The report herewith submitted is for the calendar year 1975 andis the Ninety-Ninth Annual Report upon conditions of the Coalmines within the State.
The reports from the various mining operators throughout theState show the tonnage to be as follows:
COAL PRODUCTION
Strip Mine 2,399,564.47 95%Deep Mine 85,421.00 4%Auger Mine 35,779.80 1%

COAL PRODUCTIONAllegany County: During the calendar year 1975 the Allegany
County mines employed a total of 240 surface employees. Theproduction of coal for 1975 was 949,802.16 net tons. This shows aproduction of 3,957.50 net tons per man employed during thisperiod.
Garrett County: During the calendar year 1975 the GarrettCounty mines employed 46 deep miners and 351 surface employees,making a total of 397 men. The production of coal for 1975 was1,570,963.11 net tons. This shows a production of 3,957.08 net tonsper man employed during this period.
FIRE CLAY PRODUCTION
There was no clay production in Allegany or Garrett Countiesduring the calendar year 1975.

FATALITIESFatal accident to Michael Nichols (age 23, single), Westernport,Maryland, at the tipple of Moran Coal Company, Inc., located at thenorth end of Westernport
Mr. Nichols had been employed about 3 months as a truckweighman. Don Moran, one of the owners of the company, hadinstructed him in the duties of weighman, which were to weightruckloads of coal and pick rock from coal after it was dumped onthe ground.
On the morning of the accident, the tipple crew and Mr. Nicholshad started to work in their respective jobs at 7 :00 a.m. as usual.At noon the tipple crew finished loading the railroad cars and leftthe area. Mr. Nichols remained.
According to Don Moran he visited the job at 1 :00 p.m., and Mr.Nichols was cleaning the track where the haulroad crosses. Mr.Moran instructed him to pick rock from coal when the trucksdumped, as well as weigh the trucks. Mr. Moran then left to checkthe source of "dirty" coal.
At about 1 :45 p.m. Robert Conor, independent trucker haulingfrom Clise Coal Company to the above tipple, saw Mr. Nicholscleaning off a platform (44 ft. from site of fatality). Mr. Conorwas the last to see the victim alive.
Aubrey Fairgrieve, independent trucker hauling from Clise CoalCompany to Moran's tipple, saw Mr. Nichols caught in the beltlinereturn roller a few minutes after 2:00 p.m. as he approached thescales with a load of coal. He ran over and shut the belt off andthen checked Mr. Nichols and saw that he could do nothing. Heran to the scale house and telephoned the company office, who, inturn, called the Rescue Squad (call received at 2 :17 p.m.)
The Rescue Squad arrived at the scene before Mr. Fairgrievegot back from the telephone.
The Rescue Squad found the victim caught between belt andreturn roller with both arms over and hanging down (toward driveend). His head was back over the right shoulder, and his clothingwas pulled up over his back and tangled in the roller. They hadto cut part of his clothing to get him out. As nearly as they couldtell, the victim was dead.
None of the officials or employees could understand why thedeceased was operating the belt conveyor. The return roller bear-ings were bad and in need of replacement. Whether or not thedeceased may have been tampering with the roller is not known.
RECOMMENDATION: Employees should be thoroughly indoc-trinated in exposure hazards, especially in the area of their work.

REVEGETATION OF STRIP-MINED REGIONBy Fred L. Bagley
Revegetation was accomplished at a record pace in 1975. Thisoccurred because of two reasons. First, the Land Reclamation Com-mittee scrutinized the revegetation accomplishments of each coalcompany in conjunction with their annual progress report anddemanded more and better revegetation accomplishments. Secondly,because of market conditions more strip mining permits wereissued, consequently more acres were strip mined during the year.
During 1975, one thousand one hundred and one acres wererevegetated. However the acres revegetated during 1975! cannot beconsidered for bond release until 1977 because of the two-yearholding period required by law.
Eight hundred and twenty-one acres of strip mined land reveg-etated during 1973 were considered for revegetation bond releaseduring 1975. Three hundred and ninety-six acres of this total wereapproved for release, and the remaining four hundred and twenty-five acres were not released. The reasons for not releasing the acresare either because more evaluation of the vegetation is needed; or,on a few permits, because corrective action is needed.
The actual revegetation costs for the year should be broken downinto three different categories. They are as follows, using averagedata supplied to the Bureau of Mines:

