PREAMBLES FOR TRADES
The Model Preambles for Trades 2008 as published by theAssociation of South African Quantity Surveyors shall bedeemed to be incorporated in these bills of quantities and noclaims arising from brevity of description of items fullydescribed in the said Model Preambles will be entertained
Supplementary preambles and/or specifications areincorporated in these bills of quantities to satisfy therequirements of this project. Such supplementary preamblesand/or specifications shall take precedence over the provisionsof the Model Preambles
The contractor's prices for all items throughout these bills ofquantities shall take account of and include for all of theobligations, requirements and specifications given in the ModelPreambles and in any supplementary preambles and/orspecifications

The definition of agreement is replaced with the followingdefinition :
AGREEMENT : The Form of Offer and Acceptance(Agreement) (Part C.1) and the JBCC Principal BuildingAgreement, the completed JBCC PBA contract data, thecontract drawings, the priced documents and any otherdocuments introduced to in writing and signed by the parties"
Pricing of bills of quantities
The contractor is to allow opposite each item for all costs inconnection therewith. All prices to include, unless otherwisestated, for all materials, fabrication, conveyance and delivery,unloading, storing, unpacking, hoisting, labour, setting, fittingand fixing in position, cutting and waste (except where to bemeasured in accordance with the standard system ofmeasurement), patterns, models and templates, plant,temporary works, returning of packaging, duties, taxes (otherthan Value Added Tax), imposts, establishment charges,overheads, profit and all other obligations arising out of thisagreement. Value Added Tax (VAT) is to be separately statedon the summary page of these bills of quantities
Items left unpriced will be deemed to be covered in pricesagainst other items throughout these bills of quantities and noclaim for any extras arising out of the contractor's omission toprice any item will be entertained
Prices for all construction equipment, temporary works,services and other items shall include for the supply,maintenance, operating cost and subsequent removal andmaking good as necessary
Abbreviated descriptions
The items in these bills of quantities utilise abbreviateddescriptions. It is the intention that the abbreviated descriptionsbe fully described when read with the applicable measuringsystem and the relevant preambles and/or specifications.However, should the full intent and meaning of any descriptionnot be clear, the contractor shall, before submission of histender, call for a written directive from the principal agent,failing which it shall be assumed that the contractor hasallowed in his pricing for materials and workmanship in terms oflocal and international best practice

3. The contractor shall not alter its composition or legalstatus without the prior written consent of the employer

2 Clause 2.0 - Law, regulations and notices

Health and safety
Without limiting the generality of the provisions of clause 2.0,the contractor's attention is drawn to the provisions ofConstruction Regulations 2014 issued in terms of theOccupational Health and Safety Act, 1993. It is specificallystated that the employer shall prepare a documented healthand safety specification for the works and that the employershall ensure that the contractor has made provision for thecost of health and safety measures during the execution of theworks. The contractor shall price opposite this item forcompliance with the act and the regulations and the reasonableprovisions of the aforementioned health and safety specification[2.1]

Without limiting the generality of the provisions of clause 2.0,the contractor's attention is drawn to the provisions ofConstruction Regulations 2014 issued in terms of theOccupational Health and Safety Act, 1993. It is specificallystated that the employer shall prepare a documented healthand safety specification for the works (refer to Annexure 2014for a copy of the relevant specification) and that the employershall ensure that the contractor has made provision for thecost of health and safety measures during the execution of theworks. The contractor shall the item for compliance with theact and the regulations and the provisions of theaforementioned health and safety specification as describedunder section C of this Preliminaries bill [2.1]
The contractor shall:
1. Comply with the health and safety specification for theworks
2. Prepare and agree with the health and safetyconsultant the health and safety plan for the works
3. Co-operate with the health and safety consultant in allrespects
4. Manage the compliance of all subcontractors with theregulations and with the health and safety plan andspecification
5. Conform to the conditions contained in the employer'shealth and safety specification

8.1 Duties :
The health and safety consultant is responsible for all aspectsof health and safety of the works. Without derogating from thegenerality thereof, the health and safety consultant will performthe following specific functions and duties in respect of thehealth and safety aspects of the works:
8.1.1 Act as the employer's agent in terms of ConstructionRegulations issued in terms of the Occupational Healthand Safety Act,1993
8.1.2 Prepare and update the health and safety specificationfor the works
8.1.3 Agree with the contractor the health and safety planfor the works

