CE/OBMAN's REMARKS

The AO1 is to be held on April 27th at Slaithwaite TownHa*~, (see directions on page 6). I hope that as manyoi you as possible will be able to attend. This isyour opportunity to make your voice heard and questionthe committee. We require nominations for officers andcommittee members for election at this meeting.Nominations to Bob Lewey or myself before the meeting ifpossible please but if not they will be accepted at themeeting. As I said last year, I will not be standingfor election this years for reasons and explanations seeMarch '78 issue of Pennine Link.

At the moment it looks as if boating activities are goingto be severely curtailed this year due to the actions ofBWB staff in their fi ghi for more support from theGovernment. Let's hope that this action will in the.longrun result in the long overdue maintenance on the water-ways being carried out. Meanwhile, it is a littledifficult to see how any progress can be made on ourremainder waterway when the whole of the system is runningrr idly into decay. However, we are gradually making progressin talks with BWB on the question of navigation of thetunnel; as usual it boils down to a question of money and areluctance on BWB's part to let us go and kill ourselves andothers in their tuimeli

In spite of the waather our new stand has been earning itskeep and has been on display at various sites on both sidesof the Pennines. It is at present in Ashton Library (listweek in March); it then goes to Huddersfield for the TransportExhibition (10/11 March). It will be at Uppermill Museumin April (the week before AGM)j and then we hope to have iton show at the Annual General Meeting, (see inside back'cover)

LI. I^L UOia'A^/, TRUST, CiuUtK'Y, *UL UUa?

As no doubt sorao of the lumbers are aware at the In atannual Qeneral Meeting it was resolved to look into thequestion of forming the Society into a publicly recognisedCharity and the writer was accordingly approached toa vise. To obtain public recognition it is necessary forthe i-iociet to bo registered as a Charity with the CharityCommission (one of the less well known Government Depart-ments) which is possible provirie^ the ore sent constitutionof the Society is substantially r

Tho re -attend? tent ".'ill either rean substantially re-the present constitution into a more extensive ?,\if~ com-prehensive nocuinsnt or the ao option of a '--rust >>ed or theformation of a Conoany United by jju^rsntee in its 3 tear.Re-oraftin." the frosent constitution is obviously thesii-i lost cheapest and easiest thin,; to do but in is con-sidered that in. view of the f s o f e th*t the Society expectsto continue to expand at its present r-;te a IK; »lso in viev/of the lorr- term aims of the Society a re-^rpfted con-stitution ajuearg inadequate.

'.'ho Society coul'1. alao cflo^t a Trust Dace1, ns its ; overninj-;instr--ment v/Mch , sinilpr to a constitution, '.voylr! set out«11 the powers, duties and liabilities of the Society, ormore particularly the Trustees, who woul-l need to beappointed to act on behalf of the iociety. 'ill actionsagainst the Society would then be a,:;a<nst the Trusteespersonally and they could of course bring an action arainsta Third i'arty in their own names. In addition all theassests of the Society would "be vested in the Trustees whocould no doubt lie granted powers to mortgage charge leasesell purchase or otherwise deal with any of the Society'sproperty. The powers and duties and responsibilities of aTrustee are onerous and the Trust itself is of coursesubject to the retirement dismissal or death of the TrusteesWhereupon it is necessary to alter the Trust Ifeed itself.

The overwho Iniinc1 problem with both a constitution nnrf aTrust I/eed is that the Society as such has no distinct le;-;alpersonality ?nr accordingly from time bo time certainmembers of tbo Society would be as'cef1 to be f^rsonaHyliable for acts of tbeir co-Venbers. This as you may

