Sir,I am directed to refer to your letter No. AI/IITM/Adm/008/2005
dated II th Aug, 2005 on the subject mentioned above and to convey the in- principleapproval of the competent authority on t~~ above mentioned proposal subject to certainamendmentsas listed below.:
1) As regards financial provisions/ matters contain~d iri the draft Bye-Laws. The institute mayimplement the Bye-Laws with slight amendment in Rule 15~-3,which may be read 'as follows:
"The proposals re'lating to emoluments structure i.e. adoption of pay scales, allowances andrevisionthereof and creation of posts would need the prior approvalof the Central Govt."
Now as regards the medical scheme to be implemented by the institute following amendmentsmay be made. .
Rule 3.1 may now read as follows:a) Pensioners of the Institute and members of their famiiies residing with them and
wholly dependenton them.b) Members of the family of the deceased; employee who was in the permanent
employment of the Institute, including the family of retired employee after hisdeath.. .

c) A pensioner re-employed in the Institute and members of his/her family providedhe/she is not covered by any other medical scheme in earlier pre-retirement serviceand opts for the medical scheme of the institute.
. d) The famiJyof the deceased employee may avail of the benefit of the scheme for thewhole of the month in which the employee died as well as the succeeding calendarmonth without payment of contribution said succeeding month.
Rule 3.2 stands deleted.
Rule-4 : Definition of 'Familv'
4.1 Family for the purpose of the scheme in terms of rule 3.I(a) and 3.I(c) in respect of retiredpensioner of the Institute shall mean:
a) A beneficiary wife or husband, as the case may be.b) Dependent unmarried chiJdren and step Children (below the age of 25 years)
normally residing with the employees. '.c) Unemployed widowed daughters and dependent divorced/separated daughters.d) Dependent parents which are not covered by any other Medical Scheme..e) . Sisters (unmarried and unemployed except judicially separated/divorced sic;ters).f) Unemployed widowed sisters. .
g) Unemployedminor brothersand dependentbrothers.. The total number of sisters (both unmarried and widowed) and minor
brothers and dependentbrothers not to exceedtwo. .
The total number of unmarried children, stepchildren and widoweddaughters not to exceed three.

4.2 'Family' for the purpose of the scheme in terms of rule 3.I(b) in respect of members ofthe family of deceased employeeshall mean.:
i) Wife in case of male Government servant or husband in case of a femaleGovernmentservant. .
ii) A judicially separated wife or husband,:such separation not been granted on theground of adultery and the person survivingwas held guilty of committingadultery.
iii) Son who has not attained the age of 25 (twenty five)years and unmarried daughterwho has not attained 25 (twenty five) years including such son and daughteradopted legally.

3. The beneficiary under this scheme residing at Pune and Delhi will be eligible to takemedical treatment OPD/Indoor at all the recognized hospitals under CGHS Scheme. Where thebeneficiary has settled at a place other than Pune and Delhi, they have to take medical treatmentfrom the Govt. Hospitals of the State concerned. Specialist consultation if required by the hospitalauthorities, same would be aHowed. The reimbursement for all the above treatment would be asper CGHS schedule as amended from time to time.
4. The entitlement fo~hospital accommodation,nursing home, fixation of package/ceilingrates in case of treatment from recognizedprivate hospital and diagnostic centers will be coveredby Ministry of Health and Family Welfare's introduction issued from time to til1}e,Which inter-alia relate to recognition of private hospitals/diagnostic centers for specialized and general-purposetreatment and. diagnostictreatment and fixationof package/ceilingrates.

BYE-LAWS
PART - I
In exercise of the powers conferred by Rules 9.4(3) & 20 of the Rules &
Regulations of I.I.T.M. and in supersession of the bye-laws approved by the then
Ministry of Tourism & Civil Aviation vide letter no. ME-20016/1/71-M dated 27.11.72,
the Governing Council of the Institute hereby frames these bye-laws with the sanction of
the Central Government. The bye-laws have been revised by the Governing Council at its
71st meeting held on 5
th May 2005 and approved by the Department of Science and
Technology vide letter No. AI/IITM/Adm.008/2005 dated 16.11.2005.
1 Short Title and Commencement
1.1 These Bye-laws shall be called the "Bye-laws of the Indian Institute of
Tropical Meteorology 2005 (hereinafter referred to as (IITM)". These
shall come into effect from 16th
November, 2005, the date of approval by
the Central Government.
1.2 These Bye-laws may be read in conjunction with the Rules and
Regulations of the IITM.
2 Definitions and Interpretation:
In these Bye-laws, the following words and abbreviations shall have the meanings
given against them, unless the context signifies otherwise :
"Administrative Officer" means the Administrative Officer of the Institute
appointed under the Rules;
"Accounts Officer" means the Accounts Officer of the Institute appointed under
the Rules;
"Bye-laws" means these Bye-laws framed under Rules 9.4(3) & 20 of the Rules
and Regulations;
"Central Government" means the Government of India represented by the
Ministry of Earth Sciences, Government of India;
"Chairman" means the Chairman of the Governing Council of the Society;
"Governing Council" means the Council constituted under and in accordance
with the rules;
"Director" means the Director of the Institute;

"Finance Committee" means the Finance Committee of the Institute;
"Financial Year" means the period from 1 April to 31 March;
"He", "Him", "His" shall include "She", "Her", respectively as per context mutatis
mutandis;
"Institute" means the INDIAN INSTITUTE OF TROPICAL METEOROLOGY
"Rules" shall mean and include the Rules and Regulations of the Institute;
"Non-Member Secretary" means the Non-Member Secretary of the Governing
Council;
"Society” means the INDIAN INSTITUTE OF TROPICAL METEOROLOGY.

CHAPTER- I
COUNCIL MEETINGS & PROCEDURE
1. Meetings:
1.1 The meetings of Council shall be convened not less than twice every year
by the Director at such place and date as may be fixed by him in
consultation with the Chairman. For the purpose of this rule, each year
shall be deemed to commence on the first day of April and terminate on
the 31st day of March of the following year.
1.2 A special meeting of the Council may be called at any other time by the
Chairman, either on his own initiative or at the request of not less than
four members of the Council.
2. Notice of meeting:
For any meeting of the Council, at least fifteen days notice shall be given to the
members. Non receipt of notice of any meeting of the Council by any member
shall not, however, invalidate the proceedings of the meeting.
3. Quorum and Procedure:
3.1 2/3rd
majority i.e.8 members including the Chairman, shall constitute a
quorum at any meeting of the Council.
3.2 In case of difference of opinion among the members, the opinion of the
majority shall prevail.
3.3 Each member of the Council, including the Chairman, shall have one vote,
and if there be a tie on any question to be determined by the Council, the
Chairman shall, in addition, have and exercise a casting vote.
4. Adjourned meeting:
If there is no quorum at the expiry of fifteen minutes after the time fixed for a
meeting, the meeting shall be adjourned to such a date as the Chairman may fix.
No quorum shall be necessary for a meeting adjourned for want of a quorum.
5. Chairman of the meeting:
The Chairman of the Council shall preside at all meetings of the Council. In the
absence of the Chairman, the members present shall elect one from among
themselves to preside at the meeting and he shall exercise all the rights and
privileges of the Chairman for that meeting.

6. Minutes:
The Administrative Officer who will act as the Non-Member Secretary shall keep
the minutes of the meetings of the Council and send a copy of the minutes of
every such meeting to the members as early as possible.
7. Vacancy:
Any casual vacancy in the Council shall be filled by nomination by the Central
Government in consultation with the Chairman, and the member so nominated to
fill such a casual vacancy, shall hold office for the remainder of the term of the
member in whose place he has been nominated.
8. Business by Circulation:
Any business of the Institute to be performed by the Council, except such as may
be placed before the meetings of the Council, may be carried out by circulation
among all its members and any resolution, so circulated and approved by a
majority of the members who have signified their approval, or disapproval of such
resolution, shall be as effective and binding as if such resolution had been passed
at a meeting of the Council. The resolution as approved by the Governing Council
should be reported at the next meeting of the Governing Council.
9. Advisory Committees:
The Council may appoint advisory committees consisting of its own members or
of other persons or both to report to it upon any matter concerning the Institute.
10. Committees of the Council:
The Council may appoint committees from amongst its own members of the staff
of the Institute or both, and may assign to such committees such powers and
duties as are in accordance with the Rules and Bye-laws. However, committees to
manage activities internal to the Institute such as Library, workshop, Stores etc.
shall be appointed by the Director from amongst the members of the staff.

CHAPTER – II
FINANCE AND ACCOUNTS
11 Preparation of Budget Estimates:
Not later than the 1st August of each year the Director shall prepare detailed
estimates of the receipts and expenditure and the anticipated opening and closing
balance of the Institute for the ensuing financial year. These estimates will be
prepared in two parts:
Part I: Relating to capital works and other items of capital nature;
and
Part II: Relating to income and expenditure on revenue account.
Should it be proposed, during the course of a financial year, to finance any
scheme approved by the Governing Council which has not been included in the
estimates for that year, the sanction of the Council, shall be obtained to the
method proposed for financing it, whether that be by means of a supplementary
grant from Government, or by re-appropriation within the sanctioned estimates.
12 Sanction of Budget Estimates:
12.1 In the first week of August every year, the Director shall send the Budget
estimates for the ensuing financial year before the Finance Committee
consisting of Director, the representatives of the Ministry of Finance and
the Administrative Ministry on the Governing Council, and another
member nominated by the Governing Council. With the remarks and
recommendations of the Committee the budget estimates shall be
submitted to the Governing Council for approval in such manner and at
such time as decided by the Council. The budget estimates shall thereafter
be submitted to the Government of India for approval not later than the
30th
September in each year.
12.2 The approval of the Governing Council or the competent authority as the
case may be is necessary to all schemes proposed to be financed from the
funds of the Institute.
13. Appropriation
13.1 The funds of the Institute shall not be appropriated for expenditure on any
item which has not been approved by the competent authority under these
bye-laws.
13.2 All expenditure within the budget grant shall be approved and sanctioned
by the Director, or by one or more members of the staff to whom he has
delegated this power, with the prior approval of the Council.

14. Re-appropriation:
The Director shall have the power to make re-appropriations subject to the
following conditions:
14.1 Re-appropriation to augment the provision under the head “Salaries,
Allowances and Provident Fund / Pension Contributions” shall require the
prior consent of the Council.
14.2 No re-appropriation shall be made from the head of Capital Expenditure to
the head of Revenue Expenditure.
14.3 Re-appropriation within the heads of Capital Expenditure to cover
expenditure on a new project not included in the budget shall require the
prior consent of the Council.
15. Financial & administrative powers
15.1 The Governing Council shall have the Financial and Administrative
powers as vested in the Administrative Ministry concerned of the Central
Government as per guidelines contained in DST OM NO.A.I/Misc/002/98
dated 27-01-1999 as amended from time to time (Annexure-I).
15.2 The Director of the Institute shall have the Financial and Administrative
powers as may be delegated by the Governing Council which in any case
would not be less than the corresponding powers vested in the Head of
Department of a Central Government Department.
15.3 The proposals relating to emoluments structure i.e. adoption of pay-
scales/Pay Bands and Grade Pay, allowances and revision thereof and
creation of posts would need the prior approval of the Central Govt.
15.4 In the event of a disagreement between representative of the Ministry of
Finance ( i.e. JS & FA, DST) and the Chairman of the Governing Council
on any financial matter beyond the delegated powers of the Administrative
Ministry, the matter may be referred to the Minister of the Administrative
Ministry and the Finance Minister for a decision.

15.5 Finance Committee :
There shall be a Finance Committee in the Institute with the following
composition:
a) Prof. U.R. Rao, Chairman.
b) Representative of Ministry of Earth Sciences.
c) Joint Secretary & Financial Advisor or his nominee.
d) Director, IITM- Member Convener.
All the proposals involving financial implications, Annual Report and Accounts,
Audited Statement of Accounts and Annual Budget etc. shall be placed first
before the Finance Committee for consideration and making appropriate
recommendations before their submission to the Governing Council.
16. Expenditure Sanction
16.1 No expenditure from the funds of the Institute shall be incurred without the
sanction of competent authority.
16.2 The Director shall have full powers to sanction the expenditure on any
approved scheme or head included in the budget after following the
prescribed procedure.
16.3 The Administrative Officer of the Institute shall have powers of Head of
Office (as laid down in DFPRS) to sanction an expenditure of a
miscellaneous or contingent nature etc. as prescribed by the Governing
Council from time to time.
16.4 The Director shall keep a watch over expenditure against the grants
sanctioned by the Governing Council. In cases where expenditure under
any scheme or item of expenditure is likely to exceed the sanctioned grant,
he shall make a reappropriation not exceeding 10% of the original budget
provided for that scheme from anticipated savings from other schemes. In
case where inescapable expenditure necessitating an additional grant is
involved, he shall take steps to get Council’s approval and obtain the
supplementary grant before incurring the expenditure.
16.5 A sanction to expenditure will not become operative until there has been an
appropriation of funds under these Bye-laws to cover it.
16.6 The Governing Council of the Institute shall have full powers in the matter
of incurring miscellaneous/contingent expenditure.

