I also attended the Co- alition Against Insurance Fraud Mid-Year conference in Baltimore. I assumed the summer would be quiet with state legislatures out of session; however, the leader- ship has already been involved in issues in Indiana and Florida, and hurricane season has been any- thing but quiet. Our public relations committee and association staff have been busy promoting NAPIA and public adjusting with claims tips, public service announcements and an increased presence on social media. Brian, Ann and I have also been monitoring the media for any unfavorable and false press about public adjusting and responding when necessary. Now that fall is here, I recommend registering for the 2017 First Party Claims Conference (FPCC) on October 16-18 in Warwick, RI, as well as the NAPIA Mid-Year Meet- ing to take place November 30 to December 2 in New Orleans, LA. Having attended each FPCC since its inception, I can say it’s the best continuing education for the money and an opportunity for 15 CE credits in less than three days. This year’s Mid-Year Meeting will have more unique and exciting social events as several local firms plan a special welcome. On behalf of the officers, direc- tors, committees and staff, we look forward to representing you this year and encourage you to let us know of any concerns in your home states.

PRESIDENT’S MESSAGE

Jeffrey B. Gould, CPA, American Claims Manage-ment Services

My family has been a member of NAPIA ever since its founding in 1951. I am incredibly honored to be elected president of this great organization and to follow in the footsteps of the many past leaders who have elevated our association and our profession to where we are today. Our Annual Meeting and elections in San Antonio were very well attended, and I hope everyone enjoyed the social functions and learned as much from the educa-tion program as I did.

I have tough shoes to fill as my predecessor, Diane Swerling, was a fantastic president overseeing a successful and productive year with new initiatives such as the quick strike teams, new budget controls and other processes that have made NAPIA more efficient and productive. Her single greatest accomplishment may have been leading the search committee to bring NAIC consultant, Ann Froh-man, to NAPIA. This has already produced significant results. Due to Ann’s stellar reputation across the country and in all aspects of the insurance industry, NAPIA has been invited and welcomed into conference rooms long thought off limits. Ann, NAPIA Counsel Brian Goodman and I traveled to Washington, DC to discuss FEMA’s (NFIP’s)

perception of public adjusters and jointly work on ways public adjust-ers can be a partner in helping flood victims after a catastrophe. At this meeting I was invited by NFIP attendees to join a commit-tee being formed to improve the customer experience in the claims process. I’ve already been inter-viewed by FEMA’s consultants and hope to improve opportunities for public adjusters and bring aware-ness of, and solutions to, the unauthorized practice of public adjusting (UPPA) to the program.

We also traveled to Chicago to present to the Property Casualty Institute’s fraud committee on the dangers of UPPA and assignment of benefits to the policyholders, carriers and everyone involved in first party claims. Our presentation was well received and just the be-ginning of an ongoing relationship in which we expect to work together on issues affecting the industry.

The three of us, along with newly elected Secretary Chris Aldrich, attended the NAIC conference in Philadelphia where we met with regulators from several states, the public adjuster working group, and

other trade associations where we continue to spread the word and raise awareness on the problem of UPPA. I also attended the Co-alition Against Insurance Fraud Mid-Year conference in Baltimore.

I assumed the summer would be quiet with state legislatures out of session; however, the leader-ship has already been involved in issues in Indiana and Florida, and hurricane season has been any-thing but quiet. Our public relations committee and association staff have been busy promoting NAPIA and public adjusting with claims tips, public service announcements and an increased presence on social media. Brian, Ann and I have also been monitoring the media for any unfavorable and false press about public adjusting and responding when necessary.

Now that fall is here, I recommend registering for the 2017 First Party Claims Conference (FPCC) on October 16-18 in Warwick, RI, as well as the NAPIA Mid-Year Meet-ing to take place November 30 to December 2 in New Orleans, LA. Having attended each FPCC since its inception, I can say it’s the best continuing education for the money and an opportunity for 15 CE credits in less than three days. This year’s Mid-Year Meeting will have more unique and exciting social events as several local firms plan a special welcome.

On behalf of the officers, direc-tors, committees and staff, we look forward to representing you this year and encourage you to let us know of any concerns in your home states.

2017 ANNUAL MEETING ATTRACTS TEXAS-SIZED GATHERING

Nearly a hundred and forty NAPIA members and guests attended the 2017 Annual Meeting at La Cantera Resort & Spa in San Antonio, TX. The event included seminars, social activities, a golf tournament, spouse programs and a special one-day seminar registration to allow Texas PAs to obtain three continuing education credits.

Education and business featured at the 2017 Annual Meeting

Convention highlights included three mornings of professional education worth a total of seven CE credits for public adjusters in nineteen states, election of NAPIA officers and directors, and the in-stallation of this year’s president, Jeffrey Gould, CPA of American Claims Management Services in Baltimore, MD.

Attendees enjoy opening social event

The post-convention survey con-firmed that all were happy with the property as well as the San Antonio area. All were also complimentary of the social events and other net-working opportunities. Special kudos to new NAPIA first lady, Ruth Gould, for her master of ceremon-ies performance at the banquet.

COUNSEL’S

CORNER

Brian S. Goodman, Esq.

It has been a hectic few months since the NAPIA Annual Meeting. After a successful convention we have been able to continue our progress in combating the perva-sive UPPA problem. Through the efforts of our NAIC liaison Ann Frohman, NAPIA President Jeff Gould and I have been able to travel to Chicago to address the Property and Casualty Insurers of America, a large and important carrier trade association, regard-ing this issue. The more we make the carriers aware of this problem and get them to agree to help eradicate it, the better. To that end, the legislature of Rhode Island passed a statute making it illegal for an insurance company to adjust a property loss with an unlicensed individual or entity. This is a major first step for getting carriers to stop fostering the practice of UPPA. Ann Frohman led some impress-ive meetings with me, Jeff Gould, NAPIA Secretary Chris Aldrich and various regulators in attendance at the recent NAIC meeting in Phila-delphia. We continue to work with the regulators, especially those on the NAIC Public Adjusters Working Group, to promote awareness of and prevent the illegal practice of UPPA. Perhaps most importantly, the Texas Court of Appeals recently certified a class of aggrieved plain-tiffs victimized by an unlicensed company illegally practicing public adjusting, confirming what NAPIA did in the Reyelts case and empha-sizing the legal requirement of licensed public adjusters to help a consumer in the first party

property loss arena. The court cited, on numerous occasions, the amicus curiae brief that we wrote in Reyelts. NAPIA remains vigilant, and we are making progress, slowly but surely, on this difficult and impor-tant issue.
