The Carlsbad Chamber of Commerce will hold an inaugural awards luncheon on May 2 to celebrate small businesses as the economic engine that pushed the economy forward through the Great Recession.

“The Engine that Does: Small Business is Unstoppable” will take place from 11 a.m. to 1:30 p.m. on Friday, May 2 at the Sheraton Carlsbad Resort & Spa, 5480 Grand Pacific Drive. It features a keynote address by U.S. Rep. Darrell Issa.

Air Products & Chemicals, Inc. has given an $8,000 grant to the Carlsbad Cham-ber of Commerce that will allow the ReadyCarlsbad Business Alliance — recently added to the Chamber’s reg-ular roster of committees — to continue serving the city’s business community. The alliance develops emer-gency preparedness plans and other safety-related offerings.

The mission of the Ready-Carlsbad Business Alliance is to promote business emer-gency preparedness and response through services, educational programs and cooperative partnerships that combine business con-tinuity with community pre-paredness and recovery.

The grant will allow the alliance to print a brochure to be distributed to busi-nesses, hold at least three workshops during the year and pay for an intern that will help the alliance do research and gather information and data to put together a com-prehensive business emer-gency preparedness plan for the community.

The Carlsbad Chamber is-well respected on a number of fronts. Our size, certainly, commands respect. We are the 10th-largest chamber in the state and the second-largest in San Diego County, with more members than all but the San Diego Regional Chamber. Also, because we put on more events than any other Chamber in the county, our members have access to more information, seminars, networking opportunities and social gatherings than any Chamber in the region. That earns a lot of respect.

Another thing that builds respect is establishing rela-tionships with city officials and elected representatives. Our CEO, Ted Owen, has built these relationships over time by working collaboratively to understand the city’s needs and positions while educat-ing city staff and elected offi-cials on what our members need and want. Rarely, but occasionally, the Chamber has taken positions contrary to the city’s position. The key is respectful dialogue.

But how are the Cham-ber’s policies developed? Who gets to decide? Gener-ally, the Chambers policies have been developed over time with study from staff and our Government Affairs Committee. Their findings are presented to our Board of Directors, who ratifies the position. The Chamber has developed a Public Policy Manual that guides our staff’s ability to weigh in on various matters, whether it is a letter to a public agency or voicing the business commu-nity’s opinion at a City Coun-cil meeting.

Two recent policy examples

come to mind. Each illus-trates how the Chamber arrives at its policies.

Our sustainability commit-tee recently requested that the Board submit a letter to the California Public Utilities Commission on a fairly com-plex issue regarding decen-tralized renewable energy and Feed In Tariffs (FIT’s). We brought in Chamber member SDG&E to discuss the issue and see if we could reach a consensus on appropriate language that the Chamber Board could support.

We also wanted to value the ideas developed in the Sustainability Committee and the input from SDG&E. Although, unknown at the time, the Sustainability Com-mittee originally put a draft letter together, SDG&E now has a Feed In Tariff whereby, business customers can have renewable energy projects on their property and sell it to SDG&E.

Several key questions remain. Is the price high enough to encourage decen-tralized renewable energy projects? If, SDG&E were to pay a higher price, is there an appetite among rate payers to pay more for their elec-tricity given the benefits of decentralizing the production of energy and having to feed in to the supply locally?

The Board also supported a

letter encouraging the CPUC to look further at this issue with a goal of promoting more decentralized renew-able energy without increas-ing costs to ratepayers.

Another complex issue playing out right now is how to pay for state-mandated affordable housing.

Cities typically require home builders to build 15 of their project as afford-able housing or pay an in lieu fee to have that hous-ing built. This puts upward pressure on housing costs. At one time there was an affordable housing require-ment in place for apartment buildings. That requirement was removed and now the city is seeking to add a similar requirement back.

The Building Industry Association (BIA) tells us that adding a proposed fee of $20 per square foot of apartment housing built raises their building costs and that those costs have to be passed along to the future occupant of the apartments being built. An average scenario means the future renter will be paying an additional $1,000 per year in rent to help pay for afford-able housing.