16.7 The Director of the Institute shall have powers to sanction an expenditure of
miscellaneous or contingent nature up to such amounts as may be specified
by the Council from time to time
16.8 The exercise of the above financial powers shall be subject to the provisions
of General Financial Rules and Delegation of Financial Powers Rules and
such other conditions as the Governing Council and the Central
Government may like to impose from time to time.
17. Permanent Advance
A permanent advance of a sum to be fixed from time to time by the Governing
Council may be kept by the Accounts Officer for cash payments. Imprest for
field station Delhi Centre may be fixed by the Director.
18. Execution of Contracts on behalf of the Institute
All agreements, contracts etc. which may be necessary for the proper conduct of
business of the Institute shall be executed on behalf of the Council by the
Director or by an officer of the Institute authorized by the Council for the
purpose.
19. Funds of the Institute
The funds of the institute will consist of the following:
i) Grants sanctioned by the Central Govt. for the furtherance of the objects of the
Institute
ii) Contributions or grants received from other sources approved by the Council
iii) Income from investments, consultancy and other charges, gifts, donation etc.
iv) Receipts from other sources approved by the Council.
v) Corpus Funds to which contributions from various donors and/or such funds
as the Council may so approve, shall be credited.
vi) Grants and Funds received from various other sources for specified projects
etc.
20. Investments
20.1. The funds of the Institute may be invested only in such manner as may be
prescribed by the Governing Council. The Govt. grant may be invested in
accordance with the instructions of the Central Govt. issued from time to
time.
20.2 All investments of the funds of the institute shall be made in the name of
the Institute. All purchases, sales or/alterations of such investments shall

be effected and all contracts, transfer deeds or other documents necessary
for purchasing, selling or altering the investments of the Institute shall be
executed by the Director on behalf of the Governing Council. The safe
custody of receipts and other relevant documents will remain in the
personal charge of the Officer of the Institute to be nominated by the
Council and will be verified once in six months with the Registrar of
Securities and a certificate of verification will be recorded by the Director
in the register.
20.3 The Director or any other person as may be authorized by the Director on
his behalf shall maintain a register of securities held by the Institute in
which any transactions affecting the securities shall be recorded.
21. Drawal of funds
21.1 Receipts: All moneys received for or on behalf of the Institute shall be placed in a
current account or savings bank account or fixed deposit account in the name of
the Institute with the State Bank of India and/or any of the other nationalized
banks.
21.2 Payments: Payments by and on behalf of the Institute shall ordinarily be made by
cheques. All cheques will be signed by any two of the following:
1. Accounts Officer.
2. Administrative Officer.
3. Director.
All bills for payment shall bear an endorsement "Passed for Payment", and the
endorsement shall be signed by the Director or by an officer to whom the power
has been delegated by the Director.
21.3 All cheque books will be kept in the personal custody of the Director or any other
person as may be authorized by the Director on his behalf.
21.4 The various personnel employed in the Institute will submit proposals for all new
charges and for any demand of funds to the Director.
21.5 The claims for pay and allowances and travelling allowances of personnel and
contingent bills will be drawn in the forms prescribed by the Institute. The
contingent and miscellaneous expenditure bills will be countersigned by an officer
of the Institute authorized by the Director for this purpose before these are passed
by the Accounts Officer for payment. All bills will be checked in the nature of
Pre-audit and passed for payment by the Accounts Officer. The monthly pay and
allowance bills shall be submitted directly by the Accounts Officer and passed for
payment by him. Payment will be made by means of demand drafts or cheques or
cash as the case may be.
21.6 Tour of the employees of the Institute including his /her own tour shall be
sanctioned by the Director. The TA bills would be countersigned by the

Administrative Officer. If additional sanction is required, the same would be
sanctioned by the Director.
21.7 The foreign deputation proposal of employees of the Institute shall be approved
by the Director. The deputation proposal of the Director shall be approved by the
Governing Council.
22. Accounts
22.1 The Accounts Officer shall supervise maintenance of proper accounts and other
relevant records and prepare an annual statement of accounts in such form as may
be prescribed by the Governing Council in consultation with the Central
Government. Such an officer will be responsible to the DIRECTOR for accuracy
and completeness of the Accounts of the Institute.
22.2 The Institute shall have a qualified Accountant on its staff who shall also be a
qualified Auditor and whose business is to anticipate difficulties, assist in
resolving them and help the Director to devise procedure which will enable the
work of the Institute to be carried forward smoothly and effectively. The
Accounts Officer will be responsible to the Director for the accuracy and
completeness of the accounts of the Institute. The Accounts Officer shall also
render necessary advice to the DIRECTOR in all proposals involving financial
implication.
23 Audit:
23.1 The functions of the Auditor of the Institute will be exercised by the Commercial
Auditor appointed under rule 15.3 of the Memorandum of Association and Rules
and Regulations of the Institute.
24. Annual Accounts, Audit and Results of Audit:
24.1The accounts of the Institute shall be subject to the audit annually by the Chartered
Accountant or Accountant appointed according to Rule 15.3 of Memorandum of
Association and Rules and Regulations of the Institute and any expenditure incurred
in connection with such audit shall be payable by the Institute to the Chartered
Accountant or Accountants appointed as stated above.
24.2. The auditor shall ensure observance of the following stipulations of the Central
Government:
i) Proper accounts of expenditure incurred from Government grants
and all other sources be maintained;

ii) An adequate system of internal check and control should exist to
ensure that purchase of stores and execution of works are done
with due regard to broad principles of financial prudence;
iii) A proper record be maintained of assets acquired from
Government grants and all other sources together with the cost of
acquisition shown against each item;
iv) Proper stores accounts and maintenance of consumable stores be
kept and physical verification under proper supervision be carried
out at periodical intervals;
v) A system of reporting to the Governing Council on losses of cash,
stores and other assets after proper investigation to be followed.
To achieve this task the Chartered Accountant shall have the right to demand the
production of account books, connected vouchers and other documents.
24.3 The accounts of the Institute as certified by the Chartered Accountant along with the
annual Report shall be forwarded annually to the Governing Council and to the
Central Government latest by 30th
September each year and also to the other
authorities/bodies as directed by the Council.
24.4 The Director may delegate his powers to the Administrative Officer and to such
other officers of the Institute as may be necessary with the approval of the Council.
24.5 All sanctions and orders of delegations of competent authorities under the Rules
and Regulations or these Bye-laws affecting the accounts of the Institute shall be
reduced to writing.

CHAPTER -III
ACADEMIC ACTIVITIES
25. Scholarships, Fellowships, Grants-in-aid, Special Programmes, Faculties
etc.:
25.1 In order to carry out the objectives of the Institute as set forth in the Memorandum
of Association, the Council may institute medals, prizes, scholarships and
fellowships, sponsor and finance deputation within the country and abroad,
establish research schemes and projects. Arrangements shall also be made for
lectures, seminars and symposia at the Institute in pursuance of its academic work
and for the diffusion of scientific knowledge. The Institute may award research
fellowships to students registered for a Ph.D. degree in any University or
academic institution which has acquired the status of a University. These students
will be registered with a Scientist of IITM as supervisor/guide. (Rules enclosed) –

25.2 The terms and conditions governing activities mentioned in the above Bye-law
shall be as may be laid down by the Council.
26 Honorary Fellows and Visiting Scientists etc.:
26.1 Honorary Fellows: The Council may, on the recommendation of the Director,
appoint Honorary Fellows. Honorary Fellowships may be conferred by the
Council on eminent scholars in recognition of their distinguished contribution to
knowledge in subjects in which the Institute is interested or on persons who have
rendered eminent service to the Institute or on persons who have made a
noteworthy and lasting contributions to the cause of fundamental research.
Honorary Fellows shall enjoy such privileges as may be decided by the Council
from time to time.(Rules enclosed) – Annexure III
26.2 Visiting Scientists: Scholars may be invited or admitted to the Institute for short
periods as visiting Scientists for participating in the work of the Institute. Visiting
Scientists may be paid such honoraria and other facilities as may be decided by
the Director from time to time.
The Director may invite scientists actively engaged in research in a field of
interest to the Institute to deliver lectures and participate in its activities. Invited
Scientists may be paid such honoraria and other facilities as may be decided by
the Director from time to time.
26.3 Emeritus Scientists: The Council may, on the recommendations of the Director,
designate a Scientist who has retired from the Institute after a long and
distinguished service, as Distinguished Scientist who shall enjoy such privileges
as may be decided by the Council from time to time (Rules enclosed). Annexure-

CHAPTER IV
PATENTS AND CONSULTATION
27 Patents and Consultancy:
27.1 Scientific and Industrial Consultancy:
The Director shall, from time to time, regulate the work relating to scientific and
industrial consultancy as per the norms fixed by the Council.
27.2 Industrial Research and Patent Rights:
The Director shall, from time to time, having regard to the merits of each case,
decide on the filing of patents for inventions arising out of any research
undertaken by the Institute, the person(s) or organization(s) in whose name(s)
such patents are to be taken and the distribution of the profits if any accruing
from such patents.
27.3 Contribution to Scientific Periodicals
Contributions to scientific journals resulting from work carried on at the Institute
by members of the staff of the institute shall contain the Institute’s name. A copy
of every such contribution shall be sent to the Director before it is communicated.
No contribution which may relate to classified or confidential material shall be
made without the prior approval of the Director.
27.4 Extra mural lectures
Members of the staff of the institute may, with the prior permission of the
Director, accept invitations to give lectures in their field of work to Universities or
learned societies, provided such lectures do not interfere with their work at the
institute. The honorarium if any, received by them in his regard should be
reported to the Director
27.5 Examinerships
Members of the staff of the institute may, if invited to do so, and with the prior
approval of the Director, accept university examinerships normally only for the
post-graduate students. The honorarium / fees if any, received by them in this
regard should be reported to the Director
27.6 Attendance at scientific conferences
Members of staff may be deputed by the Director to attend scientific conferences,
symposia and congress in India and for specialized training or work of the
Institute.
The participation of the Director at Conferences, symposia and congress abroad,
shall be with the prior approval of the Governing Council.

CHAPTER V
COMMITTEES
28. Committees etc.:
28.1 Procedure for conduct of business of Committees :
The procedure prescribed in the Rules and Regulations and Bye-laws for the
conduct of meetings/business of the Governing Council shall also apply mutatis,
mutandis to the various committees constituted by the Council. The powers and
functions of such Committees and the terms of the office of their membership
shall also be laid down by Governing Council from time to time.
28.2 Acts of Committees, etc. not invalidated by vacancies, etc.:
Notwithstanding anything contained in these Bye-laws, no act of any of the
authorities/bodies or committees appointed by any of the authorities/bodies or
constituted under the provisions of these Bye-laws shall be invalid merely by
reason of (a) any vacancy therein or defect in the constitution thereof, or (b) any
defect in the nomination or appointment of a person as a member thereof, or (c)
any irregularity in its procedure not affecting the merits of the case.
28.3 Sitting Fee: The Governing Council shall fix from time to time an appropriate
sitting fee to be paid to the external members, in addition to TA/DA for attending
the official meetings of the Governing Council/Finance Committee/Sub
Committee etc. of the Governing Council.
Travelling Allowance:–
28.4 In regard to Travelling Allowance and Daily allowance for travel in connection
with the business of the Institute, the fundamental and supplementary rules
framed by the Government of India and such other Rules and orders issued by the
Govt. Of India from time to time shall apply mutatis mutandis to the members of
the Governing Council and of staff of the Institute.
28.5 The Member Secretary of the Council shall be the Controlling Officer for T.A.
and D.A. bills of Members of the Governing Council / Sub-Committees of the
Council etc..

CHAPTER -VI
SERVICE CONDITIONS
29 Service Conditions, Recruitment, Promotion etc.:
29.1 Appointment on Contract:
The Director shall, on the recommendations of the Principal Investigator of the
project, be competent to engage a person on contract for sponsored/short term
projects for the duration of such projects only. Persons appointed on contract
basis will be paid consolidated emoluments. The emoluments and terms of
appointment shall be settled in advance between the Centre and the incumbent
which shall be consistent with the conditions, if any, stipulated by the funding
agency and the same should be ratified by the Governing Council.
29.2 Appointment of Consultants: The Governing Council may engage consultants
for specific purposes and for specified periods on terms and conditions settled in
advance with the approval of the Council. The Central Govt. instructions on the
subject will be kept in view in this regard.
30 Service matters:
30.1 Conditions of Service:
The Governing Council shall prescribe the conditions of service of employees of
the Institute.
30.2 Recruitment and promotion of staff :
Recruitment and promotion, including assessment and merit promotion in respect
of all categories of staff of the Society shall be regulated in accordance with the
detailed scheme formulated by Governing Council, IITM in this behalf.
30.3 Scheduled Castes / Scheduled Tribes
The Government of India Rules / Orders issued from time to time regarding
reservation of posts for SC/ST/OBCs and Physically Handicapped shall apply to
the extent applicable in regard to appointments to posts to be made in IITM.
30.4 Confidential Reports :
The Governing Council shall lay down a suitable system of Performance
Appraisal/Assessment for all categories of employees of the IITM.

30.5 Contractual Service :
The Director will outsource and contract out infrastructural, support, maintenance and
other related services for IITM as far as possible. Any person engaged by the contractor
will not be considered as an employee of the IITM.

