Introduction
n 2008, the United States Department of Justice successfully prosecutedthe Holy Land Foundation for Relief and Development (HLF) and itsfounderson108charges,includingmaterialsupportforterrorism,moneylaunderingandtaxfraud.Thegovernment’stheoryofthecase,successfully
provenat trial,was that theHolyLandFoundationwasestablishedas a frontgroupof thePalestineCommittee—acovertorganizationof theU.S.branchofthe Muslim Brotherhood—and that its purpose in this conspiracy was toprovidefundsforthePalestinianterroristorganization,Hamas.
Inordertoproveitscase,theU.S.Governmentsuccessfullydemonstrated,first,that the Muslim Brotherhood was an international organization operatingacross theglobe, including in theUnitedStates.During the launchof theFirstIntifada against Israel in the early 1980s, theMuslimBrotherhooddecided toestablish “PalestineCommittees” across theglobe inorder toprovide supportforitsthen-neworganization,Hamas,whichwasengagedinawarofterrorismagainst the state of Israel and its civilian population. The job of the PalestineCommitteeswas,intheirownwords,“tomakethePalestiniancausevictoriousandtosupportitwithwhatitneedsofmedia,money,menandallofthat.”1
Oneof thekey elementsof theprosecution’s casewas audio surveillanceof ameeting held over the course of two days at a Courtyard byMarriot hotel inPhiladelphia,Pennsylvania,inOctober1993—oneyearpriortothedesignationofHamasasaterroristorganizationbytheClintonAdministration.
Thesuccessfulsurveillanceofthe1993“PhillyMeeting,”asitcametobecalled,wasvitaltotheU.S.Government’seffortstodemonstratetheroleofU.S.-basedMuslim Brotherhood organizations in supporting Hamas. It also became awindow into theoperationsof theBrotherhood in theUnitedStates at a timewhere preparations were being made for the designation of Hamas as aterroristgroup,thefirstseriousthreattotheBrotherhood’soperationssinceitbeganintheearly1960s.
Inparticular,thePhillyMeetingstandsoutastheearliestrecordofthefoundingof the Council on American Islamic Relations (CAIR) as an organization bothcreatedundertheauspicesofthePalestineCommitteeandinthecontextofitsgoal, support for Hamas. In that framework, CAIR had a responsibility forprovidingmediasupportandpropagandaonbehalfoftheMuslimBrotherhoodand Hamas. The founding of CAIR would represent a new era, as theBrotherhoodbegan to take itsmessagenot just to thePalestinianandMuslimcommunitiesinAmerica,butalsototheAmericanpeoplemorebroadly.
CAIR’sfoundingwasanimportanteventbecausethisnewfrontofthePalestineCommitteewouldbeempowerednot just todissimulateandpropagandizeon

behalf ofHamas, but for the largerMuslimBrotherhood cause as awhole. Assuch,theproposaltocreatethisneworganization—firstbroachedatthe1993Philly Meeting—required and received the approval of the Global MuslimBrotherhoodleadershipitself,accordingtoinformationobtainedbytheFBI.2
As thePalestineCommittee, includingCAIR,preparedtooperate inanewandpotentially hostile American environment—where open reference to supportfor jihad against Israel and financial support for Hamas would no longer belegallytolerated—theywouldbeguidedbythewordsspokenbyCAIRfounderOmarAhmad,whowaspresentatthemeeting.AhmadnotedtheimportanceofmisleadingAmericansaboutthetruenatureoftheMuslimBrotherhoodanditssupportfortheterrorwaragainstIsrael.
“Ibelieve thatourproblem is thatwestoppedworkingunderground.Wewillrecognizethesourceofanymessagethatcomesoutofus.Imean,ifamessageispublicized,wewill know...,”OmarAhmad told thePhillymeetingparticipants,“themediapersonamonguswillrecognizethatyousendtwomessages;onetotheAmericansandonetotheMuslims.”3
EchoesofOmarAhmad’swordsremainvisible today.CAIR, the lastremainingorganizationoftheoriginalPalestineCommittee,continuestooperateinmuchthe same manner as it was originally envisioned in Philadelphia. Portrayingitselfasa“Muslimcivilrightsgroup,”CAIRcontinuestoenjoylobbyingaccesstostateandfederallegislators,high-levelmeetingswithmembersoftheexecutivebranch,andthesupportandendorsementofuncuriousmediaoutlets.
CAIR cloaks itself in claims of moderation while promoting the same Islamicsupremacist agenda of encouraging AmericanMuslims to support Jihad, bothagainstIsraelandelsewhere.Whilethegrouppubliclypromotesatoned-downversionofIslamistrhetoricfortheAmericanpublicasawhole,itsownhistorybeliestheseclaimsofmoderation.
A number of CAIR’s employees and board members have been indicted,convicted and deported for terrorism or material support for terrorism, asnotedbytheLouisianaStateHouseofRepresentativeswhenitvotedtosupportaprohibitionagainststateofficials“interactingwiththegroup.4
ContainedinthisvolumeareannotatedexcerptsofcourttranscriptsfromU.S.vHolyLandFoundationforRelief&Development,asFBIAgentLaraBurnswalksActingU.S.DistrictAttorneyBarry Jonas through the events leadingup to thePhillyMeetinginOctober1993,followedbythemeetingitself.Thesetranscriptsoffer a valuable window into the deliberations and operations of theMuslimBrotherhoodinAmerica.