It seems counter produc-tive to me that someone renting an apartment is ulti-mately paying the freight for affordable housing that, in theory, benefits all of us. I believe we need to have a respectful public discussion on how to pay for affordable housing. The city has not determined what will go to Council for approval yet but they have hired a consultant whose output suggests that the city should impose such a fee.

Respect and the crafting of Chamber policies

Positive Thoughts Can Help on the Road to Success

Every once in a while I need to get a dose of positive thoughts to help me along the road to my own success.

As I was reading some of the new publications in my mail, I selected a few quotes and thoughts to share with you. Some are funny and some are insight-ful, but if they make you laugh or think, then they have served their purpose of helping us cope.

• The pessimist sees only the red light. The truly wise person is colorblind.

• Don’t ever think you don’t have time to do something, after all there are 525,600 minutes in each and every year.

• People with flexibility never get bent out of shape.

• The young and the old have all the answers. Those in between are stuck with the questions.

Grant helps Chamber continue emergency preparedness efforts

For the third year, Carls-bad-based Spy Optic is paying homage to the Northern European tradition of grueling spring bike “clas-sics” by hosting a one-day, 136-mile race through hilly course along North County backroads featuring 11,000 feet of punishing climbs, water obstacles and waffles.

Yes, waffles.Spy’s Belgian Waffle Ride

(BWR) 2014 takes place on April 27. It honors Belgium’s history as a bike racing capi-tal, starting with a morning breakfast for riders and food and beverages along the course. Featured foods will include Belgian-themed delicacies such as waffles, moules frites and ale. A sold-out field of 500 riders (among them Olympians as well as world, national and state champions) will brave the challenging ride, which according to race creator and Spy President and CEO Michael Marckx, features more gravel, dirt, pavement and climbs than in previous years. Riders are warned to expect a “multifaceted, ugly, technical, tactical, grinding, pounding, relentless, spirit-sapping, muscle-cramping beatdown in the finest tra-dition of long road races.”

Proceeds from the event, more than $20,000, go to the Challenged Athletes

Foundation, whose mission is to “provide opportunities and support to people with physical disabilities so they can pursue active lifestyles through physical fitness and competitive athletics.”

The race also includes a two-day Lifestyle and Fitness Expo, which be open to the public and be held at ViaSat’s Carlsbad campus, 6155 El Camino Real, which serves as the start and finish line for the race. The expo is from noon to 5 p.m. on April 26. On race day, the expo will start at 6:30 a.m. and run through the duration of the event (the race itself starts at 8 a.m.)

Jim Miller, performance sales director at Spy Optic and event director for the BWR, said the event has grown exponentially. The first year it had a field of 150 riders, and last year 360 braved the ride. This year, the event sold out in advance of all 500 riding spots.

“The word of this event has gotten around,” Miller said. “This year alone, we have people from three dif-ferent countries, and 38 states are represented. The ages range from the early 20s up to the 60s.”

For the public, the lifestyle and fitness expo at ViaSat, which will feature nearly 40 businesses and groups

— including a booth from the Carlsbad Chamber of Commerce — provides a perfect opportunity to get a sense of the irreverence of the race without having to take on the course.

In addition to browsing through the booths, the public will be able to follow the action on the course through live broadcasts. Post-race celebrations and the awards ceremony will

also take place at the expo.“Local businesses, the

cycling and non-cycling com-munity will come together for an afternoon to cel-ebrate fitness,” Miller said. “We’re glad to make this a

community event where we get to showcase the unique local businesses in the area.”

By now most employers are familiar with the Family & Medical Leave Act (FMLA), which allows employees of larger employers to take unpaid time off for various reasons (mainly medical). Because the employee’s job is protected while on leave, it’s important for employers to understand when time off counts against the maximum and when it doesn’t.