Page 10: CANAU SOCIETY PENNINE LINK · Chairman (E) s John K Maynard, 2$ Thick Hollins Drive, Meltham, Hu^dersfield. Hudds 850 575 Vice Chairman (w)s Peter Freeman, 14 Burnell Court, Heywood,

apxeciate is a very onerous responsibility and thereforeaf'er lengthy discussions the Committee Members are suggestingthrb the Society adopts the third type of governing instrumentnai3ly the Company limited by guarantee. Forming the Societyiiro a Limited Company is obviously the most expensive forman: will necessarily involve £50 capital duty on the regis-tr:tion of the Company. In addition the Company will requirea lameplate and the governing instrument namely the memorandumar-l articles of association will require printing. In compar-is>n the cost of producing an amended constitution or a TrustD-sd is negligible but the Company has an over-riding advantagei:. that the Company itself is a dir.tinct legal person :to. the-—eir.ent that any member of the Company of Court proceedingswe:e brought against it would only be liable to pay the amountthy guarantee to pay on the signing of the memorandum andar~icles of association or th^ fomaticn of a Company, fore:-:..mple, £1 or £% There will be no personal liability othert".;.in this upon any Member.

T:r= memorandum and articles should also contain the powerdu~o.es and obligations to which the Company is subject butshc;ld no specific mention be made then the Company is subjecttc lie stringent and exhaustive provisions of the Company'sact;. Compliance with the terms of the acts will involvecertain obligations upon the Society the most familiar ofwhi;n is the annual return to the registrar cf Companiessetting cut basically the reports of the Directors andauditors and submitting the annual audited accounts. TheConruny must also keep statutory books which will also haveto :e purchased and it must have a Company seal.

As u.iny cf you are no doubt aware other Societys such as your"own ;.ave already adopted the Company form and by far this isthe nust appropriate type of governing instrument. Membersmay ccnsider at this stage that the Company is by far toounwia.'.dy for their purpcses and unnecessarily complicated. However, It is important to put the matter in perspective. The Company will be the basis of all the Society's futurebusiness and can remain in existence for hundreds of years. The aims of the Society are by definition long term and willeventually involve a large amount of finance. It is import-ant that the stage should be set as it were as early aspossible.

CANAL COSTUMES

We require information on authentic canal costumes. -:Pic-tures wculd be very useful. It would also help if someonecould translate these canal ccstume ideas on to a graph, withinstructions for making-up. This could easily then be putin Pennine Link so that interested members could make theirjwn ccatumes.

WQOLRQAD TRANSHIPMENT WAHEHOUSF, DOICROSS

In 1977 several members of Saddleworth Historical Societybecame concerned about the deteriorating state of a build-ing known as Woolroad Transhipment Warehouse which standson the side of the Huddersfield Narrow Canal at Dobcross,Saddleworth. Greater Manchester.'

The building ia stone built, wi^n an unusual stone slatedroof overhanging part of the canal. Originally the build-ing would have provided protection from the elements fornarrow boats unloading and loading perishable goods such aswool and corn.

The canal basin at W'olroad wfs the terminus of the westernsection of the Huddersfield Narrow C^nal between 1799 and1811. The canal link across the Penrines cculd not be com-pleted until the hugh undertaking of driving the 54 milelong Standedge Tunnel had been finished. This tunnel took17 years to drive and it is still the longest and highestcanal tunnel in the British Isles. The Woolrcad Warehouseis the last remaining building of this early period and itis thus an important building in bhe heritage of Saddleworthand is well worth preserving.

After discussing the matter of th-3 restoration with theBritish Waterways Board, the Committee of the SaddleworthHistorical Society were able to negotiate a lease on thebuilding from the Board for a 21 year period.

The Committee appointed four trustees* and after legalformalities had been completed, work started on the repairand renovation of the building. During the spring andsummer of 1978, working parties sf members of the Societystripped the roof of its heavy sbone "grey slates" (somewere as large as 41 x 4')» removed rotten purlins, rafters, battens and ridge tree timbers, nd in addition generallytidied up the land adjacent to trie brilding, cutting thegrass and removing some small bushes that were underminingthe foundations.

At the same time fund raising was stsrted and help was re-ceived from several quarters - ths local Saddleworth ParishCouncil, the Saddleworth Civic Vrust, Industrialists and manymembers of the public. To date £3?0 has been given towards thecost of restoration.

Page 14: CANAU SOCIETY PENNINE LINK · Chairman (E) s John K Maynard, 2$ Thick Hollins Drive, Meltham, Hu^dersfield. Hudds 850 575 Vice Chairman (w)s Peter Freeman, 14 Burnell Court, Heywood,

- 13 -During the autumn of 197^timber was purchased and a startwas made on replacing all the rotten wood in the roof. Inadditbn, four massive octagonal oak posts have "been orderedas the posts at present holding up the cantilevered roofhave rotted.

