Campaign Practices as defined in Minnesota Statute 211B and other statutes governing the use ofpublic funds.
Accordingly I am requesting a copy of the time sheets for Mr. Laures for December 2014 and January2015. As I am sure you are aware, public employee time cards are a matter of public record as defined byMinnesota Statute 13.43 subd. 2.

Thank you for the info. As I read, and as I've been told any change in status requires that a form be filledout and authorized by myself and the plan administrator which is the Town Board and not the clerk. Ourown auditors have given me this information. I've told them that we never see any election form which I'mtold should be filled out each year. Not to argue here, but I never signed any change in status form orwas even given one for any change in deduction. At worst, it should have stayed the same. In any case Iwish it to be corrected and it may be done on the Feb payroll. This cafeteria plan needs to be updated tomake sure it is in compliance. Is the health deduction considered a cafeteria plan deduction ?? and if so,then any changes should have come from me ..... Do you have such a form for change in status ??Thank you

You are correct that the plan administrator is the board of supervisors and not the clerk/treasurer. I havesimply followed the practice adopted by the board with the previous clerk/treasurer and applied the terms ofthe plan. As you point out it is the responsibility of the board of supervisors as the plan administrator toprovide the election form and manage the enrollment and any changes. Regarding the plan year to planyear continuity of an election it is my understanding that the election must be renewed. This comes fromIRS publication 969 "At the beginning of the plan year, you must designate how much you want tocontribute". This is consistent with your statement " I've told them that we never see any election formwhich I'm told should be filled out each year." However, I am not the plan administrator and will defer to theboard's direction.
Regarding your request for deductions to commence in February I will include these if authorized/directedby the plan administrator.
Regarding your request to update the plan, would you like this as an agenda item for the upcomingmeeting?

While I cannot speak for the Board in whole, my request is that you correct any payroll to me leaving thededuction as it was the previous year ..... you have my permission to ask either of the other Boardmembers if they so agree so that your books can be accurate come Monday .... or they can chime in asthey wish ....I would leave any update to the plan for the next meeting. There is only a few days till the meeting and itsa large enough document to warrant some additional study ....