A recent case in the 9th Circuit Court of Appeal held that the use of FMLA time (against the maximum) is not automatic. In that case, the employee asked for two weeks vacation to care for her father. She didn’t ask for FMLA time, and the com-pany didn’t treat the time as part of her protected

time off. When she hadn’t returned after four weeks, she was let go for abandon-ing the job. She sued under FMLA, claiming the company should have “automatically” put her on FMLA leave. The 9th Circuit disagreed, saying it’s perfectly OK for an employee to save their time off under FMLA and just take the time as vaca-tion. While the company

has an obligation to ask whether the employee’s leave is for FMLA purposes, this employer did ask her twice whether she needed more time, and twice she said no. So the jury’s verdict for the employer held up.

The lesson for employers is to have clear communi-cation about leave, making

sure employees understand the difference between vacation time (subject to the employer’s rules) and protected leave under FMLA (which could include the same vacation time). And to make sure that there is a clear understanding when the employee’s leave time will count against their annual limit.

Also, beware of firing employees who overstay their allotment of leave. In another recent case, a California appeals court held that giving a pregnant employee more time off than the law requires might be considered a reason-able accommodation for a disability. That employer was surprised to learn that firing the employee when she failed to return after her leave of four months was over was the same as wrongful termination!

In today’s suit-happy envi-ronment, employers who want to avoid risk should always get an attorney’s advice before firing anyone for any reason.

FMLA laws can trip up employers

Harrah’s reveals new name for resort after renovationHarrah’s Rincon Casino & Resort, a co-winner of the Hospitality & Leisure Award at the Carlsbad Chamber of Commerce’s 2014 Annual Business Awards Dinner, recently announced a new name — Harrah’s Resort Southern California — ahead of the completion of its $160 million multi-phase renovation.

The ambitious expansion turns the Valley Center resort into a 1.2-million square-foot all-season casino and resort.

The resort’s renovations include a new 403-room hotel tower — the fourth-largest in the county — giving Harrah’s a total of 1,065 rooms. The tower includes 52 new suites, bringing the total to 152. New this month is Spiked, a new craft cocktail ultralounge and the addition of two new eateries, Earl of Sandwich and the return of Pink’s Hot Dogs.

The expansion at Harrah’s resort started in October 2012. The first phase, unveiled last July, included the opening of a pool, a swim-up bar and a 400-foot-long “Lazy River.”The second phase, which was finished in January, included the Events Center, a 53,221 square foot state-of-the-art non-smoking convention and entertain-ment venue that seats up to 2,200 in concert-style seating or 1,200 banquet-style.

After one year of opera-tion the City of Carlsbad’s life science incubator, Bio, Tech and Beyond, has shown success by helping to launch six life sciences startups that could grow into fully fledged companies.

The Carlsbad City Council agreed last January to lease a city-owned building where the oper-ators of Bio, Tech and Beyond could build a space where sci-entific ideas could grow.

As home to more than 120 life sciences firms, including such industry giants as Isis Pharmaceuticals, Genoptix and Thermo Fisher Scientific, the City of Carlsbad decided it made sense to nurture nascent firms. The city’s life sciences cluster holds more than 600 patents and pro-vides 7,000 well-paying jobs, making it a powerful eco-nomic engine.

Bio, Tech and Beyond’s founders, Joseph Jackson and Kevin Lustig, spent their first six months converting the former auto-insurance claims building at 2351 Faraday Ave. into a workable laboratory. They held a ribbon-cutting ceremony last July that was attended by more than 400 people, and three weeks later they were renting benches to scientists.

Jackson and Lustig said that as the new year dawned they have five full-time members who are operating six compa-nies, which have the equiva-lent of 14 full-time employ-ees. The members are often industry veterans who have been nurturing an idea, and who need a place where they can develop it.

“There’s been a tremen-dous amount that’s happened in our first year,” Jackson said recently. “The building has gone from an unused entity to an ongoing hub of eco-nomic activity where people are generating businesses, showing there’s really a need for something like this.”

The city is leasing the 6,000-square-foot building to the lab for $1 a year for five years. Bio, Tech and Beyond’s

managers paid for most of the tenant improvements and fur-nished the lab with scientific and other equipment, some of which was donated by local life sciences companies.

