SECTION 1. SHORT TITLE. 3
This Act may be cited as the ââSecond Chance Reau-4
thorization Act of 2013ââ. 5

SEC. 2. IMPROVEMENTS TO EXISTING PROGRAMS. 1
(a) REAUTHORIZATION OF ADULT AND JUVENILE 2
OFFENDER STATE AND LOCAL DEMONSTRATION 3
PROJECTS.âSection 2976 of title I of the Omnibus Crime 4
Control and Safe Streets Act of 1968 (42 U.S.C. 3797w) 5
is amendedâ 6
(1) by striking subsection (a) and inserting the 7
following: 8
ââ(a) GRANT AUTHORIZATION.âThe Attorney Gen-9
eral shall make grants to States, local governments, terri-10
tories, or Indian tribes, or any combination thereof (in this 11
section referred to as an âeligible entityâ), in partnership 12
with interested persons (including Federal corrections and 13
supervision agencies), services providers, and nonprofit or-14
ganizations for the purpose of strategic planning and im-15
plementation of adult and juvenile offender reentry 16
projects.ââ; 17
(2) in subsection (b)â 18
(A) in paragraph (3), by inserting ââor re-19
entry courts,ââ after ââcommunity,ââ; 20
(B) in paragraph (6), by striking ââandââ at 21
the end; 22
(C) in paragraph (7), by striking the pe-23
riod at the end and inserting ââ; andââ; and 24
(D) by adding at the end the following: 25

sistent with the Transitional Jobs strategy (as de-2
fined in section 4 of the Second Chance Act of 2007 3
(42 U.S.C. 17502)).ââ; 4
(3) by striking subsections (d), (e), and (f) and 5
inserting the following: 6
ââ(d) COMBINED GRANT APPLICATION; PRIORITY 7
CONSIDERATION.â 8
ââ(1) IN GENERAL.âThe Attorney General shall 9
develop a procedure to allow applicants to submit a 10
single application for a planning grant under sub-11
section (e) and an implementation grant under sub-12
section (f). 13
ââ(2) PRIORITY CONSIDERATION.âThe Attorney 14
General shall give priority consideration to grant ap-15
plications under subsections (e) and (f) that include 16
a commitment by the applicant to partner with a 17
local evaluator to identify and analyze data that 18
willâ 19
ââ(A) enable the grantee to target the in-20
tended offender population; and 21
ââ(B) serve as a baseline for purposes of 22
the evaluation. 23
ââ(e) PLANNING GRANTS.â 24

ââ(1) IN GENERAL.âExcept as provided in para-1
graph (3), the Attorney General may make a grant 2
to an eligible entity of not more than $75,000 to de-3
velop a strategic, collaborative plan for an adult or 4
juvenile offender reentry demonstration project as 5
described in subsection (h) that includesâ 6
ââ(A) a budget and a budget justification; 7
ââ(B) a description of the outcome meas-8
ures that will be used to measure the effective-9
ness of the program in promoting public safety 10
and public health; 11
ââ(C) the activities proposed; 12
ââ(D) a schedule for completion of the ac-13
tivities described in subparagraph (C); and 14
ââ(E) a description of the personnel nec-15
essary to complete the activities described in 16
subparagraph (C). 17
ââ(2) MAXIMUM TOTAL GRANTS AND GEO-18
GRAPHIC DIVERSITY.â 19
ââ(A) MAXIMUM AMOUNT.âThe Attorney 20
General may not make planning grants and im-21
plementation grants to 1 eligible entity in a 22
total amount that is more than a $1,000,000. 23
ââ(B) GEOGRAPHIC DIVERSITY.âThe At-24
torney General shall make every effort to en-25

sure equitable geographic distribution of grants 1
under this section and take into consideration 2
the needs of underserved populations, including 3
rural and tribal communities. 4
ââ(3) PERIOD OF GRANT.âA planning grant 5
made under this subsection shall be for a period of 6
not longer than 1 year, beginning on the first day 7
of the month in which the planning grant is made. 8
ââ(f) IMPLEMENTATION GRANTS.â 9
ââ(1) APPLICATIONS.âAn eligible entity desiring 10
an implementation grant under this subsection shall 11
submit to the Attorney General an application 12
thatâ 13
ââ(A) contains a reentry strategic plan as 14
described in subsection (h), which describes the 15
long-term strategy and incorporates a detailed 16
implementation schedule, including the plans of 17
the applicant to fund the program after Federal 18
funding is discontinued; 19
ââ(B) identifies the local government role 20
and the role of governmental agencies and non-21
profit organizations that will be coordinated by, 22
and that will collaborate on, the offender re-23
entry strategy of the applicant, and certifies the 24
involvement of such agencies and organizations; 25

