master means the person in command andcharge of a vessel. It does not include a li-censed pilot, within the meaning of section 1.1of the Pilotage Act, while the pilot is perform-ing pilotage duties under that Act.
oil handlingfacility installation demanutentiondhydrocar-bures
oil handling facility means a facility, includ-ing an oil terminal, that is used in the loading orunloading of petroleum in any form, includingcrude oil, fuel oil, sludge, oil refuse and refined
products, to or from vessels.

passenger means a person carried on a vesselby the owner or operator, other than
(a) a person carried on a Safety Conventionvessel who is
(i) the master, a member of the crew or aperson employed or engaged in any capac-ity on board the vessel on the business ofthat vessel, or
(ii) under one year of age;(b) a person carried on a vessel that is not aSafety Convention vessel who is
(i) the master, a member of the crew or aperson employed or engaged in any capac-ity on board the vessel on the business ofthat vessel, or
(ii) a guest on board the vessel, if the ves-sel is used exclusively for pleasure and theguest is carried on it without remunerationor any object of profit;

board a vessel that contravened any of sec-tions 5.3 to 5.5 of the Coastal FisheriesProtection Actand knew, when the contra-vention occurred, that the vessel was com-mitting the contravention, or

16.1 (1) An applicant who receives a noticeunder subsection 16(5) may, on or before thedate specified in the notice or within any fur-ther time that the Tribunal on application al-lows, file a written request for a review of thedecision if
(a) the request is in respect of a Canadianmaritime document that is issued under Part3 (Personnel); and
(b) the grounds for refusing to issue the doc-ument are set out in paragraph 16(4)(a), (b),(c) or (e).

Period ofvalidity
17. (1) Every Canadian maritime documentis valid for the period specified by the Minister
of Transport. The Minister may, on applicationmade before a document expires and in theform and manner specified by the Minister, ex-tend the period if the Minister is satisfied that itis not feasible to issue a new document beforethe document expires.

20. (1) Subject to section 20.1, the Ministerof Transport may suspend, cancel or refuse torenew a Canadian maritime document if theMinister is satisfied that

(c) the document was obtained by any fraud-ulent or improper means or a misrepresenta-tion of any material fact;
(d) the holder of the document has not paida fine or penalty imposed on them under thisAct;
(e) the holder of the document has contra-vened a provision of this Act or the regula-tions that the Minister is responsible for ad-ministering;
