PERFORMANCE OF CONTRACT

It means fulfillment of legal obligation created by contract.

It also means legal obligations if parties have done their performance according to term,modes and decided place.

VALID PERFORMANCE OF CONTRACT :

Performance should be un conditional,

It must be made at proper time and place

It must be made to proper person

It must be of the whole quantity

It must be made by a person in positon.

• Promiser himself• Agent• Legal represntatives• Third person• Joint promisor

ACTUAL PERFORMANCE

A party to a contract is said to have actually performed his promise when he has fulfilled all his obligations under the contract.

ATTEMPTED PERFORMANCE

•When a party to a contract offers to perform his obligations under the contract at proper time and place but the other party does not accept the performance, it is known as attempted performance.

1.ATTEMPTED PERFORMANCE must be unconditioned.

2.It must be given at a proper time,mode and place.
