Appendix1:OverviewofICTSectorinWestCoastRegion

AddfurtherdetailonthenatureoftheICTsectorandICTusageintheRegion/District/Townifavailableandifitwillassistassessmentoftheproposal.

Thegovernment,throughCrownInfrastructurePartners,isinvestingatotalof$63.8millionintheWest

Coastregion(thisincludesUltra-fastBroadband(UFB),RBI2/MBSFandtherecentWestCoastelementsin

thelatestPGFpackageof$32.7m.Theregionhasaresponsibilitytomakebestuseofthisinvestmentand

in turn contribute more to the prosperity of its residents and New Zealand as a whole. Recent

Infometrics data confirms that the internet access rate for theWest Coast at 69.6% iswell below the

nationalaverageof76.8%.

The three West Coast Digital hubs will offer digital capability services to individual entrepreneurs,

businesses and the community by offering free Wi-Fi connectivity, digital hardware and software, and

innovativeco-workingspaces. Thiswill facilitatethecapabilitybuildingrequiredforbusinesspurposes, it

willfosterentrepreneurshipandcontributetotheongoingeconomicdevelopmentthroughouttheregion.

Theregionseekstomakebestuseoftheconsiderablegovernmentinvestmentinconnectivitybeingrolled

outcurrently.

Work streams detailed in the West Coast Digital Strategy 2019 aim at auditing and mapping the

infrastructure roll-out, establishing the specific capability needs of the industry sectors and businesses

throughout the region, and getting rid of the isolation barriers. Communities and sectors that have

benefitedfromnewinfrastructureandconnectivitywillbegivenafocus,i.e.theinlandfarmingsector.The

researchactivityaimedatcapturingtheregion’scapabilityneedswill informthecontentandspecificsof

theservicestobeofferedinthefuture.Thereislittledoubtthatmakingthemostoftheplannedimproved

connectedness in the region and improving digital capability amongst its tangatawhenuawill be greatly

enhancedbyaccesstoco-workingspacesandtechnologyresources.

FacebookandAboutUS.

In 2018 Development West Coast teamed up with Facebook’s Boost Your Town initiative to hold very

successful events in three regional locations. A series of digital skills workshops held in Hokitika,

Greymouth and Westport and proved exceptionally popular with around 250 people attending the

sessions. The Boost Your Town workshops were a collaboration between DWC, social media network

Facebook anddigital innovation agencyAboutUs. Theeventhad ahugeuptake andhas resulted in an

ongoingrelationshipwith AboutUs.

NetHUI&TechWeek

In 2018 various organisations on theWest Coast collaborated to bring TechWeek events to the Coast.

TheseincludedTaiPoutiniPolytechnic,TechSpace,GreyDistrictLibrary,GreymouthHighSchool,Westland

District Library, Buller District Library and EPIC in Westport. Grey District Library hosted two events: a

Virtual Reality experience in conjunction with Tech Space and a workshop using a spherical robot in

conjunctionwithGreymouthHighSchool.

Notlongafterthiseventasteeringgroupwasformedtohosttheregion’sfirstNetHUIinpartnershipwith

InternetNZ.

that are trusted to make games for the Walt Disney Corporation. The company produces world class

gaming,VR,ARandsoftwareproducts.ThewiderbusinessgroupthatincludesEPICWestportnowemploys

morethan staffwithupto employeeslocatedinWestport.

Industry creators CerebralFixwascriticalestablishingthegamesdevelopmentindustryinChristchurchoverthelast10years.

CerebralFix kick started, incubated or mentored other companies in the city, with the majority of

employees in the Christchurch industry trained in commercial practice by CerebralFix. Thewider games

industryinChristchurchnowemploysmorethan people.

Appendix1–TermsandConditionsofthisApplicationGeneralThetermsandconditionsarenon-negotiableanddonotrequirearesponse.Eachapplicantthatsubmitsarequestfor

ProvincialGrowthFund(“PGF”)funding(eachan“application”)hasconfirmedbytheirsignatureontheapplicationthat

thesetermsandconditionsareacceptedwithoutreservationorvariation.

