Who can use this Contract?

All Western Australian public Authorities as defined in the State Supply Commission Act 1991, or other Approved Buyers or any entity expressly authorised in writing by the State Supply Commission.

Categories Air charter services departing out of the Broome and Kununurra Airports.

In the following aircraft capacities: • Five Seat; • Seven Seat • Nine Seat; or • Ten plus Seat.

Key Features and Benefits

• An efficient ‘pick and buy’ arrangement (up to $150 000 incl. GST, beyond which sufficient quotations are required) that enables agencies to achieve value for money and to effectively match available contractors to the scope of services on offer;

• Prices shown in the Contractors Price Guide are maximum allowable prices. (Where Contractors are requested to provide quotations they may offer lower rates than the rates accepted for the Contract but not higher);

• Ability to make better informed decisions regarding charter services;

• Greater opportunity for agencies to co-ordinate services and develop potential cost savings through planned travel; and

• Price variation in relation to fuel and other costs are controlled via the Contract.

Cessna C208 Caravans are unable to be flown under Instrument Flight Rules (IFR) in the Charter Category, however they can be flown under Visual Flight Rules (VFR). This means that the aircraft can only be flown during the day and in clear visible conditions.

Broome Aviation has a dedicated booking agent which is available 24 hours a day seven days per week.

Broome Aviation will be able to advise of seat availability for upcoming charters, for the sharing of charter flights.

Aircraft ExclusionThe PA31 Navajo aircraft Registration VH-KFF is excluded from the Contract as the aircraft does not meet the minimum maintenance requirements as stipulated in the Specification. Other PA31 Navajo aircraft are suitable to undertaken the services.

Wait times at Remote Locations:

First 2 hours of wait time is complementary at remote locations. Thereafter, additional wait time is charged at: • Light Twin @$180.00/hr; and • PA31 @ $240.00/hr.

Shared Charters:

Shoal Air is happy to facilitate shared charters on mutually agreed term between the hirers (usually based on number/ratio of passengers on the aircraft).

Split Invoice Fee:

Where an invoice is split amongst two or more Agencies a surcharge of $40.00 each will be applied to each invoice.

Night Flights:

Add $100.00 per sector for higher cost of IFR flight at night. (Twin engine aircraft only)

Fuel Surcharge:

Flight routes are based on bowser fuel dispensed at Kununurra, Halls Creek and Derby. Where client payload requires a reduction in fuel on board and uploading drum fuel at remote location a surcharge of $2.50/ltr is applicable to the run fuel.

Cancellation Fee and No Show:

Unless agreed to between the Customer and Shoal Air, cancellation by a Customer of a confirmed charter flight booking is subject to the following charges: • Between 24 and 48 hours prior to Departure – 10% charge; • Less than 24 hour hours prior to Departure – 20% charge; • A “No Show: at Kununurra on the day of booked flight – 30% charge; and • A “No Show” at a Pick-up airfield to which the aircraft has flown to – 100% charge. All cancellations of less than 24 hours must be made via direct telephone communication (Person to Person) with the Shoal Air Booking Office.

BUYING DIRECT Prices for this GBA are fixed so buyers can pick and buy the specified service from the Contractors without calling quotes or tenders.

Buyers should view the Price Schedule to obtain prices for the items they require. Where more than one contractor or aircraft is appointed to a category or sub category, buyers can evaluate which aircraft represents best value for money for their needs, then contact the contractor direct to make their purchase.

Prices shown in the Price Schedule are maximum allowable prices. (Where Contractors are requested to provide quotations they may offer lower rates than the rates accepted for the Contract but not higher).

Orders should be placed directly with contractors by phone or e-mail.

If you are using a Contractor for the first time, you may need to establish a new account.

Pick and Buy Arrangement Potential Customers will purchase the Services in accordance with the following Buying Rules:

Monetary Threshold Buying Process

1. Services valued at up to $150,000 per individual purchase

Public Authorities have the option to select the services of the Contractor representing best ‘Value for Money’.