State of Maryland Doing the Revegetation Work
Total per acre $250.00
Private Contractor Doing the Revegetation Work
Total per acre $450.00
The cost must certainly be considered in revegetation, but thesuccess of the revegetation is far more important.
Contract revegetation has occurred only in the past two years inMaryland. It is too early to make a just evaluation of their work;however, to date partial success has been obtained.
The operator's revegetation work has improved steadily eachyear. They are realizing the importance of saving topsoil, preparinga seed bed, increasing the seed rate, using sufficient mulchingmaterial and having competent supervision in accomplishing theirrevegetation work.
The State of Maryland has done limited revegetation work andhas been relatively successful. This success has been attributed pri-

manly to better overall supervision and control of the entirerevegetation procedure.
In conclusion, revegetation of strip mined areas in 1975 was aprimary consideration of the Land Reclamation Committee and itsmember agencies. Costs fluctuated, and different degrees of successwere obtained. However, through experience and research projectsmore data is gathered and better revegetation is achieved. Thistrend will be maintained and very possibly be accelerated in thecoming year.

Meetings and TimeThe Land Reclamation Committee put in fourteen committee
days during the year. The committee meets on the second Wednes-day of each month at the City Building at Westernport, Maryland.Meetings begin at 9 :00 a.m. and carry through to completion of thebusiness before the committee. All meetings are open to the publicand are announced in the Maryland Register and local papers.
Functions and Duties of The CommitteeThe Land Reclamation Committee oversees land reclamation acti-
vities related to the surface mining of bituminous coal in Maryland.It is specifically directed by statute (Annotated Code of Maryland,

Section 7-205/b/) to: . . study, recommend, and approve allprocedures for reclamation, conservation, and revegetation of anyarea affected by open-pit mining within the state. .
Some of the more important specific duties addressed by thecommittee during its monthly meetings are:
1. Review, modification, and approval of the mining and recla-mation plans.
2. Review and approval of all Annual Mining and ReclamationProgress Reports and Final Reports.
3. Establish amount of revegetation bond for each operation.4. Inspect all areas for which application is made to determine
adequacy of the mining and reclamation plan.
The Site Evaluation Committee functions as a subcommittee ofthe Land Reclamation Committee and is composed of all membersexcept the Chairman. The Site Evaluation Committee schedulesabout two days each month to visit sites for which mining andreclamation plans have been filed to determine the suitability ofthe plan. The Site Evaluation Committee also examines sites forpurposes of approval of annual progress reports and final reports.
Status of ReclamationAs can be seen in the Summary of Mining and Reclamation
Statistics, 1971-1975 (Table No. 2), the acreage permitted in 1975is about equivalent to the cumulative acreage permitted from 1971to 1973. The number of acres stripped in 1975 was also greater thanin previous years. It is significant to note that the number of acresbackfilled in 1975 is almost equivalent to the acres stripped, whichindicates that the backfilling operations are beginning to keepconcurrent with the mining operations. Perhaps more significantstill is the fact that in 1975, for the first time, more acres have beenplanted (961) than have been backfilled (881) or stripped (887).This indicates that planting is beginning to catch up to backfi]lingin the reclamation cycle. The Land Reclamation Committee requiresthat vegetation go through two growing seasons (two years) beforeplanting is approved. Moreover, at least 80% cover of vegetationmust be established in order to be approved. We are concerned thatno revegetation areas had been approved in 1975; but by the end ofthe year the State Forester had tentatively approved 404 acres forrelease.
On sites where revegetation has not been successful, the com-mittee requires that the site be replanted and the revegetation bondwill remain in force and effect until such time that adequate vegeta-tion is established.
The saving of top soil and spreading it on the backfilled sitehas improved immeasurably the success of vegetative growth on thereclaimed sites.

Other Activities of The Land Reclamation CommitteeIn addition to those activities summarized in Table No. 2 covering
the past Mining and Reclamation Statistics, the Land ReclamationCommittee engaged in the following:
1. Assisted in conducting tours of mining and reclamation sitesfor the General Assembly and the Tn-County Council.
2. Developed a report in cooperation with the Bureau of Minesand the Maryland Geological Survey on the effects of mining inthe Cherry Creek Basin for the Garrett County Zoning Com-mission.
3. Developed revised regulations in regard to application pro-cedures and coordination with other regulatory bodies.
4. Approved continuation of a $600 per acre revegetation bond.5. Approved procedure to announce proposal to release re-
vegetated acres in Maryland Register.6. Initiated press release at conclusion of each meeting sum-