CHAPTER - VII
MISCELLANEOUS
31 Matters not covered herein:
31.1 Removal of doubts- Where a doubt arises as to the interpretation of any of the
provisions of these Bye-laws, the matter shall be referred to the Council for a
decision. In the event of their being any inconsistency between Rules &
Regulations and these Bye-laws, the provisions of Rules & Regulations shall
prevail.
31.2 If any question arises which is not covered by these Bye-laws, the decision of the
Council shall be the final. In regard to the regulation of any matter not covered
hereinabove, recourse shall be taken to Central Government rules/orders etc. on
the subject.
31.3 Any alteration in the Bye-laws shall be carried out with the approval of the
Governing Council and Central Government.

OFFICE MEMORANDUM
Subject:- Guidelines for Enhancement of Functional Autonomy of R&D
Autonomous Institutions under the S&T Departments/Institutions.
-:-
The Government of India have been considering for sometime the
question of making the management in R&D autonomous institutions under the
S&T Deptts. more flexible and responsive. Consequently, the Central
Government have decided to enhance their financial and administrative autonomy
in the manner indicated in the following guidelines:-
(I) FINANCIAL MATTERS
(i) Powers of Governing Bodies/Governing Councils:
In accordance with Rule 13(2) of Delegation of Financial Powers Rules, a
Department of Central Government can confer powers, not exceeding those
vested in the Department, upon an Administrator or Head of the Department or
any other subordinate authority in respect of matters covered by these rules. On
the analogy of the above rules, the Governing Councils/Governing Bodies of
Autonomous R&D institutions may exercise powers up to the limit of powers
enjoyed by the Administrative Ministry/Department concerned except with regard
to the following:-
(a) Creation of posts;
(b) Write off of losses; and
(c) Reappropriation exceeding 10% of the original budget provision.
The exercise of enhanced financial powers by the Governing
Councils/Bodies would be subject to the provisions of General Financial Rules,
restrictions in DFPRs; other instructions/orders now in force and/or to be
amended/issued by the Central Government from time to time.

(ii) Powers of Director:
The Director, i.e the Executive Heads of the Autonomous R&D
Institutions may be vested with financial powers which are delegated and
exercised by the Heads of Departments under the FRs/SRs/GFRs/DFRs,
wherever the position is otherwise.
(iii) Financial Flexibility within the Rupee Budget Ceiling:
The Governing Bodies/Councils of the Autonomous R&D
institutions would have full financial flexibility subject to the budgetary ceilings
and approved budget grant. Thus, the R&D institutions would have full freedom
in deciding the consultancy required, fee to be paid, purchase of equipments and
vehicles depending upon the requirements of the projects subject to availability
of funds and posts, and no supplementary grants would be allowed outside the
annual budgetary ceiling , except in emergent situations.
(iv) Powers of Governing Bodies/Governing Councils to sanction
schemes :
As per the existing instructions, plan expenditure upto Rs.15 crores
is approved by Standing Finance Committee with which the Financial Adviser
and the Planning Commission’s Representative are associated. In case the
Governing Bodies/Governing Councils are represented by Financial
Adviser/Planning Commission’s representative also (as per standing Finance
Committee’s constitution) they can approve expenditure upto Rs. 15 crores
subject to budgetary provisions.
(v) Accountability:
The Governing Bodies/Governing Councils will be accountable to
see that schemes and programmes are properly implemented and the financial
propriety is not lost sight of . For this purpose, the Governing Bodies/Governing
Councils of autonomous institutions should meet frequently with a view to
ensuring that funds have been used as per the programmes/objectives approved
by them. At the end of the year, a report in this regard would be furnished to the
administrative Ministry concerned.
(vi) Carry-forward/forwarding of unspent balance/income.
The grants of the Autonomous institutions may continue to be
budgeted in the Demands of Scientific Deptts. on annual basis. While disbursing
the grants to the institutions, the Department may on case-by-case basis fix a

reasonable time (as provided in the GFRs) but may be allowed to extend upto six
months into the next financial year for utilisation of the grant and the sanctioning
authority may include this as one condition in the sanction order. This will be
further subject to (i) observance of provisions of GFRs and instructions issued on
fiscal management by Government from time to time like ceiling on expenditure,
restriction on creation of posts, etc; and (ii) even though expenditure can be
incurred within 6 months after 31st March in the next financial year, the opening
balance should reflect the actual position and the Budget Division should be kept
informed about the deferred expenditure in advance so as to enable it to make
budgetary provisions for the next financial year in a realistic manner after
adjusting the unspent and uncommitted balance from the subsequent year’s grant.
(II) ADMINISTRATIVE MATTERS
Powers of the Governing Bodies/Governing Councils to create posts.
1. The scientific Departments enjoy operational freedom regarding Group B, C
& D posts. They are subject to DOPT/MOF’s Guidelines in case of Group A
Posts. Once the strength of different grades in Group A posts is fixed, there
may be no objection to the flexibility of allocating such posts within each
grade to any disciplines as per the requirements of the Institute. Transfer of
posts among different grades, however, will not be permitted. There is no
objection in granting horizontal and not vertical flexibility in the reshuffling
of posts.
2. The above guidelines are brought to the notice of the Administrative
Ministries/Departments of the Central Government for being communicated to
the Autonomous R & D institutions under their administrative control for
appropriate action.
3. It is once again emphasized that the exercise of enhanced financial and
administrative powers by R & D Autonomous institutions would be subject to
the provisions of GFRs/DFPRs; other Central Government Orders issued from
time to time, e.g. recently issued Office Memorandum No. F-19(1)- E.II dated
28th
August 1998 by the Ministry of Finance.
4. The above guidelines/Scheme would be reviewed by the Central Government
after a period of two years and/or as and when required.

ANNEXURE – II OF PART I OF BYE-LAWS
THE TERMS AND CONDITIONS FOR APPOINTMENT OF
RESEARCH ASSOCIATES AT THE INSTITUTE.
(under bye – law 25.1)
(AS APPROVED IN THE 75TH
MEETING OF THE
GOVERNING COUNCIL HELD ON 1 August 2007)
1. Purpose :
The Research Associateship is awarded to promising young researchers who have
promise in original research and propose to pursue research. The Research
Associate will do full time research work at the Institute.
2. Mode of Selection :
The applications for the award of Research Associate shall be invited through
advertisement in Employment News, leading new papers in India, notification to
universities, research Institute and on Institute’s website. The Research Scholars
of the Institute who are awarded Ph.D. are eligible for appointment as Research
Associate at the Institute for a maximum period of two years.
3. Qualifications:
A doctorate degree in Meteorology, Atmospheric Sciences, Oceanography,
Physics, Mathematics, Applied Mathematics, Statistics, Applied Physics or
Geophysics from a recognized university.
4. Age Limit:
The upper age limit for award of Research Associateship shall be 35 years. The
upper age limit is relaxable upto 5 years in the case of applicants belonging to
Scheduled Caste / Tribe, and as per rules for physically handicapped and OBC
candidates.
5. Stipend
The Research Associate shall be eligible for a consolidated stipend to one of the
following :
Rs. 16000/-
Rs. 17000/-
Rs. 18000/-

The stipend shall normally be fixed at Rs. 16000/-. However, a selected Research
Associate may be placed in the higher stipend if there is ample justification and
such recommendation is made by the Selection Committee.
In addition to stipend, the Research Associate will also be entitled for HRA as per
rules of the Institute, provided he / she has not been given accommodation.
Medical reimbursement as per rules of the Institute would also be provided which
would be limited to Research Associate only and not his / her family members /
dependents.
6. Tenure:
The Research Associate will be tenable initially for a period of one year
extendable for one more year at the discretion of the Director. The progress of
Research Associate would be assessed every year by the Institute and extension is
considered. The total tenure of the Research Associate is maximum of two years.
A Research Associate who joins on the first day of the month, his / her tenureship
will be completed on the last day of the previous month. In other cases, the
tenureship will be completed on the last day of the same month. If he resigns, it
will be effected from the last date of the duty.
7. Leave:
(a) Leave with stipend not exceeding 45 days for each completed year of
tenure may be allowed. The leave will be treated as part of the tenure. The
leave due can be carried over to the next year, however not more than 90
days can be accumulated at any time during the tenure. Of this not more
than 30 days can be availed of at the end, prior to completion of the tenure
of Associateship. During the first year or any uncompleted year, leave
may be granted on pro-rata basis. Sanction of leave without stipend may
be considered under special circumstances. In case RA proceeds on leave
before termination of Associateship he/she must join back before the
expiry of tenure, failing which the tenure will be deemed to have
terminated with effect from the date he / she proceeds on leave. The fact
of joining back from leave should be communicated immediately.
(b) If leave is not due, such cases will be decided by the Director.
( c ) The women Associates with less than two surviving children are entitled
for full stipend plus HRA, during the period of absence upto 135 days on
grounds of maternity. Such leave shall be sanctioned by the
Administrative Officer. The stipend for leave period will be paid after the
fellow resumes duty and submits a medical certificate in support of actual
confinement. It is expected that the Associate will make up the deficiency
during the remaining tenure.

(d) Male fellows with less than two surviving children are entitled for 15 days
paternity leave during confinement of his wife on submission of relevant
documentary proof.
8. Place of work:
The Research Associate is tenable at IITM, Pune. The selected person may also
be asked to work at branch Office in New Delhi.
9. Payment of stipend:
The stipend shall ordinarily be paid on the last working day of the same month. if
that day happens to be Sunday or holiday, payment will be made on the working
day, before the holiday.
10. Progress Report:
The Research Associate shall submit to the Director through his /her guide a
comprehensive report every year on the progress of his / her research. He / she
shall also submit to the Director any special report on the progress of his / her
work that may be called for.
11. Publication of results :
The results of the research work done by the Research Associate may be
published with proper acknowledgement of the assistance provided by the
Institute. Copies of published papers ( in duplicate) shall be made available to the
Director of the Institute.
12. Hostel Accommodation :
If required, Research Associates may be provided with hostel accommodation in
the Institute campus on payments of nominal charges. They have to pay security
deposit as per rules.
13. Obligation of Research Associate :
The Research Associate is required to fulfill the following obligations under the
Research Associate Scheme:

1. He / she shall submit himself / herself to the disciplinary jurisdiction of the
Institute.
2. He / she shall participate in such other academic activities of the Institute
which in the opinion of the Institute are likely to prove beneficial to his /
her research work.
3. He / she shall not discontinue the Associateship without the prior
permission of the Director.
4. Before termination of the award or resignation by the Research Associate,
he / she shall submit to the Director a detailed consolidated report.
14. Termination of Research Associateship:
The award ordinarily be terminated on the last date of the normal tenure of the
date specified by the Director of the Institute in case the Research Associate
discontinues it on resignation. If the Research Associate is found to be lacking in
research aptitude or negligent in carrying out his / her research assignment or if
his / her conduct or progress is not satisfactory, the Director may without
assigning any reasons, terminate the Research Associateship. The decision of the
Director in this matter shall be final.
The award of the Research Associateship does not imply any assurance or
guarantee for subsequent employment in the Institute.
15. Director to exercise overall power :
The Director shall be the final authority in any matter concerning the Research
Associateship and his decision shall be binding on the Research Associate. A
written undertaking shall be furnished by the Research Associate at the time of
joining agreeing to abide the rules of the Research Associateship framed by the
Institute from time to time.
16. Any change in the terms and conditions approved by the Govt. of India would
apply mutatis mutandis.

TERMS AND CONDITIONS FOR RESEARCH FELLOWS OF
THE INDIAN INSTITUTE OF TROPICAL METEOROLOGY, PUNE.
(Under Bye-law 25.1)
1. Purpose:
The fellowships are awarded to promising young research workers who have
completed a post graduate course in Science from a recognized university and
have shown aptitude for research in science.
2. Mode of Selection:
Applications for the award of the research fellowship shall be invited through
advertisement in the Employment News leading newspapers in India and through
notification to Universities and research Institutes. Forms of application may be
downloaded from the Institute’s website www.tropmet.res.in .
3. Subject:
The fellow shall conduct research on a subject assigned to him by the Institute in
consultation with him.
4. Value and Tenure of Fellowship:
a. The stipend payable to the Research Fellows on the award of fellowship
will be Rs. 12,000/- during 1st & 2
nd year
b. The work of Research Fellow will be assessed at the end of two years, if
recommended the stipend will be raised to Rs. 14,000/- p.m. from the date
of assessment.
c. The total tenure of a Research Fellowship will normally be for a period of
four years.
d. The candidate selected for the fellowship will be required to register for
Ph.D. degree. After successful completion of Ph.D. he may be considered
for a suitable position in the Institute depending upon the availability of
vacancies. The selected candidate will have to complete the full term of
fellowship.
5. Qualifications:
A good Master’s degree in physical sciences of any recognized University with
preferably first class. Candidates should have shown aptitude for research.