ââ(C) describes the evidence-based method-1
ology and outcome measures that will be used 2
to evaluate the program funded with a grant 3
under this subsection, and specifically explains 4
how such measurements will provide valid meas-5
ures of the impact of that program; and 6
ââ(D) describes how the project could be 7
broadly replicated if demonstrated to be effec-8
tive. 9
ââ(2) REQUIREMENTS.âThe Attorney General 10
may make a grant to an applicant under this sub-11
section only if the applicationâ 12
ââ(A) reflects explicit support of the chief 13
executive officer, or their designee, of the State, 14
unit of local government, territory, or Indian 15
tribe applying for a grant under this subsection; 16
ââ(B) provides extensive discussion of the 17
role of Federal corrections, State corrections 18
departments, community corrections agencies, 19
juvenile justice systems, and tribal or local jail 20
systems in ensuring successful reentry of of-21
fenders into their communities; 22
ââ(C) provides extensive evidence of collabo-23
ration with State and local government agencies 24
overseeing health, housing, child welfare, edu-25

cation, substance abuse, victims services, and 1
employment services, and with local law en-2
forcement agencies; 3
ââ(D) provides a plan for analysis of the 4
statutory, regulatory, rules-based, and practice- 5
based hurdles to reintegration of offenders into 6
the community; 7
ââ(E) includes the use of a State, local, ter-8
ritorial, or tribal task force, described in sub-9
section (i), to carry out the activities funded 10
under the grant; 11
ââ(F) provides a plan for continued collabo-12
ration with a local evaluator as necessary to 13
meeting the requirements under subsection (h); 14
and 15
ââ(G) demonstrates that the applicant par-16
ticipated in the planning grant process or en-17
gaged in comparable planning for the reentry 18
project. 19
ââ(3) PRIORITY CONSIDERATIONS.âThe Attor-20
ney General shall give priority to grant applications 21
under this subsection that bestâ 22
ââ(A) focus initiative on geographic areas 23
with a disproportionate population of offenders 24

ââ(B) includeâ 3
ââ(i) input from nonprofit organiza-4
tions, in any case where relevant input is 5
available and appropriate to the grant ap-6
plication; 7
ââ(ii) consultation with crime victims 8
and offenders who are released from pris-9
ons, jails, and juvenile facilities; 10
ââ(iii) coordination with families of of-11
fenders; 12
ââ(iv) input, where appropriate, from 13
the juvenile justice coordinating council of 14
the region; 15
ââ(v) input, where appropriate, from 16
the reentry coordinating council of the re-17
gion; and 18
ââ(vi) other interested persons, as ap-19
propriate; 20
ââ(C) demonstrate effective case assessment 21
and management abilities in order to provide 22
comprehensive and continuous reentry, includ-23
ingâ 24

ââ(i) planning for prerelease transi-1
tional housing and community release that 2
begins upon admission for juveniles and 3
jail inmates, and, as appropriate, for pris-4
on inmates, depending on the length of the 5
sentence; 6
ââ(ii) establishing prerelease planning 7
procedures to ensure that the eligibility of 8
an offender for Federal, tribal, or State 9
benefits upon release is established prior to 10
release, subject to any limitations in law, 11
and to ensure that offenders obtain all nec-12
essary referrals for reentry services, includ-13
ing assistance identifying and securing 14
suitable housing; and 15
ââ(iii) delivery of continuous and ap-16
propriate mental health services, drug 17
treatment, medical care, job training and 18
placement, educational services, vocational 19
services, and any other service or support 20
needed for reentry; 21
ââ(D) review the process by which the ap-22
plicant adjudicates violations of parole, proba-23
tion, or supervision following release from pris-24
on, jail, or a juvenile facility, taking into ac-25

count public safety and the use of graduated, 1
community-based sanctions for minor and tech-2
nical violations of parole, probation, or super-3
vision (specifically those violations that are not 4
otherwise, and independently, a violation of 5
law); 6
ââ(E) provide for an independent evaluation 7
of reentry programs that include, to the max-8
imum extent possible, random assignment and 9
controlled studies to determine the effectiveness 10
of such programs; 11
ââ(F) target moderate and high-risk offend-12
ers for reentry programs through validated as-13
sessment tools; and 14
ââ(G) target offenders with histories of 15
homelessness, substance abuse, or mental ill-16
ness, including a prerelease assessment of the 17
housing status of the offender and behavioral 18
health needs of the offender with clear coordi-19
nation with mental health, substance abuse, and 20
homelessness services systems to achieve stable 21
and permanent housing outcomes with appro-22
priate support service. 23