No subcontractor or suppliernotice boards may be erected unless permission is granted bythe principal agent for such notice boards to be erected[12.2.18]

The employer is not in a position to identify access to water,sewer, stormwater and/or electricity connections to the site asmay be suitable for the execution of the works. The contractoris to allow what he considers to be required and is to qualify histender in detail in this regard, failing which it shall be taken thatthe contractor has allowed what will be required for theexecution of the works. In such case no claims for additionalcost or loss shall be entertained [12.1.5]
Statutory and other notices
The contractor shall submit and/or comply with all statutoryand other notices that may be required by any local or otherauthority in order not to cause any delay to the commencementof the works by the contractor. The contractor shall pay alldeposits or fees in this regard [12.1.6]
It is, however, specifically recorded that the employer shall beresponsible for the timeous approval of building plans by anylocal or other authorities and the payment of any fees orcharges related thereto

26 Clause 25.0 shall be deemed to be amended and extended asfollow;
25.16 Retention Fund
25.16.1 The Employer shall withhold from the Contractor tenper cent (10%), with a maximum of five per cent (5%) of allpayments made before the issuing of the certificate of practicalcompletion as a retention fund. No interest is to be paid to theContractor on the retention fund. The retention fund shall beheld by the Employer as a guarantee to the Employer for thecompletion of the contract. 25.16.2 Two fifths (2/5) of the retenion fund shall be paid to theContractor on the issuing of the certificate of practicalcompletion, and two fifths (2/5) on the issuing of the certificateof final completion and the remainder on the issuing of the finalaccount

Controlling all forms of pollution

62 Warranties for materials and workmanship

79 Occupational health and safety act - section 37(2)
The tenderers attention is drawn to the fact that theOccupational Health and Safety Act (Act 85 of 1993) andConstruction Regulations 2014 is in force. Copies of the Act areavailable from the Government Printing Works, 149 BosmanStreet, Pretoria (Private Bag X85, Pretoria, 0001, Tel No. (012)334-4500).
Tenderers are expected to be fully aquainted with therequirements of the Act.
A pro-forma "Agreement in terms of the Occupational Healthand Safety Act - Part C 1.4" is included in these bid documents.Tenderers are advised to study this pro-forma in order to makethemselves fully conversant with the requirements andresponsibilities of the Act and the Municipality.

80 Community employement and smme involvement

Local labour
It is an explicit condition of this contract that only personsnormally resident in the locality of the works (Local labour) maybe employed on the contract. Provided however, that shouldadequate and appropriate labour not be available within thelocality, other labour may be employed, subject to the approvalof the Principal/Agent and satisfactory proof being provided thatevery reasonable endeavour has been made, to employ labourfrom the immediate locality. SUPPLEMENTARY PREAMBLES
Indemnity
The Contractor shall take full responsibility for piling work andshall guarantee that piling work will support the calculated loadslaid down by the Engineer without injurious settlement. Theactual length shall be determined on site by the contractor inconsultation with the Engineer who will give all assistancepossible. This does not in any way relieve the contractor of hisresponsibility or obligation to provide the specified guarantee.
The contractor shall indemnify the Employer against any injuryto or death of any person and all loss or damage to allstructures resulting from failure of any pile. In the event of thefailure of a pile the contractor shall make good such pile and allconsequent damage at his own expense.
The Contractor shall insure by means of a policy, approved bythe Pricipal Agent, against risks arising out of theresponsibilities , gurantees and indemnities specified. thecontractor shall pay all premiums in respect of this insurancepolicy. The guarantee shall be for the amount and effectiveperiod as stated hereafter in this bill.