Abdel Haleem Ashqar was a Palestine Committee member and one of thefoundersoftheAlAqsaEducationalFund,anorganizationsuspectedofhelpingtofinanceHamas.Hewouldbeacquittedofterrorismfinancecharges, inpartbecause some of the evidence against him predated Hamas’ designation as aterrorist organization. Ashqar would later be convicted and sentenced to 11yearsinprisononchargesofcontemptandobstructionofjusticeforrefusingtotestify in a grand jury hearing about Hamas finance activities in the UnitedStates.5

OmarAhmadakaOmarYehia,wasoneof the foundingmembersofCAIRandpresidentoftheIslamicAssociationofPalestine6(aboutwhichmorewillbesaidlater).Ahmad’sroleasPresidentEmeritusofCAIRwasoneofthereasonscitedbytheFBIfortheirpolicyofcuttingtiestoCAIR.7 IntheaftermathoftheHLFtrial,duringadepositionforthesuccessfuldeportationofCAIRBoardmemberNabil Sadoun8, an FBI agent would describe Ahmad’s presence at the 1993PhillymeetingandidentifyAhmadas“oneoftheleadersofHAMAS.”9

The Islamic Association of Palestine (IAP) was an organization that theGovernment described as the “Propaganda and information” arm of thePalestine Committee that received money from Hamas leader Mousa AbuMarzooktoprovideHamaspropagandaintheUnitedStates.11ThegovernmentbriefgoesontodescribetheircaseagainstIAPasfollows:

The IAP, which involved the defendant Ghassan Elashi as an originalincorporator and bank account signatory,was designed as a propagandafacility,responsibleforIntifadafestivals(involvingthedefendantHLF),pro-Hamas publications, and the general rallying of support within theAmerican Palestinian community. The IAP was the first organization topublishanEnglishversionof theHamascharter,whichaspreviouslyexplainedvowstoreplaceIsrael,theWestBank,andGazawithanIslamicstate.

In addition to attending the PhillyMeeting and being named an unindicted co-conspirator in the Holy LandFoundation Trial, Hanootiwas also an unindicted co-conspirator in the 1993WorldTradeCenterBombingandhelpedtoraisefundsforthelegaldefenseofHamas leader Mousa Abu Marzook. TheElbarassedocumentsreferstoacacheofdocumentsseizedatthehomeofMuslimBrotherhoodPalestineCommitteememberIsmailElbarasse.Elbarasse’shome was searched after he and his wife were caught filming the structuralsupports of the Chesapeake Bay Bridge by an alert law enforcement officer.IncludedasevidenceforthesearchwarrantwasElbarasse’sattendanceatthe“PhillyMeeting”.15The subsequent searchof theAnnandale,Virginiapropertywould uncover a large archive of Muslim Brotherhood internal documents,speeches,audiotapesandothermaterials.Inall,fortyseparatedocumentsfromthe search were submitted as evidence by the prosecution in the Holy LandFoundationTrial.