6. Place of work:
The fellowship is tenable only at the Indian Institute of Tropical Meteorology,
Pune, or any of its units outside Pune. Permission will not be granted to move to
another institution during the tenure of the award.
7. Payment of Stipend:
The stipend shall ordinarily be paid on the first day of the month following. If that
day happens to be Sunday or a holiday, payment will be made on the next
working day.
8. Progress Report:
The Fellow shall submit through his research guide to the Director a
comprehensive six-monthly report on the progress of his research work. He shall
also submit to the Director any special report on the progress of his work that may
be called for.
9. Publication of Results:
The results of the Research work done by the Fellow may be published at the
discretion of the guide with a proper acknowledgement of the assistance provided
by the Institute. Copies (in duplicate) of the published papers shall be made
available to the Director of the Institute. All rights of the research work conducted
by the fellow at the Institute shall vest in the Institute.
10. Leave:
This shall be regulated as per rules of Central Govt. (DST) as revised from time to
time.
11. Accommodation:
Research Fellows may be provided with single accommodation on the campus on
payment of nominal charges.
12. Obligation of Research Fellows:
The Research Fellow is required to fulfill the following obligations under the
Fellowship scheme:
a) He shall submit himself to the disciplinary jurisdiction of the Institute.
Regular attendance of the Fellow may be ensured by the Research guide
by keeping an attendance register.

b) He shall submit to the Director through his guide the six-monthly progress
reports as well as any special report that may be called for.
c) He shall participate in such other academic activities of the Institute which
in the opinion of the guide are likely to prove beneficial to his research
work.
d) He shall not discontinue the Fellowship without the prior permission of
the Director.
e) Before the termination of the award or the resignation by the fellow, he
shall submit to the Director through the guide a detailed consolidated
report (with summary) of research work done by him. A copy of the
doctoral dissertation, if any, submitted by the Research Fellow shall be
deposited with the Institute.
f) The fellow shall not accept during the tenure of his fellowship at the
Institute any other Fellowship or paid employment or otherwise engage
himself in any remunerative assignment, which, in the opinion of the
Director, would interfere with the course of his research work in the
Institute.
13. Termination of fellowship:
The award shall ordinarily terminate on the last date of its normal tenure or the
date specified by the Director of the Institute in case the Fellow discontinues it on
resignation.
If the Fellow is found to be lacking in research aptitude or negligent in carrying
out his research assignment or if his conduct or progress is not satisfactory, the
Director, may without assigning any reasons, terminate the Fellowship. The

RULES GOVERNING THE HONORARY FELLOWS OF THE
INDIAN INSTITUTE OF TROPICAL METEOROLOGY
(UNDER BYE-LAW NO. 26.1)
The Council approved the extension of the following facilities to the Honorary
Fellows of the Institute in connection with academic and scientific work :
a) Library facilities.
b) Facilities for preparation of diagrams and then duplication in connection
with scientific papers and reports.
c) Computer facilities for data processing.
d) Clerical assistance for typing scientific papers, reports etc.
e) Any other facilities as may be considered necessary by the Director for
scientific and academic work of the Honorary Fellow.
The Council made it clear that the Honorary Fellows should not go to the press
regarding any matter pertaining to the Institute and should continue themselves to
research only.

ANNEXURE IV OF PART I BYE-LAW
RULES GOVERNING THE
VISITING PROFESSORSHIP AT THE INSTITUTE
(Under rule 26.2)
Governing Council at its 30th
meeting held on 6.9.1985 approved the scheme of
Visiting Professorship at the Institute
1. The Scheme :
The scheme will contribute significantly towards enabling the scientists of the
Institute to keep abreast of the latest developments and advances in the different
disciplines and to work at the rapidly advancing frontiers of knowledge. The
scheme would go a long way to strengthen the scientific base of the Institute
and would also help to accelerate its development as the premier scientific
institution in the country in the field of Atmospheric Sciences.
2. Objective :
The objective of the scheme is to invite an eminent scientist in any of the
different discipline of atmospheric sciences from outside India to work at the
Indian Institute of Tropical Meteorology, Pune, for a period up to four months
in a year. One such scientist would be invited during each financial year. The
visiting scientist would deliver lectures in his field of specialization for the
benefit of the personnel of the Institute. In addition, some of the research
workers of the Institute could also associate themselves with the visiting
scientist during his period of stay to work on specific problems.
3. Selection:
The selection of the Visiting Professor would be done by the Governing
Council in the recommendation of the Director of the Institute.
4. Terms of appointment :
a) The appointment of the Visiting Professor would be for a period up to four
months in a year.
b) The Visiting Professor would be paid to and fro air fare by excursion class
and take care of the local transport, accommodation, boarding, etc during
the period of his assignment at the Institute.

c) In addition, the Visiting Professor would be paid a sum of Rs. 5000/- per
month as honorarium.
d) The lectures delivered by the Visiting Professor would be published by the
Institute.
5. Periodicity :
One Visiting Professor per year.

ANNEXURE V OF PART I OF BYE-LAWS
RULES GOVERNING THE SCHEME OF
EMERITUS SCIENTISTS AT THE INSTITUTE.
(Under Bye-law 26.3)
1. The Governing Council may, on the recommendation of the Director, designate as
Emeritus Scientist, persons who have either retired from active service of the
Institute not below the rank of Scientist D or from the India Meteorological
Department in the equivalent cadre or eminent persons in the field of Meteorology
and allied subjects who have served in different meteorological Institutions in
India or abroad.
2. The emeritus Scientists may participate in the training and research programme of
the Institute and render such research guidance / assistance as may be necessary.
3. The Emeritus Scientist should submit to the Director reports on the work done by
him, when called upon to do so.
4. The Emeritus Scientist should be provided with facilities for his work as may be
considered necessary by the Director.
5. Retired persons who have completed the age of 65 years shall not be eligible for
consideration as Emeritus Scientists.
6. The term of the Emeritus Scientist shall initially be for a period of two years. Any
further extension of the term will be considered and approved by the Governing
council.
7. The honorarium payable to an Emeritus Scientist will be determined after taking
into consideration the pension and pension equivalent of Death-cum-retirement
gratuity and ensuring that the honorarium plus pension and equivalent of DCRG
does not exceed the last pay drawn by the scientist concerned.
8. The Emeritus Scientist shall abide by the Rules and Regulations of the Institute
and guidelines issued by the Director / Governing Council from time to time.

ANNEXURE VI OF PART I OF BYE-LAWS
THE TERMS AND CONDITIONS FOR THE APPOINTMENT OF
THE ADJUNCT PROFESSORS AT THE INSTITUTE.
1 The Scheme :
The scheme will contribute significantly towards enabling the scientists of the
Institute to keep abreast of the latest developments and advances in the
different disciplines and to work at the rapidly advancing frontiers of
knowledge. The scheme would go a long way to strengthen the scientific base
of the Institute and would also help to accelerate its development as the
premier scientific institution in the country in the field of Atmospheric
Science.
2. Objective :
The objective of the scheme is to invite eminent scientists in any of the
different discipline of the atmospheric and oceanic sciences from India or
outside India to work at the Indian Institute of Tropical Meteorology, Pune for
a period of one month in a year. A maximum of five such scientists could be
invited during each financial year. The Adjunct Professor would deliver series
of lectures and conduct short courses in the field of specialization for the
benefit of the personnel of the Institute. In addition, some of the research
scholars of the Institute could also associate themselves with the adjunct
professor during his period of stay to work on specific problems.
3. Selection :
The selection of the Adjunct Professor would be done by the Governing
Council on the recommendation of the Director of the Institute.
4. Terms of appointment :
a) The appointment of the Adjunct professor would be for a period of 3 years.
They would work for a month each year.
b) The Adjunct Professor would be paid to and fro air fare and the Institute
would take care of the local transport, accommodation, boarding, etc. during
the period of his assignment at the Institute.
c) In addition, Adjunct Professor would be paid a sum of Rs. 30,000/- per
month as honorarium.
d) The lectures delivered by the Adjunct Professor would be published by the
Institute.

5. Periodicity :
Five Adjunct Professors per year. At a time, there would not be more than five
Adjunct Professors in position.

STAFF RULES
INTRODUCTION
The Indian Institute of Tropical Meteorology (herein referred to as IITM) was registered
as a Society on 1.4.1971 under the Societies Registration Act, 1860. The IITM is under
the administrative control of the Ministry of Earth Sciences (MoES), Govt. of India.
1 Short Title: These Rules shall be called the “IITM (Staff) Rules 2005”.
2. Date of Commencement:
The date of commencement of these rules is 16 November, 2005 (date of
approval by the Central Govt.).
3 Application:
These rules shall regulate the terms and conditions of service of regular
employees of the Indian Institute of Tropical Meteorology. These rules shall
not apply to
(i) contingent employees;
(ii) employees engaged on contract basis;
(iii) research fellows i.e. Junior Research Fellow, Senior Research Fellow,
Post Doctoral Fellow, Research Associates, Visiting and Distinguished
Scientists, appointed by the Institute;
4 Definitions :
In these rules, unless the context otherwise requires
a. “the Institute” means the "Indian Institute of Tropical Meteorology";
b. “Council” means the Governing Council of the Institute;
c. “Chairman” means the Chairman of the Governing Council of the Institute;
d. “Director” means the Director of the Institute appointed under the rules;

e. “Appointing Authority” in relation to any post in the Institute means the
authority competent to make appointment to that post;
f. “Competent Authority” means the authority indicated for various purposes
in these Rules or any other Rules applicable or in force in the Institute or
any such orders of the Govt. issued for its Autonomous Bodies;
g. “Administrative Ministry” means the Ministry of Earth Sciences, (MoES),
Govt. of India.
5 Interpretation :
In the matter of interpretation of any rules/orders, the decision of the Chairman,
Governing Council shall be final unless otherwise, specifically included in these
rules.
6 Power to relax:
Notwithstanding anything contained in these rules, the Chairman of the
Governing Council may relax any of the provisions of these rules for reasons to
be recorded in writing. Relaxation should, however, be given in very
exceptional and rare circumstances where the operation of any of these rules
causes extreme hardship in a case.
7 Repeal and saving:
(i) These staff rules have been framed by the Governing Council of the
Institute under bye-law No. 29.2 of the Bye-laws of IITM in supersession
of the bye-laws and service rules approved by Central Govt. (Ministry of
Tourism & Civil Aviation) vide letter No. ME-20016/1/71-19 dated
27.11.1972. These Staff Rules shall not affect adversely the interests of
the existing employees by virtue of the operation of any rule or any order
made or any action taken earlier. Any action taken under the old rules
prior to the date of promulgation of these rules shall be deemed to have
been taken under these rules.
(ii) Any of the provisions of these rules can be repealed, modified or altered
subject to the approval of Governing Council for sufficient and cogent
reasons to be recorded in writing.

CHAPTER VIII
CATEGORIES OF POSTS
8 Classification & Grouping of Posts/Employees of the Institute:
The posts/employees of the Institute are divided into the following
categories:-
The employees of the Institute shall be classified into the following five
categories:
Category: ( i) Research Staff (i) : Which term includes Director, Scientist H, Scientist
G, Scientist F, Scientist E, Scientist D, Scientist C and Scientist B. These
categories of officers are primarily engaged in R&D and other core
activities of the Institute.
Research staff (i-A): Which term includes Junior Scientific Officer and
Senior Scientific Assistant.
Category :(ii) Scientific Staff: Which term includes Scientific Assistant and Junior
Scientific Assistant. These categories of officers are primarily engaged in
R&D and other case activities of the Institute.
Category: (iii) Technical Staff: Which term includes Civil Engineer, Mechanical
Engineer, Computer Engineer, Senior Technical Officer Gr. I, Senior
Technical Officer, Grade II, Junior Technical Officer, Senior Technical
Assistant, Technical Assistant, Junior Technical Assistant, Senior
Draughtsman, Draughtsman and other members of staff doing technical
work. The category also includes workshop staff in the grades of Foreman,
Mechanical Assistant, Mechanic Grade I and Mechanic Grade II, as well
as Mechanic Grade II (Driver), Electrician and other members of staff
doing mechanical works.
Category: (iv) Administrative Staff: Which term includes the Administrative Officer,
Accounts Officer, Section Officer, Hindi Officer, Personal Assistant to
Director, Senior Assistant, Hindi Translator, Assistant, Stenographer
Grade I, Stenographer Grade II, Stenographer Grade III, Security
Inspector, Upper Division Clerk, Security Sub Inspector, Lower Division
Clerk, Laboratory Assistant and other members of staff doing
administrative work.
Category: (v) Non-Technical Maintenance Staff: Which term includes Laboratory
Attendant, Office Attendant, Peon, Cleaner, Safaiwala, Helper, Cook,
Gardener, Watchman, Mazdoor and other members of staff doing general
maintenance work.

CHAPTER IX
APPOINTMENTS
9 Creation of posts and appointments:
9.1 The Council may create, abolish and upgrade scientific, administrative and
other posts in the Institute in accordance with Bye-law 15.3 and the guidelines
issued by the Central Government from time to time.
9.2 The Council may provide guidelines regarding appointment procedures
essential qualifications etc. for a post from time to time.
9.2.1 Appointment of Director: Appointment to the post of Director will be made by
the Council with the prior approval of the Central Government on the basis of
the recommendations of a Search-Cum-Selection Committee. Appropriate rules
and procedure for selection of suitable candidate including qualifications to be
prescribed will be framed by the Governing Council from time to time. The
Search-Cum-Selection Committee shall also be constituted by the Council with
the prior approval of the Central Govt. The Secretary, Ministry of Earth
Sciences, (MoES) Govt. of India shall be the Chairman of the Search-Cum-
Selection Committee.
9.2.2 Appointment of Other Staff: Appointments to the posts with Pay Band above
Rs.15600-39100 with Grade Pay of Rs.5400.00 shall be made by the Council.
Appropriate rules and procedures for selection of candidates, including the
qualifications prescribed for each post will be framed for this purpose by the
Council from time to time.
9.2.3 Appointments to the posts with pay scales upto the Pay Band Rs.15600-39100
with Grade Pay Rs.5400.00 shall be made by the Director. Appropriate rules
and procedures for selection of candidates, including the qualifications
prescribed for each post will be framed for the purpose by the Council from
time to time.