The lab continues to develop a revenue stream from membership fees, corpo-rate sponsorships, donations, event fees, course fees and grants. The facility also houses a cell culture lab that it can use to generate revenue and help make it self-sustaining. It is already contributing to the North San Diego County economy by purchasing goods and services from a variety of local firms.

The ultimate measure of the Bio, Tech and Beyond’s success will be whether it helps members graduate into the ranks of self-sustaining,

job-creating companies on the strength of a new product or technology.

One of the companies housed at Bio, Tech and Beyond, Orphi Therapeutics, is a candidate to make such a transition. Its founders are researching a therapy that would treat a blood disorder, cerebral amyloid angiopathy, that causes strokes. The scien-tists are researching a genetic form of the disease that affects the young, and they hope to begin testing a drug therapy within two years.

This is the exact idea that the City of Carlsbad had when it embraced the concept for a life sciences incubator, and the city believes it makes sense to help Bio, Tech and Beyond help others to achieve great things for our future.

Schumacher Appointed to Carlsbad City Council

Michael Schumacher, a La Costa resident and member of the Carlsbad Chamber of Commerce,

was appointed to the Carlsbad City Council on March 11. He filled the vacancy created when former Councilwoman Farrah Douglas resigned.

The unanimous Council vote puts Schumacher in office until December 2nd when newly elected Council Members are expected to take their seats fol-lowing the November 4th Gen-eral Election.

Schumacher, who has served on the Carlsbad Plan-ning Commission for the past five years, and chaired the Commission in 2011, filed campaign papers for the November General election for the seat he has been appointed to, prior to the Council’s decision. He was selected over 38 citizens who, following the Council’s direction, applied for the vacant seat.

“I am honored and humbled that the Council has asked me to fill the seat on an interim assignment,” Schumacher said. “Over the last dozen years, I’ve been fortunate to have had the opportunity to gain an understanding of how our City operates. This has come, in part, through my current involvement on the Planning Commission and the Agricultural Miti-gation Conversion Committee, and my past service on the Design Review Board,” he told the Council.

Schumacher owns a Carlsbad asset management consulting firm, Enact Partners, LLC, that helps pri-vate real estate clients manage their real estate hold-ings. With a masters degree that focused on Tax Increment Financing from Central Michigan Uni-versity, Schumacher is an expert in land-use issues, real estate investment and commercial finance, a career path he told the Council would be valuable as a city leader.

For years, Schumacher has focused on helping revitalize the Village. As a Carlsbad Chamber of Commerce member, he was very involved for many years in supporting economic development issues in the community. “As a matter of fact, my work in the areas of redevelopment, historic rehabilitation and tax increment financing is what originally prompted me to get involved in the City through the Chamber’s Village Enhancement Committee in 2001,” he said.

Did you know there are now more than 600 busi-nesses in Carlsbad Village? It seems astounding, but we’ve collected data on Vil-lage and Barrio businesses to help communicate all that the Village has to offer.

In general, the “retail mix” hasn’t changed much since 2012, when we first collected this data. The retail mix, or offering, is the big-gest challenge in the Vil-lage’s long-term success, according to surveys of resi-dents, business owners, visi-tors, and property owners.

However, new businesses have opened, or are in the planning phases, that begin to fill the gaps for consumer demand. Let’s take a look at the top five business catego-ries in the Village today:

1. Health & Wellness: 16 percent

2. Beauty: 11 percent3. Financial & Legal

Services: 11 percent4. Dining: 8 percent5. Specialty Services:

7 percent

The top three catego-ries make up 38 percent of

Village businesses, and the top five make up more than half. Over time, these per-centages will change, espe-cially as the Village begins to attract new employees and new residents with changing demands.

ATTRACTING THE CREATIVE CLASS

A missing category in the Village that we often hear about is “creative office.” From small start-up firms to co-working spaces, down-towns are perfect locations for millennial workers that want to go out for lunch, shop and dine after work and be in a social and con-nected environment. They may even live nearby and bike or walk to work.