Work will progress steadily during the coming months and itis hoped that in 1979 the building will be made completely'wind and watertight1 - .a condition of the lease from BWB.

Several ideas have been put forward as to the future useof the building, but initially it will be used as; a muchneeded store for the Society's excavating equipment and asan /erflow store for Saddleworth Museum.

Recently, offers for help towards the landscaping andtidying up of a much larger area, surrounding the river andthe canal, have been made "by Oldham Metropolitan Borough, and so what started cff as a simple restoration project maywell result In a whole tract of semi-derelict land beingturned into an attractive area that could be a credit tothe district.

AN ADVENTUIffi OF ULYSSES DIGGLH (cent)

Ulysses remembered his emergency kit, out came the nailand he pushed that firmly inbo the ground, and then he threwthe string over one of the "branches and fastened the endto £he nail. Holding tightly to the other end of the string,Ulysses began to climb. It was a good job he was still ingood conditions, but he was very tired when he reached thetop.

He edged himself to the end of the branch and pulled off apod. He bit a little piece out of it just to test thequality. Moan!, This will make very good Diggle rock. Hefilled his emergency bag almost to the top, and thenquickly slid down the string, rolled it up and put it inhis bag. On his way back to the tunnel entrance horemembered his nail. That nail was one of his prizedpossessions and he had no hesitation in returning to pickit up.

Suddenly, Ulysses heard footsteps coming along the pathtowards him and he hurriedly tried to hide in the under-growth. He had just managed it when a large dog snnffledpast. 'Phewl Thank goodness he's gone* thought Ulyssesand, being curious, poked his nose out to see what washappening. The dog was sniffing about in the flowers andso Ulysses froze on the spot. The dog lifted his head, took a few deep breaths and then looked straight at Ulysses.

'The aniseed1 ho thought,, 'the dog can smell me. What canI do now?1 YJMle he was thinking about that the dog ambledover, sniffed at Ulysses and picked him up. -

Ulysses was not hurt, though a little bit anxious. Hecould see the dog was heading towards the tunnel and wasgrateful for that. However, they turned off the towpathand headed for the moors.

SERIAL: HUDBEESFIELD NARROW CANAL 1792TQ PRSENT DAY - compiled by Diane Charle3wo4th

By 1837 trade had much increased as is shown by the numberof carriers in White's Directory :'Buckley, Kershaw & Company to Hull, Manchester, Liverpool, etc., daily.'Carver, Driver & Company to Manchester, Liverpool,Dewsbury, etc., daily.'John Kenworthy & Company to London, Manchester, Stafford, etc., daily.T. & ¥. Marsden to Manchester, Liverpool, Hull, etc.daily.'L. Dyson tc Manchester, etc., twice a week.'Deacon & Company to London, etc., daily.'Pickford & Company to London, Birmingham, Bristol,Manchester, etc,, daily , ,,.. 0 '

It is interesting tc ncte that the canal came earlier thanthe third turnpike road, (ie the (New) Manchester Road up~:he Cclne Valley). Two neasens suggestetl were that narrowboats weie capable of hauling tremendous loads, there-fore, this type of transport was much cheaper, and also?it ,;a3 an escape from statute laborer (ie statutory r;.adGliding duties for every man living in the area, up to1635;* As the "Terrier" extracts show, heavy . oods such.13 lime and coal could be carried. Also, the cost wasb.rne by the Canal Company, a private concern, and netthe l3r_dov:rFxT3 and their tenantry. However, another reason",nd probably the most important, was that the motive forcebehind the upsurg-e in canal building was the wooll'--n_...ndustry1 it was totally dependent on good transport tokeep business going: and mention has been made of how thefuture prosperity of Huddersfield was influenced.