CHAPTER X
SERVICE CONDITIONS
10 Appointment and Duration of Service of the Employees of IITM.
10.1 Terms and Conditions Offered to the Director : The appointment, terms and
conditions of the service of the Director shall be laid down by the Governing
Council in accordance with Rule 10 of the Rules and Regulations.
10.2 Employment on Contract Basis: The Governing Council shall have powers to
appoint a person with exceptional qualifications and experience to any post or
position in the Institute except that of Director on contract basis. The tenure,
remuneration, terms and conditions of appointment shall be determined by the
Governing Council keeping in view the merits of the case and the requirements
of the Institute.
10.2.1 Period of service: Members of staff of IITM, excepting the Academic and
Scientific staff who are appointed on purely temporary or adhoc basis for short
periods, and also those appointed explicitly on a contractual basis, shall be
appointed on probation for a period of two years. At the end of this period,
probation may be extended but for not more than twice the normal period of
probation. At the end of the probation period, on the basis of an evaluation of
the individual's performance during probation, the appropriate appointing
authority may offer the staff member permanent appointment in the Institute till
the age of superannuation. If a staff member having a permanent appointment at
IITM is made Director, then at the end of service as Director, he shall have the
option to revert to the prior appointment, unless he has reached the age of
superannuation.
10.2.2 Probation and Confirmation: A person appointed to post under direct
recruitment quota shall be placed on probation for a period of two years from
the date of joining the post. The appointing authority may declare successful
completion or may extend the period of probation on the basis of evaluation of
the individual performance. The extension of probation period shall not
normally exceed twice the normal period of probation. The probation shall stand
successfully completed on issue of orders in writing. On completion of
probation period and issue of orders in writing to that effect, an employee would
be treated as a regular and confirmed employee unless otherwise, provided
under the terms & conditions of appointment.
Confirmation of an employee will be done only once in his service carrier
against the post to which he was initially appointed in the Institute. On
subsequent promotion/elevation, he would carry his permanent status. A
promotee will also be kept on probation for a period of two years where the
promotion involves change of Group e.g. promotion from Group B to Group A.

10.2.3 Certificate of Physical Fitness: Every employee shall, prior to taking up his
first appointment, be medically examined and be certified fit for service by a
competent medical officer or a Medical Board constituted by the Council. The
standards of fitness shall be as prescribed by the Council from time to time. The
fees for the medical examination shall be borne by the employee.
10.2.4 Agreement: Every staff member of the IITM shall accept in writing the terms
and conditions of his appointment before joining the Institute and again before
taking up each subsequent appointment.
10.2.5 Appointing Authority: All appointments of the staff of the IITM except that of
the Director shall be made in accordance with procedure laid down in Rule 9.4
(10) & 9.34 of the Rules and Regulations and Bye-laws 9.2.2, 9.2.3.
10.2.6 Reservation: Nothing in these Staff Rules shall affect reservation and other
concessions, if any, required to be provided for the candidates belonging to the
Scheduled Casts/Scheduled Tribes/Other backwards classes and other special
categories of persons in accordance with the orders of the Govt. of India issued
from time to time in respect of appointment made in the Institute.
10.2.7 Emoluments and Allowances: The Council shall fix the Pay Bands, Grade
Pays and other allowances of the staff of IITM from time to time. These will in
general follow the Central Government norms in respect of Central Govt.
employees of corresponding categories stationed at Pune. The Pay Band and
Grade Pay as applicable and approved by the Governing Council are given in
Annexure-I.
10.2.8 Superannuation: The age of superannuation for all members of the staff would
be as per Government of India rules in this regard.
10.2.9 Extension Beyond Superannuation: Based on an assessment of the work of an
individual Scientist/Technical Staff, the Governing Council may extend his/her
service in accordance with the instructions issued by the Central Government
from time to time.
10.3 Moving Expenses: In special cases the Council may reimburse the actual travel
and moving expenses of an employee who has joined IITM from any of the
recognized institutions that may be so listed by the Council to an extent not
exceeding the expenses covered by the Government of India rules.
10.4 Children Education Allowance: In the matter of education of their children,
all IITM employees will be given reimbursement of tuition fees & other
educational allowances as per Government of India rules.

10.5 Ad hoc Bonus : Ad hoc Bonus will be paid as per guidelines laid down by the
Central Govt. from time to time.
10.6 Moving Expenses on Retirement: An employee of with 10 years service at
IITM shall on retirement be paid moving expenses to his next place of residence
in India as per the rules fixed by the Council. These shall not exceed those
allowed by the Government of India rules. In case the employee has joined
IITM from another institution where he had a similar benefit which he could not
avail of, he may carry over the tenure at the previous institution towards the 10
years requirement of service with IITM.
10.7 Leave Travel Concession Scheme: The employees of the Institute shall be
eligible for the Leave Travel Concession scheme as applicable to the Central
Government employees with such modifications as may be introduced by the
Council from time to time.
10.8 Loans and Advances:
10.8.1 Interest bearing advances for house building and for purchase of conveyance,
computer etc. may be granted to employees of the Institute on terms and
conditions as are applicable to Central Government employees with such
modification as the Council may consider necessary.
10.8.2 Non - interest bearing advances such as Festival Advance, leave salary advances
etc. may also be granted to the employees on the same terms and conditions as
are applicable to Central Government employees, with such modifications as the
Council may consider necessary.
10.9 Forwarding of applications for outside jobs: All applications for outside jobs
shall be routed through the Director, who may forward them at his discretion.
10.10 Annual Professional Update Allowance:
Annual Professional Update Allowance will be granted to Scientists of the
Institute as follows w.e.f. 1st April 2009:

CHAPTER XI
RECRUITMENTS
11 Recruitment /Assessment of Work & Promotion:
11.1 The posts in the Institute shall be filled by direct recruitment or by assessment or
by merit promotion or by departmental promotion, transfer on deputation or by
absorption in accordance with the rules framed for the purpose by the Governing
Council. The particular method of recruitment on each occasion shall be decided
by the competent authority depending upon the requirements of the Institute and
other relevant factors. Recruitment rules for the posts filled by direct recruitment
(Annexure II)
11.2 General:
1. All posts in Group A & B in the Institute meant to be filled by Direct
Recruitment shall be advertised in leading news papers (including
employment News) on All India basis. The direct recruitment posts in
Group C & D shall be advertised / notified in Employment News, local
news papers etc. and by inviting nominations from the Central
Employment Exchange and Local Employment Exchange. All posts
falling under deputation / transfer shall be notified in the Employment
News and circulated to the concerned organizations. The time allowed for
inviting nominations / applications shall be a minimum of 45 days. There
is no Age limit for the IITM employees and to the Government Servants.
2. The Institute shall not defray travelling or other expenses of candidates
summoned for interview. It shall, however, contribute towards these
expenses at a rate corresponding to the amount of Second Sleeper class
railway fare to candidates called for interview for posts of Senior
Scientific Assistant, equivalent and above ranks and Scientific Assistant
by the shortest route to the place of interview from the Railway Station
nearest to the normal place of residence of the candidate or from which he
actually performs the journey, whichever is nearer to the place of
interview, and back to the same station or the amount of railway fare
actually incurred by the candidate, whichever is less. In all cases where
concessional return tickets are available, candidates should utilize them for
their journey. The Institute’s contribution in such cases will be limited to
the cost of return tickets when such concessions are available. In respect
of journeys by sea from and to any place in India, which is not connected
by rail and where the mode of travel is by steamer the rate of contribution
will be restricted to a single second class steamer fare exclusive of the diet
charges. Candidates who live at a place where there is no railway station
will, in addition be paid road mileage as per rules in force or the actual
amount paid for the road / bus journey, whichever is less for the journey to
and from the nearest railway station or steamer station or from the sub-

divisional / Tehsil headquarters to the nearest railway or steamer station
and back, whichever is less. Candidates coming from outside India will be
paid the Institute’s contribution in respect of the journeys performed
within the limits of Indian Union only.
The Institute’s contribution towards the travelling expenses will be paid in
cash on the spot when the candidates come for interview. In case, if any
clarification is needed the traveling expenses would be paid by demand
draft after the bill is settled.
11.3 The work, performance and conduct of every staff member shall be assessed
periodically for the purpose of promotion, as often as may be necessary,
according to a system to be prescribed by the Governing Council.
11.4 Direct recruitment to the category of Research Staff (Group-‘A’) shall normally
be made at the lowest entry level. However, if the exigencies of work so require,
the posts of Scientists (Group-‘A’) can be filled at a higher level with the
approval of the Governing Council.
11.5 The cases of staff belonging to the categories of Research Staff (i) will be
assessed for in situ promotion to the next higher level/grade by a Review
Committee constituted for the purpose by the appointing authority under and on
the analogy of Flexible Complementing Scheme as being practiced in other
similar Research and Development institutions of DST as per G.O. NO. 2/41/97-
PIC dated 9th Nov. 1998 which is applicable exclusively to Scientists. The
periodical assessments shall be made on completion of minimum residency period
stipulated for each grade for elevation to each level. The recommendations of the
Review Committee will be considered by the appointing authority for the grant of
promotion, under FCS. Promotion to the next higher grade, where this is
considered justified on merits, will be by upgrading of the post in the lower cadre
held by the employee for so long as he holds the upgraded post. Provided that the
Review Committee shall meet not more than twice in a year and its
recommendations shall be given effect (January & July) to from the date of
eligibility recommended by the selection committee. Provided further that the
cases of such employees who are not recommended for promotion by the review
committee on a particular occasion shall be reviewed on completion of one year
until such time they are recommended for promotion. The essential ingredients of
assessment process under FCS shall be assessment of ACRs, performance at the
interview and scientific / research achievements etc. The process of review etc.
shall be determined by the Council (Annexure-III).
11.6 Promotion/elevation of staff in the grades of Research i-A, Scientific and
Technical staff shall be made on the basis of recommendations of a Review
Committee to be constituted by the Council / department. The cases of above
categories of employees will be assessed for elevation to the next higher Grade
Pay in the appropriate Pay Band after a period of every 5 years of regular

service rendered in a particular grade and thereafter after every two years (in
the event of an employee not being found fit for promotion on any occasion).
Promotion to the next higher grade shall be against existing vacancies in the
discipline concerned. If the discipline concerned has no vacancy in the higher
grade, the promotion may be by upgrading the post in the lower grade held by
the employee until such time that a regular vacancy in the higher grade in the
discipline concerned occurs or till the employee concerned vacates the higher
post, whichever is earlier. Such up-gradation of the post shall be within the
competence of the appointing authority for the post to which the promotion is to
be made. Under this scheme no employee except for staff in scientific category
shall be promoted more than thrice above the level at which he was last
recruited. The rules for assessment of work shall be laid down by the Council
(Annexure-III).
11.7 The promotion of Administrative and Non-Technical Maintenance Staff would
be vacancy based. The rules for such promotions would be laid down by the
Council. These employees would also be governed by the Modified Assured
Career Progression Scheme of the Govt. of India.
11.8 Notwithstanding anything stated in the Bye-laws, promotion, advance
increment, or special pay may be granted by the Governing Council to any
employee of the Institute for meritorious work. Assessment of work for merit
promotion etc. under this scheme shall be in accordance with rules framed by
the Governing Council. Annexure III.
11.9 Stagnation increments: All the employees of the Institute would also be
eligible for the grant of stagnation increments in accordance with the
instructions of the Central Govt. on the subject.
12 Termination of Service:
Procedure for termination of services shall be determined by the Council /
Director as the case may be. The following conditions apply:
12.1 Period of Notice: The agreement of service of any member of the staff
appointed under the Bye-laws may be terminated by either party after giving to
the other party not less than three months notice in writing except during the
period of probation when the period of notice shall be as specified in the letter
of appointment.
12.2 Curtailment of period of Notice: Notwithstanding anything contained above.
(a) The service of any member of the staff may be terminated by giving a
shorter notice than that specified in the above rule on payment of a sum
equivalent to the amount of pay plus allowances for the period by which
such notice falls short of the period specified;

(b) The appointing authority, or the authority to whom the power has been
delegated, may accept a shorter period of notice from a member of the
staff in special circumstances.
12.3 Leave on termination of Service:
Earned leave on full pay may be counted towards the period of notice required
under Rule 12.1 above and for any part not so utilized, pay and allowances may
be paid at the discretion of the Director.
13 Obedience to Rules and Regulations:
During the period of his service, every employee shall observe, obey and abide
by the rules of the Institute and the Bye-laws made from time to time by the
Council and all standing orders issued by the Director.
14 Performance of Duties:
Every employee shall at all times maintain absolute integrity, devotion to duty
and do nothing which is unbecoming of an employee of the Institute. Every
employee shall perform such duties as may be entrusted to him and shall to the
best of his ability carry out the lawful directions of the Council, of the Director
or of any other person to whose authority he may be subject according to the
Rules and Bye-laws of the Institute and the standing orders of the Director. An
employee shall devote his whole time to the service of the Institute and shall not
take active part in politics, engage, directly or indirectly, in any trade, business
or occupation or enter into any remunerative commitment except consultancy
assignments taken up with the prior approval of the Governing Council.
Members of the staff shall not stand for election or accept nomination to any
local body or university authority without the previous permission of the
Council in the case of the Director, and of the Director in the case of others.