ââ(4) AMOUNT.âThe amount of a grant made 1
under this subsection may not be more than 2
$925,000. 3
ââ(5) PERIOD OF GRANT.âA grant made under 4
this subsection shall be effective for a 2-year pe-5
riodâ 6
ââ(A) beginning on the date on which the 7
planning grant awarded under subsection (e) 8
concludes; or 9
ââ(B) in the case of an implementation 10
grant awarded to an eligible entity that did not 11
receive a planning grant, beginning on the date 12
on which the implementation grant is award-13
ed.ââ; 14
(4) in subsection (h)â 15
(A) by redesignating paragraphs (2) and 16
(3) as paragraphs (3) and (4), respectively; and 17
(B) by striking paragraph (1) and insert-18
ing the following: 19
ââ(1) IN GENERAL.âAs a condition of receiving 20
financial assistance under subsection (f), each appli-21
cation shall develop a comprehensive reentry stra-22
tegic plan thatâ 23

ââ(A) contains a plan to assess inmate re-1
entry needs and measurable annual and 3-year 2
performance outcomes; 3
ââ(B) uses, to the maximum extent possible, 4
randomly assigned and controlled studies, or 5
rigorous quasi-experimental studies with 6
matched comparison groups, to determine the 7
effectiveness of the program funded with a 8
grant under subsection (f); and 9
ââ(C) includes as a goal of the plan to re-10
duce the rate of recidivism for offenders re-11
leased from prison, jail or a juvenile facility 12
with funds made available under subsection (f). 13
ââ(2) LOCAL EVALUATOR.âA partnership with a 14
local evaluator described in subsection (d)(2) shall 15
require the local evaluator to use the baseline data 16
and target population characteristics developed 17
under a subsection (e) planning grant to derive a 18
feasible and meaningful target goal for recidivism re-19
duction during the 3-year period beginning on the 20
date of implementation of the program.ââ; 21
(5) in subsection (i)(1)â 22

ââ(M) increased self-reports of successful 9
community living, including stability of living 10
situation and positive family relationships; 11
ââ(N) reduction in drug and alcohol use; 12

viduals receiving reentry services after release, 15
as compared to either baseline recidivism rates 16
in the jurisdiction of the grantee or recidivism 17

ââ(3) provides juvenile and adult eligible offend-1
ers reentering the community with coordinated and 2
comprehensive reentry services and programs, such 3
asâ 4
ââ(A) drug and alcohol testing and assess-5
ment for treatment; 6
ââ(B) assessment for substance abuse from 7
a substance abuse professional who is approved 8
by the State or Indian tribe and licensed by the 9
appropriate entity to provide alcohol and drug 10
addiction treatment, as appropriate; 11
ââ(C) substance abuse treatment from a 12
provider that is approved by the State or Indian 13
tribe, and licensed, if necessary, to provide med-14
ical and other health services; 15
ââ(D) health (including mental health) serv-16
ices and assessment; 17
ââ(E) aftercare and case management serv-18
ices thatâ 19
ââ(i) facilitate access to clinical care 20
and related health services; and 21
ââ(ii) coordinate with such clinical care 22
and related health services; and 23
ââ(F) any other services needed for reentry; 24

SEC. 3. AUDIT AND ACCOUNTABILITY OF GRANTEES. 1
(a) DEFINITION.âIn this section, the term ââunre-2
solved audit findingââ means an audit report finding or rec-3

unauthorized expenditure or otherwise unallowable cost 5
that is not closed or resolved during a 1-year period begin-6

paragraphs (1) through (5) of subsection (b) may not 19
be used by any grant recipient toâ 20

fectiveness of the type of program on recidivism. 2
ââ(2) ELIGIBILITY FOR RECIDIVISM REDUCTION 3
PARTNERSHIP.âA faith-based or community-based 4
nonprofit organization that provides mentoring or 5
other programs that have been demonstrated to re-6
duce recidivism is eligible to enter into a recidivism 7
reduction partnership with a prison or community- 8
based facility operated by the Bureau of Prisons. 9
ââ(3) RECIDIVISM REDUCTION PARTNERSHIPS.â 10
The Director of the Bureau of Prisons shall develop 11
policies to require wardens of prisons and commu-12
nity-based facilities to enter into recidivism reduc-13
tion partnerships with faith-based and community- 14
based nonprofit organizations that are willing to pro-15
vide, on a volunteer basis, programs described in 16
paragraph (2). 17
ââ(4) REPORTING REQUIREMENT.âThe Director 18
of the Bureau of Prisons shall submit to Congress 19
an annual report on the last day of each fiscal year 20
thatâ 21
ââ(A) details, for each prison and commu-22
nity-based facility for the fiscal year just 23
endedâ 24

TIES RELATING TO REENTRY OF OFFENDERS. 23
(a) TASK FORCE REQUIRED.âThe Attorney General, 24

