INTRODUCTION

As I reflect upon the numerous business cycles I have witnessed since the late 1980s during my career as a bankruptcy practitioner, I am surprised by both the similarities and the uniqueness in each of those cycles. Lax lending standards, an overextension of credit, and departures from basic principles of finance always seem to accompany peaks prior to a downturn in the business cycles. Yet the combination of catalysts and drivers and the severity of each economic downturn has made each one unique.

Financially distressed and bankrupt businesses have always behaved in erratic and unpredictable ways. Such behavior adds to the challenges of developing logical and supportable conclusions of value. The unique elements of each economic downturn add further complexity to valuing such businesses. In response to such complex issues, more robust and sophisticated methods are con-stantly being developed to address the challenges of assessing the value of business interests and assets in context of financial distress and bankruptcy.

Valuation issues are at the heart of virtually every bankruptcy case and arise at almost every stage as the case proceeds. Whether in connection with adequate protection, plan confirmation, or the assessment of solvency in the context of avoidance actions, bankruptcy matters and valuation is-sues are always connected.