CHAPTER XII
SERVICE BENEFITS
15 Constitution of Pension and Gratuity Funds:
The Governing Council shall create corpus of an appropriate size for the
administration of the retirement scheme of employees of the Institute in
accordance with the instructions of the Central Government.
15.1 Retirement benefits: Employees of the Institute appointed prior to 1.1.2004
shall be entitled to the pensionary and other benefits including DCRG as per the
provisions of CCS (Pension) Rules, 1972, as amended from time to time.
Employees appointed with effect from 1.1.2004 shall be entitled to the new
Pension Scheme introduced by the Govt. of India vide O.M. No. O.M.
No.1(7)(2) 2003/TA dated 7 January 2004.
15.2 GPF: The Institute shall administer General Provident Fund for all its regular
employees through a Board of Trustees. The provision of GPF Scheme of
Central Govt. shall apply mutatis mutandis to IITM.
15.3 Retirement on Medical grounds: Notwithstanding anything contained in the
foregoing Bye-laws, the Council may retire a member of the staff on three
months notice from the service of the Institute, if he/she has been incapacitated
for further service on account of permanent physical or mental disability, on the
basis of findings of a medical board constituted in this behalf by the Director.
The decision of the Council in this regard shall be final and binding on the
member of the staff concerned. The Council may pay such members of the staff
three months pay and allowances in lieu of notice, if necessary.
15.4 Voluntary/Compulsory Retirement: The Rules for Compulsory/VRS shall be
the same as applicable to the employees of the Central Government from time to
time.
16 Medical Scheme:
A suitable medical scheme for the medical treatment of the pensioners of the
IITM and their families on the pattern of Medical Attendance Scheme in vogue
in the Central Autonomous institutions namely S.N. Bose National Centre for
Basic Sciences of DST will be provided with the approval of the Council
(Annexure-IV). In regard to employees of IITM, the existing CS (MA) Scheme
would continue.

17 Telephone facility at residence:
The Director shall be provided with residential telephone with ISD/STD facility.
The Administrative Officer of the Institute shall also be provided with the
facility of a residential telephone (without ISD/STD facility). The Director of
the Institute may permit residential telephone facilities to other officers keeping
in view the functional needs of the Institute subject to such restrictions as he
may deem fit to impose. Mobile telephone facility would be given to officer as
per Govt. of India order on the subject.
18 Working hours and holidays:
The normal working hours of the IITM shall be from 09:30 am to 06:00 pm
with a lunch break for half an hour on all working days from Monday to Friday.
All other holidays as observed by the Central Government shall normally be
Institute holidays. However, the Director may modify the holidays to meet the
local needs. The number of holidays should not exceed the total number of
holidays sanctioned to the Central Govt. Staff. The Director or a member of the
staff to whom the power has been delegated by the Director, may for urgent
work detain any member of the staff beyond working hours on any working day
or on holidays and grant compensatory leave or such compensation as is
admissible to the staff under the Central Government rules for attendance on
Sundays and holidays.
19 Leave Rules:
Employees will be granted leave (including casual leave, earned leave, leave on
medical grounds etc.) in accordance with the leave rules of the Central
Government. Rules for the study leave, sabbatical leave, extra-ordinary leave
etc. as being practiced in other similar Research and Developmental institutions
of DST shall be framed by the Council from time to time.
19.1 Sanction and Refusal: Leave cannot be claimed as a matter of right. Where
the exigencies of office so require, discretion to refuse or revoke leave of any
description is reserved to the authority empowered to grant leave.
19.2 Authority Empowered to Grant Leave: Application for leave shall be
addressed to the Chairman of the Council by the Director and to the Director by
other members of the staff. Leave may be sanctioned by the Director or by a
member of the staff to whom the power has been delegated by the Director.
The Council may sanction leave to the Director, but the Director can avail
himself of casual leave on his own authority.

CHAPTER XIII
DISCIPLINARY MATTERS
20. Conduct Rules
The CCS (Conduct) Rules shall apply mutatis mutandis to the employees of the
Institute.
21 Discipline, Suspension, Penalties and Appeals etc.:
21.1 Discipline : The authority that appoints a member of the staff of IITM may
discharge, remove, dismiss, or impose any other penalty on him e.g. censure,
withholding of increments, withholding of promotion, recovery of any
pecuniary loss caused to the Institute by him, reduction in rank, reduction to a
lower stage in the timescale of pay, compulsory retirement etc., for misconduct,
or for breach of the terms and conditions of his appointment, after following the
procedure prescribed in these rules. The Director may suspend a member of
staff preparatory to disciplinary action as described above. Suspension shall not
be treated as a punishment.
21.2 Order of Discharge, Removal or Dismissal: No order of discharge, removal
or dismissal or imposing any of penalties mentioned in the above Bye - Laws
shall be passed under the preceding service conditions unless the specific
charges on which such order is to be passed, are framed against the person in
writing, and given to the said person, so that he shall have a reasonable
opportunity of defending himself provided that the requirements of this Service
Condition may be waived if the facts on the basis of which action is to be taken,
have been established in a Court of Law, or where he has absconded, or where
it is impracticable to communicate with him for any other reason. In every such
case where all or any of the requirements of this Service Condition are waived,
the reasons for so doing shall be recorded in writing.
21.3 Appeals:
An employee who has been discharged, removed or dismissed or awarded any
other penalty mentioned above shall have a right of appeal against any order
passed by the appointing authority to an authority to whom the appointing
authority is immediately subordinate, hereinafter referred to as "appellate
authority". Every appeal shall comply with the following requirements:
(a) It shall be couched in concise, polite and respectful language, and be free
from irrelevant matter.
(b) It shall contain all material statements and arguments relied on and shall
be complete in itself.
(c) It shall specify the relief desired.

(d) It shall be submitted to the authority who made the order appealed against,
within a period of three months from the date on which the appellant
receives a copy of the order appealed against provided further that a
copy of the appeal may be submitted directly to the appellate authority.
It shall not be addressed to any other authority or person connected with
IITM
Non-observance of any of the above may result in the Appeal being
summarily rejected.
21.4 Consideration of Appeals:
In the case of an appeal against an order of discharge, removal or dismissal etc.,
the appellate authority shall consider:
(a) whether the procedure prescribed in the preceding Service Condition has
been complied with and, if not, whether such non-compliance has resulted
in a miscarriage of justice;
(b) whether the findings are justified;
(c) whether the penalty imposed is excessive, adequate or inadequate and
shall pass orders,
(i) setting aside, reducing, confirming or enhancing the penalty, or
(ii) remitting the case to the appointing authority or to any other
authority with such direction as it may deem fit in the circumstances
of the case provided that the appellate authority shall not impose any
enhanced penalty unless the appellant is given an opportunity of
making any representation which he may wish to make against such
enhanced penalty within 60 days from the date he has been given the
said opportunity.
A schedule of Appointing, Disciplinary and Appellate Authorities is
enclosed (Annexure-V).
21.5 Implementation of Orders in Appeal: The authority, that made the order
appealed against, shall give immediate effect to the orders passed by the
appellate authority.
21.6 Orders Passed by the Governing Council not Appealable : Notwithstanding
anything contained in these Service Conditions, no appeal shall lie against any
order made by the Council.
21.7 Governing Council's Power to Review : Notwithstanding anything contained
in rule 22.2 to 22.5, the Council may on its own motion or otherwise, after
calling for the records of the case, review any order which is made or is appeal
able under these Service Conditions, and

(a) confirm, modify or set aside, the order,
(b) impose any penalty or set aside, reduce, confirm or enhance the penalty
imposed by the order,
(c) remit the case to the appointing authority that made the order or to any
other authority directing such further action or enquiry as it considers
proper in the circumstances of the case, or
(d) pass such other orders as it deems fit, provided that an order imposing or
enhancing the penalty shall not be passed unless the person concerned has
been given an opportunity of making any representation which he may
wish to make against such enhanced penalty provided he makes
representation within 60 days from the date he has been given the said
opportunity.
21.8 Review of Orders in Disciplinary Cases:
The authority before which an appeal against an order imposing any of the
penalties specified in rule above lies may of its own motion or otherwise, call
for the records of the case in a disciplinary proceeding, review any order passed
in such a case, and pass such orders as it deems fit, as if the employee had
preferred an appeal against such an order provided that no action under this
Service Condition shall be initiated six months after the date of the order to be
reviewed.
21.9 Pay and Allowances on Acquittal:
If a member of the staff of IITM who has been discharged, removed or
dismissed or compulsorily retired or awarded any other penalty has been
reinstated/ acquitted/absolved as a result of appeal, review or due to a court
decision favorable to the employee, or the charges are not proved against him,
the competent authority may grant to him for the period of absence from duty,
(a) if he is fully exonerated, the full pay to which he would have been entitled if
he had not been suspended, discharged, removed, dismissed or compulsorily
retired and by an order to be separately recorded, any allowance of which he
was in receipt prior to his discharge, removal, dismissal or compulsorily
retired,
(b) if not fully exonerated, proportion of such pay and allowances as the
competent authority may prescribe.
The period of absence from duty will be treated as period spent on duty in case
(a). It will not be treated as period spent on duty in case (b) unless the appellate
authority directs to the contrary.

CHAPTER XIV
DUTIES AND FUNCTIONS OF OFFICERS AND STAFF OF IITM
22 Duties of the Director:
Duties of Director:
22.1The Director shall be the chief executive of the Institute and shall be responsible for
the day to day management of its activities and overall administration of the Institute.
He shall discharge these responsibilities in accordance with the Rules and Bye-laws
of the Institute and any instructions issued by the Governing Council from time to
time.
22.2Direction and control of the Staff: All members of the staff of the Institute shall
be under the general control of the Director, who may issue standing orders from
time to time.
22.3Supervision of work: The Director shall exercise general supervision over the
programme of work and the research projects of the Institute.
22.4Coordination of work: The Director may call for the general plan of work of each
Division, Section or group as the case may be, at the beginning of each year and at
any other time he may consider necessary, and coordinate the work of the various
Division or Sections of the Institute.
22.5Annual Reports: The Director shall submit the Annual Reports of the Institute to the
Governing Council by the end of June each year.
22.6Current duties: The current duties of the Director when he is away on tour or
deputation or absent on leave, sickness, etc. will be performed by an officer to be
nominated for that purpose by the Director in consultation with Chairman.
23 Duties of Scientists ‘H to B’ and Junior Scientific Officers:
23.1Scientist ‘H to B’ and Junior Scientific Officers shall participate in and supervise the
work of their respective subjects, schemes / projects. The Head of the
Division/Program Managers will submit reports on the working of projects in his
Division to the Director. There should be at least one report in the course of a year.
23.2 Each Head of the Division/Program Managers shall submit to the Director from time
to time or when called upon to do so his research programme and that of the
members of staff and scholars working with him.

23.3 Sanction of work: All new scheme of research to be conducted at the Institute,
which may involve any expenditure, shall be submitted to the Director for
sanction.
24 Duties of In-charge, Library :
24.1Responsibility for custody of the Library: The In-charge, Library shall be responsible
for the custody of books, manuscripts, periodicals etc. belonging to the Library and
shall maintain a complete register and index. The purchase of books and journals for
the library will be recommended by the Library Committee for approval by the
Director.
24.2Library Rules: The Rules for the management of the Library shall be framed from
time to time, as may be found necessary by the Library Committee appointed by the
Director to be responsible for the proper functioning of the Library.
24.3Annual Report: He/ she shall prepare, by the end of the March every year, annual
report on the working of the institute for submission to the Governing Council and to
the administrative ministry.
24.4He / she shall coordinate in preparing plan document for the Institute for submission
to the Governing Council and Government.
24.5Purchase of Books: The Librarian shall be responsible for purchasing of books
approved by the Library Committee or the Director.
24.6Stock taking : The Librarian shall take stock every year of all the books in the
Library. The Library Committee may assign personnel to check the report.
25 Duties of Administrative Officer:
25.1.1 The Administrative Officer shall be the non-member Secretary of the Governing
Council.
25.1.2 Secretarial work: The Administrative Officer shall assist the Director in all work
connected with the meetings of the Governing Council.
25.1.3 Work under the general control of the Director: In all matters concerning the
Institute, he / she shall act under the general control and orders of the Director.
25.1.4 Correspondence: The Administrative Officer shall be in charge of correspondence
relating to administration and finances of the Institute, subject to the instructions
of the Director.
25.2 Office Management: The Administrative Officer will be in charge of the
administrative staff and the general maintenance staff of the Institute.

25.3 Maintenance of the Premises: The Administrative Officer will look after the
maintenance and upkeep of the premises and the property of the Institute.
25.4 Annual Budget Estimates: He shall prepare the Annual Budget Estimates of the
Institute for submission to the Director.
26 Duties of other Officers:
The duties of other officers will be as prescribed by the Director. They will work
under the control of the Director in accordance with the standing instructions
issued by him from time to time.