2. Services valued at $150,000 or above per individual purchase

Public Authorities will be required to approach all Panel Contractors for a formal quotation and select the services of the Contractor representing best ‘Value for Money.

Public Authorities may purchase services by contacting the Contractor directly and supplying the following information or similar written confirmation stating: • Customer/Agency name; • Contract number (GBA110132013); • Service required (Eg – Flight path); • Number of staff (this relates to the size of the plane); • Preferred Time/Date for delivery of the services.

Customers may make payments through a Purchase Order process or a Purchasing Card. Where possible it is recommended that all purchases under $5,000.00 be paid by Purchasing Card.

Pricing Contractors have nominated different aircraft across each category. Buyers should check the aircraft category to ensure that value for money is obtained. Prices are to be treated as “Commercial in Confidence” and not given to third parties not associated with the contract. Any queries regarding this should be referred to the Contract Manager.

Planned Flight Dates – Flight Notification It is preferred that Agencies notify the Contractor as soon as they are aware of upcoming flights. This will allow the Contractor to plan aircraft and pilot availability. This will also assist in flight co-ordination between Agencies. However, it is recognised that on occasions this may not be possible due to urgent and unforseen circumstances and the Contractor will endeavour to meet the Customers requirements where they can.

Flight Cancellations Flight cancellations caused by the Customer with 7 days notice will incur no cost. However, cancellations caused by the Contractor, for bad weather, aircraft failure, air strip unavailability or any other factor not directly related to the Public Agency will not incur a charge.

Variations to the Charter Service Any variation approved by the Public Authority during a charter flight ie required to stay longer at a location or change destination will be costed at a portion of the hourly rate specified by the Contractor/s in the price schedule.

Standby/Per Hour/Overnight Rates Rates are quoted for day trips to a single location. However, where the Aircraft Charter is required to travel to a number of locations or stay in locations overnight the cost of the journey will be calculated using the per hour hire rate. Refer Price Schedule for rates.

Exclusive Hire Rates Public Authority’s may wish to seek rates for the exclusive use of an aircraft. Refer Price Schedule for rates.

Payment by Purchasing Card The Government Purchasing Card offers a quick and convenient method of payment allowing many goods and services to be efficiently purchased.

Always remember to inform the supplier that you will be paying by Government Purchasing Card, at the time of ordering the product or service, and ensure they clearly understand that they must send the tax invoice directly to you, the cardholder.

Exemption from using this GBA Agencies are recommended to use this contract. However, this contract is Non Mandatory so no exemptions are required.

Civil Aviation Act The Contractors are compliant with the relevant rules and regulations of the Civil Aviation Safety Authority, including but not limited to, the Civil Aviation Act, Civil Aviation Regulations (CAR) an Civil Aviation Orders (CAO).

Complimentary Feedback and Complaints Resolution Department of Finance aims to continuously improve the services it provides to Customers and welcomes feedback on the level of satisfaction experienced under this contract or with the Contractor(s) performance.

If you are dissatisfied with the service provided by the Contractor or have any specific concerns, these should be discussed in the first instance directly with the Contractor.

If the problem or issue is not resolved to your satisfaction the Contract Manager should be advised through the completion and forwarding of the “Contractor’s Performance Review”. To assist/resolve the complaint please record the following detail when completing the Contractor Performance Review Form: • Nature of complaint; • When the complaint was made; • To whom the complaint was made;

APPENDIX 1: FREQUENTLY ASKED QUESTIONS Can I purchase outside of this contract? Yes provided that normal procurement rules are followed. It is strongly recommended that prices be checked against this price schedule.

If the contract is Non Mandatory why should I use it? This contract has a number of checks and balances in place such as Insurances, assurance that CASA requirements are met, minimum pilot experience and qualifications, maximum prices, contract management and contractor’s adherence to general conditions of contract.

How do I pick the right aircraft? The size of aircraft that is suitable for your needs is dependent upon a number of factors and not just the number of seats for example:

• Weight of passengers and luggage (Payload); • Distance travelled – The further the plane travels the more fuel it needs to take on board

hence more payload less passengers and/or luggage;

Any night travel? When in doubt ask the Contractor.