In 1846, the Huddersfield (Narrow) canal arid theJohn Ramsden (Broad) Canal became owned jointly by -; GHuddersfield Railway Company, and in 1847» they becameown^d by the London & North Western Railway Company. Aprice of £150,885 (again, one- of several prices mentioned)va« paid for the Huddersfield (Narrow) Canal,

In 1849, the railway line from Huddersfield to Stalybridgei-;aFi opened,

Page 19: CANAU SOCIETY PENNINE LINK · Chairman (E) s John K Maynard, 2$ Thick Hollins Drive, Meltham, Hu^dersfield. Hudds 850 575 Vice Chairman (w)s Peter Freeman, 14 Burnell Court, Heywood,

- 18 -

Up to the opening of the railways, all materials required by thetextile industry had "been brought by canal, then most of the goodstransferred to the railway. However, the railway company did en-courage heavy minerals to go by canal, e.g., t'tere was a 25%reduction in coal charges; much stone was shipped to Lancashirefrom Marsden; and the railway company did have their own boatsfcr transportation of corn.

In 1853, a T^r- John Mellor was wharfinger at Canal Office, nearEngine Bridge, Huddersfield, and vessels owned by Law Dyson andethers operated.

^In 1866 there still existed the L & EV/R Canal Office with theoffice manager and agent: Kenwcrth ? Company;Lay Dyson also still operated.

In May 1875» the London and North Western Railway (New Lines)Bill went before Parliament, arid evidence was heard in con-nection with it. One witness, d^ard Greenwood, was the localcanal engineer stationed at Hudffersfield: he had been employedby the Huddersfield Canal Company in 1832. He stated that boatsfrcm the Aire and Calder rarely went up the Colne Valley, andstoppages occurred there quite oftens in 1849 a stoppage lasted6 days, in 1852 - 35 days; in 1054 - 23 days; in 1868 (droughtyear) -66 days. The cause of tho stoppages was insufficientwater in the suJimit pounds. (f£LL«3 hardly seems feasible asthe Huddersfield Narrow is known to have a plentiful supply ofwater, and indeed, as has already been shown, between 1811 and1845 the traffic was considerably heavier and the canal was notknown to have water shortage prob ems then). There was alsoan early stoppage at Whitsuntide for maintenance and inspectionpurposes. A certain William Bartholomew of the Aire and Calr""Navigation also gave evidence: he said that narrow boats hadbeen built by his company between 1856 and 57 for use on theHuddersfield (Harrow) Canal; but +Traffic had not been encouragedand when stoppages occurred boats went via the Calder & Hebbleand Rochdale Canals into Lancashire.

The above evidence would suggest fiat the Company were tryingtc dampen down business on the Huc.iersfield (Narrow) Canal, andim fact, over the years trade did disappear.

- 20 -

The following is a letter received from Mr. T.L. -Robortcr56 Radcliffe Road, Golcar

Dear Mrs Charlesworth,

I am the Labour candidate for the Golcar and Linthwaiteward at the forthcoming council election and am writing toask for the support of members of the Canal Society. Someof you will probably react in horror at the bringing ofpolitics into the question of the future of the canal. Such a reaction would be naive. Only 'politics1 will ,reopen the canal. Without the support of councillorsprepared to turn down planning applications threatening theline of the canal and to aaopt positive policies for itsrestoration,, no amount of voluntary effort will succeed.

I have been a member and enthusiastic support of theCanal Society for several years. I see the canal as one ofColne Valley's greatest csseiic: and wish Kirklees to adopta policy directed towards its eventual restoration fornavigation and its immediate use for informal leisure,In particular the long pound below Golcar should be dugout to create better angling facilities and to allow boating,The Council should investigate the possibility of buyingor compulsory purchasing part of the canal as a way roundsome of the problems preventing action at this time. Inview of the economic and leisure advantages to the ColneValley this would be a right £.nd proper use of rate-payera 'money.

^I would not pretend that all members of the local branchLabour Party are sold on the idea of reopening the canal, although strong support for the aims of the society wasgiven in the branches evidence to the West YorkshireStructure Plan. I would, therefore, like to invite arepresentative of the society to come along to a branchmeeting to explain the potential of the canal for benefitingthe locality and to show what has been achieved in other, more enlightened, parts of the country.
