Legislation Impacting CAPPS: Contract Management

The 84th Legislature expanded the ERP definition of Purchasing to include Solicitations and Contracting.

• Senate Bill 20 directs state agencies to report contract and purchasing information in the uniform manner required by CPA for contracts entered into with an effective date of Sept. 1, 2015, or greater.

• By rule, the CPA will determine what contracting information CAPPS agencies will report. Agencies can provide contracting information through specific data fields or with attachments.

Legislation Impacting CAPPS: Contract Management Cont.’d

Enhanced transparency will provide more information on contracts such as:

• A brief summary of contracts• The criteria used to award contracts• Details on awards based on best value to

the state• Statements of work and work orders for contracts• The proposed budget for contracts• Information on conflicts of interest• Justification for change orders, amendments,

renewals, extensions or other actions resulting in increased monetary value

• Contract monitoring detailsAdditionally, mandatory approvals at various stages can be established through system workflow functionality.

Legislation Impacting CAPPS: Contract Reporting Requirements

CPA is actively working to define how CAPPS users will be impacted by SB20 and will issue CAPPS reporting requirements soon.

Additionally, CPA will be meeting with the LBB and DIR to determine how CPA can assist oversight bodies.

CPA is also analyzing the impact of Article IX of House Bill 1 which requires additional contract reporting requirements from agencies to the

Legislative Budget Board (LBB). This includes:• Reporting all previous fiscal year contracts over $50,000 by Oct. 1 of each year• Notifying the LBB prior to making a payment over $10M on a contract• Certification signed by the agency Executive Director stating that the process used to

award the contract (over $10M) is compliant and in accordance with published rules

Legislation Impacting CAPPS: Legacy System Retirements

By Oct. 1, 2016, CAPPS Agencies must report the following to the LBB:• Any information technology

systems retired as a result of a CAPPS deployment or anticipated deployment

• Cost savings or projected cost savings resulting from the systems’ retirement
