RECOMMENDATION: That Council: A. Undertake a Schedule 1 Amendment to the Planning Scheme for the Former
City of Cairns, CairnsPlan to include the Smithfield Town Centre Amendment 2009 No.2
B. That Council endorse the Smithfield Town Centre Amendment 2009 No.2 for
the purpose of a first State interest review in accordance with the Integrated Planning Act 1997 as attached as Appendix 1.
INTRODUCTION: The Smithfield Town Centre has been considered previously by past and present Councils. This report summarises and seeks Council endorsement of the proposed amendments to CairnsPlan to include details on the proposed Town Centre for Smithfield to proceed for the first State interest review. The FNQ 2031 Regional Plan commenced on 13 February 2009. It should be noted that the proposed amendment does not reflect the regional plan. Comments will be received from State agencies during the first State agency review in relation to this matter.
BACKGROUND: Planning for a Town Centre in Smithfield has been recognised for over a decade. In the mid 1990’s the Smithfield Town Centre Development Control Plan Planning Study informed a Smithfield Town Centre Development Control Plan (DCP) which was incorporated in The Panning Scheme of the Balance of the City of Cairns (1996). This Development Control Plan identified land bounded by the proposed Smithfield bypass alignment to the east, and to the west by Cumberland Avenue and the western boundary of properties fronting the Captain Cook Highway to become a primary focus for the Marlin Coast and the northern areas of the Cairns region. The DCP listed a number of Planning Goals and Objectives along with proposing precincts for different areas of the Town Centre.

The Smithfield Town Centre Development Control Plan stated that: “The Town Centre will comprise a mix of commercial, retail, residential, tourist, educational, cultural, health and community facilities with a pedestrian focus. It will be designed around and served by public transport and will be accessible, attractive and friendly to people young and old, able and disabled, resident and visitor“. In 2005 the CairnsPlan became the Planning Scheme for the City of Cairns under the Integrated Planning Act 1997 (IPA). Under the IPA detailed regulatory Development Control Plans were not able to be included in IPA Planning Schemes and as such the Smithfield Town Centre Development Control Plan was not carried on through to the CairnsPlan. The Draft CairnsPlan included the greenfield land within the Town Centre as Industry, in recognition of the need for greater employment land in the Cairns Beaches. A number of submissions were received on the matter, primarily because of the Industry zone intent. Prior to the adoption of the CairnsPlan, a development application was lodged and approved to for residential and commercial uses, and as such the adopted CairnsPlan reflected this decision. In early 2007, Council was approached by representatives of land located at Smithfield to consider a proposal for the establishment of a town centre to service the Northern Beaches. An Enquiry by Design (EbD) Workshop was held over one and a half consecutive days, from 23 to 24 July 2007. Following this Workshop, the “Smithfield Town Centre” Planning Area was renamed the “Cairns Beaches Town Centre”. This branding was considered at the time to best reflect the wider location and design elements that could be used. A Technical Working Group was convened to discuss issues from a State and Local Government perspective. At its 24 January 2008 Ordinary Council meeting, Cairns City Council resolved to use the Design Outcomes Report as a basis for progressing the Planning Scheme amendments for the Cairns Beaches Town Centre, subject to further investigations all possible options for the future provision of commercial, business and industry activities for the Smithfield and Beaches areas be undertaken. In June 2008 it was confirmed that both Conics and Flanagan Consulting Group would represent LHL Investments and Trinity Park Investments as a consultant team. From this it was requested that Council endorse the proposed Draft Schedule of Tasks for the Cairns Beaches Town Centre. It was also requested that Council conduct a peer review of the economic reports for the Cairns Beaches Town Centre which was carried out by Economic Associates in October 2008. The peer review considered three Economic reports presented by Consultants and focused on the appropriateness of the methodology, assumptions and data on which the reports relied in forming their conclusions regarding the scope, scale and timing of the proposed Cairns Beaches Town Centre.