OFFICE MEMORANDUM
Sub:- Flexible Complementing Scheme for Scientists in various scientific departments –
recommendations of the Fifth Central Pay Commission for modification of the
Scheme- regarding.
The undersigned is directed to say that in Chapter 51 of its report, the Fifth
Central Pay Commission has made a number of recommendations for modifying the
existing Flexible Complementing Scheme in operation in Scientific & Technological
Departments for in-situ promotion of scientists/technical personnel, with a view to
removing the shortcomings/inadequacies in the Scheme highlighted by the Commission.
The recommendations of the Fifth Central Pay Commission in this regard have been
examined in consultation with the Secretaries of the Department of Science &
Technology and some other major scientific Departments and the following decisions
have been taken:
1. The recommendation of the Pay Commission that the modified Flexible
Complementing Scheme proposed by it should be applicable in all the Departments,
including the Departments of Space, Atomic Energy and DRDO without any special
dispensation for any individual Department, has not been accepted. The existing scheme
of merit-based promotion system covering the Groups A, B & C personnel, as presently
applicable in the Deptt. Of Atomic Energy, the Deptt. of space and the DRDO shall
continue.
2. The recommendation of the Pay Commission to define “scientific administrators”
and to exclude them from the benefit of in-situ promotions under Flexible
Complementing Scheme and to bring them under the ambit of “Assured Career
Progression Scheme” formulated by the Pay Commission has not been accepted.
However, it has been decided that the Flexible Complementing Scheme should, as per its
original objective, be made applicable only to scientists and technologists holding
scientific posts in scientific and technology departments and who are engaged in
scientific activities and services. It has also been decided that assessment norms for
promotions under the Flexible Complementing Scheme should be rigorous with due

emphasis on evaluation of scientific and technical knowledge so that only the scientists
who have to their credit demonstrable achievement or higher level of technical merit are
recommended for promotion under the Flexible Complementing Scheme. For achieving
these objectives, the following decisions have been taken:
a) The criteria for identifying institutions/organizations as scientific and
technological institutions as well as for defining scientific activities and services,
scientists and engineers and the scientific posts shall be as prescribed in Annexure I to
this Office Memorandum. The FCS shall not be applicable where the criteria specified
vide this Office Memorandum are not fully met.
b) A revised assessment procedure as prescribed in Annexure II to this Office
Memorandum shall henceforth be followed by all Scientific Ministries/Departments for
considering advancement under FCS.
3 The recommendations of the Pay Commission that the existing disparities in the
operation of Flexible Complementing Scheme in various scientific and technical
departments in the matter of designation of post, the number of pay scales and the
residency period should be removed and there should be uniformity in this regard has
been accepted. Accordingly, all the posts covered under the Flexible Complementing
Scheme shall carry the following uniform scales of pay, designations and the minimum
residency period linked to performance:-

In order to give immediate effect to the decision contained in this para, an umbrella
Notification has been issued vide G.S.R. No. 660(E)
Dated 9.11.1998.
4 The recommendation of the Fifth Central Pay Commission for introducing a
‘cooling off’ period of 3 years before an officer is considered for the Flexible
Complementing Scheme on the second occasion at the same level has not been accepted.
The recommendation for disqualification of the candidate permanently from the FCS in
case of failure to qualify thrice at the same level, etc. has also not been accepted.
Therefore, the existing system of assessing the officer every year would continue.
5. It has further been decided that in order to extend the benefit of in-situ promotions
under the Flexible Complementing Scheme to other Scientific Organisations that are
demanding the extension of FCS in their case, the administrative Ministry of such
institutions shall satisfy itself that such institutions are scientific and technical institutions
and the officers are scientists holding scientific posts and are involved in scientific and
technical activities as defined in the Annexure I to this Office Memorandum and make its

recommendations to the Department of Science & Technology. On receipt of such a
request the Department of Science & Technology shall set up a Committee, including the
representative of the Department of Personnel & Training and of the Department of
Expenditure as well as eminent scientist relevant to the discipline, for examining the
proposal referred by the administrative Ministry concerned. A final decision on the
proposal of an administrative Ministry for extension of FCS to other scientific
organisations shall be taken based on the recommendations of this Committee. Since it is
not necessary that all the pay scales under the Flexible Complementing Scheme should be
applicable in all the scientific organisations, as the size of the organization may not
justify introduction of the entire group of scales, the Committee, while making its
recommendation, would take a specific view as to the number of scales that should be
operated in the organisation as well as the appropriate residency period for ensuring an
even pace of promotion. However, the progression under Flexible Complementing
Scheme will only be as per scales indicated in para 3 of this Office Memorandum.
6. It is requested that all the Ministries/Departments, where the Flexible
Complementing Scheme is in operation, may initiate action for review of the provisions
of the Flexible Complementing Scheme and amend the provisions of the relevant
recruitment rules so that the scheme is brought in conformity with the
decisions/guidelines being conveyed vide this Office Memorandum. Results of the
review may also be conveyed to the Department of Science & Technology, the nodal
department for operation of the Flexible Complementing Scheme. Action for extension of
the Flexible Complementing Scheme to other Scientific organisations, where the same is
not in operation at present, may be taken in accordance with the decision contained in
para 5 of this Office Memorandum.
7. The relevant provisions of Department of Science & Technology Office
Memorandum No. A.42014/2/86-Admn.I(A) dated the 28th
May, 1986 stand amended to
the extent the provisions of this Office Memorandum are at variance with the provisions
of the said Office Memorandum.

ANNEXURE-I
Criteria for identifying Institutions/Organisations as Scientific & Technical
Institutions and definition of Activities and Services, Scientists & Engineers and
Scientific Posts.
(i) The institutions referred to as S&T would be characterised by pursuit of
excellence.
(ii) They should be engaged in research, design, development or programme
implementation (including review, analysis, promotion and aspects of science
policy, etc.) which would cover a broad spectrum of pure and applied research
but the essential feature would be innovative character and spirit of enquiry
that permeates their overall functioning.
(iii) The scientific culture is characterised by a few salient aspects, namely the
persons involved are highly qualified and skilled technical personnel, involved
in creative and innovative activity, they are willing to be judged on the basis
of merit and competence rather than on the basis of seniority and a hierarchial
structure.
(iv) The criteria could cover the aims and objective of the institution/organisations
qualifications of the personnel qualitative requirements for performance of
various types of activities, etc.
Scientific Activities and Services:
Scientific activities and Services covered for considering the applicability of the Flexible
Complementing Scheme are as under:
(a) Fundamental/basic research: Original investigation to gain new scientific
knowledge, not necessarily directed towards any specific practical aim
or application.

(b) Applied Research: Original investigation to gain new scientific or
technical knowledge directed towards a specific practical aim or
objective.
(c) Experimental Development: Use of scientific knowledge directed
towards producing new or substantially improved materials, devices,
products, processes, systems or services.
(d) S&T activities which are directly linked to R&D in terms of promoting
the scientific activities and services.
Scientist and Engineers: Persons
(a) who possess academic qualification of atleast Master’s degree in
Natural/Agricultural Sciences or Bachelor’s Degree in
Engineering/Technology/Medicine and
(b) working in those capacities, use or create scientific knowledge and
engineering and technological principles, i.e persons with scientific or
technological training who are engaged in professional work on S&T
activities, high level administrators and personnel who plan, direct or
coordinate the execution of S&T activities.
Scientific Post is the one, the incumbent of which is a ‘Scientist or Engineer’ defined
above in a scientific institution/organisation declared as ‘Scientific Department’ as
defined and is engaged in the generation, advancement, dissemination, and application of
scientific and technical knowledge in the S&T activities.

CRITERIA FOR CONSIDERING PROMOTIONS UNDER FLEXIBLE
COMPLEMENTING SCHEME
(a) All officers will be first screened on the basis of gradings in the Annual
Performance Assessment Report (APAR) for consideration for promotion; the APAR
should be assessed on a 10 point scale giving 10 marks for “outstanding”, 8 marks for
‘very good”, 6 marks for “good”, 4 marks for “average” and 0 for “poor” and only
those officers who satisfy the minimum residency period linked to their performance
as indicated in the table below be screened in.

(b) As the procedure adopted for assessment of APARs in various Scientific
Departments differ at present, it has been decided that an external member, from
Department or Atomic Energy, Space or DRDO who have developed over the years a
fine tuned system of screening in meritorious Scientists may be co-opted in the
selection process, till such time a system gets established in other Scientific
Departments. The position will, however, be reviewed after 5 years from the date of
issue of this Office Memorandum.

(c) All Officers who are screened-in will be called for an interview. The
performance in the interview will also be graded similarly on a 10 point scale and the
eligibility for promotion will be based on the same norms as in the above Table.
(d) Field experience in research and development and/or experience in
implementation of such scientific projects is compulsory for promotion of scientists
recruited to the posts in the Secretariat of the Scientific Ministries/Departments to
higher grades under FCS. Field experience of atleast 2 years and 5 years respectively
will be essential for promotion to Scientist F and Scientist G grades respectively.
However, during the transitional period, Committee may relax this requirement in
case of meritorious candidate.

6 Procedure :
Appointing authority will take steps to constitute the Assessment Committee and arrange
for their meeting in time. Recommendations of the Assessment Committee shall be
considered by the appointing authority who shall submit the report of the committee to
the Governing Council for approval. Decision of the competent authority shall be
communicated to concerned employee.
II Review Scheme
1. Eligibility for Review scheme
Under Staff Rule 11.6, the work of Research staff (i-A), Scientific Staff and Technical
Staff shall be reviewed on completion of 5 years of service in the grade and thereafter
every two years, by review committees constituted for the purpose by the appointing
authorities (Review Scheme). Under this scheme no employee except for staff in
scientific and research staff shall be promoted more than thrice above the level at which

2. Procedure :
Director will initiate action in April and September every year about all cases which
become due for assessment upto the end of December of preceding year and June of that
year respectively and arrange to hold the meetings of the Review Committees as early
thereafter as possible. Candidates will be asked to submit a detailed account of their work
in the enclosed prescribed form. Appointing authority will take steps to constitute the
Review Committee and arrange for their meeting in time. Recommendations of the
Review Committee shall be considered by the appointing authority who shall submit the
report of the committee to the Governing Council for the grant of promotion, special pay
or advance increments, as the case may be. Decision of the competent authority shall be
communicated to concerned employee.

4.2 The suitability for recommending advance increments, special pay or promotion
will be judged by the degree of fulfillment of the criteria laid down above, taking
into account the grade of the employee whose work is being reviewed.
5. Reference to Assessment Reports:
Before recommendations are finalized by the Committee under review Scheme,
reference to confidential reports should be made to check for gross incompatibilities,
factual information, etc.
III Merit Scheme
Under Staff Rule 11.8, advance increments, special allowance, or special pay may be
granted by the Governing Council to any employee of the Institute for meritorious work
or for special service rendered to the Institute (Merit Scheme). For assessment of work
under the scheme, committees shall be constituted by the Governing Council.
1. Procedure:
On the basis of application in the prescribed form (enclosed) received from individual
employee or on the initiative of the Director, concerned the cases of employees in the
grade Scientist-B and above, will be taken up by the Director for processing for grant of
awards under the merit scheme. All cases shall be forwarded by the Director to the
Governing Council which shall decide whether a Committee under the merit scheme
should be constituted or not. Recommendations for award under the merit scheme shall
be considered by the Governing Council. Decision of the Governing Council shall be
communicated to the concerned employees. No application or recommendation for award
under the merit scheme shall be entertained within a period of two years of appointment
of an employee in the grade, or within one year of last review.
2. Eligibility :
Standards of assessment under merit scheme shall be distinctly higher than those
specified under Review Scheme and shall require outstanding professional contributions.
The contributions may be a novel theoretical model or approach, analysis of data leading
to new ideas or concepts, original experimental set-up, design of instruments leading to
new or improved capability or large-scale import substitution, collection of valuable
meteorological observations under extremely difficult conditions, etc. The award of a
Doctoral Degree shall not automatically entitle a person for promotion under the merit
scheme

CONTRIBUTORY MEDICAL SCHEME (CMS)
1. Title and Scope :
The Scheme shall be called ‘Contributory Medical Scheme’(CMS) for
pensioners of Indian Institute of Tropical Meteorology.
2. Date of effect :
The Scheme shall come into effect from 2 May, 2005.
The pensioners would be entitled to the benefit of the scheme from the date
of receipt of contribution.
3. Applicability :
The Scheme is applicable only to –
3.1
(a) Pensioners of the Institute and members of their family residing
with them and wholly dependent on them.
(b) Members of the family of the deceased employee who was in the
permanent employment of the Institute including the family of
retired employee after his death.
(c) A pensioner re-employed in the Institute and members of his / her
family provided he / she is not covered by any other medical
scheme in earlier pre-retirement service and opts for the medical
scheme of the Institute.
(d) The family of the deceased employee may avail of the benefit of
the scheme for the whole of the month in which the employee died
as well as the succeeding calendar month without payment of
contribution for the said succeeding month.
4. Definition of ‘Family’
4.1 ‘Family’ for the purpose of the Scheme in terms of rule 3.1 (a) and 3.1(c) in
respect of retired pensioner of the Institute shall mean:
(a) A beneficiary’s wife or husband, as the case may be
(b) A dependent unmarried children and step children (below the age of 25
years) normally residing with the pensioner

(c) Unemployed widowed daughters and dependent divorced / separated
daughters*.
(d) Dependent Parents who are not covered by any other medical scheme .
(e) Sisters ( unmarried and unemployed except judicially separated / divorced
sisters)
(f) Unemployed widowed dependent sisters
(g) Unemployed dependent minor brothers*
• The total number of sisters ( both unmarried and widowed) and minor
brothers and dependent brothers not to exceed two.
• The total number of unmarried children and step children and
widowed daughters not to exceed three. Wholly dependent and
normally residing with the employee

Explanation :
1. The term ‘parents’ includes ‘step-mother’.
2. In respect of those beneficiaries who have joined the Institute before
20.10.1998 the total number of unmarried children and step children
below the age of 25 years and widowed daughters to be covered under the
Scheme shall not exceed 3. The benefits under the Scheme shall; however
be admissible to all such children born to a beneficiary in three deliveries,
provided that the number of living children just before the third delivery
does not exceed two.

