    SUMMARY

    This enactment amends the Canadian Human Rights Actby deleting sections13 and 54 to ensure there is no infringement on freedom of expressionguaranteed by the Canadian Charter of Rights and Freedoms.

    An Act to amend the Canadian Human RightsAct (protecting freedom)

    Her Majesty, by and with the advice andconsent of the Senate and House of Commonsof Canada, enacts as follows:

    CANADIAN HUMAN RIGHTS ACT

    1. Section 4 of the Canadian HumanRights Act is replaced by the following:

    4. A discriminatory practice, as described insections 5 to 14.1, may be the subject of acomplaint under Part III and anyone found to beengaging or to have engaged in a discriminatorypractice may be made subject to an order asprovided in section 53.

    2. Section 13 of the Act is repealed.3. Paragraph 40(5)(b) of the Act is re-

    placed by the following:

    (b) occurred in Canada and was a discrimi-natory practice within the meaning of sec-tion 5, 8, 10 or 12 in respect of which noparticular individual is identifiable as thevictim;

    4. The portion of subsection 53(2) of theAct before paragraph (a) is replaced by thefollowing:

    (2) If at the conclusion of the inquiry themember or panel finds that the complaint issubstantiated, the member or panel maymake an order against the person foundto be engaging or to have engaged in the

    1. Larticle 4 de la Loi canadienne sur lesdroits de la personne est remplac par ce quisuit:

    4. Les actes discriminatoires prvus auxarticles 5 14.1 peuvent faire lobjet duneplainte en vertu de la partie III et toute personnereconnue coupable de ces actes peut faire lobjetdes ordonnances prvues larticle 53.

    2. Larticle 13 de la mme loi est abrog.3. Lalina 40(5)b) de la mme loi est

    remplac par ce qui suit:

    b) a eu lieu au Canada sans quil soitpossible den identifier la victime, maistombe sous le coup des articles 5, 8, 10 ou 12;

    4. Le passage du paragraphe 53(2) de lamme loi prcdant lalina a) est remplacpar ce qui suit:

    (2) lissue de linstruction, le membreinstructeur qui juge la plainte fonde peutordonner, selon les circonstances, la personnetrouve coupable dun acte discriminatoire :

    discriminatory practice and include in the orderany of the following terms that the member orpanel considers appropriate:

    5. Section 54 of the Act is repealed.

    6. Section 57 of the Act is replaced by thefollowing:

    57. An order under section 53 may, for thepurpose of enforcement, be made an order of theFederal Court by following the usual practiceand procedure or by the Commission filing inthe Registry of the Court a copy of the ordercertified to be a true copy.

    COMING INTO FORCE

    7. This Act comes into force on the daythat is one year after the day on which itreceives royal assent.

    6. Larticle 57 de la mme loi est remplacpar ce qui suit:

    57. Aux fins dexcution, les ordonnancesrendues en vertu de larticle 53 peuvent, selon laprocdure habituelle ou ds que la Commissionen dpose au greffe de la Cour fdrale unecopie certifie conforme, tre assimiles auxordonnances rendues par celle-ci.