The analysis of potential locations for a town centre was carried out in response the Council resolution from January 2008. The outcome of this analysis identified the Smithfield site as the best possible site for a town centre to occur as it satisfied and scored highly against all the required criteria when compared to other possible sites. The project was also re branded the “Smithfield Town Centre” due to changes to local government boundaries and to provide greater consistency with the Edmonton Town Centre project. The re-branding also provided a location based identity for the project A detailed design workshop was conducted on 1 December 2008 between Council Officers, State Government Agencies along with the land owner appointed consultants. Based on the outcomes of this workshop a “preferred option” for the structure of the proposed Town Centre was identified. As part of the project program, a community consultation program was undertaken for the project. The consultation program included consultation sessions along with the opportunity for submissions to be received on the Town Centre concept. The consultation and resulting report went before for noting Council at its Planning & Environment Committee meeting on the 11 February 2009. At its Planning and environment meeting on 8 July 2009 Council resolved to: ● Endorse the revised CairnsPlan Town Centres Amendment 2009 No.1 for the
purpose of a first State interest review in accordance with Schedule 1 of the Integrated Planning Act 1997; and
● Prepare a new Planning Scheme Policy – Requirements for Town Centre Master
Plan in accordance with Schedule 3 of the Integrated Planning Act 1997. In addition to this Council also made minor changes to parts of the codes relevant to the Smithfield Town centre. These have been cared forward to this amendment with the exception of changing the level of assessment for Shopping Facilities > 10,000m2 GFA to Impact assessable. This remains as Code assessable.
COMMENT: At the Ordinary meeting on the 29 July 2009 a recision notice was put forward for the July 8 resolution citing that Council reconsider the report and the proposed amendments to CairnsPlan. Following this recision notice a Councillor workshop was held on the 5 August 2009 to discuss issues and reach agreement on a way forward for the Town Centre amendments. From this workshop it was agreed that the amendments be split to individual amendment packages for each town centre. It was also acknowledged that the minor changes to parts of the codes relevant to the Smithfield Town Centre remain in the Smithfield Town Centre amendment with the exception of changing the level of assessment for Shopping Facilities > 10,000m2 GFA to Impact assessable in the Barron Smithfield District Assessment Table. This is recommended to remain as Code assessable.

The Smithfield Town Centre amendment seeks to amend Planning Areas Maps, Overlays, District Intent Statements and Desired Development Outcomes for the Barron Smithfield District. The Amendment introduces a new Planning Area entitled the “Town Centre Planning Area” and also Precinct Overlays which will direct detailed development outcomes for the Smithfield Town Centre.
CONSIDERATIONS: Corporate and Operational Plans: Corporate Plan 2009 - 2014 The proposed amendment also support the following objectives contained in the plan. 3.1 Implement an integrated approach to planning by Council and stakeholders 3.2 Deliver integrated provision of physical and social infrastructure in existing and
future parts of the region 3.7 Promote good urban design outcomes which are responsive to the region’s
tropical environment and unique character. 5.4 Encourage self containment of communities through the integration and co-
location of employment with residential development and public transport Statutory: The process for the amendment of a Planning Scheme is outlined in Schedule 1 of the Integrated Planning Act 1997. The Sustainable Planning Bill has now been tabled with parliament; however the introduction of the new Act will not impact on the proposed amendment which will still be undertaken in accordance with the Integrated Planning Act 1997. Policy: CairnsPlan is the tool to deliver Council’s desired development outcomes across the former City of Cairns. Financial and Risk: The budget allocation can be accommodated within the Planning Strategies Budget to undertake the Schedule 1 amendment process. Sustainability: The purpose of the Integrated Planning Act 1997 is to achieve ecological sustainable development. CairnsPlan seeks to advance this purpose. Sustainability criteria have been incorporated into the desired development outcomes and codes for the Town Centres including responding to tropical design, local character and energy reduction.

CONSULTATION: Public consultation for this amendment will be undertaken in accordance with the requirements of the Integrated Planning Act 1997 whereby the proposed amendment will be on public notification for at least 30 business days.
OPTIONS: That Council endorse the Smithfield Town Centre Amendment 2009 No.2 for the purpose of a first State interest review in accordance with the Integrated Planning Act 1997 as attached as Appendix 1; Or That Council not endorse the Smithfield Town Centre Amendment 2009 No.2 for the purpose of a first State interest review in accordance with the Integrated Planning Act 1997 as attached as Appendix 1.
CONCLUSION: It is recommended that Council resolve to amend the Planning Scheme in order to get the required detail in a statutory form to ensure desired development outcomes for the Smithfield Town Centre are achieved.