Scope of the work
The work comprises the installation of 67 piles. The Contractoris referred to drawing No 701/SL/001issued together with thesebills of quantities in order to aquaint himself fully with the natureand scope of the work.
Piles are to be installed subsequent to the site being excavatedor filled to the correct levels.
Drilling
Classification of material
"Hard rock" shall mean granite, quartzitic sandstone or otherrock of similar hardness, the removal of which would normallyrequire drilling, wedging and splitting or the use of explosives.
"Soft rock" shall mean hard material the removal of whichwarrants the use of pneumatic tools and includes hard shale,ferricite, compact ouklip and material of similar hardness

Cost of tests
The costs of making, storing and testing of concrete test cubesas required under clause 7 "Tests" of SABS 1200 G shallinclude the cost of providing cube moulds necessary for thepurpose, for testing costs and for submitting reports on thetests to the architect. The testing shall be undertaken by anindependent firm or institution nominated by the contractor tothe approval of the architect. (Test cubes are measuredseparately)
Breeze concrete
Breeze concrete shall consist of twelve parts clean dry furnaceash, free from coal or other foreign matter, to one part cement(12:1), the ash graded up to particles which will pass a 16,5mmring from a minimum which fails to pass a 4,75mm mesh. Thefiner materials from the screening are to be first mixed with thecement into a mortar and the ash added afterwards andthoroughly incorporated

Formwork
Descriptions of formwork shall be deemed to include use andwaste only (except where described as "left in" or "permanent"),for fitting together in the required forms, wedging, plumbing andfixing to true angles and surfaces as necessary to ensure easyrelease during stripping and for reconditioning as necessarybefore re-use.
The vertical strutting shall be carried down to such constructionas is sufficiently strong to afford the required support withoutdamage and shall remain in position until the newly constructedwork is able to support itself.
Formwork to soffits of solid slabs etc shall be deemed to be toslabs not exceeding 250mm thick unless otherwise described
Formwork to sides of bases, pile caps, ground beams, etc willonly be measured where it is prescribed by the engineer fordesign reasons. Formwork necessitated by irregularity orcollapse of excavated faces will not be measured and the costthereof shall be deemed to be included in the allowance fortaking the risk of collapse of the sides of the excavations,provision for which is made in "Earthworks"

PREFABRICATED ROOF TRUSSES
NOTE:
1. All the roof trusses to be at an average of 900mm centresand constructed for a 15 or 23 degree pitch unless otherwisestated
2. All the roof trusses to be designed and constructed withsoftwood structural timber and to included for live loads, windloads and to take concrete roof tiles and battens. Each rooftruss shall have each of its members accurately cut and closebutted together and rigidly fixed by CSIR approved patentedgalvanised metal spiked connectors, fixed on both sides ofeach intersection by an approved method, all in accordancewith th manufacturer's instructions.
3. Unless otherwise described all rafter feet are to extend 500mm beyond the length of the tie beam with ends twice splaycut.
4. The design, manufacture and transportation of the rooftrusses, bracing, etc. shall be underthe control of a registeredEngineer in accordance with SABS 0243 and it shall berequired from the manufacturer of the trusses to lodge a writtenguarantee that his construction has been designed by aqualified Structural Engineer and that he is in possession of acapability certificate issued by the institute for TimberConstruction and approved by the Representative/Agent
5. The tenderer's attention is drawn to the fact that the detaildrawings included at the back of these Bills of Quantities onlyrepresents the overall size and bearing points of the trussesand not the required design.

Copper pipes
Pipes shall be hard drawn and half-hard pipes of the classstated. Class 0 (thin walled hard drawn) pipes shall not bebent. Class 1 (thin walled half-hard), class 2 (half-hard) andclass 3 (heavy walled half-hard) pipes shall only be bent withbenders with inner and outer formers. Fittings to copper waste,vent and anti-syphon pipes, capillary solder fittings andcompression fittings shall be "Cobra Watertech or similarapproved" type. Capillary solder fittings shall comply with ISO2016. Only compression fittings shall be used in walls or inground
Reducing fittings
Where fittings have reducing ends or branches they aredescribed as "reducing". In the case of pipes with diametersnot exceeding 60mm only the largest end or branch size isgiven. Should the contractor wish to use other fittings andbushes or reducers he may do so on the understanding that noclaim in this regard will be entertained. In the case of pipeswith diameters exceeding 60mm all sizes are given and noclaim for extra bushes, reducers, etc will be entertained
Wire gratings
Descriptions of gutter outlets etc shall be deemed to includewire balloon gratings
Exposed concrete surfaces