Development, the Secretary of Labor, the Secretary of 1
Education, the Secretary of Health and Human Services, 2
the Secretary of Veterans Affairs, the Secretary of Agri-3
culture, and the heads of such other agencies of the Fed-4
eral Government as the Attorney General considers appro-5
priate, and in collaboration with interested persons, serv-6
ice providers, nonprofit organizations, States, tribal, and 7
local governments, shall establish an interagency task 8
force on Federal programs and activities relating to the 9
reentry of offenders into the community (referred to in 10
this section as the ââTask Forceââ). 11
(b) DUTIES.âThe Task Force shallâ 12
(1) identify such programs and activities that 13
may be resulting in overlap or duplication of serv-14
ices, the scope of such overlap or duplication, and 15
the relationship of such overlap and duplication to 16
public safety, public health, and effectiveness and ef-17
ficiency; 18
(2) identify methods to improve collaboration 19
and coordination of such programs and activities; 20
(3) identify areas of responsibility in which im-21
proved collaboration and coordination of such pro-22
grams and activities would result in increased effec-23
tiveness or efficiency; 24

would improve outcomes of reentering offenders and 3
children of offenders; 4
(5) develop methods for increasing regular com-5
munication among agencies that would increase 6
interagency program effectiveness; 7
(6) identify areas of research that can be co-8
ordinated across agencies with an emphasis on ap-9
plying evidence-based practices to support, treat-10
ment, and intervention programs for reentering of-11
fenders; 12
(7) identify funding areas that should be co-13
ordinated across agencies and any gaps in funding; 14
and 15
(8) in collaboration with the National Adult and 16
Juvenile Offender Reentry Resources Center, iden-17
tify successful programs currently operating and col-18
lect best practices in offender reentry from dem-19
onstration grantees and other agencies and organiza-20
tions, determine the extent to which such programs 21
and practices can be replicated, and make informa-22
tion on such programs and practices available to 23
States, localities, nonprofit organizations, and oth-24
ers. 25

(c) REPORT.â 1
(1) IN GENERAL.âNot later than 1 year after 2
the date of the enactment of this Act, the Task 3
Force shall submit a report, including recommenda-4
tions, to Congress on barriers to reentry. 5
(2) CONTENTS.âThe report required under 6
paragraph (1) shall identify Federal and other bar-7
riers to successful reentry of offenders into the com-8
munity and analyze the effects of such barriers on 9
offenders and on children and other family members 10
of offenders, includingâ 11
(A) admissions and evictions from Federal 12
housing programs; 13
(B) child support obligations and proce-14
dures; 15
(C) Social Security benefits, veterans bene-16
fits, food stamps, and other forms of Federal 17
public assistance; 18
(D) Medicaid Program and Medicare Pro-19
gram procedures, requirements, regulations, 20
and guidelines; 21
(E) education programs, financial assist-22
ance, and full civic participation; 23

(H) reentry procedures, case planning, and 5
transitions of persons from the custody of the 6
Federal Bureau of Prisons to a Federal parole 7
or probation program or community corrections; 8
(I) laws, regulations, rules, and practices 9
that may require a parolee to return to the 10
same county that they were living in before 11
their arrest and therefore prevent offenders 12
from changing their setting upon release; and 13
(J) trying to establish pre-release planning 14
procedures for prisoners to ensure that a pris-15
onerâs eligibility for Federal or State benefits 16
(including Medicaid, Medicare, Social Security 17
and veterans benefits) upon release is estab-18
lished prior to release, subject to any limita-19
tions in law, and to ensure that prisoners are 20
provided with referrals to appropriate social and 21
health services or are referred to appropriate 22
nonprofit organizations. 23
(d) UPDATED REPORTS.âOn an annual basis, the 24
Task Force shall submit to Congress an updated report 25

Section 8(e)(1) of the Prison Rape Elimination Act 6
of 2003 (42 U.S.C. 15607(e)(1)) is amended by adding at 7
the end the following: 8
ââ(C) LIMITATION.â 9
ââ(i) VIOLENCE AGAINST WOMEN ACT.â 10
For purposes of this subsection, a grant pro-11
gram shall not be considered to be covered 12
by this subsection if the program is admin-13
istered by the Office of Violence Against 14
Women. 15
ââ(ii) DELAY.âDuring the 4-year pe-16
riod beginning on the date of enactment of 17
the Second Chance Reauthorization Act of 18
2013, for purposes of this subsection, a 19
grant program shall not be considered to be 20
covered by this subsection if the program is 21
funded under subpart 1 of part E of title I 22
of the Omnibus Crime Control and Safe 23
Streets Act of 1968 (42 U.S.C. 3750 et seq.) 24
or section 221 of the Juvenile Justice and 25