TheProvincialGrowthFundisagovernmentinitiativewhichisadministeredbytheProvincialDevelopmentUnit,aunit

withintheMinistryofBusiness,InnovationandEmployment.AnyreferencetotheProvincialDevelopmentUnitinthese

termsandconditions,isareferencetoMBIEonbehalfoftheCrown.

ReliancebyProvincialDevelopmentUnitTheProvincialDevelopmentUnitmayrelyuponallstatementsmadebyanyapplicantinanapplicationandin

correspondenceornegotiationswiththeProvincialDevelopmentUnitoritsrepresentatives.Ifanapplicationis

approvedforfunding,anysuchstatementsmaybeincludedinthecontract.

EachapplicantmustensureallinformationprovidedtotheProvincialDevelopmentUnitiscompleteandaccurate.The

ProvincialDevelopmentUnitisundernoobligationtocheckanyapplicationforerrors,omissions,orinaccuracies.Each

applicantwillnotifytheProvincialDevelopmentUnitpromptlyuponbecomingawareofanyerrors,omissions,or

inaccuraciesinitsapplicationorinanyadditionalinformationprovidedbytheapplicant.

OwnershipandintellectualpropertyOwnershipoftheintellectualpropertyrightsinanapplicationdoesnotpasstotheProvincialDevelopmentUnit.

However,insubmittinganapplication,eachapplicantgrantstheProvincialDevelopmentUnitanon-exclusive,

transferable,perpetuallicencetouseanddiscloseitsapplicationforthepurposeofassessinganddecisionmaking

relatedtothePGFapplicationprocess AnyhardcopyapplicationordocumentationsuppliedbyyoutotheProvincial

DevelopmentUnitmaynotbereturnedtoyou.

Bysubmittinganapplication,eachapplicantwarrantsthattheprovisionofthatinformationtotheProvincial

DevelopmentUnit,andtheuseofitbytheProvincialDevelopmentUnitfortheevaluationoftheapplicationandforany

resultingnegotiation,willnotbreachanythird-partyintellectualpropertyrights.

Confidentiality

TheProvincialDevelopmentUnitisboundbytheOfficialInformationAct1982(“OIA”),thePrivacyAct1993,

parliamentaryandconstitutionalconventionandanyotherobligationsimposedbylaw.WhiletheProvincial

DevelopmentUnitintendstotreatinformationinapplicationsasconfidentialtoensurefairnessforapplicantsduringthe

assessmentanddecisionmakingprocess,theinformationcanberequestedbythirdpartiesandtheProvincial

DevelopmentUnitmustprovidethatinformationifrequiredbylaw.IftheProvincialDevelopmentUnitreceivesanOIA

requestthatrelatestoinformationinthisapplication,wherepossible,theProvincialDevelopmentUnitwillconsultwith

youandmayaskyoutoconfirmwhethertheinformationisconsideredbyyoutobeconfidentialorstillcommercially

sensitive,andifso,toexplainwhy.

UseanddisclosureofinformationTheProvincialDevelopmentUnitwillrequireyoutoprovidecertaininformation,includingpersonalinformation,on

applicationformsifyouwishtoapplyforfunding.Ifyoudonotprovidealloftheinformationthatisrequiredonan

applicationform,theProvincialDevelopmentUnitmaybeunabletoprocessorotherwiseprogressyourapplication.

MBIEwillgenerallyonlyusepersonalinformationprovidedintheapplicationprocessforthepurposeofadministering

thePGFwhichincludesassessinganapplicationyouhavesubmitted,contracting,monitoringcomplianceandreporting.

WemayusepersonalinformationprovidedtousthroughtheapplicationforotherreasonspermittedunderthePrivacy

Act(e.g.withyourconsent,foradirectlyrelatedpurpose,orwherethelawpermitsorrequiresit).