Unfortunately, the Village has limited existing space for the flexible demands of these types of offices, but new development should incorporate it as often as possible if the Village is to attract new energy and cre-ative, entrepreneurial minds.

COMMUNICATING THE VILLAGE’S OFFERING

These days, nearly every-one gets most of their infor-mation online, which is why it’s so important to have an effective online presence. To that end, we’re work-ing on a new website for Carlsbad Village that will have a cleaner, user-friendly

interface and will incorpo-rate the 600-plus businesses that are here in a visual, map-based format. The site will go live by next month, and its mobile-friendly ver-sion will be especially helpful to the thousands of tourists who visit in the summer months. Spring is here (can you believe it?!) and this has me thinking about the things we usually do during this time. The change of weather away from the cold (theo-retically, here in Carlsbad, of course) makes us start think-ing about starting fresh, whether it’s spring cleaning, adopting healthy habits or taking up new activities.

In keeping with the theme, the event illustrated

2014 ANNUAL BUSINESS AWARDS WINNERS

A TRIBUTE TO HEROESDuring the ceremony, the Chamber took pause to cel-

ebrate four American heroes of the U.S. Marine Corps, Purple Heart recipients who were wounded serving our country in Iraq and Afghanistan.

The Chamber presented “The American Spirit Award” to Major Byron Owen, Sgt. Jorge Hernandez, Sgt. Leroy Johnston and Sgt. Jason Pelandrano.

To illustrate the courage and sacrifice of these men, Chamber President and CEO Ted Owen (no relation) gave an account of the battle that earned Major Owen the Silver Star Medal. During the battle, which took place Aug. 8, 2008 in the southern Afghan city of Shewan, Owen and his 30-man reconnaissance platoon encountered 250 enemy fighters and engaged them in a firefight. All of the members of the American platoon survived.

“The young Americans you are about to meet are some of the best of the best America has to offer,” Chamber CEO Ted Owen said. “Each of them nearly paid the ultimate price by being wounded in battle to protect our nation. Stillings, who recently retired as executive director of the California Center for Sus-tainable Energy, brings more than 30 years of experience in sustainability, energy ini-tiatives and environmental education.

During her 10 years of leadership, she grew CCSE from 7 to 90 employees and broadened their focus to include renewable and alter-

Carlsbad Unified, like all school districts in Califor-nia, is grappling with a new school funding formula and accountability plan, slated to go into effect on July 1.

This past June, after 40 years under an antiquated school funding model, the State of California adopted the Local Control Funding Formula (LCFF) and Local Control Accountability Plan (LCAP). This new funding and accountability system:

1) Provides a uniform funding level for every

student in California based on their grade span (elemen-tary, middle or high school).

2) Establishes an incre-mental approach to reduc-ing grade K-3 class size over

the course of the next seven years. The intent is for all pri-mary grade classes across the state be at a 24-to-1 by the year 2020.

3) Provides additional rev-enue to serve students with the greatest needs, such as our English Language Learn-ers, children from low income families, and foster youth.

4) With fewer strings attached, gives our school board and local community a greater say in how district funds are spent.

Because property taxes

within CUSD’s boundaries are slightly higher than the funding proposed under LCFF, Carlsbad is currently a “Basic Aid” district, and would not receive state funding under LCFF. How-ever that could change depending on future prop-erty tax revenuesr.

While we’re excited that CUSD will be experienc-ing some much-needed improvements to our budget in 2014-15, it must be said that this new funding model does not address California’s

low level of school funding.The accountability mea-

sures under the new LCAP are aligned with eight state-wide priority goals.

These eight priority goals are: Student Achievement; School Climate; Credentials & Materials; Implementation of Common Core Standards; Other Student Outcomes; Parental Involvement; Course Access; and Student Engagement.

Many of the requirements under the LCAP are already being addressed in Carlsbad

Unified’s existing work to raise student achievement, but we still have some work to do before the Board adopts CUSD’s LCAP plan in June.