3. In respect of those employees who have joined the Institute on or after
20.10.1998. The total number of unmarried children and stepchildren
below the age of 25 years and widowed daughters to be covered under the
scheme shall not exceed two. The benefits under the Scheme shall
however, be admissible to all such children born to a beneficiary in two
deliveries, provided that the number of living children just before the
second delivery does not exceed one.
(a) If the son or daughter or any dependent member of beneficiary’s
family admitted to the Scheme is suffering from any disorder or
disability of mind or is crippled or disabled so as to render him /
her unable to earn a living he/she can be continued to be covered
under the Scheme even after attaining the age of 25 years subject
to the following :
A.1 The controlling Officer concerned shall satisfy, before continuing the
scheme to such son or daughter or dependent member that the handicap is
of such a nature so as to prevent him / her from earning his / her livelihood
and the same shall be evidenced by a certificate obtained from a Specialist

Doctor recognized / empanelled under the Scheme setting out the exact
mental or physical condition of the son or daughter or dependent member.
A.2 Further the concerned beneficiary shall produce every three years, a
certificate from a Specialist Doctor recognized / empanelled under the
Scheme to the effect that his / her son or daughter or the dependent
member continues to suffer from the disorder or disabled, failing which
the facilities shall be withdrawn for such a son or daughter or the
dependent member
Note:(I) Children : Married, divorced or otherwise legally separated daughters
even though dependent on the beneficiary are not eligible for medical
benefits under the Scheme. In the case of adopted children, only legally
adopted children will be eligible for medical benefits. Such children as are
employed as defined in the rules.
(II) Parents: Parents will be regarded as wholly dependent on the beneficiary
if they normally reside with him / her and if their (both parents) total
monthly income does not exceed the pension of the beneficiary and is not
more than Rs. 1500/- per month excluding Dearness Relief vide GOI
Dept. of Health O.M. No. S-11012/1/98-CGHS(P) dated 14.3.2001. For
adoptive parents, the provisions of the Government of India, Ministry of
Health, O.M. No. F.29-21171 M.A. dated 29th
January 1972, read with
O.M. No. S.14012/5176-M.C. dated 9th
September 1976.
Explanation:
1. Parents of a married female beneficiary would also be entitled to the
benefits of the Scheme if they continue to be wholly dependent on female
beneficiary after her marriage. She will, however, have a choice (the
option once exercised can be changed only once) to include either her
parents or her parents-in-law for availing benefits under the scheme
subject to the conditions of dependence, residence etc., being satisfied.
This is subject to condition about drawing of monthly income as per rule.
2. More than one wife of an beneficiary can be registered under the Scheme
if the extra wife is not in contravention of
(a) Rule 21 of the Central Civil Services ( Conduct) Rules, 1964.
(b) Administrative Orders issued by the Ministry of Home Affairs vide
their O.M. No. 290/59-Estt dated October 16, 1954.
(c) The legislation restricting plural marriages.

An adopted child shall be deemed to be the child of his adoptive parents
for all purposes and the ties of the child in the family of his birth are
severed and replaced by those created by the adoption in the adoptive
family. It has, therefore, been decided that :
i) Once the adoption is effected the medical facilities under CMS
cannot be extended to the real parents, even though they are wholly
/ mainly dependent on the Institute’s beneficiary.
ii) The term ‘Family’ for the purpose of these Rules will include
adoptive parents who are wholly / mainly dependent on the
Institute’s beneficiary subject to the condition of dependence and
residence laid down and
iii) In the case of adoptive parents, if the adoptive father has more than
one wife living, and the adoption has been made with the consent
of more than one wife, only the senior-most among them in
marriage will be deemed to be the adoptive mother for the purpose
of eligibility to the concession under the Contributory Medical
Scheme, and orders and the other will be treated as step-mother
and as such will not be eligible to these concessions, as under the
rules the term ‘parents’ does not include step-mothers.
4.2. Family for the purpose of the scheme in terms of Rule 3.1 (b) in respect of
members of the family of deceased employee shall mean :
a) Wife in case of male Govt. servant or husband in case a female
Govt. servant.
b) A judicially separated wife or husband, such a separation not been
granted on the ground of adultery and the person surviving was
held guilty of committing adultery.
c) Son who has not attained the age of 25 years (Twenty five years)
and unmarried daughter who has not attained age of 25 years
(twenty five years) including such son and daughter adopted
legally.

4.3. No person who is receiving or is eligible to receive medical aid / facility / cash
subsidy, cash allowance or reimbursement for medical care from any source other
than this Scheme such as, for example, the Railways, CGHS, Commercial
organizations, public sector undertakings, State Government, Private Sector
Organizations etc., shall be admitted to the Scheme without the explicit
permission of and subject to such restrictions as may be imposed by the Institute
4.4. Annual Declaration:
.
4.4.1 A declaration in the prescribed form regarding income and residence of parents,
as also regarding residence, dependence and age of eligible children, and other
dependents, should be furnished by the beneficiary at the time of initial

registration and at the beginning of every calendar year thereafter for continuation
of the Contributory Medical Scheme facilities.
4.4.2 It shall be the responsibility of the beneficiary concerned to notify to the Institute
as soon as their sons / daughters, parents or other dependents become ineligible
for the benefits of the Scheme so that their names can be deleted from the list of
Contributory Medical Scheme beneficiaries. Any suppression of information,
would lead to withdrawal of the facilities under the Scheme and also institution of
disciplinary proceedings as per rules.
5. Contribution / Subscription:

The rates can be changed by the Institute from time to time.
Contribution may be charged from the pensioner on the basis of their last pay
drawn or the pension, as per the option given by the pensioner.
Accommodation / treatment / diagnosis / medicines procedure etc:
The entitlement for the hospital accommodation / nursing home / fixation of
package / ceiling rates in case of treatment from recognized private hospitals and
diagnostic centres may be governed by the Ministry of Health & Family Welfare
O.M. No. S.11011/33/271-CGHS Desk-II/ CGHS(P) dated 20th
January 2004 and
as amended from time to time.
5.1 In the cases where both the husband and wife are beneficiaries of the Institute, the
payment of contribution will be regulated as under:
(a) The contribution shall be recovered from either the husband or wife. The
husband and wife shall send a joint declaration to the Accounts Section
giving detailed information in this regard. The rate of contribution to the
Scheme will however be calculated at the rate applicable to the spouse
drawing the higher pension.
(b) The person from whose pay-bill the contribution is recovered shall be
regarded as the prime beneficiary, and will be eligible to register his / her
parents.

(c ) In case the spouse of the prime beneficiary wishes to additionally register
his / her dependent parents, who are otherwise eligible, a separate
contribution shall be payable by him / her on the basis of his / her pay.
(d) If the wife is paying the contribution and husband wishes to register his /
her parents, who are otherwise eligible, he will have to pay an additional
contribution based on his pay.
(e) The entitlement of parents shall be determined with reference to the pay of
the prime beneficiary in all cases.

5.2 Contribution:
In the case of retired employees the monthly contribution shall be recovered from
the retired employee. Pay for the purpose of recovery shall mean pay as defined in
FR 9 (21)(a)(i) in Government of India Rules, drawn by the deceased employee at
the time of death.
5.3 Contribution from the family of deceased retired employee:
In the case of deceased employee, the monthly contribution shall be recovered
from their family. Pay for the purpose of recovery shall mean pay as defined in
FR 9 (21)(a)(i) in Government of India Rules, drawn by the deceased employee at
the time of death
6. Details of Scheme:
6.1 The beneficiary under this scheme residing at Pune and Delhi will be eligible to
take medical treatment OPD / Indoor at all the recognized hospitals under CGHS
Scheme. Where the beneficiary has settled at a place other than Pune and Delhi,
they have to take medical treatment from the Govt. hospitals of the State
concerned. Specialist consultation if required by the hospital authorities, same
would be allowed. The reimbursement for all the above treatment would be as per
CGHS schedule as amended from time to time.
6.2 The entitlement for hospital accommodation, nursing homes, fixation of package /
ceiling rates in case of treatment from recognized private hospital and diagnostic
centers will be covered by Ministry of Health and Family Welfares introduction
issued from time to time, which inter-alia relate to recognition of private hospitals
/ diagnostic centers for specialized and general purpose treatment and fixation of
package / ceiling rates.

7. Ayurvedic and Homeopathic Treatment:
The beneficiaries can get hospitalization / treatment from any Government or
Government authorized Ayurvedic / Homeopathic hospitals / dispensaries. The
reimbursement would be done as per rules.
8. Pathology, X-ray etc. examination for diagnosis:
The pathological tests, x-ray, cardiogram etc. for diagnosis can be got
conducted at one of the recognized laboratories / diagnostic centers / X-ray
centers / nursing homes / hospitals / poly-clinics under CGHS Scheme Actual
charges for such tests will be reimbursed as per CGHS Schedule
9. Medicines:
Cost of medicines prescribed by the recognized hospital will reimbursed as per
the guidelines of CGHS in this behalf. The medicines shall be purchased only
from the licensed medical shops registered under the Drug Control Act of the
State.
10. Procedure for payment of fees and charges to the Specialists /
Nursing Homes / Hospitals / Poly-Clinics:
Beneficiaries should settle the bills for any consultation / treatment directly with
the recognized hospitals / nursing homes and seek reimbursement from the
Institute; the reimbursement in such cases will be restricted to the approved rates.
11. Other Facilities:
11.1 A beneficiary if not in a position to get administered injections, prescribed by the
recognized hospital, can get it administered from any R.M.P. registered under the
Indian Medical Council Act, 1956 either at his dispensary or at the beneficiary
residence. The bill for the same should be certified by hospital and rates would be as
per CGHS Schedule
11.2 When transport by ambulance is recommended on medical grounds an ambulance
may be hired and charges incurred in connection with such hiring, to the extent
considered reasonable by the Institute, will be reimbursed to the beneficiary
11.3 The beneficiary and their families should go to the recognized hospital for getting
their eyes examined. The charges will be borne by the scheme. This facility will be in
addition to any other treatment prescribed by the eye specialists.

11.3.1 The Scheme will not reimburse the cost of the lens / frame prescribed by the eye
specialist. Goggles will not be provided nor will its purchase subsidized under the
scheme. If the contact lenses are warranted, it will be permitted under the
certificate of the recognized specialist and the reimbursement of charge will be
restricted to Rs. 200/-. For cataract operation including implants of IOL / multi
focal lens etc. conducted through referral, the reimbursement will be limited to
Rs. 6500/- for each eye. The notes are as per Ministry of Health and Family
Welfare orders.
12. Reimbursement of expenses incurred in a medical emergency (Other
than maternity):
12.1 When there is a medical emergency, a beneficiary may receive medical
attendance and treatment from any nearby private hospital duly recognized
under the Indian Medical Council Act 1956. The claim would be reimbursed
as per CGHS Schedule on production of certificate from hospital concerned
indicating the nature of emergency.
12.2 For the above purpose, the term ‘emergency’ shall mean a situation or
contingency when but for the immediate medical treatment, there would have
been, on the basis of the medical and attendant considerations, a serious
danger or hazard or severe or deleterious consequences to the health of the
patient. The accessibility, availability or otherwise of the facilities under the
scheme in the context of the severity of medical emergency / ailment at the
time of emergency will also be taken into consideration. The opinion of the
Institute shall be final as to what constitutes an emergency treatment.
13. Miscellaneous provisions:
13.1 The Scheme shall be administered by the Institute
13.2 The Institute may withdraw temporarily or permanently the benefit of
Scheme in the following cases:
a) When the contribution is not being paid in time by the beneficiary.
b) In the case of misuse of the benefits of the Scheme by the
beneficiary or a member of his / her family.
c) When he ceases to be the pensioner
d) In such other cases where such a step is considered necessary.
Note : Before taking action as mentioned above, the beneficiary
concerned will be given a chance to explain his / her position.
13.3 A sum of Rs. 5/- or as decided by the Institute from time to time will be
recovered on each occasion for each Contributory Medical Scheme identity
card (registration) lost or misplaced requiring issue of a fresh card.

13.4 In cases where it is found that a beneficiary registered under the Scheme is
not eligible to be so registered or is not eligible for any particular benefit
under the Scheme, the Institute may decide upon the amount of recoveries in
each case and the date from which such recoveries should be effected.
14. The Director may from time to time issue office orders and amend various
schedules and forms as may be necessary for the operation of the Scheme.
15. Notwithstanding anything stated above, the Director has the power to settle any
claim and his decision will be final and binding.
16. If any question arises relating to the interpretation of these rules, it shall be
referred to the Governing Body of the Institute whose decision thereon shall be
final and binding.