TheProvincialDevelopmentUnitmaydiscloseanyapplicationandanyrelateddocumentsorinformationprovidedbytheapplicant,toanypersonwhoisdirectlyinvolvedinthePGFapplicationandassessmentprocessonitsbehalfincludingtheIndependentAdvisoryPanel(“IAP”),officers,employees,consultants,contractorsandprofessionaladvisorsoftheProvincialDevelopmentUnitorofanygovernmentagency.ThedisclosedinformationwillonlybeusedforthepurposeofparticipatinginthePGFapplicationandassessmentprocess,includingassessmentandongoingmonitoring,whichwillincludecarryingoutduediligence.DuediligencemayinvolveMBIEdisclosinginformationtoanotherMBIEbusinessunitorrelevantagencyinordertoassesstheapplicationandverifytheinformationcontainedintheapplicationandaccompanyingdocuments.MBIEwillgenerallynototherwisedisclosepersonalinformationprovidedorcollectedthroughthisapplicationunless

requiredorotherwisepermittedbylaw.Forexample,wemayseekyourconsenttoundertakeadditionalduediligence

checksandrequestinformationfromotherrelevantthirdparties.Ifanapplicationisapprovedforfunding,information

providedintheapplicationandanyrelateddocumentsmaybeusedforthepurposeofcontracting.

Intheinterestsofpublictransparency,ifanapplicationisapprovedforfunding,theapplication(andanyrelated

documents)maybepublishedbytheProvincialDevelopmentUnit.Commerciallysensitiveandpersonalinformationwill

beredactedbyreferencetotheprovisionsoftheOfficialInformationAct1982.

LimitationofAdviceAnyadvicegivenbytheProvincialDevelopmentUnit,anyothergovernmentagency,theirofficers,employees,advisers,

otherrepresentatives,ortheIAPaboutthecontentofyourapplicationdoesnotcommitthedecisionmaker(itmaybe

SeniorRegionalOfficials,MinistersorCabinetdependingontheleveloffundingrequestedandthenatureoftheproject)

tomakeadecisionaboutyourapplication.

ThislimitationincludesindividualmembersoftheIAP.TheIAP’srecommendationsandadvicearemadebytheIAPinits

formalsessionsandanyviewsexpressedbyindividualmembersoftheIAPoutsideofthesedonotcommittheIAPto

makeanyrecommendation.

NocontractualobligationscreatedNocontractorotherlegalobl gationsarisebetweentheProvincialDevelopmentUnitandanyapplicantoutof,orin

relationto,theapplicationandassessmentprocess,untilaformalwrittencontract(ifany)issignedbyboththe

ProvincialDevelopmentUnitandasuccessfulapplicant.

NoprocesscontractThePGFapplicationandassessmentprocessdoesnotlegallyobligeorotherwisecommittheProvincialDevelopment

Unittoproceedwiththatprocessortoassessanyparticularapplicant’sapplicationorenterintoanynegotiationsor

contractualarrangementswithanyapplicant.Fortheavoidanceofdoubt,thisapplicationandassessmentprocessdoes

notgiverisetoaprocesscontract.

CostsandexpensesTheProvincialDevelopmentUnitisnotresponsibleforanycostsorexpensesincurredbyyouinthepreparationofan

application.

ExclusionofliabilityNeithertheProvincialDevelopmentUnitoranyothergovernmentagency,northeirofficers,employees,advisersor

otherrepresentatives,northeIAPoritsmemberswillbeliable(incontractortort,includingnegligence,orotherwise)

foranydirectorindirectdamage,expense,lossorcost(includinglegalcosts)incurredorsufferedbyanyapplicant,its

affiliatesorotherpersoninconnectionwiththisapplicationandassessmentprocess,includingwithoutlimitation:

a) theassessmentprocessb) thepreparationofanyapplicationc) anyinvestigationsoforbyanyapplicantd) concludinganycontracte) theacceptanceorrejectionofanyapplication,orf)anyinformationgivenornotgiventoanyapplicant(s).

advisor,orotherrepresentativeoftheProvincialDevelopmentUnitoranyothergovernmentagencyinconnectionwith

thisapplicationandassessmentprocess.

GoverninglawandjurisdictionThePGFapplicationandassessmentprocesswillbeconstruedaccordingto,andgovernedby,NewZealandlawandyou

agreetosubmittotheexclusivejurisdictionofNewZealandcourtsinanydisputeconcerningyourapplication.