What new funding model means for school district

Dr. Rodriguez bids farewell to MiraCosta College When I arrived at Mira-

Costa College in March 2009, I spoke about the transformative power of education and my commit-ment to a community college system dedicated to open access and student success, academic excellence and affordability. Five years have passed since my inaugural address, and I now prepare to leave MiraCosta College to serve as the chancellor of the Los Angeles Community College District. It has been an honor and a privilege to serve as MiraCosta’s superin-tendent/president these past five years, during which time the institution has made tre-mendous progress in serving the needs of our students, staff and region.

Student Success: This is job one at the college and in the last five years, our

graduation numbers have more than doubled. In 2013, we awarded a record 2,455 degrees and certificates, plus an additional 52 high school diplomas. The college also has earned the distinction as a Hispanic-Serving Institution (HSI), a federal designation that positions MiraCosta for funding to bolster student success.

College Enrollments and Programs: Enrollment has grown by nearly 25 percent since 2009 and the

number of military veterans and active-duty personnel has nearly doubled to 1,900, prompting us to create a veterans lounge, hire a vet-erans academic counselor and bolster veteran-specific services. The Honors Scholar Program has flourished, affording intensive instruc-tion, challenging coursework and close interaction with Honors faculty.

New Academic and Training Programs: A new, high-tech science building on the Oceanside Campus has helped meet student demand for science courses. A new science building also is under construction at the San Elijo Campus, where stu-dents are benefiting from a growing academic program. New programs in biomass technology and social media are arming students and

those already in the work-force with the vital skills needed in an increasingly tech-savvy world.

Online Education: In 2009, we offered 208 online and hybrid courses. Today, we offer 310. A new online tutoring service allows students live access to tutors throughout the week, including nights and weekends.

Community Engage-ment: We continue to meet the needs of the local busi-ness community. The Com-munity Services and Business Development Program, for example, crafted a new Machinist Technology Pro-gram for individuals seeking fast-paced, high-level train-ing for employable job skills.

Our partnerships with Encuentros Leadership of North County and the

GEAR UP Program with the Oceanside Unified School District prepare students for college and careers and develop a college-going culture for all students and families.

Philanthropy: Total Mira-Costa College Foundation assets have grown from $4.6 million to $8.8 million and endowments have nearly doubled. This has enabled the foundation to distrib-ute more than $1.3 million in scholarships and direct financial aid to students while also providing nearly $2 million in support of pro-grams and priorities over the same five-year period.

Fiscal and Organiza-tional Management: Our firm commitment to fiscal prudence has guided the dis-trict through the country’s most severe financial crisis

since the Great Depression. We have also revamped our governance structure, com-pleted our accreditation processes with strong results and we continue our string of successful financial audits.

Looking back, we have much to be proud of. Clearly, MiraCosta College continues to be an exceptional institu-tion with an unfaltering com-mitment to students and the community. MiraCosta is a great college with even better people. I have no doubt that the college’s outstand-ing reputation for academic excellence, responsive student services, and robust financial standing will attract superb candidates to serve as the next superintendent/president – someone who will build on the college’s strong founda-tion and bold vision to serve students and this region.

The second most profit-able home improvement is a bathroom addition. Adding one more bathroom to a home can add twice the value of a new bedroom. One important consider-ation: don’t spend money remodeling the bathroom if it’s the only one you have.

Finally, adding square footage is number three on the list. A room addition can be an expensive project and costs can get out of control rather quickly. As long as you stay within budget, you can typically recoup almost three quarters of your investment.

Of course, your return on your investment depends on various factors including the value of your house, the value of houses in your immediate neighborhood and how soon you sell after making improvements, and the quality of the project itself (again, per hgtv.com).

It is important to keep in mind if you are not plan-ning to sell in the near future, spend your money

remodeling in a way that you will most enjoy. Even if you get less than what you invested, you may become richer over time because

of the memories you have madeusing the wonderful space!
